underway today for former president carter. america's 39th and longest lived president died last sunday at 100 years old. the ceremonies beginning with a procession in his hometown of plains, georgia, a motorcade carrying his remains traveled past his boyhood family farm. then headed to atlanta for brief pause at the state capitol building where carter served as governor. he will lie in repose at the carter presidential center for mourners to pay their respects ahead of ceremonies in washington next week. much more on the carter memorials straight ahead. but first -- president-elect trump new york case coming a close next week the judge yesterday announcing sentencing is set for friday. a little over a week before trump's inauguration, the president elect spokesperson vows to keep fighting the sentencing and the case itself welcome to another hour of fox news live, i'm bryan.

>> i'm anita vogel. denied to dismiss fraud money hush case and likely spare the president-elect from jail time or any punishment. that has done nothing to calm trump's anger. brian:our cb koment season lye e scene. >> while we learned the latest ruling that jail time is likely off the table we've still seen the president elect sound off about the case just this morning. he repeated his claim of political prosecution on true social now last may a manhattan jury convicted trump on 234 counts of falsifying business records. and what prosecutors said was an alleged scheme to cover up a hush money payment made to adult film star stormy daniels in the final weeks leading up to the 2016 presidential election. the conviction left trump open to a variety of penalties

ranging from fines probation, or up to four years in prison. but judge merchan indicated in latest ruling he's likely to sentence trump to what's called an unconditional discharge which would allow conviction to stand without any punishment and give trump the option to appeal that conviction. here's fox news legal analyst and commentator greg jared weighing in. >> while judge mer shaun is determined sustain trump of labeled convicted felon to do that, though, he has to sentence him before inauguration. otherwise you can't -- really technically call him a convicted felon. judge merchan says donald trump can appear virtually for the sentencing. ming all eyes on friday. cb cotton, thank you. anita: all right for more on this let's bring in former federal prosecutor jonathon fahy, great to have you with us

today. we both watched cb cotton's report, and she said that judge juan merchan wants to sentence president-elect trump to an unconditional discharge out of respect for presidential the presidential immunity doctrine that means no prison time, no jail time. anything like that -- but you know, to many looking at this it does seem vindictive can you explain to us what this means. >> it does seem vindictive this case is law fair at its worst and more so on the alvin bragg end it have but basically what he's doing is saying conviction will stand but they won't be any punishment at all. again that sort of begs a question why not just a dismiss the canes let us move on and if you look at the immunity decision and the immunity decision basically from the supreme court said donald trump had immunity the entire time. it wasn't that they just created immunity for them in that decision and whole porn was that -- so that donald trump or any president could do their job

without the fear of state officials or other officials. interfering with it and we're in a unique phase transition phase know he's not the president now this is a critically important phase where he's putting together his administration. that set to take effect on january 20th, the last thing he needs is to be distracted and disrupted by the sentencing which again isn't going to lead to anything but another point that judge merchan seems to be missing out on is this doesn't end the case because donald trump will and he has multiple avenues for a successful appeal most notably the presidential immunity decision this case will continue on during his term which again it doesn't make any sense there's no societal interest in this case going forward. and really at this point the only people that seem to have really defend this case are judge merchan and alvin bragg nobody else even the most hardened democrats know this case is law fair and everyone is somewhat embarrassed by this

case and it really would make -- judge merchan and alvin bragg in particular would restore some credibility to the justice system by just letting this case go and be dismissed outright. anita: yeah. to your point what -- interest does it serve, judge juan merchan says he wants to honor the jury's decision here. trump is on social media calling this whole case a charade that should have been dead on arrival i guess legal scholars will debate this for some time to come. but in the meantime now that trump team is going to have to try to stop this sentencing. is there any chance that they can do that they can stop this january 10th sentencing? >> i think there's a chance they could appeal his ruling to a higher court or maybe try to take it to federal court again. and -- and make the presidential immunity argument as it relates to the transition so i think there's a chance and it really makes sense for this case just to go away and just the other thing is if donald trump wince

on immunity this case could be back in front of judge merchan during donald trump's term again -- this thing never really goes away, and unless it is dismissed. i think a higher court should get involved say the greater societal good is you know getting rid of this case certainly alvin bragg has more than enough to do in new york with people getting pushed in front of subways other things like that that this shouldn't be high on his priority list and should have never been on his priority list but yeah there's a chance i think they will do that. if not they'll be the sentencing next week where judge merchan will probably make some sort of speech again trying to justify this case as it's -- legitimacy and then donald trump can go on to appeal but really it is not worth of the distraction. we had a terrorist attack we have all of these things he needs to put his administration together, and this is a needless distraction not only for him but everyone in the country when there's far more important things going on. >> yeah just a quick answer here -- judge merchan has said if the trump team is able to stop this

sentencing, then he will pursue this after trump leaves office. actually seek to sentence trump after he leaves office he would be 82 years old just a quick answer, what is the point of that at that point? >> there is no point other than justifying this case because it doesn't serve any -- any legitimate interest. the point they're making they're always -- always convicted by what is actually going on they're trying to say this sort of restores or maintains integrity of the justice system. but this case more than any of the law fair cases has harmed the justice system not just in new york but nationwide. >> yeah we will see what happens on january 10*9 we will all be watching that thank you so much for your legal insight today. jonathon fahy. >> thank you. >> uh-huh. >> anita we're learning more about the suspect in the new year's terrorist attack in new orleans. the fbi confirms it has spoken to one of the suspects ex-wives

meantime president biden and first lady are expected to visit the city on monday. garrett live in new orleans with the latest. garrett. >> yeah. bryan investigators now believe this suspect was hoping to carry out a much more devastating attack than he ultimately did early wednesday morning. these new surveillance images show shamsud jabbar places two ids that the fbi believes he planned to detonate along with another one in his truck unclear why that didn't happen but the fbi says inside jabbar houston home on the left of the screen they found bomb making materials which they also found inside an air airbnb on the right of the screen where the army veteran was on new year's eve. investigators say jabbar tried to destroy all of the evidence he left behind at that airbnb by setting fire using and not

securing the most popular tourist destination and we've learned city commissioned safety security reports including 2017 and 2020 that warn city officials the french quarter and bourbon street were vulnerable to a terrorist attack specifically one using car. louisiana attorney general says even now there are huge lapses in security. >> i've been working with administration for eight years to put a plan to manage the quarter. there's no protection to jackson square. i put a video out yesterday you can drop through that mall around jackson square -- by the st. louis cathedral a car can run right through there so lack of leadership while travels world and leave this is city unprotected. everyone should be outraged. >> we've also learned that the

first of what could be many lawsuits against the city will be filed this next week the law firm behind this suit says the city's, quote, negligence paved the way for the tragic events that unfolded calling the terror attack both foreseeable and preventible. back on bourbon street you can see the city now has those yellow barriers archer barriers called and they're designed to prevent this very kind of attack we've learned the city bought 48 of those barriers back in 2017 but did not have them deployed tuesday night that chief of police didn't know about them until after the attack. so even now, a lot of ongoing questions about what security measures should and shouldn't have been in place on new year's eve and those questions and concerns are heightened given that the super bowl is coming to new orleans a month from now. bryan. >> absolutely just so many questions as there are still 13 people hospitalized eight still in the intensive care units. so our thoughts are with them

garrett live -- coming up ted williams will join us to break down what we know so far about this tragic case. anita: all right. to weather now, a live look at syracuse, new york look at that know is piling up. virtually the entire northern half of the country is bracing for the first big winter storm of the year. nearly 60 million people across 25 states are under a winter weather alert. right now the storm is working its way through the central plains, fox weather mike is in st. louis with more. >> good afternoon, from st. louis, where we are bracing for what could be the biggest snowstorm in three years, and this part of the midwest, as we go through the afternoon and tonight the clouds thicken. temperatures today will stay at or below freezing, in fact, they're going to stay below freezing until at least the end of next week they took down the

skating rink and you may likely be able to skates on ponds around here by end of next week you have to have six inches of ice. now back to storm a swath of snow from kansas across the plains midwest, all the way to the jersey shore with 60 million impacted by some type of winter weather advisory. we've got warnings, watches, and advisories plus more importantly, from a power perspective ice storm warnings. they're up for southern illinois, we're talking the areas around evansville carbon dale southern missouri nakeds cape gerardo and i-64 corridor half an inch of ice maybe more as we go through sunday and sunday night then you throw in the wind, and you have the limbs and powerlines jostling with extra weight that is the perfect prescription for power going out for several days so plan ahead. back here in st. louis, and along i- 0 snowfall accumulation based on how much

weather alerts currently stretching from winter storm warnings, ice is going to be a major concern. pretty much all of it depending where you are and even some severe weather now this isn't the big winter storm from the big system this is across a three on the scale of five as far as severe weather goes and isolated tomorrows for sunday afternoon on top of that big thunderstorms with some hail. but the real show stopper is going to be all of the snow we're seeing all of those pinks you kind of here -- largely eight to 12 inches of know so in some of these areas most snow they've seen in years those purples are indicating closer to 12 inches of snow up to 18 inches of snow don't be shocked with isolated areas where numbers are a little bit higher. but as mike mentioned probably the biggest concern from this entire system is going to be ice, these are areas where you could see very heavy ice very heavy ice often leads to power outages you're going to have power outages you want it to be warm. that is not the case we have beginning to see some extreme cold temperatures -- but the next couple of days look

anita: we're learning more about the new year's day explosion of a tesla cybertruck outside the trump hotel in las vegas. including details only the suspect and his apparent motive. christina coleman is live in los angeles with more on this. christina what are you learning? reporter: hi anita well federal authorities identify the man who blew up as 37-year-old matthew of colorado springs not on the fbi radar and didn't have a criminal history. they say ultimately this appears

to be a tragic case of suicide involving a highly decorated combat veteran who was struggling with ptsd and other family issues or personal grievances. they believe he shot himself in the head while inside of the cybertruck. today on "fox & friends" an army ranger who knew him shared his thoughts on this tragic situation. >> the guy was a great dude. he, you know, he was a fit -- he was fit he was a good shooter. he was good communicator he was a talented green buret, and sounds like everybody liked to work with him. so none of this makes sense and it is so heartbreaking. i truly hope that -- you know this is a wake whereupon call for -- for service members to make sure that we're checking in with each other right now. >> even though authorities say levels burger blew up the cybertruck in fropght of a hotel in las vegas they don't believe he had any animosity to the president-elect based off of their investigation.

they say they found notes on one of his cell phones that was found inside of the cybertruck that gave some inside into his mind frame and possible motive does yesterday press briefing they read off some of his notes. >> you can read a couple of of the xerpghts but right now we are terminally ill and headed to a collapse and it was a wakeup call americans only pay attention to spectacles and violence what better way to get my points away than firework and explosives? >> seven people suffered minor injuries from the explosion. authorities say this could have been much worse if the steel sided vehicle didn't absorb force from the blast they also say it was not connected to the terrorist attack in new orleans. authorities are still trying to recover information from other devices that were found inside the truck including a second cell phone and a laptop as part of their ongoing investigation. anita. anita: all right a strange story

christina coleman thank you so much for that report. bryan. bryan: fbi confirm it is spoken to a suspect in the new orleans terror truck the truck ramming left four dead doesenings hurt in the french quarter on new year's day. fbi says the suspect was a former army soldier 100% inspired by isis let's bring in ted williams fox news contributor former police detective in washington, d.c. ted good to see you. the reporting is now starting to really find out more about how he was radicalized it appears he reportedly traveled to egypt in 2023. there's going to be a lot of questions about how that -- effected his thinking and then also really how he got radicalized. it is really at the center of that isn't it? >> it is at the center of it. it really touches home. i'm from the great state of

louisiana from louisiana, and i went down for fox and it is hard to believe that i also a military veteran that another military veteran would kill 14 of our citizens. on behalf of a foreign terrorist group isis, and so right now what is going on, bryan is that the federal bureau of investigation is backtracking, trying to determine how did this soldier this so-called soldier become radicalized? and what happened here? when e i look at everything here and the fact once he got to new orleans, that he rented an airbnb and upon leaving that airbnb he tried to burn the place down and he was not successful. left a great deal of evidence

there. there's evidence also bryan in houston, texas at his home that the fbi has known -- they have in their possession. as a result of that, they're trying now to determine was isis directly in contact with jabbar and that led him to go into new orleans and to kill these wonderful folk there. bryan: fbi says 100% true he was inspired whether it went further to him being directed we shall see in this investigation. there's a lawsuit that has been filed by a law firm there on behalf of at least one victim against the city of new orleans saying that this attack was foreseeable, and preventable. a lot of attention on the fact that the city had these sidewalk barriers but they were not put in place, in fact, the new orleans police superintendent had no idea that they even existed -- do you believe that this was a

foreseeable and preventible attack? >> i believe that the city of new orleans is not only negligently nelgt but they're grossly neglect i anticipate many and numerous lawsuits to be brought against the city of our shod have been better prepared. they had two cars that they put into place where bloggers were when they were doing some kind of repair. the terrorists decided to go around the two cars on to the sidewalk. and to kill these various people and the injure so many. that to me is not negligence. that is gross negligence. and i think the city is going to be held accountable. bryan: ultimately what do you make of the report real quickly ted that he potentially used a rare chemical xowngd i mean it was an in the making of his

anita: state funeral ?oans for america 39th president are now underway jimmy carter procession left his hometown of plains, georgia, this morning. it will soon arrive at the state capitol in atlanta. he'll then lie in repose at the carter presidential center for mourners to pay their respects. senior correspondent jonathon surrey is live in atlanta with more on all of this. hi, jonathon. reporter: good afternoon. anita today is the first of six days of formal funeral ceremonies commemorating the life of former president jimmy carter. this morning, his family met his casket at pb sumter medical center it is a small community hospital. but the former president helped raise funds to build. the motorcade stopped briefly

outside mr. carter's boyhood home and farm which is now in the historical national park a bell rang outfront 39 times in honor of the 39th president of the united states. from there, motorcade as we speak is carrying mr. carter's remains to atlanta. it will pause briefly this afternoon outside the georgia capitol building where mr. carter served as governor from 1971 to 1975 and from there his body will be brought here to the carter presidential center where it will lie in repose for lee days. it was through his nonprofit carter center that former president led international campaigns to fight disease and promote democracy through election monitoring programs. even when mr. carter's death staff members remain optimistic they'll be able to carry on his humanitarian legacy. >> it's never been all about him it's been inspired by him and

helped house speaker mike johnson secure his reelection, the president elect is now focusing on how best to advance his agenda legislatively through congress. in a trump advisor tells fox news today that the president-elect prefers single reconciliation package rather than a two bill approach because of slim republican majority that margin is also why president-elect trump had to call house members yesterday who were hesitant to vote for speaker johnson and trump did that on the golf course here's texas republican keith cell talking about his phone call with the president-elect. >> president trump was hitting five iron about time we talked. we had a very good discussion -- he understood my concerns he understands the concerns of the people frankly the people who withheld their votes or voted no are the biggest trump supporters. the people who stand behind him to close the border to control spending.

bryan: nate foye in west palm beach thank you. anita: let's brig in political advisor iraq war veteran christopher, christopher good to have you here today. so yesterday was filled with a lot of drama. mike johnson did win the speakership eventually on the first ballot. but only after two lawmakers switched their vote as we heard in that last report. we're talking about ralph norman and keith we heard a little bit from keith but let's hear more about where he was hesitant to vote for johnson in the first place. >> the last two years have been a disaster. we passed bills with democrat votes, lots of democrat votes just since trump won the election, congress has passed 300 plus billion dollars in new borrowed money spending. and so that's why this happened. because we need to make sure that the republicans do better

under trump. >> okay. so you heard it right there. fiscal conservatives in the house are upset over spending bills that johnson signed off on what kind of battles does he face in the future? >> well, i think whether it's politics or business organizing new house it is like the art of war and president trump did this with speaker johnson to arrange this and work things out in advance so this was very smooth to get them onboard i think the first 100 days they need to look at president trump framework that initial bill for reconciliation that will make things easier to negotiate these things now so you're getting these things put together. one member said the house they don't get as much input as larger bills as the senate because it is done in committees so some of the concerns are e assuaged sod they have six months to put together legislation to deal with a larger spending bill beyond this temporary stop gap measure as we know expires in mid-march.

>> yeah. as you mentioned the first 100 days are going to be very busy president trump has a full agenda of things he wants to pass. you know, we're talking about issues relating to the border -- fiscal issues, is there any consensus here on any of these spending issues with the democrats where do you see consensus? >> well i think that the democrats understand as well that the american voter wants folks to get to work election is over, and americans expect congress to do what all americans have to do. we have to get along with cowork wheres we don't like them and need to get the job done and there's an expectation to make numbers work and get the government to function the stop gap measures cannot allow community directed fund organize larger projects, infrastructure, interstate funding these are things that people need and that voters need moving beyond politics. so the first 100 days is important to get framework of the legislation together when they get to the ploor it is not accra moanous and get the house

screen -- of course. of course doctor here's the warning this is what the surgeon general said, quote, the direct link between cancer and alcohol risk is for seven types of cancer including of the breast, colon esophagus liver, mouth, throat and voicebox regardless of the type of alcohol that is kiewled for breast cancer specifically 16.4% of breast cancer cases are attributable to alcohol consumption. doctor do you agree that alcohol should have a warning label? >> most definitely. alcohol should definitely have a warning label. i mean, when you think about it at its basic alcohol is a toxin, and we as humans need to limit the intake of toxins that we have. when you look at it -- i'm italian italians are fond of drinking wine among alcoholic beverages key thing is to remember to use common sense. and you know, you can't have this toxin every day. because it does affect our major organs pretty much every system in the body.

>> i think a lot of people will be surprised that it doesn't matter the type of alcohol. i mean, we've heard a lot of research that it does. i feel like people feel like that wine is healthier, no? >> no. agreed, i mean, the previous research has shown that drinking moderate -- amounts of red wine and, you know, beverages like that have a good cardiovascular effect new research, though, we have to remember research sols ongoing and always discovering new things. the new research shows that increase risk in those seven cancers with alcohol consumption. so they're not saying that you -- [inaudible conversations] >> appears we lost the doctor there. hopefully we can bring him back at some point this week or so. all right doctor thank you so much for that. but this, obviously, getting a lot of attention anita. this week -- a lot of people thought that moderate drinking was okay apparently drinking at all is

anita: it is a white weekend from the rockies to the mid-atlantic many communities can expect up to a foot of snow the most some areas have seen in over a decade. let's check back with adam klotz at the fox weather center and adam i guess if you didn't get a white christmas you're getting white start to the new year. right?

>> that's going to be the case for a whole lot of folks certainly if you don't see that cold weather or maybe some ice. so there's a little bit of a grab back but it is early winter and beginning of this event that's ultimately going to sweep across the country but there in the plains a little bit of ice a little bit of snow. this is really going to spread out and you're seeing a huge swath of the country under some sort of winter alert. the orange right there is a blizzard warning. you see ice warnings you see watches and warnings and snow is a big part of everything you're looking at here in the purple colors is indicating anywhere from a foot to a foot and a half of snow. a little bit more widespread is that pink in that area you're looking at 8 to 12 inches so a real big snow maker across ohio river valley and some areas further south than we traditionally think of for big snow it is does include major cities like d.c. up to baltimore where on the high end you could be seeing foot of snow as well. pretty quickly outside of this band, though, it does die down probably not a huge snow for new york city.

the same is the case a little bit further south. the problem a little bit further south is suddenly this becomes more of an ice maker air is warmer you get a little bit more sleet. and this could be a huge problem so from louisville back over to st. louis. you're talking about power outages, and once power goes out because of all of that ice and branches coming down, suddenly you're talking about really cold temperatures. this is just beginning of it sunday morning but it is going to spread out anita. we're going to be seeing really cold air in the week ahead, obviously, new power outages would be really bad news. anita: no kidding adam klotz thank you so much for that we'll tiewk you later. bryan. >> jimmy carter motor keyed due soon in atlanta where he served as governor. he will then lie in repose at the carter presidential center in atlanta ahead of his state funeral in washington thursday. we'll have live coverage of ceremonies throughout the week right here on fox. you know, anita this is -- unbelievable. his legacy, and i always think
