could be placed from the president-elect and two of those reflect back, johnson needed 218 is a minimum and he got exactly 218 and they got this done in one round which is what needed to happen, there was no viable alternative to speaker johnson. he was endorsed by the president-elect, the republicans have no margin for error and they did not want their very first act of the new congress to be dysfunctional failure with a slim republican majority and they were to their credit able to avoid that. rachel: this is what newt gingrich those. >> i could not have been the kind of speaker he is. i don't have the patience, i don't have that ability to keep moving forward. it's a very extraordinary, second, it was the first great victory of the trump presidency in legislative terms. without donald trump we probably would still be voting tonight because i don't think

the dirty tricks done in the last election, they won handily but cannot be underestimated is mike johnson. i personally like mike johnson. i disagree with him fundamentally on issues like ukraine but his personality, when interviewing members who voted for him his personality, donald trump mentioned it, he is a good man. you can disagree with him as i do on ukraine and that funding but he is a good person. a lot of the members said he has never said a bad thing about anybody. he is a kind, truly christian man and i think that also helped him in this as well. guy: he doesn't make enemies. he is absolutely a good guy but it benefits him. it is how he became speaker because of that personality he has.

i agree with a mostly on ukraine, disagree with them on other issues but that doesn't matter, they have to play as a team and i do think the fact that he didn't make a bunch of promises and concessions in exchange for votes, we are not doing a quid pro quo, you will vote for me or not vote for me, i know from that promise individual numbers specific things to get them to vote for for me ultimate the people respected that rather than goodies being handed out. let's go to this fox news alert here, the first lawsuit will soon be filed against the city of new orleans and its police department over failure to secure bourbon street before the terror attack that left 14 innocent people dead and dozens more wounded. rachel: officials warn about copycat attacks. >> reporter: good morning. the lawsuit will be filed by a local law firm representing one of the survivors of the terror

attack and the firm says it is because of an opd's failure to put some basic safety measures in place that would have protected citizens and visitors. the firm says all the people impacted deserve answers and their lives are now forever changed, the law firm says, quote, the evidence will demonstrate that the act of terror perpetrated by shamsud-din jabbar was preventable. this resulted in a horrific act of that is archived in our country's history because of the negligence of the city of new orleans 14 innocent lives were lost. the city was warned something like this could happen. for years, several security reports said french quarter crowds are a risk from mass casualty events. typical barriers in place here were not because of super bowl preparations.

>> they had the street blocked off, no one knew the guy was going to go down the sidewalk story. but you had security at every corner. >> reporter: the fbi's returning to shamsud-din jabbar's home. shamsud-din jabbar set fire to his new orleans rental property to conceal evidence. the fbi says bombs about making materials were found in both locations. shamsud-din jabbar planned to detonate two ieds found inside his truck during the attack. the fbi and dhs center joint bulletin 218,000 law enforcement agencies nationwide warning those to be hypervigilant of copycat attacks. we are expecting several local vigils here today and on monday president biden and the first lady are expected to be here to mourn with survivors and families of those who died from this attack. i will send it back to you.

worse except for the hapless this of the perpetrators. if it weren't for their incompetence who knows how much worse it would have been? the driver in new orleans had these explosives in his truck and wasn't able to get to them. police neutralized him within seconds after he hit the crane on bourbon street. he was dead on the ground within seconds which is a wonderful thing but if he had managed to get those explosives off who knows how much worse it could have been? rachel: people trust the fbi on this investigation and they are right about this. what do you think? charlie: people wake up and see the horrible headlines and the death toll rising and an fbi spokesperson said this is not an act of terrorism when every indicator was terrorism and the next day they completely

reverse themselves which they did on whether this guy acted alone. and some of it is fog of war, can't cast aspersions on all of it but coming out of the gate with this isn't terrorism is another blow to credibility. rachel: they did that with the assassination attempts on donald trump the first when they said he acted alone, the second one he acted alone, it is so soon and we don't know anything about it and the department of been so politicized, again from political enemies against the right that a lot of people very suspicious of what comes out of the fbi. senators are calling for a very quick confirmation for national security nominee is. they are saying we don't trust this administration. we want a smooth transfer quickly and for those of us

going to the inauguration that hits home. we move to another alert, las vegas police revealing a possible motive for the cybertruck explosion outside the trump international hotel in las vegas. guy: letters were allegedly written by the special forces soldiers said to be behind this attack. >> we are learning about the motivation behind the cybertruck explosion, police released portions of the suspect's digital journal recovered from the torched cell phone found in that rented tesla truck. police say 37-year-old shot himself in the head as he detonated the explosions, matthew livelsberger was an active duty member of the special forces suffering ptsd and other personal issues that

his conscience was getting to him and so he was reporting on this. you guys have any thoughts on what else was in that letter? guy: he then blows up a cyber truck, is he just a lunatic? all right. let's turn to other headlines now. police on a manhunt for an armed and dangerous suspect who they say shot in indiana sheriff's deputy during a traffic stop. the suspect was last seen early yesterday morning driving the silver pontiac grand prix. police were able to locate that vehicle but say the suspect is on the run adding residents should not open their doors for anybody they don't know. the victim, deputy zach andrey, remains at the hospital, his condition unknown. vice president-elect j d vance underwent minor surgery on friday. officials say was a previously

guy: legal drama for donald trump as judge merchon since the sentencing date for that trial for january 10th, days before trump's inauguration, trump slamming that judge who donated to president biden along with democrat in the interview but fox digital saying, quote, this is a political witchhunt by biden and the doj, to get a pound of flesh because every case has failed. fox news contributor and george washington university law professor jonathan turley joins us. we talked about this case, trump is upset about it, probably angry the case was brought in the first place but in terms of this specific outcome, you don't think this is bad news?

>> remarkable change of events, the trial of the century, we are looking at an unconditional discharge without any jail or probation, like marking a hurricane down to passing flurries. it is quite a change. the president-elect will have the ability to appeal the case. he is right, this was lawaffair denounced by cnn senior legal analysts but by democratic senator who said it was total bs. many people in the public view it that way. this will be the final rally and crawl but he will not have that orange jumpsuit moment

many people wanted. he will walk out of that courtroom either physically or virtually and he will walk into the white house 10 days later. guy: legal analyst are confident their won't be any punishment attached when this proceeding happens days from now. why are people feeling that way, what is the clear indicator from the judge? >> i did coverage of the trial but after the verdict, this was the most likely result not just because of the nature of this case but most defendants would get this type of unconditional discharge but after he was reelected, it made that all the more likely, if the judge does not impose limits on his freedom or some type of probationary conditions it

defuses the constitutional issues. part of the problem is the timing. why this judge waited so long. there's a suggestion that if he appeals and the sentencing is the laid then mrchon may leave it suspended for four years, that would be a horrific result that would allow this trial judge in new york to hold a leash on the american president for four years, allow the media to continually portray him as a convicted person awaiting sentencing. there is that chance if trump appeals and it is delayed too much, merchon may carry out that implied threat. guy: some finality coming to this on january 10th could allow trump to get sworn in, go
