sources tell fox that the suspect was driving a truck with texas plates. that vehicle is said to have come through our border in eagle pass two days ago. the fbi is investigating the incident as an act of terrorism. an hour from now, new orleans police are set to give another official update. this is a brand new hour of fox news live. i'm molly line. >> i'm bryan llenas. officials confirmed the suspect behind the incident is now dead. new orleans police with this earlier today. >> this event started at about 3:15. it did involve a man driving a pickup truck down bourbon street. it was a fast pace and intentional behavior. he was trying to run over as many people as he could.

>> bill cassidy with this message last hour. >> we have to hunt the terrorists down, bring them to justice and live on with our lives and not let them stop us doing what we normally do. >> bryan: david spunt on the federal investigation. first, alexis mcadams on the details as they develop. alexis? >> yeah, the death toll has stayed at ten. also we know there's more than 35 people that were injured. what were their injuries? they could have been severe we're told and transferred to local hospitals or they could have been from trying to run during this chaos. you have to put yourself out there. at 3:00 a.m., people were partying. they heard gunshots and the ramming from the truck that went in the crowd. people were trying to run for

their lives. listen. >> what i can also tell you is that this man, this perpetrator, he fired on our officers from his vehicle when he crashed his vehicle. two of our officers have been shot. they are stable. >> so per two federal law enforcement sources, the suspect drove a truck with a texas license plate. it's a white truck. it had a texas license plate on it. you can't see the entire truck from the pictures. we're told it crossed the border and unclear if this driver drove it through eagle pass. the only truck -- it was only the truck that was traced to eagle pass. it went down bourbon street early this morning around 3:00 a.m. this has been going on for a matter of hours, this investigation.

they said it was fast, intentional and this person was trying to hurt or kill as many people as possible out there. so the fbi strawberry also working with the authorities, too to try to figure everything out in this case calling it an act of terrorism. several local elected officials are saying there's a possibility that this driver did not act alone. so talking about them having some type of an event with the sugar bowl, if there still is other people that could be involved that could impact the planning. the department of public works -- listen to this -- they were upgrading the bollards along the section of bourbon street where this attack occurred. they were trying to replace the old things that block traffic, the little kind of -- they were plastic, i guess. trying to replace them with stainless steel. they were trying to replace them and that could have led to the barricades not being in the right places, if this driver was able to go around those barricades on a night when there

new orleans on bourbon street. nothing yet from president biden. the only thing we know is he spoke to the new orleans mayor a few hours ago to extend his condolences and pledged the full support of the federal government, meaning the fbi, doj, atf, homeland security and all of those related agencies. we have heard from president-elect trump that will move in here in a few weeks. he put out a statement that says when i said the criminals coming in are far worse than the criminals we have in our country, that statement was refuted by democrats and the fake news media but turned out to be true. our hearts are with the innocent victims and the brave officers of the new orleans police department. the trump administration will support new orleans as they recover from this pure act of evil. we also did hear from the nation's top law enforcement officer, attorney general merrick garland. he says "the country woke up to

news of a terrible tragedy in new orleans that killed at least ten people and injured many more. my heart is broken for those that begin their year by learning people were killed in this horrific attack. police department officers risked their lives to saved others. we've heard that this truck crossed eagle pass, texas. picked up on a license plate reader at the border. there's license plate readers that pick up license tags. that's where the truck came across from mexico in to the united states at that border point. what we don't know is if this specific driver that was killed several hours ago that committed this terrible attack was the person driving the truck that came across the border. we're expected to learn more in the next hour. the fbi is the lead on this investigation as president biden and others in his administration continue to get these frequent

updates. molly? >> molly: david spunt with a major piece of the pusle potentially. thank you. >> bryan: let's bring in bill dailey, former fbi investigator. we learned that thevehicle crossed through eagle pass. how does that impact the investigation? now we're talking about across-border situation. how does this impact on the ground? >> absolutely. it certainly has turned in to a trans border investigation. the question will be several -- at least in the forefront of this investigation. one, was the vehicle stolen? you know, what was his genesis. who owned it. doesn't mean the person owned it was driving it and also doesn't mean the person that came across the border is the same person that drove the vehicle down the street. so a lot of missing parts to

this. it is a significant lead if in fact all of that turns out to be true. i think at the same time, the fbi and law enforcement across the country and across the border now looking at whether or not there could be other people potentially involved. there was a mention of that in your earlier reporting. it is very concerning because here we are on new year's day, around the country we have a number of public parades, football games, gatherings of large numbers of people. was this any part of a larger conspiracy planned by this person or other persons who may be connected with him. >> molly: great points there. discussing whether it's domestic or international. now we're seeing a connection to the southern border in the early investigation. there were a number of weapons used. we have the truck, potential ieds and a gun involved. what do you make of that and the scene was targeted? >> first of all, all of that

suggests there's a lot of pre-planning. the weapons, backtrack those and see where they're from, if they came across the border, ones here in the u.s. also the construction of ieds. any of that suggests that there was this pre-planning, this intention to commit as much harm and havoc as this person could. you know, as much as this is a horrible, terrible incident, we have seen other incidents where vehicles have been used in 2017, in new york city, eight people were killed by an individual that used a trented truck to mow down people on a sidewalk. he got out. he was shot by police as he tried to shoot them with a pellet gun. we have the christmas parade in whisk. killed a number of people as a truck rolled down that street a very busy street during the christmas parade.

it's unfortunate here in this country, we've not been immune. we look across the world and there's been these type of incidents. many of them unfortunately inspired by what al-quaida told people to do many years ago. use whatever weapon at put on the internet pictures of trucks, pickup trucks to be used. so all of that seeps in to people's subconscious and whether this person is directly, indirectly or unassociated with the terrorist group. some of that may have been the reason why this person chose the vehicle and the timing but certainly all what you suggested was preplanning involved. >> bryan: bill, hearing you, makes me really question or wonder -- i think this is why we don't have an answer yet as to whether or not the sugar bowl game will happen tonight. we have at least one suspected ied that they're investigating. we don't know for sure if there's another vehicle or another person. we have no indication yet that there is. this is all part of the

investigation. there's a lot of questions here leading up to a game that is scheduled to happen nine hours from now. >> yeah, we don't want that effect to stop what people are planning. however, caution is the name of the game here. certainly within the arena itself, a more controlled environment, controlling people coming in. beforehand you can search that arena for devices or anything that you think may pose a hazard. the biggest concern is outside as people gather to go in and those soft areas, those kind of public areas around the perimeter that might be more concern. so i'm sure police and other authorities will put all they can around that. certainly as people are coming together, that also poses a risk to them. >> molly: bill, one of the most horrific events was the bastille day parade. there were 86 killed, 434

injured. after that, articles in new orleans talking about how they created the new bollards put in in 2017. now there's a major project going on. the bollard assessment replacement project underway in new orleans. how did this happen on bourbon street given all of the history and the efforts to protect people? why would someone think it would be possible to drive on to bourbon street? >> certainly great questions. i'd say many both small and big towns, any time there's a large gathering, you'll see them place large vehicles if they can't close the streets with bollards. they'll close off the area. so it further goes to my question as to how much reconnaissance and surveillance that this person knew. did they select the time perhaps earlier in the evening, we don't know. much more in the way of containment and vehicles in the way and they couldn't carry out

this horrible act. perhaps as the evening unfolded and things started to unwind, gave them the opportunity. a lot of questions need to be asked about that. i don't have this details. i'd say is that certainly -- any time we have parades around the country, gatherings, looking at protecting people with vehicles or bollards as they're putting in new orleans or put in many places around the country, unfortunately is the way the world of today is. >> thanks, bill. >> molly: when i said great plan, i meant a plan of great magnitude. you said there was a great deal of planning going into what the perpetrator had gotten underway. thanks for your insights. bryan? >> bryan: we're getting a new statement from president biden saying "i have been continually briefed since early this morning by federal law enforcement leadership and the homeland security team. the fbi is investigating this as

>> molly: we're getting more and more information. we're less than an hour from a press conference expected to bring us some new information about the horrific vehicle ramming attack that occurred on bourbon street in new orleans today. bringing in now, our guest, phil holloway. a retired u.s. navy former police officer and legal adviser to georgia's sheriff department. phil, thank you for coming on today. we greatly appreciate it. with all that we know so far, i want your early insights, your thoughts. >> well, obviously this is a very sad to pick to start off or fresh new year on. from what i can see and i've been watching the programming over the last hour or so and as this information develops, it confirms my earlier suspicions that this at least appears to have the hall marks of something

that involved some other person or persons beyond the individual who is now deceased. look, the truck as we now know, it's been reported, has passed over the eagle pass border crossing. whether it was this individual that drove it or somebody else drove it. it was driven by a human being. so law enforcement is going to have to work backwards. they have lots of ways to do that. for example, there's these flock cameras that read license plates so they can track this vehicle and see where it's been over the last several days. if it stops at any homes or any other businesses, they're going to need to do search warrants to see what kind of information that they can get there. but there's information that can be gathered from this very crime scene. i'm looking at some of the images and videos that are circulating on social media and elsewhere. it appears that there's some things that law enforcement is looking at.

items and pieces of forensics that they can get from the diseased person himself, from the cab of that truck. there's a pole on the back of the truck bed that appears to have something on the top of it. i'm very curious to know what that was. is it a flag designed to send a message or other pictures make it look like it might possibly be a camera. if that's the case, that obviously has other implications. these are things that law enforcement is looking at and will continue to investigate in the days and weeks moving forward. but suffice it to say, if this is something that is bigger than this one individual, if there was anybody that helped in any way to plan it or to participate in it some small way, you have a conspiracy by definition. if that conspiracy goes outside the borders of the united states, then the investigation just gets bigger and bigger and bigger.

it's very, very important that we let law enforcement do their work. i wanted to point out some of the bravery that i saw of these first responders, these new orleans police. they went directly to the danger. they didn't hesitate. they didn't go set up some kind of barrier. they ran to the danger and then they neutralized the immediate threat. so lots of things happening, guys. they're happening very quickly. the information is fluid, dynamic and we will learn in the weeks to come that law enforcement has done a good job. they're going to also have to learn how to better secure these types of events and these locations where you have big crowds. if there's somebody that is determined to do this type of evil harm, it's very, very difficult if not impossible to stop them as we see here today in new orleans. >> bryan: no doubt, phil. this is bryan here.

we're working to verify the images. there's photos that show what you're seeing -- talking about, which is a black flag that appears to be on the back of the vehicle. these no doubt will be clues that the investigators have at this point. i want to talk about securing that area. i think some next could be -- would be surprised perhaps that this wasn't top of mind given what just happened in germany with a vehicle ramming attack there as well. we know that new orleans was trying to update the bollards in the french quarter to stainless steel ones, which could be surprising that they weren't already. that seems to be a standard in cities like new york. the fact that this truck was able to at least from the initial reporting go around or go through barricades. i know it's tough right now that a lot of people have done yeoman's work to save lives on the ground and then to talk about what could have been done. what stands out to you about what could have been done to

stop this? >> we have the 2020 lens of hindsight now to say look, there should have been better barriers to protect this location. maybe we have to consider taking some of these high pedestrian traffic areas like the french quarter, times square on new year's eve and things like that and putting some type -- even if it's temporary, maybe a concrete barricade, make this perimeter broader, make it wider and have multiple layers and rings to it so that they can better be secured. obviously if it's just little metal barriers or the temporary barriers, those are things that can be easily defeated by someone with a 2,000 or 3,000 pound pickup truck determined to do the type of harm and evil that this individual did. so that was clearly insufficient. we're going to have to analyze this and do a postmortem on it, if you will, to figure out how

law enforcement can better secure these events moving forward like your other guest said. >> we don't want to live in a society where everything is locked down all the time. we want some freedom of movement, we want freedom to travel, walk, drive our cars and ride our bikes. but there's some times when we have special events where we know we'll have big crowds like new year's eve celebrations and the like where it might make sense to completely shut off large areas of these cities from all vehicular traffic. that might be what we have to do >> molly: a number of our analysts, phil, have talked about the likely planning that went into this. the callousness, not just went after these people but went after this iconic beautiful historic area where they knew there would be a lot of people partying. what do you make of the planning, the likely scouting that went in to looking at this bourbon street area? >> yeah, that was one of the things i thought about this

morning when your producer contacted me about coming on the show. i started looking at this and reading about the ieds and all of this stuff. that suggests that this was something that was thought out in advance. as you mentioned, this individual knew where the crowds would be. they knew that the barriers were insufficient. it takes at least some type of skill to make ieds. if they're complicated ieds, maybe it takes a lot of skill. so law enforcement is going to have to backtrack. they have to trace this individual's steps in the days at least back several days, maybe crossing back over the eagle pass border and see where this vehicle came from, who did it interact with. was there other people. and then, you know, you just have to follow the evidence to wherever it leads. that's how investigations work. they can't really come up with any kind of preconceived idea

alexis, what is the latest? >> you know from covering these things, when you get to the scene, we think its one situation. we think it's a certain number hoff casualties or injuries. it can update. we're waiting to get an update from police to see how many people were injured and killed. you can see they still have the coroner trucks out there. imagine that. bringing in a 2025 on bourbon street and ending with this horrible situation with ten people dead and dozens others that were hurt. we were waiting to get those new updates from police. this is what the they last said about the situation. watch. >> what i can also tell you is that this man, this perpetrator es eshgs, he fired on our officers when he crashed his vehicle. two of our officers have been shot. they are stable. >> so this is from two federal law enforcement sources according to fox news. so griff jenkins and david spunt have been working on this for

hours now. we know the suspect drove a truck with a texas license plate in this crowd. it's unclear in the driver crossed eagle pass, texas, but the truck came from eagle pass about two days ago. we're working to get more on that. we know as you heard from the police, this person was driving at a high rate of speed going right down bourbon street. this was a packed area. not only are people there for the sugar bowl but people are there also to celebrate and bring in the new year. so 3:00 a.m. local in new orleans, this place was still bumping, people were out there and started to run for cover as they heard not only gun fire by a witness but also, you know, what was happening with that crash. he rammed his truck all through the crowd according to investigators. so also the fbi says that they are investigating this as an act of terrorism. several local officials are saying there's a possibility that the suspect did not act alone. we talk about what we do know and don't know. we don't know if another person was involved. we're hoping to get an update.

the department of public works was upgrading the bollards or those barriers along bourbon street. i just got off the phone with a council man that said the reason that they were replacing the old barriers to put stainless steel ones in is to prevented issues in the future with the super bowl. they're supposed to have the super bowl in a matter of weeks. they still will have possibly the sugar bowl tonight. that's why they wanted to make sure everything was in place like the barriers. were they up or down at this time? that is still a question that needs to be answered. you can look at the damage to that truck. that's a ford f-150. it has all damage to the front. it was smashed in after they hit numerous people. you can see the people are if swat gear. the videos i saw on social media shows these investigators and

officers that were out there on bourbon street jumped in to action. they ran on foot down bourbon street to try to respond to the two officers that were shot and dozens of people that were hurt and lost their lives. back out here live. we'll keep you posted with everything we get as it continues to develop. >> bryan: no doubt. our thoughts and prayers are with the victims as well as the two officers that were shot in the response. alexis mcadams, thank you. >> molly: we know bring in jason pack, retired fbi agent and hostage negotiator. i know you have been filled in on the new and emerging details, including details where the truck may have come from, what we know about the suspect so far. your initial thoughts. >> good afternoon, molly. let me back up a little bit. when the fbi says something is being investigated as an act of terrorism, they're looking in to whether that meet the legal definition of that. while we all think we know what it looks like now, we have to

make sure that we take the deliberate steps to see what exactly the facts are. so basically if i can take you behind the scenes a little bit. the new orleans field office high school a joint terrorism task force there made up of fbi agents, bomb technicians, new orleans police investigators and also louisiana state police troopers are all on the task force together. they're looking at that right now. so new orleans has a counter terrorism background. i know that they will be working with cornell hodges of the louisiana state police. we're about to hear from them in the press conference. they're setting up a joint operations center where they are able to get real-time information about the investigation. the truck came from mexico -- across the border in eagle pass. our attache office there has to be involved in mexico city and looking to whether or not the same person is driving that. like your other guests and

alexis and dave mentioned, was this a rental car? is it the same person? we don't know. these are the facts that have to be looked into. this task force that each fbi field office has is likely what is happening now. hopefully we'll hear more from the sac and the team approach that we use. i think the last time you and i talked, molly, we were in the boston marathon bombings together. that was a great example of the joint investigation. i think that's what will happen here and you'll see that. >> bryan: jason, bryan here. thanks for being with us. i want to get -- molly and i were just talking a little bit ago off camera about this. this attack happened in a part of the french quarter where they were updating the barriers that were started in november, supposed to finish in early 2025. you take that detail, you added the ieds, at least one. you add the fact that there was a gun obviously. there's a lot of preplanning

here, particularly to think that you can go to new orleans and attack one of the most popular places in america and get away with it. >> yeah, it would be spraying if they new the exact piece of information. something throughout the investigation they'll have to take a look at it. he was committed in doing the act. not only did he drive in to the crowd of people there, but he also engaged in gun fire with law enforcement. possibly there's an improvised explosive device there. those are all pieces of the puzzle that may indicate that there's something more. i know in situations like these, the speed and the thirst for information is great out there. as fbi agents, it's important that they take their time, slow down a little bit and look at all the different types of possibilities, whether something is terrorism or not has to meet a specific definition. if it looks like a duck and quacks like a duck, we say it's a duck.

the fbi has to be able to prove that through a set of facts and through the u.s. code there. so they will be taking a look at that. >> molly: jason, the wake of the two explosions going on in boston, there was a wide perimeter similar to this with the same concern, there could be additional ieds. >> molly: what is happening on the ground there? how possible is it that there are additional ieds? >> well, that's a good question. i think right now that's the number 1 question. the scene there appears to be secure in the french quarter. now we need to look into whether or not this goes somewhere else. so they want to make sure that everybody is going to be safe. so they're taking a look at that, investigating things we don't know about. probably have leads about who this person might be and any other types of tips or intelligence. i'm sure you'll see an 800 number and now probably in the press conference for information about this particular incident

thank you. >> bryan: there's president biden making his first on-camera comments about this attack in new orleans. he was asked was this domestic or a foreign attack. he was not going to get into detail. we're all going to find out new details from the investigators in about 15 minutes. 12:00 eastern time. let's bring in danny colson, former fbi deputy assistant director. da danny, thanks for being here. i want to go back to the truck. this is a truck that our sources here are telling us crossed the border through eagle pass, texas. we don't know in the individual was in the truck but we know the truck had texas plates and made its way to new orleans. that's a 11-hour drive. it's about 700 miles. danny, what -- can you bring us to this? how are the investigators going to track this truck over that stretch? >> well, actually, they'll track the truck by tracking the cell phone that this individual used who was driving the truck.

that's where the key will come from. there will be cameras at the border, cameras in certain restaurants. i will tell you that the fbi will retrace that route and go in every convenience store, every gas station along the route from eagle pass in new orleans. that's the way we caught tim mcveigh. the cell phone will tell us about his associates, conversations he's had and the route of travel to get there. >> molly: how imperative that this is done swiftly? >> it's imperative. probably already done. i'm sure that they have done it already. i mean, i commanded major bombing investigations. i'll tell you, that when the the fbi gets going, it's like gang busters. they go crazy fast.

everybody wants to help them. the phone companies will help them. local police wants to help them. private citizens want to help them. that's the reason these cases of this magnitude are solved so quickly. there's so much energy involved in finding the bad guy that they happen quickly. >> bryan: danny, based on the details that we know, what is your gut telling you about what this is? >> my gut is telling me that they didn't do much planning. start with that. new year's eve onbourbon street is a big deal. they should have used better barricades. you don't use a saw horse to barricade a parade route. you can see that's what they used. i don't know the answer to your primary question. i know that we have amazing people coming here unvetted. these people, they came across this southern border apparently.

we want to bring in as many resources as possible. the new orleans police department is highly resourced. they have the largest police department in the state of louisiana. in addition to that, we want to have them work in tandem with the state law enforcement agencies as well as our federal partners in law enforcement. there's an immense level of resources that we can draw together to find out what the actual motive is. as you mentioned earlier, this is a truck that we believe came from eagle pass, texas. so we're going to look to the cameras from police vehicles that this actual vehicle passed as well as traffic cams to identify what the route was and where -- what potential stops occurred and also connect with atf to find out how these firearms were acquired. what type of chatter is online as relates to his descent with us as american citizens.

do we have anything online that supported that he was going to commit to an attack of this magnitude? those are the things we'll look through the lens of to find out what the motive is and hopefully we can put more fortifications in place to prevent more horrific attacks like this in the future. >> last year, a horrible attack on halloween night that killed eight. what did the nypd learn from that attack? i'd imagine there's been communication from the nypd and federal resources to all law enforcement nationwide. we did learn a lot from that attack. i'm wondering based on that context how you're viewing this attack today. >> all police departments have an intelligence unit that is responsible for merely looking at what is happening in society. so we look at what happened in

germany recently when we had a vehicle that rammed that village celebration. you mentioned what happened here in the nypd when we had a terrorism attack on the west side highway. we had a vehicle that ran people over on the bike trail. we also had an incident a couple years ago in times square where we had an individual that suffered a medical emergency and ran into a series of patrons that were in that area. we wanted to extract as much information as possible and erect this for something like a new year's eve celebration in a place like bourbon street. they had an expectation of thousands of revellers. this is something that we need to roll out. >> thanks for being with us, darren. we're getting to breaking news. sources now tell fox that that truck from eagle pass, texas did not cross two days ago. it crossed november 16. the identification of the driver that crossed the border does not
