president biden sending shock waves just two days before christmas as he continues his mission for clemency in his final days in office. this is "the faulkner focus" and i'm john roberts in for harris today. biden announced today he is going to commute the sentences for nearly all inmates that are on federal death row. this is less than two weeks after the largest single day of clemency in u.s. history. of the 40 federal inmates with death sentences biden is commuting 37 of them. reclassifying their sentences to life without a possibility of parole. the list of inmates include several child killers and mass murderers. one of the inmates kidnapped and shot 12-year-old lexus roberts days after the girl watched him murder her mom on a road trip. another convict granted a commutation sexually assaulted and fate stabbed two young girls, eight and nine years old.

that same person strangled a naval officer. andy mccarthy with this perspective. >> i think it's yet another abuse of the pardon power. he is wiping the slate clean on death penalty charges that were brought by other administrations and other justice departments. but not in cases where he and his justice department actually had to deal with the victims and the families of the victims in these brutal homicides. >> biden has granted many pardons and commutations. we have more with alexandria hoff. >> another person on that list was convicted for killing 12 people in philadelphia including four children. president biden says that he condemns these murderers and grieves for the victims' families but added this. in good conscience i can't stand back and let a new

administration -- malliotakis said instead of death row these monsters will rot in jail for life at taxpayer expense. exempt from the downgraded sentences are those who committed acts of terrorism or mass murders fueled by hate. the boston marathon bomber and dylann roof and robert bauer expect from the list. the names included in the first round of mass clemency, 1500 more than so prompted several democrats even to sound off. >> i have no doubt there were some righteous pardons in this group. let's say that. i believe there were. but there were a number that i think make no sense at all. >> there was bipartisan pushback on that. kids for cash scandal judge michael conahan who sent children to for-profit detention centers and got kickbacks.

commutations, 37 out of 40 death row inmates, including people who are responsible for taking the lives of young children. biden says this is to insure a fair and effective justice system. for the family members of the vic victims, how is that doing that >> it isn't. and two days before christmas. i can only imagine the grief and shock these families are experiencing getting ready for the holidays remembering the loved ones lost and deal with this insult to injury. joe biden in his effort to trump-proof. we saw some of that for the next administration whether it's hiding d.e.i. workers for things at the border, this is beyond the pale. cementing his status as one of the worst presidents in american history. in that intro as a former prosecutor myself it is important to talk about the victims here. lexus roberts went on a camping

trip with her mother and thomas sanders, thomas sanders on the way back took her mother out and executed her in cold blood in front of lexus and slit lexus's throat and let her die in the woods. this is someone joe biden on the eve of christmas decided to commute his sentence. this is nuts. totally nuts. so the outrage is real. it's justified and again joe biden on his way out is again cementing his status as one of our worst presidents. >> john: it makes you wonder what is going through his mind when you commute a sentence of a person like that. i know this is a big issue for you. president-elect trump not backing off his promises to get tough on immigration as soon as he gets into office. listen to what he said over the weekend. >> on my first day back in the oval office i'll sign a historic slate of executive orders to close our border to illegal aliens and stop the invasion of

[cheers and applause] and on that same day we will begin the largest deportation operation in american history, larger even than that of president dwight eisenhower. we'll get them out and out fast. we have no choice. >> president biden could be fighting back. "new york times" report says he is considered a plan to extend protection for hundreds of thousands of immigrants whose legal status will expire under trump. there have been historic numbers of border incont yours, since 2021 we've seen more than 7 million migrants at the border. this would be an extension of temporary protected status for hundreds of thousands of people who entered this country illegally. i talked to tom homan this morning. he says those aren't the people they will be targeting, not in the initial wave unless they're criminals. what effect would this really

have? >> it wouldn't have any effect. if it's executive order president trump can undo that. if it's some sort of administrative rule congress can reverse that. i haven't seen that specifically. this is joe biden on the way out doing what he did on the way in. reversing all the success we had under president trump. 94 executive orders that he have did to undo that success. president trump, i expect him to come in secure the border, remain the mexico, deportations of these illegal immigrants, there are terrorizing our communities, the flood of fentanyl coming in and killing our neighbors, brothers, sisters, cousins. president trump ran on this. it was part of his mandate and part of the reason he swept the battleground states and won the popular vote. american people don't want to see an open border. not just white papers anymore. these people got in charge and wreaked havoc on our country and president trump is coming in and

homan is coming in and do what they said they were going to do, deport these criminals who are taking over apartment complexes, lighting people on fire on new york subways and we saw that news yesterday. this stuff is nuts. the american people will welcome in. >> john: they will hit the ground running. "wall street journal" editorial board is calling the sanctuary state migrant boom. it asks are democrats in self-declared sanctuary states trying to attract illegal migrants to compensate for growing domestic flight to other states? a fair question. new york, california and illinois have reversed a year's long trend of declining population only thanks to foreign migration. separate piece is a showdown between the trump administration and sanctuary cities arguing those local officials will lose in court. back to tom homan. he has said any city or state

official who stands in his way of removing these particularly criminal illegal aliens will be prosecuted. can he do that? >> they have no legal foot to stand on here, these sanctuary mayors, to prevent federal jurisdiction to deport folks. forever, john, republican or democrat presidents the law of the united states of america was if you came here illegally you were detained. unless you got to stay you were deported until four years ago when they flipped this thing on its head. to your earlier point, the worst-kept secret the democrats were relying on illegal immigrants to bolster their census for 2030. you don't need to be a citizen to be counted in the census. that is their plan all along and the next part if they won they would have mass amnesty for illegal immigrants and so thankfully president trump won and we'll deport the criminals. sanctuary city mayors and states

maybe not a ton of slowdowns but winter weather is there. a lot of 20s and 30s, teens when you add in windchill. the big weather system we are paying attention to skating its way across portions of the great lakes where snow is currently falling. by the time we get into tonight and tomorrow this pushes into some more heavily populated areas. right now you see snow pretty much across the state of michigan. it will drag itself to the east coast. for now these are the airport delays and cancellations. most delays are cause of volume slowing things down. weather-wise we see the big low pressure system currently sitting over the great lakes move to the east coast. overnight tonight into early tomorrow. snow for a lot of interior new england. as you push up along the coastline gets warmer and start to see other problems, particularly with ice that could be an issue across portions of the mid atlantic. one of the biggest slowdowns

yesterday morning. palm is boarded a subway car in manhattan to make the arrest after three high schoolers recognized and reported him. this wasn't the only deadly incident on the subway system yesterday alone. >> the subways that are all but a rolling psych ward. the same day this happens we get another knifing murder on the subway. we have a third man pushed onto the tracks. he now is fighting for his life with spinal injuries. all in one day. >> despite those incidents hours after the attack new york governor kathy hochul received criticism for posting on x quote in march i took action to make our subways safer for the millions of people who take the trains each day. since deploying the national guard to support the nypd and adding cameras to all subway cars crime is going down and ridership is going up. incoming border czar tom homan says governor hochul deserves blame here. >> as far as governor hochul,

>> john: fox news alert. suspected united healthcare shooter luigi mangione in a new york state courtroom this morning. he pleaded not guilty to the 11 charges against him including first and second degree murder as well as act of terrorism. alexis mcadams at the new york state supreme court with more on this. >> well, today luigi mangione

had his first chance to go up in front of the judge on the state charges and address those charges. he didn't appear nervous. talking to some local police sources with the nypd, it is how it has been. calm, cool, collected as much as a 26-year-old can be facing possibly the death penalty if not guilty. we finally had a camera in the courtroom. there with his attorney, too. she is from the same law firm that represents sean diddy combs. he entered a not guilty plea today. mangione was also seen here in this video walking into that courtroom this morning. he is surrounded by police again. that seems to be a common theme here. shackled around his waist and wearing some orange tennis shoes that match his orange jumpsuit but has a maroon sweater and khakis. a different look when he goes in front of a judge.

mangione was also facing two separate cases against him. this is where it gets confusing. at the state level haft with three murder charges on your screen including murder in second degree as a crime of terrorism. the one gaining a lot of attention here and making headlines in new york. the 26-year-old faces federal charges through use of a firearm and could face the death penalty if found guilty. his defense say the different cases are in conflict with each other. they say he was waiting for brian thompson outside of a hotel in mid town manhattan and opened fire. the video is the key evidence in this ongoing case. mangione is in federal custody at the same lockup as diddy in brooklyn. state case could go first, we're told. when president-elect trump brings in pam bondi and new team in new york could take that case over and those state charges could fall to the wayside we're told. john.

"wall street journal" report with this headline. democrats are adrift as donald trump prepares to take power. the party has yet to land on a clear message or a leading messenger. democratic strategist said there is no leadership at the highest level. former dnc chairwoman donna brazile says i don't think it is about countering donald trump and the republicans but rebuilding a brand that's durable and reaches people. president biden also facing a lot of criticism in his final days. radio host charlamagne tha god called him out last week. >> my last question do you think biden has quietly quit? >> no, absolutely not. >> we'll see. if he don't do nothing over the next 30 days i'll say he quit. >> john: the so-called obama bros criticized the president.

biden. they didn't know how to defend their past four years and policy proposals they had. democrats have to figure out a message and then choose a messenger. >> john: mary anne willianson is a family friend said it will take deeper insight into people. greater compassion for what americans are going to and expert insight into the dynamics that have led millions of people to abandon the democratic party. there is a lot in that article. it calls for a top down review at least at the dnc if not the entire democratic party. is that what's necessary, brad? >> look, i think you look at the election. a lot of policies that democrats support introduce and champion in congress from paid leave to abortion protections were ratified at the state level in some states that also voted for donald trump.

so that tells us our policies are right but the previous speaker's point we have to work on our message and messengers. for a party it is important for us to recognize it is not voters' responsibility to come to us but us go to them. instead of lecturing we have to listen and learn and deliver results. we have a dnc chair race coming up to select a new chairman of the party february 1st. you look at folks like martin o'malley. the experience and operational leader and flipped red states, that is the sort of person that can operationally bring the party to success. we need a fighter in congress. hakeem jeffries will pick up the mantel and work with republicans as we have seen on the cr this last week. he is willing to work with republicans and govern but he is also going to fight donald trump where he thinks he doesn't stand in line with values that have been the foundation of america for centuries. >> john: he also can't seem to

figure out what doge is all about. even though democrats are starting to embrace it. let me ask you this. democratic senator john fetterman who is a contrarian in the democratic party scolded critics who want trump to fail. calling him a fascist wasn't the smartest thing to do. >> i've been warning people you have to chill out, you know? the constant, you know, freak-out. it is not helpful. i'm not rooting against him. if you are rooting against the president, you are rooting against the nation. and i'm not ever going to be where i want a president to fail. so country first. >> john: breonna, what does it say about democrats lining up the resistance against trump? >> i will hang on a second. go back to something about aboring. scripted. the administration denied that biden has declined. a new opinion piece with the headline. the biden cover-up is fast unraveling. we've heard democrats and liberal media run defense against concerns over biden's mental fitness. >> this version of biden intellectually, analytically, is the best biden ever. not a close second. i've known him for years. >> he is just fine. i engage with him frequently and alert, sound. >> he is the president of the united states. you know, i can't even keep up with him. >> that is not a question that we should be even asking. >> john: according to reports in the "wall street journal" and "new york times." all those statements did not have the added benefit of being true. >> let me respond back to the previous speaker about abortion. it was the president trump and republicans that got rid of the right to protection of abortion

nationwide. >> there is no right in the constitution. >> look what fetterman said about the president. he has a point. clarify for democrats this can't be about opposing donald trump because you don't like him. i don't think many democrats are doing that. we think his policies are wrong and dangerous for the country and therefore we will work with them to get it to a point we rethink they are the best they can be or oppose the ones we think are bad. we have to get back to focus on kitchen table issues. we have to work together. democrats have shown they will. >> john: what about this idea that the white house looks like it is engaged in a cover-up of monumental proportions about biden's declining cognitive abilities? >> if we had a functioning press it wouldn't take four years to come out. all the evidence is there. we saw it. we have a propaganda press that carried water for the white house message on joe biden being sharp as a tack.

update to a story we covered earlier this hour. dhs sources now telling fox that the suspect arrested after fatally setting a woman on fire on the new york city subway yesterday is a previously deported illegal migrant from guatemala. those sources say he was arrested and deported in june of 2018 after crossing illegally into arizona. he then re-entered the united states illegally as a gotaway at an unknown time and location. dhs has no record of him entering the united states again. this is one of the alleged gotaways that we know where they ended up. there are thousands -- hundreds of thousands of others we have no clue about. we'll keep you updated on this as we get more information. confirmation there. iran in the midst of an energy prices despite some of the biggest oil deposits and natural gas in the world. iran's energy crisis hits dire point as industries are forced to shut down. iran's power has declined following the collapse of the assad regime in syria and israel's destruction of hezbollah in lebanon. it is expected the president-elect trump might bring back the maximum pressure policy that will pinch the economy even more. stephanie bennett live in london with the latest. >> a lot of things going on here. years of sanctions, mismanagement and aging infrastructure that has taken a toll on iran's energy sector. plus you also have israeli strikes that have pushed this situation over the edge. now at the moment analysts say that iran isn't able to produce as much electricity as it needs to meet the growing demand. to try to combat this iran has been rationing its supplies, forcing government offices and banks to close or work as reduced hours. schools have moved on lines. shops and homes are in darkness

and industrial plants are denied power. this comes as temperatures are near freezing this time of year. "the new york times" reports that 17 power plants were completely taken off line last friday. iran's president apologized. as a sense of uncertainty grows the government is scrambleling to -- they were forced to tap into emergency gas reserves. the oil min is tier in july will import gas from russia and tehran lost an ally after the collapse of the assad dynasty and tensions will grow when president trump takes office in 2018. he began the maximum pressure policy that they would abandon ambitions for a nuclear weapon.

without investments in infrastructure this energy crisis will continue. john. >> john: stephanie bennett with the latest. thank you. the fight for fairness in women's sports on full display in women's volleyball. the team at the center of it all, san jose state university, which is now struggling after a controversy riddled season. several teams refused to play against them over a biological male athlete competing on their squad. the team is facing a mass exodus. seven volleyball players have entered the transfer portal and several have sued the conference and university saying they were forced to compete against a biological male without even being informed about it. the team's assistant head coach was suspended last month said this. >> to me it's like common sense. there should not be biological men playing in women's sports. so proud of those young women to stand up for what they believe in when they are also being

silenced by the mountain west. and they are holding their scholarships and things over their head. i think that is amazing. that's what we need. we need everybody to stand up and make sure that this does not continue. >> john: the co-captain of the volleyball team and one of the players suing the conference and also joined another lawsuit against the ncaa. brooke slusser, great to have you with us. what's the goal of the lawsuit and your role in it? >> i think just at the end of the day it is to protect the future of women's sports. because if things can keep going the way they are and allowing trans and men in women's sports there won't be women's sports any longer. if you want to be successful in any college sport, if you want to have men and women's teams what will stop coaches from

having a whole team of them? the end goal of this is to not allow any young women that have to come into college sports and pursue their dreams go through what my team has had to go through. >> john: title ix protected the access that women had to sports in college and a lot of people say the way it's rewritten under biden administration protects biological men to compete in women's sports. ncaa president charlie baker was on the hill and suggested the onus is on female athletes to use other facilities if they are uncomfortable with a trans gnder player in their locker room. >> why do your guidelines allow biological men into women's locker room without their consent and foreknowledge. >> that's what the guidelines say. >> your guidelines say that transgender student athletes should be able to use the locker

rooms, shower and toilet facilities in accordance with their gender identity. >> everybody else should have an opportunity to use other facilities if they wish to burd. >> talked to riley gaines about that last week. you were rooming with blair fleming without being told about his biological status. >> yeah. just going back to the video of they are still deciding and saying if you have an issue with this you can go find another bathroom to use. they will be allowed to be in here because they identify as a woman. we'll think about what makes them comfortable. they have a whole room of women terrified and uncomfortable in having to go somewhere else that
