into some delays and cancellations as snow and freezing rain move into parts of the u.s. upper midwest and northeast regions. we're monitoring the weather and any effects on holiday travel and bring you the latest information moments from now. but first chilling new details emerging about the illegal immigrant charged with the murder of a death of oh a woman set on fire in a subway car. the words, up in flames pointing out the suspect was previously deported by the country and snuck back in. i'm griff jenkins. hi, julie. merry christmas. >> julie: i'm julie banderas. federal officials have confirmed the suspect, an illegal immigrant from guatemala who entered the country in arizona back in june of 2018. he was removed just days later and returned to guatemala.

it is unknown when he unlawfully re-entered the u.s. he was detained by the nypd on sunday in connection to the train attack and charged with murder and arson yesterday. the heinous crime shining a light on the migrant crime crisis that has exploded under biden-harris border policies. >> this individual was deported. he came back in as a gotaway. and there has been over 2 1/2 million gotaways under the last four years because border patrol agents aren't out there on the line patrolling the border. instead they're in border patrol facilities facilitating and processing illegal aliens. we have to get away from that. the policies that you will see with the new incoming team including tom homan as well as others will put a stop to that. >> griff: we have someone from the texas department of public safety. but we begin live in new york city. >> there are so many people in

new york city who want to take the subway and hear this news. it comes as investigators say the suspect in the case had the lighter in his pocket when he was arrested. he lit a woman on fire and fanned the flames with his jacket before he ran off. this is who we are talking about. this man is charged with first degree murder and arson. he was walked out by authorities in new york city yesterday. this comes in the death of a woman he is accused of lighting on fire while sleeping on the subway. authorities haven't identified that woman. sources say she appeared to be homeless and doing everything they can right now to track down any family members to talk to them about what happened. we're learning more about the 33-year-old suspect from guatemala. investigators say he was in the country illegally according to immigration officials. he crossed into the u.s. at least two times and then deported back to guatemala in 2018 but later came back to the u.s. again even with this

incident governor hochul posted this on x after the murder. after this woman was lit on fire claiming crime in the nation's largest transit system is down. many people say they don't feel like taking the subway anymore. >> as far as governor hochul same on her. she supports sanctuary status. nothing you can say to make it right in new york. >> we're working to get the exact details on what it is like now in terms of crime stats on the subway. get you an update on that. the man is in custody and expected to be arraigned in the coming days. >> griff: alexis, thank you. let's bring in lieutenant from the texas department of public safety. this case highlights the consequences of the past four years. what is your reaction to this? >> it's very upsetting and disturbing. we've talked about this over the years and talk about gotaways. the importance of gotaways and

just the mention of them or the untold stories of gotaways is not reflected when you talk about the border crisis. but you know as i do, gotaways really are a threat to our country. we don't know exactly who these individuals are, what their backgrounds and intentions are and why they would pay more to sneak into the country to avoid capture. a prime example of a gotaway and how they're able to sneak into country and commit crimes just heinous crimes. there is a senseless act of violence for this innocent woman to be killed at the hands of an illegal immigrant. it shows how the current border policies, catch and release has impacted the entire country. complete senseless act of violence. we shouldn't be having any acts of violence at the hands of criminal illegal immigrants. the new administration the priority of focusing on criminals and those that are committing acts of violence, those threats to public safety and national security.

we need to focus on that and underscores why it is so important to focus on gotaways and locate the individuals and have them removed to prevent any further acts of violence to anybody in our country. >> griff: we're already hearing that governor hochul may try to stand in the way of homan and federal authorities trying to go into sanctuary jurisdictions like new york and governor hochul seems to be tone deaf just hours after this heinous crime posting that the subways were safer. what do you make of that? >> it's unacceptable for any political figure, anybody, no matter what political party you are a part of to stand in the way of the federal government trying to step in and do their job and enforce the laws. this is an example again why everybody regardless of who you are and what your personal feelings are about this current administration, set that aside and focus on the safety and security of your state and focus on trying to cooperate with the

federal government and locate these criminals to prevent any further acts of violence in your state. i don't see how anybody could be opposed to that. it is something we should have been doing for the last four years. many refuse to do so. politics get involved with it. politics should not be involved when we talk about the lives of innocent people impacted by the border crisis. >> griff: i just want to show some images you gave me moments ago, a trooper here on christmas eve struck by a careless and reckless driver. clearly what is the state of this trooper and how important is it that we remember law enforcement officers and troopers like yourself willing to work on christmas eve, christmas day to protect the public and secure the border? >> thanks for sharing that. i want to share the photos with you. at times we forget law

enforcement in general and what they do every day, not just the border or responding to critical incidents. when they are out there every day especially on the holidays away from their families not knowing if they will return home because of certain dangers whether it's the border, critical incident, in this case just a reckless drive or intoxicated driver that crashes into one of our troopers. this trooper was able to walk away from it. several major crashes involving intoxicated and reckless drivers crashing into our troopers instead of the road. we lost a trooper in september for a reckless driver distracted on their phone and crashed into one of our troopers and killed him. we want to actually focus on that and send our prayers out to law enforcement in general. troopers out there working every single day away from their families want them to be safe and return home at the end of their shift. >> griff: our thanks to law enforcement officers like

the effects of this travel hiccup this morning. at last check over 1200 delays across all airlines in the u.s. with only 28 cancellations. not too bad. our 2024 holiday forecast if i can describe it in one word is busy. look at these record breaking numbers. according to aaa over 7 million people will be flying. over 100 million people will be driving to their destinations. most people are searching for sunshine and warmth. most popular domestic destinations are in florida including orlando, fort lauderdale, miami and tampa. some people we spoke to say this year's travel is hurting their wallet. >> definitely 1200 for our flight. not cheap at all. you have to do it to see family and everything but it's not cheap. >> 100%. the prices have gone up so much. >> to be honest i haven't noticed a price difference in the ticket market. if anything, i would say it's a

what do you make of it? >> well, it is in the toilet because they don't control the senate or house or the white house and they don't control a majority of governorships. that's as toilety as it gets. the message for democrats, vote for us, only we can save democracy from donald trump and we'll do so by shipping the sitting president joe biden and replacing him with a candidate in kamala harris who didn't receive one primary vote and not allow the candidate to speak to the press in any capacity for six weeks after they becomes the nominee. then bill for over a billion dollars to make it look like there was a ground swell among the most unpopular vice president since dick cheney and while we're at it we'll try to jail our opponent and take him off state ballots, call him a fascist and when he holds a

rally in madison square garden we'll say it's to the nazis. this is all the exact opposite of saving democracy. so that was one of the more common sense perspective i've seen in the "new york times" place. bill clinton, work with the other side, say the era of big government is over and welfare space is done. work to the center and maybe you'll win an election again. >> julie: a lot of democrats have been coming to their senses. you heard about the senator from pennsylvania, joe fetterman -- john fetterman who said that it is just common sense. for people to get on board with the president. going against the president is basically going against your country and you should be for your country, not against it. it is time for people to become unified. maybe a new year's resolution for many. quotes from democratic strategists trashing their party. the democratic brand is in the

toilet. democratic strategist writes toilets have clear utility. perhaps the comparison is even generous. campaign consultant, another one, says the sign outside hq now should say beware, entering an echo chamber. that was former ohio representative tim ryan. what do you make of democrats sort of piling on the democratic party and obviously seeing a need for change? >> well julie, the toilet is too generous, the only part of the article that really do say that they got spot on there. this is a party that has been flushed down the toilet, gone down the sewer, went to the sewer processing treatment plant and washed out to sea. it's that bad. they said goodbye to the working class people in this country years ago. they became the party to quote james carville, the faculty lounge and coastal elite.

if democrats run against being a democrat they win. it's like i don't support my own party, are you crazy? john fetterman is a great example. how many times did he have to come out and defend israel and say we should have a secure border and while we're at it shouldn't destroy the jobs of the hard working people working energy in pennsylvania. all across the country the same message. democrats care about college educated white liberals. when they pay off their student loans the guy and gal in the truck working for a living turns around and says what about me? you can't do that. that's completely unfair. democrat party cares about impressing professors, republican party cares about impressing plumbers and that's the difference. >> julie: rich and joe, that's all the time we have. thank you both for coming on. i was only kidding. you are like a rising star, joe. you know how much i love you. i'm not sure about the suit but i love you. >> this is a great christmas.

>> julie: rich and joe, thank you. >> griff: house speaker mike johnson could be at risk of losing his gavel as the house majority leaves little room for him to lose support from republican colleagues. aishah hasnie has more. seems like a battle is brewing here. >> good morning. the gavel has to be on johnson's christmas wish list this morning because when everybody left down re town last week he did have the votes to become speaker again. house republicans have a thin majority, 219 to 215. that means johnson can only afford to lose one republican. right now johnson has president-elect trump's support. a big deal. as many as 38 members bucked trump last week over that government funding bill and they could do it again, griff. congressman thomas massey has already announced he will be voting for someone else.

congresswoman victoria sparks says she is undecided. house freedom caucus andy hair use is undecided what leadership should look like next year and open the door to other freedom caucus members revolting. johnson's predicament follows his deal with democrats on the 1500 page government funding bill later derailed by trump and musk. then johnson passed a clean cr without resolving the debt ceiling issue. a source tells fox news the president-elect was pretty unhappy with that move. here is what some of his numbers are saying what needs to change for johnson to get the gavel again. >> i think he has to show me that we'll be serious about making these cuts. >> i don't necessarily think the answer is to replace the speaker. but i do think there needs to be a better understanding between leadership and the membership. >> we need to back president trump and if president trump will back johnson i'm sure he will be the speaker. >> and griff, another thing to

hi, madison. >> this strike started on thursday and we've been covering it for days. normally when we get here the sidewalk is full of strikers and protestors. when we got here this morning, i was the only one here, completely empty. i was able to reach out to the teamsters and get information on that. they told their strikers to go home for christmas eve and christmas day. take a break for the holidays. initially they had wanted to strike 24/7 until their demands were met. the demands being amazon sit down with the teamsters. that didn't happen. a pause or end of the strike? teamsters are taking a look at the statement they sent fox bis this morning saying we told amazon there would be consequences for not coming to the table. there were. the teamsters know now that amazon is scared. at least 200 amazon locations nationwide saw picket lines with thousands of amazon workers exerting their strength.

as pickets break for the holiday make no mistake the teamsters will never let up and workers will never stop fighting for their rights at amazon. i do want to clarify some things. pulling up the map there were nine locations where we saw people striking and protestors. to call them amazon workers is not accurate. none of these folks are direct employees of amazon. they are contracted by amazon through third parties. striking workers wanted to see a resolution but not necessarily happening. now we've not gotten a clear response from teamsters whether or not the strike will resume on the 26th. but they are saying they'll vote and get us the latest information. the reality is it's empty here. amazon didn't budge. something tells me the teamsters won't stop trying to get further into amazon. >> julie: thank you so much. >> griff: a cording to a resent

survey shoppers are spending a record amount. americans are expected to spend up to $989 billion during this christmas season. let's bring in mitch rocheel, the managing director of management ventures plus and san diego school of business visiting research fellow. mitch, let's get it right off the top. if you are in florida in the sunshine and on the beach later don't tell me about it. it's freezing here but we have snow. that's positive and uplifting. the survey that americans are going to spend more despite the inflation, why do you think that is? >> it's actually interesting, griff. many analysts thought this year would be down not because of inflation. we had five less shopping days. but the resilience of the consumer is really what's driving our economy. in terms of the sales volume, i'm not blown away by that.

it is up 3% versus last year, which is basically the rate of inflation we're living with. americans are doing what they did last year. the thing that does concern me is the amount of household debt that americans are incurring to buy all the stuff that they are buying. >> griff: let's look again at the graph. it is very fascinating. you can see in this, mitch, that the 100,000 plus folks are 6%, the 40 to 100,000 down 20%, the pragmatic gang. the 40,000 or less on 27% or less spending on holiday gifts, does that suggest there is really a lot of hope as you put it and optimism that better days are ahead? >> yeah, 100%. i think that how americans shop is an indicator of how they feel. when people are down in the dumps they don't go out and shop. but we've made it real easy. you can be optimistic in the

moment, pick up your phone and go buy something and that's what is happening. so i do think that by and large americans feel that the prospects for the future are good and that bears out in the consumer sentiment index and consumer confidence index that get reported on a monthly basis. i do think average americans feel that the future is brighter next year than perhaps they felt a year ago. >> griff: another sector where the future appears bright, home sales. we can show you how much that's up. almost 6% from october of this year. but up nearly 9% from november of last year. this is a zillow economist. listen to what he has to say. >> we should see existing home sales rebound somewhat, homeowners are starting to come back on the housing market. inventory is up 17% from the previous year, from last year.

so more options for buyers, a little bit more bargaining power, slight improvement in affordability could be good for the housing market. it will be a healthier housing market in 2025. >> griff: do you agree, mitch? >> i do. i think the thing that's held back the housing market is interest rates. that's not really a new story, but i think what's interesting about it is that americans have just gotten used to this higher level of interest rates. i think, you know, for a good 18 months as rates were rising, people were hopeful that maybe it would turn the corner and rates would fall back to where they were. i think average home buyers realize this 7% mortgage or somewhere between six and eight is where mortgage rates are is going to be what it is going to be and they are moving forward and not sitting on the sidelines. i do think that 2025 we are going to see an up-tick in home

security in paraguay. this one is on congress. >> i got a lot of problems with big spenders in both parties. here is the thing, everywhere you look you find more of this stuff. ultimately it takes congress. congress has to get rid of the spending. doge can point out the spending problems and waste the same way i've been pointing it out. the reason it is not eliminated they don't have the votes to get rid of the spending. >> as to the suggestion this may be a good starting point for doge. that department paul says he has been fighting government waste like doge before doge was cool. the bulk of the projects in this report come from the non-defense discretionary side of the federal budget. small compared to what the federal government spends on entitlements, medicare, medicaid and social security. bah humbug. >> griff: i suspect they won't

equipment company in russia was sentenced to 3 1/2 years in prison in september of 2022 for enabling bribes to an aide of the former deputy prime minister. today he was sentenced to 13 years in maximum security on the espionage charges and bribe rae was added to this term. a 15 year sentence and given a 140,000 fine. specter was born if russia but moved to the u.s. and received citizenship. one of a few u.s. citizens sentenced to lengthy terms in russian prisons this year. you may remember evan gershkovitch sentenced for 16 years. he was lateroric in august. the united states previously said it did not believe specer was wrongfully detained. we're waiting for a confirmation. back to you. >> griff: steffi, thank you.

>> julie: the drone debacle continues as law enforcement locally in new jersey band together demanding answers for the american people. nate foye is live from jersey city. have you figured out who is flying these drones? the government isn't. somebody has to. >> it's crazy. in the second month of this mystery and both new jersey state police and the nypd tell fox that essentially we're no closer to solving it. in fact, new jersey state police over the past several nights they have had one reported drone sighting each night. that's down from about 150 per night a short time ago. authorities are still working to handle drone threats better and as you mentioned, that's why
