and submarines come expected to grow to 435 by 2030. the question remains if you think china has been preparing itself to ramp up its arsenal before trump takes office, knowing that they never would've gotten away with this had he been present in the past four years. >> thank you for having me on. the trend line is all going up, and not in some small fashion, some gradual fashion, but going up in a very large way. another number that will draw attention to is the 300 additional medium-range ballistic missiles that are primarily used to go after u.s. navy warships like the aircraft carrier, but also attack our homeland in guam were over 100,000 u.s. citizens and strategically important bases are located. the u.s. for the last 20 years, the navy has not been able to grow in any meaningful fashion. 300 ships. the last time we were above that was in 2003. we have a long way to go pick the chinese are not slowing down

11:23 am
>> i go back to the u.s. constitution that specifically lays out high crimes and treason -- in this case it's a high crime -- our reasons for impeachment. we never really got far enough down the road against president biden. it's a constitutional dilemma we have to rectify. i think the next team that comes in, the next administration, should look at it from that perspective. we have to do better than we have the last four years. not only in jurisprudence, but also in our defense, or else we are going to have a dangerous future where people will be more violent. >> day 1, when it comes to tackling china, how does president trump get china to dial it's weapons arsenal? they have to have so much progress. is it too late? >> it's never too late and you never give up. the united states has a lot of advantages. we just continue to not prioritize things that would have made it easier as a problem to solve. what we need to do one day 1 january 21st of next year,

11:32 am
could be enough to lead to a hung jury. the hope is that the picking the jury make sure they are very careful -- and the judge as well -- about not letting that happen. >> let's drill in on that. it raises a great point. i'm not a lawyer but i have covered enough cases to note this process, where they choose the potential jurors. there is a reason poll i wanted to show you. it says to what do you describd it responsibly for the murder? 78% say the individual, but 69%, nearly seven in ten, said denials for coverage for health insurance companies, and 67% saying profits. how difficult will it be for those lawyers to make sure the sentiment is not present? >> the thing that i like about the jury system -- jurors take
11:33 am
their job seriously. while that reflects the american public's feelings about insurance and health care, at the end of the day, the thought that someone who is capable of murder in cold blood on the streets of new york city might go back on the streets should be enough to prevent what we call jury nullification, or one juror taking the case in their own hands. the attorneys are going to have to tap into -- they will definitely get those jury consultants on board. i have a psychology degree, which is a big help in jury selection, and knowing the jury. they want to make sure that somebody that doesn't have this set intends to lead to injury does not squeak and by acting as though they are willing to be there, take this very important job of being a juror very seriously. >> is the evidence overwhelmingly? wdamning to --
11:34 am
overwhelmingly -- we have the shell casings left behind with words like "deny" on them. is it overwhelming in your opinion? >> it absolutely is. there is a strong chance that this case resolved some sort of a plea deal. as you mentioned at the start of our talk, there are a lot of charges. one of the federal charges leads to the potential death penalty. if the defense attorney can get that off the table, get him life in prison, this case may end making a plea deal. if it doesn't go, a good defense attorney will look for jurors who are more sympathetic to him, who would be the type of people that would answer the poll you just showed in a way that reflects that they might be willing to blame someone else. the evidence and law are pretty set in stone. >> is the terrorism charge a reach? >> it's a reach.
11:35 am
it's also unusual, though not illegal, for there to be both the state and federal charges. that seems like piling on as well. ideally, the state and the feds get together and get an airtight case, decide one road to go down, maybe reduce some of the charges so that they are really focused on what seems to have been a cold-blooded murder and not the stretch for terrorism. >> it's going to be a trial we will be watching with a lot of interest. heather hamson, thank you for joining us, and happy new year. >> happy new year. thanks for having me. >> oil and gas companies are gearing up for big policy changes once president-elect trump returns to office, but where the planes face roadblocks along the way? >> plus, and other debt limit deadline. president-elect trump at odds with some republicans about what to do about it. our economic panel takes that up next. cut! more mud! action! louis, louis!

11:44 am
this. this is something that wall street understands intuitively. you can't keep spending money you don't have. you run out of money, financing options, and you go out of business or your stock plummets. politicians need to understand that very clearly. there's only so many levers you can pull, so much money you can borrow before the end of the road to kick down ends. >> you put it into layman's terms. you don't pay that mortgage, you will default on it, and that will happen potentially if they don't do something about this. look at this "new york times" headline and subhead on the treasury secretary's warnings. she talks about this. once extraordinary measures needed to avoid default. the treasury secretary urged congress to protect the full faith and credit of the united states by raising the debt limit. calling on congress essentially to either raise or suspend the nation's debt ceiling. the question is will congress heed her warnings?
11:45 am
>> good question. they're two hard truths. the first is we cannot continue down the road we are going down. it's unsustainable. you can -- as far as the eye can see. the second hard truth is you have to raise or suspend the debt ceiling. you cannot to fall on u.s. treasuries. what is not clear is how did i get from this two hard truths to a plan for action? they haven't in the past. they have not fixed the problem. lots of treatment surrounding raising the debt ceiling. and we have gone right back to doing the same thing. this time it has to be different. you have to change the tune, get the spending under control, and chart a path that is sustainable. if you do, you get better growth, lower interest rates, markets are well positioned to grow more strongly in the fu future. >> even if you get the spending under control, obviously cutting spending is one of the number one agendas for president-elect trump. he has this committee and
11:46 am
elon musk and -- going to be heading that. it might upset some of his party's spending hogs the cutbacks. the question is is there a path forward that can get the u.s. back on financially stable ground? >> they can be offended but i also have to remember how they got back in power. they rode the wave of trump being reelected. a little loyalty would go a long way. you have to be reasonable. to doug's point, you have two choices. you get rid of the debt ceiling cap, or raise it slightly. if you get rid of it, i can tell you it will be this style of outcome as "we are going to spend more," and every pure cat will will keep spending. it needs to be a hand-in-hand compromise. americans get tired like with government shutdowns. it's always a compromise at the 11th hour and 59th minute when it is a crisis. we cannot have that with the debt ceiling. i think president-elect trump is prudent in trying to bring it to a head so that you can have paired it spending cuts with a slight increase in the debt

ceiling so we can get on the path to fiscal responsibility. to doug's point, a little bit would go a long way. it would've mock a lot of trust and more confidence that we will see spending cuts and reinvigorate the american economy. >> it sounds like a great plan. let's hope for it. thank you both for coming on, and happy new year. >> happy new year. >> thank you. >> great conversation. president biden leaves office in just a few weeks, but could his lame duck term leave a lasting mark?
