>> welcome to a special edition of jesse watters primetime. i'm kayleigh mcenany in for jesse. well, we start with a fox news alert this evening. and here it is. we're learning a lot more about the man who detonated a car bomb in front of the trump hotel in las vegas. authorities held a press conference today revealing that the man you're looking at, they were able to crack into one of his phones, where he wrote chilling journal entries that could give us a clue into his mindset before the explosion. >> this is an excerpt from that letter. he says fellow service members, veterans and all americans, time to wake up. we are being led by weak and feckless leadership who only serve to enrich themselves. we are the united states of america, the best country people to ever exist. but right now we are terminally ill and headed towards collapse. this was not a terrorist attack. it was a wake up call. americans only pay attention to spectacles and violence. what better way to get my point across than a stunt with fireworks and explosives? why did i personally do it? now i need to cleanse my mind of the

brothers i've lost and relieve myself of the burden of the lives i took. >> the fbi says matthew berger, an active duty u.s. soldier and combat veteran, likely suffered from ptsd, and this was a suicide designed to be a spectacle, reveals berger's ex-girlfriend told the washington post that he confided in her about suffering a traumatic brain injury while deployed overseas. officials stress that the las vegas explosion does not appear to be linked to the new orleans terrorist attack. >> there is no evidence that these two events are connected. the only things that we have connecting them are incidental. what we believe to be coincidental. similarities in that both vehicles were rented through the same service, that they were both both subjects served in the military, that they both stayed at an airbnb, things like that. we have identified no telephonic or email communication between the subjects, no information that suggests that they knew each other, that they ever served in

the same unit, that they were ever assigned at the same place at the same time, and had interaction. and no witness interviews, have corroborated or provided any information that the two events are connected in any way. in similar fashion. we have not identified any connection between this subject and any other terrorist organization. >> while we have a better idea about what happened in vegas, the country is still searching for answers on that isis inspired attack that took the lives of 14 innocent americans in new orleans. tonight, we're trying to piece together what happened on that terrible night. check this out. this is new footage obtained by the new york post, and it shows police in an intense shootout with the terrorist. i had just done. >> oh, hell no. >> and the new orleans police chief made a startling

admission. the city had massive metal archers. these are anti-vehicle barriers that police use to block off the streets, but the police chief somehow did not know they had them until the day after the attack. >> so our yellow archers, where did they come from? >> actually, we have them. i didn't know about them, but we have them, and so we have been able to. >> well, that's entirely unhelpful. those barriers could have prevented the attack and saved 14 lives. why didn't the police chief of a major city know that she had them at her disposal? it's a huge question. tonight we're also finding out. authorities found bomb making materials at a new orleans airbnb potentially linked to the terrorists. this is the same airbnb that jabbar was seen on a ring camera unloading boxes from the truck that he later used in the attack. meanwhile, fox news digital went inside the terrorist

houston home and spotted multiple copies of the quran, as well as a book on christianity and a book about teaching children about islam. and while the fbi believes jabbar acted alone, the bureau and dhs sent out a bulletin to 18,000 law enforcement agencies across the country, warning them to be hyper vigilant for copycat attacks. there's no specific threat they're worried about, but isis has been promoting these types of vehicle massacres for a decade. obama's former secretary of homeland security says he's concerned. >> you can see the terrorist threat to our country evolving from terrorist directed attacks, where a terrorist organization overseas directs a large scale attack on the united states, nine over 11 being the prime example. we evolved from that in about 2013, 2014 to what we now refer to as terrorist inspired attacks, where a terrorist organization on the internet will attempt to inspire someone

who is living in this country to radicalize and take it upon themselves to carry out a terrorist attack. that threat has not gone away, and i'm concerned that it's at a heightened level right now. >> but leave it to msnbc to say that muslim extremists are not the problem. it's young white men that we need to be worried about. >> the problem here is that you you know, you jump on one sort of crime, one crime committed by one, one name. that sounds exotic, one brown face. rather than looking at all of the domestic terror that we face, including what the fbi says, you know, is a really big problem, which is young white men in america. >> but how can you blame msnbc? maybe they're just parroting the president of the united states who called white nationalists the greatest threat to our country. does he still think that?

thank you for that. being that i was one of the holdouts back in january, we were trying to change the institution. we did. and we saw today that we are unified gop moving forward. >> well, that's good to hear that. they got a policy deliverable. so maybe something that is worth it in the long run. but you know, congresswoman, as you look at this and you think about a narrow 217 to 215 majority, which is what it will be when you count for the two going into the trump administration. what does this say about passing major legislation? do you think there will be an issue? >> you know, i think that there's going to be a lot of people that might try to become mini mansions, is what i like to call it. but at the end of the day, when we ran for reelection, we all ran on the america first agenda, really securing our borders, eliminating some of these crazy taxes, but then also to ensuring that the american people were put first and foremost and not being forgotten. and so i think that all of those messaging items are winnable, especially in a narrow majority. and i just hope that my colleagues decide to work together again. kayleigh, we have our first big test that's going to be on

aggressive. >> yeah, it is rather aggressive. but you know, this will allow president trump to appeal. you mentioned the layers of reversible error. what happens next. does this make it to the supreme court. what's the timeline on that. >> well it's going to have to go through the new york court system, and there's not a lot of expectations left for most of us in the new york legal system. i'm hoping for the best, but eventually it will go to the supreme court. but in terms of that's the first appeal in terms of dealing with the sentencing. now, generally, trial judges have the advantage. the court of appeals courts tend to prefer sentencing to be done so that the case can be finalized. as for the case itself, that could take years of appeal. it would go deep into trump's presidency, and he would have to continue to argue the case while he's president. >> you know, final question for you, we just have a few moments. but this was an under

the radar headline from the new york post yesterday. three senior doj officials leaked nonpublic investigative information days before an election, according to the inspector general. this nonpublic information, according to a grassley leader, involved negative information about president trump. it could have included classified u.s. intelligence. uncertain about that. i mean, does this surprise you that doj officials are leaking this kind of information? >> no, unfortunately, it's not surprising at all. of course, you had comey, who was the former fbi director, who actually removed classified material from the fbi, gave it to a friend who leaked it to the media. you had andrew mccabe, who was accused of leaking material to the media. this is a pattern within the department of justice, and it does show this culture that makes the department of justice the most hardened silo for the incoming trump administration. i think that's why the president wanted someone without any connections to the
