>> good morning. we have bull riding in new york city. guy benson, rachel campos-duffy, charlie hurt in new york city. starting to lighten up out there. snow headed to a lot of the country here and we're toasty inside and so much news to get to, guys. rachel: we have a lot of news to get to. we're going to keep going back down and i love that bull riding has come to madison square garden in new york city and the guest he had was saying they start with the pledge -- with a player and then the pledge of allegiance. i saw that patriotism when i went to the ufc fight with will cain just before the holidays in november. was it november, early december. any case, i was surprised at the crowd at how patriotic they were and how excited they were to be this. i think you'll see the same thing here at this bull riding event. carley: i want to know where charlie: i want to know where they got all the dirt from. guy: they rented it. they rented the dirt from new

bourbon street before the terror attack that left 14 dead and dozens wounded. charlie: the looming legal action comes as grieving families and the community hold vigils honoring the dead. guy: madison mad sca -- madisono is live for us. reporter: good morning, guys. one of the survivors of the terror attack will be filing the lawsuit on wednesday. the firm said because of the nopd and city's failure to implement basic safety precautions that would have protected citizens and visitors. now, the firm says all the people impacted by wednesday's attack deserve answers and says the act of terror was both foreseeable and preventable and evidence will prove that. the law firm said "because of negligence of nopd and city of new orleans, 14 innocent lives were lost, dozens more injured, and the courses of their lives

forever changed. survivors of this tragic event bearing the emotional and physical scars for the rest of their lives". the city was warned something like this could happen. for years several reports said french quarter crowds are a risk for mass casualty events. we know typical barriers that are in place here were not because of super-er bowl preparations and a 2020 security assessment specifically mentions the vehicle barriers and calls the french quarter "a fish tank of bad behavior". fbi is returning to jabbar's houston, texas, home and he set fire to his new orleans rental property to conceal evidence. bomb making materials were found in both locations, and the fbi says jabbar planned to detonate two ieds found inside his truck during the attack. now, meanwhile we're learning the identities of most people who were killed and some of the victims include a former

orleans. rachel: charlie, new orleanss is a huge tourist destination and a place that obviously needs top w enforcement and so many events there. what are they thinking putting this woman in charge? she does not in any way shape or form make you feel confident. is this dei hiring 124 what is happening here? charlie: no, she does not inspire any confidence whatsoever and i agree, i think, you know, a quote like that will be perfect in a lawsuit. the other thing that's really frustrating though right now, and we're doing what we should be doing, which is focusing on the people who made these terrible decisions and focusing on who committed these -- this atrocity, but of course at the same time you're talking about, you know, as you pointed out, the pictures of the victims, you're talking about these wonder -- you read the stories about them, these wonderful

people and because we're rightly focused on how to prevent from this ever happening again and holding people accountable, every single one of these people represents a life that and loved ones, and they were all there in new orleans for the best of reasons, they were there to celebrate and enjoy life and many of them very young people, 18, 20 years old at the beginning of their lives and obviously we don't spend as much time talking about them as we should at this time because we are still kind of uncovering all of the ridiculous incompetence that was laid bear by this. rachel: yeah, one of the saddest things i saw were parents that told their kids, listen, i was one of those kids my parents said don't go to this and multiple parents that had warned their child, i don't want you to go. don't go to this, to new year's eve at this place. they went and this happened. that's heart breaking.

charlie: and they're at that age where they're supposed to start doing what their parents say not to do. guy: end up in the drunk tank and not getting murdered by a terrorist. rachel: of course. as a parent imagine having given that miles an houring and having that happen. the whole thing is so tragic. meanwhile i spoke earlier with nicole parker, a former fbi special agent. asking her how she feels about the fbi leading this investigation because a lot of people have no confidence in them. here's what she had to say. >> this terror attack exposed the fbi's cr cracks and vulneras on a national level and i saw these for years and caused myself to walk away. this a-sack that got in front of the media and said definitively this was not a terrorist attack. that is so damaging for the fbi. it absolutely was a terrorist attack, and people are asking do you think this individual is

going to get fired? will she get disciplined? in my opinion, not only will she not be disciplined or fired under this current fbi leadership, she likely will get promoted. i want to believe that the fbi will be made great again, but it will take a major shift, cultural shift, hiring, you've got to hire people based on meritocracy, promotions based on meritocracy and nothing else and shift the priorities to protecting the american people. if your agenda is to push your special and political ageneral disa, you need removed. rachel: again, nicole parker left the fbi talking about the culture change that needs to happen. you look at how it's been run and what kash patel has to face. it's daunting. charlie: truly. so president elect trump is slamming judge merchan for segment the sentencing date in his -- setting the sentencing date in his new york case days before he's set to be sworn in

as the next president a. quote from him, this is a political witch hunt by biden and the doj and want to get a pound of flesh because every case has failed and it's a completely accurate statement. he's not wrong about that. you spoke earlier today to jonathan turley. guy: yeah, the law professor and fox news contributor and asking about this decision. first of all, the judge rejectioned team trump's request to vacate or throw out the conviction and that'll have the sentencing date on january 10*9, a week and a half before the inauguration and turley think this is is a pretty good outcome for trump. here's part of what turley said. >> president is right, it's lawfare and denounced by cnn legal analysts and by democratic senator who said it was total bs. this will be the final rallying call of lawfare, but he will not have that orange jump suit

moment that many people had wanted. he will walk out of that courtroom physically or virtually, and he will walk into the white house just ten days later. there's a suggestion in the order that if if the ft. appeals and sentencing is delayed, that merchan may leave this and suspend it for four years. that would be a perfectly horrific result and hay low this trial -- allow this trial judge in new york to hold a leash on the american president for four years. it would allow the media to continually portray him as a convicted person who's awaiting sentencing. rachel: some is f the analysis on the democrat side was this backfired and there was no appetite and people could see

through this was a hoax, and that's 24 part of why donald trump won the way he won. seeing the results of that election, guy, do you think that this is going to backfire? there's no appetite for this anywhere and people generally want donald trump to have a shot after this without any of this these really, i think, unfair persecution? >> i think the appetite is dried up for those that brought them. the point was preventing trump from win winning and he won. we try that had and it failed, let's move on. what's interesting about the conversation with turley is he said, look, obviously trump is upset. this is another opportunity to slam the biden donor judge in the case, but if as we expected there's going to be no punishment attached to the sentencing, this would allow trump to basically clear the decks on the issue, it's now over and done with. there's not not going to be jail time or anything else for trump and meanwhile it's resolved at

this stage, it doesn't hang over his presidency and trump's legal team can start the process of appealing this case off to the side on another track and turley said as he has many times on our air, he believes there's all sorts of opportunity to overturn the conviction on appeal on reversible error. rachel: just drop it. it's stupid. charlie: one final reminder of what a boob judge merchan and all the democrats pursuing the cases have been and probably helped hand the election to donald trump. rachel: i think so too. james carville saying he knows why they lost in 2024. he says we lost for one very simple reason, it was and it is and it always will be the economy, stymed. is that the right analysis? charlie: think invented the line talking about it's the economy, stupid, with george h.w. bush in 1992 when bill clinton was running and obviously james

carville and george stephanopoulos were running that campaign and looked like they've been lost in the wilderness for awhile since then. rachel: not just they lost the election because of the economy, the economy is result of progressive policies and a lot of people have been saying hey, this is the end of progressivism in terms of how to manage the economy and how they manage some of the foreign affairs. guy: and the policies, stupid. or might say it's the stupid policy. rachel: right. guy: the culture. there's a number of reasons why and it's interesting here because carville is basically admitting he got this wrong. he was sounding bullish about kamala harris and his parties chances and of course they lost. he had to remind himself of his own line about the economy. like if he had just followed james carville's truth and speech from 1992, he might have seen what was coming.

rachel: we're back with a fox weather alert. this is a live look at a small town in western pennsylvania near lake erie much the roads are coated with a relatively thin layer of lake effect snow, and this year-over-year's first major winter storm spanning more than 2,000 miles is sweeping across the central plains. let's turn now to chief meteorologist rick reichmuth for the fox weather forecast. rick, i've been hearing all about this winter storm. tell us what to expect. rick: yeah, big impacts for a lot of people and lake effect snow is going quite a bit and will continue for the next few days and take a look at maps, talking about this storm, it'll be our first real major winter storm with major impacts for a big swath of the country. this kind of cuts a west to east line there from places in kansas all the way towards washington dc and southern parts of new jersey and winter storm warnings in effect and winter storm watches and icing as well and that'll be a big problem because we'll have ice then on top of
