>> welcome to a special edition of "jesse watters primetime". i'm in for jesse. we start with a fox news alert to this evening. and here it is. we are learning a lot more about the man who detonated a car bomb in front of the trump hotel in las vegas. authorities at a press conference today unveiled at the man you are looking at, they were able to crack into one of his phones. where he wrote chilling journal entries that could give us a clue into his mind-set before the explosion. >> this is an excerpt from the letter. he says, fellow service members, veterans and all americans, time to wake up. we're being led by weak leadership only serve to enrich themselves, where the united sates of america, the best country of people to ever exist but right now we are terminally ill and heading towards collapse. this was not a terrorist attack, americans only pay attention to spectacles of violence, what better way to get my point across than the stuff of fireworks and explosives. why did i do it now?

i need to cleanse my mind of the brothers i have lost and relieve myself of the burden of the lives i took. >> the fbi says the active-duty u.s. soldier in combat veteran likely suffered from ptsd. this was a suicide designed to be a spectacle. his ex-girlfriend told "the washington post" that he confided in her about suffering traumatic brain injury while deployed overseas. officials stressed that the las vegas explosion does not appear to be linked to the new orleans terrorist attack. >> there is no evidence that these two events are connected. the only things that we have connecting them are incidental and what we believe to be coincidental similarities. in that both vehicles were rented through the same service, that they were both subjects serving in the military, that they both stayed at an airbnb, things like that. we have identified no communication between the subjects. no information that suggest that they knew each other or that

they ever served in the same unit, that they were ever assigned at the same place or at the same time and had interaction and no witness interviews have corroborated or provided any information that the two events are connected in any way. and a similar fashion, we have not identified any connection between this subject and any other terrorist organization. >> while they have a better idea about what happened in vegas, the country still searching for answers on the isis inspired attack that took the lives of 14 innocent americans in new orleans. tonight we're trying to piece together what happened on that terrible night. check this out. this is new footage obtained by "the new york post" that shows police and on intense shoot-out with the terrorist. >> and the new orleans police chief made a startling admission the city had massive metal archers, these are anti-vehicle barriers that police used to block off the streets. but the police chief somehow did not know that they had them until the day after the attack. >> the archers, where they come in? >> actually we have them, i didn't know about them but we have them. and we have now been able to put them out. >> well that is entirely unhelpful. those barriers could have prevented the attack and saved 14 lives. why didn't the police chief of a major city know that she had them at her disposal? that's a huge question. tonight we're also finding out authorities found bomb making materials at a new orleans airbnb potentially linked to the terrorists. this the same airbnb that saw seen on a ring camera unloading on boxes from the truck that he later used in the attack.

meanwhile, fox news digital went inside the terrace houston home and spotted multiple copies of the quran as well as a book on christianity and a book about teaching children about islam. and while the fbi believes the man acted alone, the bureau and dhs sent out a bulletin to 18,000 law enforcement agencies across the country warning them to be hypervigilant of copycat attacks. there's no specific threat they are worried about but isis has been promoting these types of vehicle massacres for a decade. obama's former secretary of homeland security says he is concerned. >> you can see the terrorist threat to our country evolving from terrorist directed attacks where a terrorist organization overseas, directs a large-scale attack on the united states. 9/11 was the prime example. we evolved from that in about 2013, 2014, to what we now refer to as terrorist inspired attacks. were a terrorist organization on the internet will attempt to

inspire someone who was living in this country to radicalize and take it upon themselves to carry out a terrorist attack. that threat has not gone away and i'm concerned that it is at a heightened level right now. >> leave it to msnbc that they will say muslim extremist or not the problem, it is young white men we need to be worried about. >> the problem here is that you jump on one sort of crime, one crime committed by one name that sounds exotic, one brown face instead of looking at all of the domestic terror that we face, including what they advise is a really big problem which is young white men in america. >> but how can you blame msnbc? maybe they're just parroting the president of the united states who called white nationalists the greatest threat to our country. does he still think that?

highlighting u.s. fears of terror attack on the u.s. and then there is an abc one that follows. it seems we have a problem and it is not right wing extremism. >> i'm so glad you bring this up. first of all, you mention senator lindsey graham, the senator and i have been asking for briefings on isis. we have sent letters, we have made requests. the biden administration needs to let us know what is going on. after their disastrous withdrawal from afghanistan, that the media did not shed proper light on, we have seen a rise in extremism and radical islamic extremism. when you are looking at what hakeem jeffries said today, that cannot be further from the truth. first off, they have had for years to actually work to secure our border and they have done the exact opposite. if you look at the number of terrorists that have come across our border under the biden administration, no terrace that were caught at the border, there was 382 people in three fiscal years alone.

signs of slowing down. president trump says that democrats, quote, just want to see if they can get a pound of flesh because every case has failed. he went on to say the judges corrupt and i'm still under a gag order. i am not allowed to speak about the thing he leased wants me to talk about. it is crazy. now despite moving forward with the sentencing, he has signalled that he will not sentence trump to any jail time. so what does this mean for the president-elect or any other politician who may be targeted by their political enemies? a constitutional law attorney and fox news attorney and george washington law professor is here now. professor, you always have such a way with words. and you say this is the final cathartic act for law fair warriors. but these warriors did not just lose the battle, they lost the war. have they not figured that out at this point?

>> it is very true. i think that -- the amazing thing about this order is that it is almost sensing by sound bite. what he is giving to the trump critics is a label. that once he sentences the president-elect, he will technically be a convicted felon. and that will become the new mantra. the sound bite going into the inauguration that this is history being made. even though the president-elect has had no opportunity to appeal this case. which in my view, is layers of reversible error. but this is done just before the inauguration. and the timing, by the way, is notable. we have been waiting for him to make this decision. he schedules at just over a week before the inauguration and then he drops a hint that if he was not able to sentence and before the inauguration, he may just suspend sentencing for four years. i mean i would call that

passive-aggressive but seems rather actively aggressive. >> yes, it is rather aggressive. but this will allow president trump to appeal. you mentioned layers of reversible error. what happens next? does this make it to the supreme court? what's the timeline? >> it will have to go through the new york court system and there is not a lot of expectations left for most of us in the new york legal system, i'm hoping for the best. but eventually it will go to the supreme court. but in terms of the -- that's the first appeal in terms of dealing with the sentencing. generally trial judges have the advantage and the court of appeals courts tend to prefer sentencing to be done so that the case can be finalized. as for the case itself, that could take years of appeal and would go deep into trump's presidency and he would have to continue to argue the case while he is president. >> a final question for you, we just have a few moments.

but this was an under-the-radar headline from "the new york post" yesterday. three senior doj officials leaked nonpublic investigative information days before on election, according to the inspector general. this nonpublic information, according to a leader involved negative information about president trump and could have included classified u.s. intelligence uncertain about that. does this surprise you that doj officials are leaking this kind of information? >> unfortunately, it's not surprising at all. of course you had the former fbi director who actually removed classified material from the fbi , gave it to a friend who leaked it to the media and then you have andrew mccabe who was accused of leaking material to the media. this is a pattern within the department of justice. and it does show this culture that makes the department of justice the most hardened silo for the incoming trump administration. i think that is why the president wanted someone without
