rachel: incredibly, two crew members have been pulled from the wreckage alive but emergency crews without any life threatening injuries. that is a miracle, truly. meanwhile, local officials say the control tower issued a bird strike warning and the pilots declared may day before trying to land the plane. will: reports say the landing gear was not deployed. sad story that we talked about throughout the morning, what happened with the landing gear, what happened with it failing when it comes to its air flaps, no brakes, as it belly landed on the runway. we're going to be joined by an aviation expert at 9:20 a.m. eastern time. rachel: that's right. we'll get more information on that. the black box has been found. so hopefully there will be more answers coming from that as well. this is an interesting topic.

we've been discussing it. we discussed it yesterday. it's still raging online. we're going to discuss it right now, which is on the h1 1b visa. elon musk and vivek ramaswamy say they believe this is the way to make america competitive in the tech world but a lot of other people saying wait a minute, the visa program has been abused. a lot of americans would like these entry level coding jobs that are going to a lot of people that are coming from other countries with the incentive that they eventually will get a green card and be able to bring family members over. people say these people are qualified, sure, but we have people here in america. donald trump weighed in on this which left a lot of people confused. he seemed to have been against some of the abuses of this program earlier in 2016 he weighed in ob on it. here he is saying to the new

york post, i've always liked the visa, that's why we have them. i have the visas in my properties. i am a believer in h1b, i used it many times. it's a great program. what do you make of this? >> as you pointed out earlier, the idea of having a program that allows an elon musk to come into the country, i don't think anybody has a problem with that, and certainly donald trump doesn't have a problem with that. the problem with the program is that it's been so abused and turned into a system where it is designed for a big tech employer to get maybe not cheap labor but cheaper labor. will: and inden cdentured serve serveitude. you have to remain employed with whoever brought you over. >> you remain indebted to them for perhaps a lifetime. these are the very abuses that the first trump administration

tried to clean up and i think successfully did clean up. rachel: i'm not entirely sure, we should fact check that, i'm not entirely sure if you have to remain with that company. will: for a period of time. rachel: for a period of time. i think you're right. i think the term you used is correct. i think the ultimate thing is you have to remain -- people don't just -- they're not just coming for the salary. they're coming for the opportunity to stay here and then chain migration, hopefully bring family members over. elon musk weighed in on this. he said the reason i'm in america along with so many critical people who built spacex, tesla and hundreds of other companies that made america strong is because h1b. take a step back and blank yourself in the face if you're against it. will: he's doing a line from tropic thunder. rachel: tropic thunder, expressing that -- will: you pointed this out. i saw this on your x feed yesterday. it was really good. nicole shanahan, rfk's running

mate for a while, she's a silicon valley veteran. she weighed in. it was a wrong thread where she explained the pu pros and probh the visa system. she said i take issue with some the discourse i read online suggesting lazy american culture is the main reason why we need to continue the h1b program. i agree with her on that. she said tech companies getting massive breaks on cheap labor at the expense of the american way of life is predatory, blaming our culture for why american stem grads don't take underpaying jobs is ridiculous and insulting. rachel: my son-in-law is a math guy, majored in math at university of wisconsin, he said they don't pay enough. part of the reason they don't pay enough, they have an influx of workers willing to work for less because what they get paid in the states is less than they get in india and has the incentive of staying. >> of course, the real problem

here is something -- it's a much larger problem across the board with globalization and made far worse by having open borders where you get not only some of the skilled labor but also lots and lots of unskilled labor. one of the things i think that i value about having this argument, this discussion is that we want these big tech companies in america to be invested in american education. so that -- and that's a long-term problem and a lot of these people don't think long-term. they just want the instant grat gratification solution like you were talking about. we need schools designed to give students valuable, usable talents, not stupid idiotic courses on dei or teaching racism. it's idiotic when what we need are students that are prepared to take these jobs and have these jobs be well -- good

paying jobs. will: we're not an algorithm. we're not a company. we are a country. we're a nation. we are a people. and that purpose of that nation is to serve americans. ned ryan was on "fox & friends" earlier, he talked about serving americans. >> america fundamentally is not an economic zone. we're not some global store front. americans should not be treated as second class citizens in their own country because federal policies allows billion dollar corporations to hire foreign workers at under market wages instead of paying american workers full wages. if we can frame the conversation that way and understand the system is broken, it needs to be reformed and the american people should be prioritized on all things, that's the message of america first many i think stephen miller has made it very clear how he feels about the h11b visas. there is need for reform. the starting part in the conversation with h1b visas is how do you reduce the numbers to

bring in those that are exceptional and not let it be abused. i feel confident that stephen miller and his reform ideas h1b visas will be what will happen the second term. rachel: if you limit the visas and only bring in the elon musks and the really exceptional people, what you're going to see is there's a tighter market and the wages will have to be -- you'll vi have to pay wages that young math students like my son-in-law who is married and has to support a family would want to be part of and that may mean, guys, guess what, fox news alert, it may mean that big tech bosses make a little less money and they have to pay their workers a little better. i think all of us would be okay with that. by the way, this debate we talk about how healthy this debate is for everybody, for this country, especially on the right to be having, this is a comment to that really thoughtful post from nicole shanahan, a tech person weighed in and said imagine if we took the money from the department of education and

created stem block grants to give kids educational opportunities in under-served communities. this is what we should be thinking about, not importing people to do entry level coding jobs but how do we take our kids who need jobs and maybe can be trained into this and i think if we change our education system, we certainly can. >> and i think it's completely fitting that the debate is also not only happening on the republican side but also happening within sort of the maga movement, within the trump movement because of all the politiciansings donald trump is the only politicians to come along in decades and recognize the problem of immigration whether it's legal or illegal but the problem of globalization and immigration and how it affects people and families. will: and to that point, i would just add even if it is the 0.0.1%, the best of the best, there's still a requirement to buy into the american way of

life, al sim similar -- assimile into the culture to make it so everyone wants to be in america. rachel: it's the thought that some how americans are mediocre. we are not. there's a lot that adds to intelligence. there's raw intelligence. there's emotional intelligence. there's cultural intelligence. there's a lot of things that weigh into that but we should set our educational system up so that our own children can access these opportunities. >> nothing is done more to destroy the fabric of the country than the open border, the intentional open border by the biden administration to allow millions of illegals into the country who have no interest in trying to climateize to the american culture and we are seeing and of course the media does everything they can to sort of cover this up but we have

heart breaking photographs of 5-year-old and a 9-year-old who were found at the border, dropped off, probably by the cartels, probably -- possibly in an effort to divert our border resources away from their effort to move what's more valuable to them, massive drug shipments across the border in another area. will: they came across with just that sheet of paper you can see in the photo that had an address and phone number. lieutenant christopher olivarez posted that, saying troopers recovered two unaccompanied children left behind. they were el salvador, 5 and 9. had a note with address and phone number. they were referred to u.s. border patrol. rachel: this is child abuse what happened to these children. let's be frank about it. poverty is not an excuse for child abuse. their parents put them in the hands of evil cartels who

abandoned them in the desert with a phone number. that piece of paper, we should find out who are those people? who are these people that these children were supposed to be sent to? we've lost as you guys know 300,000 children. and we talk about the horrors that happen to these children along the journey, many of them raped, abused, traumatized, but then when they get lost in our system, i know you mentioned that bringing people across the border or bringing drugs and things across the border, you know, that's valuable but guess what? human beings are also valuable. there are children that are sex trafficked over and over and over again and so that's important, the horrors that happened to them. once they get there, who are the people on the card, on the letter? who are those people. our dhs doesn't know. until donald trump gets in office we won't be able to talk about that because this administration hasn't given a damn about these people. >> when i say valuable, i need

south korean runway, killing all but two on board in one of the country's worst aviation disasters. we warn you, the video is graphic and some of you may find it disturbing. kyle bailey is a pilot and former faa safety team representative. he joins us now. thank you for joining us, kyle. >> good morning. >> i think earlier you said that you thought this was clearly equipment failure. what do you think happened here? >> you know, i'm not really leaning towards equipment failure. it's very unusual that the airplane is in a cruise flight configuration for landing meaning the landing gear is in the up position, the flaps are in the up position, there are no slats extended on those wings to slow the airplane down.

so the airplane is basically coming in very hot. now, if it was in fact a bird strike or if there was, say, an engine failure on the right engine, it appears there might have been engine problems on the right side, it doesn't explain why the airplane is coming in so hot and with the landing deer gear inthe up position. normally there would be bells and alarms going on in the cockpit of the airplane but it's leading me to believe the pilot was preoccupied with possibly multiple things happening at the same time to explain the airplane basically in that cruise flight configuration for landing and coming in very hot. >> so two questions. one is, how fast do you think the plane was traveling when it starts skidding across the runway and if the people on the ground were able to put foam down before it landed, would that have made a difference?

>> you know, i don't think so. the speed i always say maybe is about 20 or 30 knots higher than it typically should be but that's just speculation but the key here is that the airport has instrument landing equipment pretty much a housing structure right in the vicinity of runway end which is very common at most airports but here in the u.s. those facilities are very light weight and pretty much meant to break apart if they were impacted by an airplane. it appears from that explosion on the airplane is a result of the aircraft impacting that ststructure from what i can seeo i think that's pretty much what spelled disaster for that airplane in striking the housing structure for the instrument landing equipment. >> well, truly a tragedy and we're grateful for the two that survived but my goodness, what a travesty, thank you, kyle

ago. they didn't take care of business when they were supposed to. they've been accelerating the spending. they haven't been slowing it down. that is absolutely ridiculous. they're trying to screw over donald trump as he comes into office. he's not even sworn in until january 20th for good necessary sake so they didn't do their business and now donald trump's going to have to come in and help clean up this mess. rachel: it's kind of bogus when they say we're running out of money. we gave $64 billion to ukraine. they just approved yesterday or this past week 1.2 billion for ukraine so don't tell me we're running out of money as you're willing to give it to ukraine to defend their borders, our borders are wide open. we're talking about stem programs here, jason chaffets. we could have programs, job programs, stem programs that employ our own people but we don't have the money somehow so how will this hamper the trump administration? what do you expect that this dilemma of running out of money, how will that impact donald

trump and how will he deal with that? >> well, it kind of gets into the weeds. it's sort of insider baseball but it has to do with how they score tax cuts. so remember, when we had the first round of trump tax cuts, everybody up and down the economic scale got tax cuts. right? when that happened, revenue to the treasury went up but when you look at how they score it within congress, the congressional budget office and whatnot, when they look at that, they say oh, tax cuts, that's missed revenue. it's not. that's what accelerates the economy, that's what drives revenue to the treasury. so that's what we have to look at. so in order for donald trump to use the reconciliation package with congress to actually implement things that are going to be stimulating to the economy and help drive down inflation, you've got to do two things. put the tax cut in place. cut the spending. but the scoring slows you down and that's what donald trump's going to have to tackle right
