one thing we know for sure if there ends up being some kind of speaker slow down that will slow down an agenda that president trump elect trump plans to hit the ground running with. if we have some kind of protracted fight where we can't erect a speaker, the speaker's not elected we're not sworn in and if we're not sworn in we can't certify the election. i would hope president trump would chime in and talk to those who are hesitant and say we've got to get going we don't have time. but in a post right time for festivus the day where grievances are shared by seinfeld rand paul offered a very real prediction that johnson is not long for the job i noted last year that i would be roasting the next speaker and the gang who put him in power by this festivus as usual i am right. i want to be the first to congratulate former speaker johnson who will be gone before dc gets warm again. but some house republicans, they do agree with that, angered by the initial funding bill that

it was absolutely unnecessary. he's been cooperative of law enforcement. it was like perfectly coulder graphed. >> carley: mangione facing 11 charges including first degree murder. his next new york city court date is set for february 21st sooth an illegal immigrant from el salvador wanted for sexual assaulting a child has been arrested by ice in massachusetts. after a local sheriff's office there ignored a detainer to hold him, the suspect was arrested on felony charges of indecent assault and battery of a child under the age of 14 and remains in custody arrested back in august but got released on bail and into the pushability ice never notified despite the detainer. the arrest comes as massachusetts governor maura healey has doubled down on resisting president elect trump's deportation plans. >> meantime, the illegal migrant arrested for setting a woman on fire then watching her burn to death on a new york city subway was previously deported.

the country in the first place, and now a city where people are too scared to be good samaritans because they don't want to have happen to them what happened to daniel penny. >> i think you're exactly right. you have bad policy coming together and collide to make the lives worse for the citizens of new york, particularly that victim. but i think it is really interesting he says the penny effect. it reminds me of what people were calling the ferguson effect years ago where police aren't going to want to do their jobs if they're always going to be accused of misconduct and wrongfully in many and often most cases. and it is so sad when you see that because, one, no one tried to help her when she was burning, saw that article in the new york post i think yesterday, but also maybe it could have been prevented because even though daniel penny was acquitted he still had to go through the rigamarole of a trial, the expense, the stress of not knowing if he's going to

prison so it really is absolutely horrific and then you go back to the fact this this was preventible. we know the biden administration after this was supported during the trump administration, they didn't do anything to prevent people from coming in. in fact, they encouraged people to come in by, you know, providing them benefits, by telling them once they're here they'll never get deported absent the most extraordinary circumstance. so, yeah, all of these bad policies collide to lead to one of the most horrific deaths i've ever seen plus it makes the lives of everybody in new york and nfrn the country worse off because we know sanctuary cities, which is another one i think we're getting to, but those aren't just limited to the people in those cities like we know with laken riley new york's policies throwed her death. so all of these bad policies harm everyone not just the victims which makes them even more and more disgraceful than just limited to a precise incident. >> todd: we don't just lose our humanity by happenstance, it is

furthered along with policies like you mentioned, like sanctuary city policies and this soft on crime da that we've seen throughout the remainder -- throughout the last ten, 15 years i'd argue. we mentioned sanctuary cities conservative watch dog american first legal putting it on the letter reads we have identified your jurisdiction as a sanctuary jurisdiction that is violating federal laws such lawlessness subjects you and your subordinates to significant risk of criminal and civil liability. jonathan what criminal and civil liability as somebody who's prosecuted people could these jurisdictions and the officials in them face? >> the liability a harboring statute title 8 section 324 which basically if you do anything to shield, conceal, harbor an illegal alien, somebody you know is an illegal alien or have reason to know is an illegal alien in this country

you could be guilty of harboring which is a federal penalty with a max number of ten years so you have that statute and the way the federal government can these communities is the leaders directing the people beneath them the sheriff's office and stuff to essentially to harbor and hide illegal aliens they can be targets of the investigations and what the federal government can do in terms of the investigation is they can subpoena all these people that work in the jails and communities, subpoena their communications these records of these jails to find out who's illegal in the jail when they're getting out things like that and what will make it particularly difficult for these communities, or these sanctuary cities will be, it will be extremely expensive to fight this and they don't want to go to federal prison solely to keep illegal alien criminals in the country, which is what they're doing. they try to portray this as, hey, we're trying to keep illegal aliens, you know, people from being deported from schools or hospitals, but what they're

doing in actuality is people in jails, convicted of crimes or charged with serious crimes, like the one in massachusetts you just referenced, that was a sanctuary city, they released a sex offender because they wouldn't cooperate with ice. this is either going to stop or be criminally liable and can be civilly libel for things these criminals commit in violation of ice detainers. so they're really going to face hard choices coming up at the beginning of the yearen a i think most of them are going to yield and the ones that don't are going to wish they did. >> todd: finally president biden sparing dozens of federal death row inmates including child murderers like jorge torres, who you, jonathan, prosecuted. let's go over his bio, if you will. he was given the death penalty after he sexually assaulted and stabbed two eight year olds, two girls, one eight year old, one nine year old, to death in 2005, then four years later he strangled a 20-year-old naval

officer. is josé torres someone who should be given the gift of a commutation this christmas jonathan? >> no, absolutely not. this is so disgraceful the biden administration, i just want to say the names of these victims lara hobbs was eight years old crystal tobias was nine years old when they were murdered on mother's day stabbed to death. laura hobbs was sexually assaulted stabbed in both eyes over 30 times in total. amanda snell was serving our country, was sexually assaulted and strangled while she slept in her barracks in fort mire in arlington virginia. also attacked three women at arlington raped one of them strangled her and left her for dead in the woods, she happened to survive. so, yeah, he shouldn't be given a gift by the biden administration and what the biden administration did, which really makes this disgraceful in a number of ways, one basically nullifying the death penalty totally but he didn't want to go

through congress nor did he want to discuss he was doing it, this was a christmas eve release when he did this. the other thing that makes it really bad, there were three people who were spared the death penalty, the most high profile of these cases and biden in his statement about why he's getting rid -- or why he's commuting the sentence, he couldn't in good conscious impose the death penalty meaning the death penalty as a whole is unconscionable but for some reason not for high profile cases. i would like to know and i hope somebody will ask the white house did they ask any of the victims they were going to commute the sentence of the killers of their children or their loved ones right on christmas eve or did they have to find out about it in the news yesterday in the whole things stinks, such cynical politics the way he did it. it shows lack of compassion for the victim, which we've seen over and over in this administration. they put criminals ahead of victims, criminals ahead of cops. it's one of the most disgraceful things and done in the most

meteorologist adam klotz is here. >> dreaming of a white christmas. >> carley: i would love that. >> maybe snowflakes in new york city interior will see a lot more snow currently falling across these areas. maybe not feet of snow but certainly measurable in these locations, this is the system we're paying attention to and there are winter weather advisories in these interior locations especially a spot where you're seeing elevation a good chance you will will see a decent amount of snow with this. we're currently looking at temperatures in the mid 20s or so 31 degrees in new york city still waiting for that line of snow to ultimately make it this way. now if you live a little further south, unfortunately, and this could be some of the biggest problems, dc, baltimore, up to philadelphia, this is a little bit warmer, which means all ice, big travel trouble for folks who are trying to get on the road throughout this christmas eve. thanks to that and probably some travel trouble as well across this entire region with some airport delays today as this entire system ultimately moves on through. what about the rest of the country? that really is our big weather

rod is the the host of the christmas program and his wife helps out in a big way. good morning to you. great thing you guys are doing. rob tell us more about the program. >> well, the christmas basket program is simply a program where we will assemble and deliver food baskets to families in need throughout our entire county. as you said 73 years this has been going on and it's a wonderful program. this is my 17th year chairing the program but it is an amazing process to see all these people from the community come out and help us. they just, a lot of people are just making it part of their christmas tradition to do that with us. >> that's so cool. michelle seems like such a nice thing to get the whole community together and do this so what does it feel like when you all are putting those baskets together? >> it's a great feeling that we're helping out so many people

in our county, in our area, and our family truly, our kids and everything are truly involved and we don't ask for any volunteer support, everyone just shows up, they go right into position from the year before and truly just get to work and within a few hours we have fed thousands of people. >> carley: wow. >> each family. >> carley: that is fantastic. so, rob, the wrestling team has also been involved. that's a major component of this, the high school wrestling team. have they been involved the whole 73 years? how did that get started. >> well, i don't know when they started getting involved but they've been doing it the whole 17 years i've been doing it. but it's kind of like their community service project every year they come in, they'll be there at 7:00 in the morning with us helping us unload trucks, helping us set up the garage. the ford dealership which is in beaver dam here they actually give us their entire service
