in the big apple when the clock strikes midnight, but hopefully they brought umbrellas and ponchos. the forecast calling for a heavy dose of rain. >> alexis mcadams live from times square with a look at the literal calm before the storm. they are not allowed umbrellas and still. is that still a policy? in other words you are getting wet no matter what. >> no umbrellas. i think these people don't care about the weather too much. they don't care that they also can't go to the bathroom, can't get anything to eat for like ten hours and counting. get a closer look. this is sixth avenue. this is hundreds of people, just here. these people are waiting as well. they told us they came from korea specifically for the new year's eve celebration in new york city. rain or shine, they don't care. they have been looking forward to this for months. a lot of planning has gone into this. most people say they feel safe and are excited to be in the big apple. >> i have money, so i'm just trying to have fun.

way down here. then, what happens is you get up to those checkpoints. they will make sure people don't have big bags, umbrellas, backpacks, things like that. then they will allow them in. a pushback start for people to get them in. that's even more waiting time, but more time to get excited for the ball drop. >> and more time to go to the bathroom. i am an optimist. the glass is half-full, or toilet, whatever. >> maybe they could use task rabbit, that can save your spot or something. >> brutal. like seriously. 12 hours without going to the bathroom. >> it is brutal. there are some people that just decide to use the restroom in the pins they put them in. it's tough to be out there. >> but nobody has to worry about breaking the seal as you know, because there is no alcohol involved. they will be drinking. they will be thursday and dry as desh out there. i made that sound fun. anyway, ringing in the new year right here on fox news. tyrus and kat are not afraid of the rain and they will take us off at 9:00 p.m. eastern.

if you want to check out pregnant lady in times square, this is the place to find her. then, jimmy failla will pick up at 11:00 p.m. eastern with his all-american new year's bash, so stay tuned. >> i will tune in and watch it. meanwhile, the u.s. treasury department hacked by a chinese state-sponsored actors. officials calling it a major breach. fox team coverage on deck to react. first, grady trimble is live from the white house. grady, what did the hackers get access to? >> the treasury department says this hacking group affiliated with the chinese communist party without access to the workstations of treasury employees, as well as unclassified documents. the treasure was notified about the breach on december 8th, and then sent a letter to the senate banking committee, alerting them to it yesterday. the letter says the hackers remotely access to the info on one of the departments third-party cybersecurity

companies. the company is called beyond the trust. the treasury tells us the compcompromised beyond the trust service has been taken off-line, and there is no evidence the hacker still has access to treasury systems or info. experts say government agencies are particularly vulnerable to this kind of cyber attack, especially the treasury department. >> they are the ones that are levying and owning the sanctions being done on the chinese and other governments. it makes them a target, more so than say just a corporation when it comes to state-sponsored hacking. >> we know the hackers got their hands on these unclassified documents. what we don't know exactly is what is in those documents. it may come as no surprise to you, but the chinese embassy is saying they have nothing to do with this. >> shocking. we knew what was happening and needed to know more about it.

grady trimble life for us at the white house. thank you. >> let's bring in dan hoffman, former cia station chief in mar- moscow. happy new year. this comes on the heels of a series of chinese hacks on the government with the white house disclosing last week that chinese officials accessed americans hunter viets private text messages and our phone conversations, which is disturbing. do you believe the biden administration left america vulnerable to china? >> we are under siege from chinese hacking. they penetrated our critical infrastructure, the tile communications companies you mentioned. on that one, those companies failed to implement, according to our national security advisor, the deputy security for national security, and a new burger. she said the companies could have implemented basic cybersecurity protocols and prevents of the hack, but they didn't. we need better partnership between the government and

private sector. hopefully trump administration will bring that to bear. when it comes to the latest attack on treasury, that is an intelligence failure in. in cyberspace, we should be able to spot these attacks before they happen and then preempt them before any harm is caused. now we are at incident response phase trying to figure out how much information the chinese have stolen from treasury, not to mention the fact they are still rooting around in our infrastructure, and access to all of our telephones and text messages and phone numbers. they are particularly on those who worked in the u.s. governments, or continue to work in the u.s. government. am sure they will use that information to enable other spying operations against us. >> the fact that there is this lack of urgency when it comes to this situation with china and washington is disturbing enough as is, but also to think this was preventable is inexcusable as far as i'm concerned.

here is the republican congressman michael waltz on combating china. his thoughts. >> i think we need to take a step back and look at that in the cyber field. we need to start going on offense. we need to start imposing consequences for those stealing our technology, spying on us. i know president trump will lead the charge to restore peace, restore stability. that is why making our adversaries -- and that's by making our adversaries respect is. >> consequences, that's a concept. how will trump change the approach once he gets into a white house? >> in a big strategic sense, we need to do a better job of defending ourselves against china and counter in china worldwide. these cyberattacks are just part of what china is doing to threaten our national security. remember that they are militarizing the south china sea and stealing intellectual property. they are penetrating markets in the western hemisphere and gaining traction and security for relationships with our enemies, like cuba and vene venezuela.

we need better bipartisan consensus on china. that is one of the -- of the first trump administration, were democrats and republicans came together with some good bipartisan consensus and legislation. we need that and direction from our new national security advisor mike waltz, where we counter china across all of these battlefields. >> switching gears a bit from china to another country pushing her buttons. that is russia. the other foreign minister sergey lavrov -- involving ukraine and nato quoting that the proposals have been made by president-elect trump advisors. could he brokered a steel once he takes office? and why are they accusing trump advisors when they never even mentioned nato? >> the russians negotiated this way. they employ a maximalist strategy. they will try to get as much as they can out of a war that's been a losing one for vladimir putin.

>> tiktok could be gone from the u.s. in just a few weeks. president-elect trump is asking the supreme court to hold off on implementing a law that would force the app to divest from china to stay up and running here. a coalition of attorney general have found a brief to support the ban. alan wilson, south carolina's republican attorney general as part of that group and joins us now. mr. attorney general, happy new year. thank you for joining us. this is really -- let me tell you, everyone under the age of about 30 has paid close attention to this. on january 10th, scotus will hear the case, and nine days later if they have not ruled quickly, or tiktok has not divested from chinese ownership, then they would be effectively banned. you write this. you say "tiktok is a tool of the chinese communist party and

enemy of the united states. it is an operations post, a serious threat to our national security. the first amendment does not protect a platform that allows the ccp to exploit americans' data and undermine our freedoms." are you concerned that your position runs contrary to that of president-elect trump's? >> not at all. first of all, president trump agrees with all of us that china is not only an extensional threat, but a pacing threat to the security of the united states of america. we all share that belief. now, one thing i will say is there are several remedies for dealing with a problem with china. there are administrative remedies, political remedies such as passing a law like congress did in this case. there are also political or legislative remedies in defending the law. then, there will be the legal remedies which could include -- before president trump takes office, we file a lawsuit to support the law congress passed that once tiktok divested from its parent company which is

controlled by the chinese, communist government regime. we see what the chinese government is doing with air balloons, drones, geotargeting u.s. citizens, hacking the u.s. treasury. imagine what they would do with a platform that they have control over. i believe president trump, as leader of the free world in this country, if he wants to take control of this issue and negotiate a political or policy resolution that would negate the need for us going to the supreme court, i'm in favor of that. but if trump doesn't, if he's not able to deal with this, then we need to have this lawsuit in effect ready to go to divest this company from the communist chinese governr this delay. they writealmaking expertise, te electoral mandate, and political will to negotiate a resolution to save the platform while addressing the national security

concerns expressed by the himself has acknowledged." trump do you see, putting her lawyer had on, that the supreme court, that this process could even be delayed? you have got the supreme court obviously scheduling their hearing january 10th. the law is scheduled to take effect on the 19th if there is no resolution. >> the supreme court may take what president trump is saying into consideration as it deliberates after oral arguments on the tenth. this law goes into effect or is supposed to the day before the inauguration. president trump and his team believe they can negotiate a resolution that would protect u.s. citizens and our country from the existential threat that china poses to us, especially our data security. i trust the president to do what is in the best interest of this country. if he is not able to negotiate something good enough for our country, we have this lawsuit ready to go into effect. i don't know how the supreme court will react to that but i stand ready to support president trump, either through

fighting for common ground. alexandria hoff in washington. what is the mayor saying? >> the mayor said she and president-elect trump want d.c. to be the best, most beautiful city in the world, in order to reflect the strength of the nation. she continued "we discussed areas for collaboration between local and federal government, especially around our federal workforce, underutilized federal buildings, great spaces and in the structure. i'm optimistic that we will continue to find common ground with the president and his second term." we have to look back. on the campaign trail, president-elect trump routinely pledged to federalize d.c., calling the nation's capital a death trap and horribly run. the mayor said as recently as last month that the district "had to defend itself." in 2023, d.c. saw a shocking spike in violent crime. 26 years -- and violent crime rose by 39%. >> we will rebuild our cities, including our capital in

washington, d.c.. we will get all of the graffiti off of those beautiful marble columns. we will make those cities safe, clean, and beautiful again. >> in may, the house passed this crime act which gives congress more control over the way d.c. handles crime. earlier this month, mayor bowser testified before lawmakers, noting that this year, violence has gone down. you look at some of the data, homicides down 32% compared with last year, down 25%. total violent crime down 35%. homicides are still up compared with 2019. one area in particular were trump and bowser clearly agree is mandating federal workers to return back to the office. still a lot of empty buildings downtown. >> thank you so much. >> if you have hit the road this holiday season, you may have noticed some surprising tolerable gas prices peer aaa says today's national average

gas price is $3.04. that's a significant drop from six months ago. the incoming trump administration may help even more. let's bring in phil flynn, price futures group senior analyst and fox news contributor to discuss more. happy new year. this is good news, it seems, that prices were already trending down, but now in comes donald trump to drill baby drill. how much more might we see a drop? >> i think it could drop significantly when it comes to oil over time, but it's not going to happen overnight. donald trump, even the suggestion that donald trump is going to come in and drill baby drill is one of the reasons why we've seen prices go down already, griff. it's that anticipation, of course. i think we have priced in a lot of the expectations of what donald trump can do in the short term, but driving them down further, it's going to take time to undo some of the damage we saw under the last

administration. the lack of investment, the lack of drilling may cause those prices to go down a little bit more in the short term, but it's going to take longer term for them to drop significantly. >> you raise a good point. here is a little bit about what president-elect trump has been saying that may have contributed to it. he was in the press conference in the middle of december. >> energy coming in. we have more energy than anyone else and we are going to use it. we don't have to buy make energy from venezuela, where we have 50 times more than they do. it's just insane what we do. we will not rest until america is richer, safer, stronger than it's ever been before. we have a big head start. >> walk me through what that looks like, because the u.s. was producing quite a bit of energy already. now, he is saying even more. >> he absolutely is. what we have seen under the last

administration, yes, we did see the amount of oil produced in this country hit a record high, over 13 million barrels a day. a lot of the work that drove the prices, or that production to those record levels happened under the last administration. these projects take years to come online. what we are seeing right now is the signs that u.s. production may be peaking. people pull back under president biden. we are going to see that initial drop in production. what president trump -- back to reality, take advantage of the united states being the biggest producer of natural gas and oil, and use that to our advantage, and help the people at home. if you want to beat inflation, you're going to have to be oil prices, and that is with donald trump is going to do. >> all right, fill. looking into the crystal ball. here is what gas buddy is saying for there 2025 predictions. they say that springtime prices in april, but prices are expected to drop further

homes of prominent nfl and nba players. garrett tiny in chicago live with the story. how widespread is this? >> we are now up to nearly a dozen pro athletes in five states with other homes broken into since september. the latest victim's nba all-star luka doncic of the dallas mavericks who had $30,000 worth of jewelry stolen from his home friday night right around the same time the mavericks were playing an away game in phoenix. the fbi is investigating this string of crimes, and has more in professional sports that athletes are being targeted by what they describe as organized and skilled criminals who are believed to have ties to a south american crime syndicate. according to a report by the agency obtained by abc news, the criminals are conducting extensive surveillance ahead of the jobs, scoping out the homes and players social media to give a sense of what valuables they might have and where they are kept. the fbi report says these preparation tactics enable theft
