mark: welcome back america. as here with our great friend david schoen. want to talk about the department of justice, jack smith and their last effort to really abuse the rule of law for political purposes. this is very, very serious. give a case in florida, you have a judge cannon who is a fantastic judge and so course she is ridiculed by that usual low iq oil lawyers. and she has already ruled jack smith appointment is unconstitutional. they have appealed it. and yet in her courtroom there is jack smith excuse me, you don't have any authority in my courtroom for their he is he's trying to file a report they are rushing the authority of the

attorney general of the united states. and probably other reprobates of the department of justice. where they are going to give their opinions how guilty donald trump is about the documents case when they are still codefendants. where do you make not just as a legal matter of that kind of a ploy, but what do you make of a mentality of a department of justice that continues to think this way? >> that easy politicalization of weaponization of the justice department that we have spoken about but jack smith has no standing whatsoever in this case anymore. when the ironies is she found the was unconstitutional under the appointments clause in the appropriation clause in article one section nine and now they're spending money for him to appear our money to appear again in a case in which he has no standing. you're one 100% rate. look, he wants to issue this report under section 600.8c of the special counsel regulations. he does not exist based on her
