mark: hello america i am mark levin and this is "life, liberty & levin" send eight to sunday ts rest professor jon r friend ben shapiro as well i'm not a very happy camper not in the least as a result of and actions taken by the united state supreme court in a five -- four order the other day that you are generally familiar with. this is an order that basically told the trump lawyers in new york go ahead and proceed with your judicial abomination. and you will have no recourse. now, i want to discuss this at some length i think some of the legal analysis is fantastic but it's way off point. the issue here is not just what happened in that courtroom for what happened in that courtroom in manhattan was a disgrace of

jury instructions, prejudicial testimony phony laws, ignoring the immunity and the supreme court and so forth and so on. the fact the judge ruled he's not going to imprison the president of the united states is not a victory to me. let's start from the beginning. we have something called the supremacy clause. why do we have that question of deltoid why we have that wit articles event confederation problem was the national had no authority to state governments would thumb their nose at the national or state government were fighting with each other for the national government could not raise taxation even to have an army. even to pay its debt. and so a number of our founders got together and said we've got to change this. long story short we've got our constitution. one of the areas they debated at length, at length was whose law should control what? that was the heart, the core of the problem before.

they came up with this today, article six clause to the supremacy clause. now what does it say? this constitution the laws the united states which shall be made pursuant thereof and all treaties made or which may be made under the authority of united states shall be the supreme law of the land. the judges in every state shall be bound thereby anything in the constitutional laws of any state to tstateto the contrary notwit. wow, that is a big deal there's a lot of fighting over that there were three iterations of this language. there is fighting at the ratification conventions they said it must be done if we are going to have a republic. we are going to have a functioning country. what took place in new york was a direct attack on the supremacy clause in a functioning country in the purpose for the constitution in the first place. now, i can get into the fifth amendment that we did that last week the sixth amendment, i can get into the eighth amendment, the 14th amendment which applies the fifth amendment and

other amendments to the states. we can get into all of that. i can wring my hands about what took place in that courtroom we can go over it all over again a long list of outrageous decisions, outrageous acts phony loss on and on and on that gets us exactly nowhere. and so president trump's lawyers wisely go to the supreme court although with the 11th hour and they say look, we want a stay we want you to stay this sentencing before he puts that scarlet letter on president trump's forehead about convicted felon and so we have an opportunity to do our appellate work and the new york appellate system in addition in their brief they included several arguments that i have made here. what did the supreme court do? this is all they did it's no opinion, it is an order here is the order from the supreme court the application for stay

presented to justice sotomayor and is denied for among other reasons the following reasons first, the allegedly evidentiary violations present a lecture from state court trial can be addressed in the ordinary course on appeal with the new york courts. second the verdant sentencings will impose in the present elect responsibility is a relatively insubstantial by the trial court stated intent to impose a sentence of unconditional discharge after a brief virtual hearing. four justices the originalist justice thomas, justice alito, justice gorsuch us justice cap and i would grant the application they said wait a minute we need to hear this case. five said no including two appointed by republicans one appointed by donald trump the chief justice roberts associate justice barry who was obviously flipping she is flipping more and more and more. justice roberts who ha have tald about before on radio and tv is

very much influenced by the legal media. by the "new york times" is very thin-skinned he has in many respects lost his way in my humble opinion. if we had had a chief justice william and associate justice scalia with addition to these four outstanding justices that would've been a six -- three decision they would've taken of the case they would've addressed this. why? why not just let this play out in new york? number one if i had been filing on behalf of the president, this is not an attack it's just a statement i would have filed and the headline would have been merchan the new york courts have no jurisdiction. not stay so i sewin so in bot it the new york appellate court process it would've been the marquee point probably the only point and then i would've backed it up with support. because that is the bottom line.

this judge, that prosecute the new york appellate court system has no jurisdiction. so why play in the jurisdiction when you're trying to tilt the supreme court they have no jurisdiction? that is my view. why is this important and why is that true? i read you the supremacy clause did i not? what are we talking about here? without federal campaign law, even though they played hide and seek with it was the underlying law that was used to apply the hook to everything else to bring it in. this mda this judge had no authority whatsoever under federal campaign finance law. they knew which is why they would never mention it until the very end. they knew which which is why they would not allow, they would not allow the former chairman of the fcc bradley smith, that is the judge, to testify about federal campaign law they did not want that front and center,

why? because they know what i know iy would've lost jurisdiction. jurisdiction is number one. but, i want to focus on the court and these two justices robert and barry what is the job of the supreme court? i am not talking conflict of state law what is the ultimate job of the state supreme court? to uphold the constitution of the united states. that is their job. that is the bottom line. two of the republic appointed justices decided to take a walk. i don't know if they're cowards, i don't know what their position is ultimately it's not stated in the order. for justices knew we better take this up. why? this is a judicial scandal it's an abomination. the idea that the supreme court allowed the continuation of a judicial scandal a judicial abomination to allow it to play out in new york creates a

monumentally damaging precedent but let me give an example, stick with me. let's it is an appellate court in new york that has its wits and they say wait a minute we not have jurisdiction over this. were going to reverse and throughout the case of the lower court in new york. that would be a great outcome for president trump. i am all for it. that would be great. but it would only apply to new york it does not apply to any other state. let's say we have alvin bragg in l.a. and let's say elected state judge appointed state judge in l.a. we will call him merchan they pull the same stunt they can do it they can interfere with the federal election. they can make decisions about federal campaign law. they can make all of these abuses of the federal constitution of the bill of rights because new york cannot stop them and the supreme court took a pass.

what you think about that? thousands of d.a. offices, county prosecutors, state attorneys general they look they look at this preposterous order this silly order the court did not have the guts to do with this court needed to do. with this court needed to do is put an end to this say wait a minute there is no jurisdiction we cannot have a local d.a. in the middle of a federal presidential election we cannot have a local judge in the middle of a federal presidential election to make rulings like this an in number two, 10 days before the inauguration decide is going to impose a sentence whatever the sentence is. the idea that the sentences unconditional discharge and therefore they get a pass still the court is giving to this process. to the seizing of federal jurisdiction by a local prosecutor and the state judge. this is a scandal now. that's what it is a judicial

scandal because two republican opponent justices the three radical left-wing democrat appointed justices did not vote with the four constitutional originalist to say no, no, no without a straightness out. we cannot allow this abomination, this process to continue in the new york courts we are giving it supports. this is a federal matter week the supreme court are the only court they could openly that cay straightness out. this is our duty. this is our responsibility they said no. so right now there is nothing to stop a local d.a. for manufacturing another case against another presidential candidate in the middle of an election. there is nothing to stop a state judge from doing the kinds of things that merchan did outrageous, outrageous things that he did. and, on top of that the dump document here the department of justice half a century both parties taking the position we

need to avoid all of this like the plague at the federal level. we are not going to allow the prosecution's indictment of the prosecution of a sitting president. now, the criminal justice process does not end at the trial court level there's an appellate level. with the supreme court did is it allow that to go on that is the criminal process the appellate court process while donald trump's president. they rejected the federal department of justice position. in fact, everything merchan and bragg did violates this memo the position of the department of justice for half of a century which is why there's not a single federal prosecutor who would do what's being done now which is why they had to drop their cases except the case in new york goes on. and it goes on. now this is a big deal this a

jurisdictional issue. it is a big deal because they have not resolve the issue. let me go further by these two justices who are absolute cowards in outrageous and what they did and want wh white whatd was abandon their responsibilities. bush v gore decision the court stepped in without any statutory authority. basically an emergency appeal filed just like an emergency appeal was filed by president trump's lawyer call it whatever you want it is a common law process at that point because it's not a statutory appeal or a statutorily sanctioned appeal. you call it what he said the other day you call it a kumquat, whatever you want it's an emergency appeal. this court the six republicans afforded to did not thank god they finally sent us a document they finally sent us this and now we can act and protect the federal judiciary. now we can act, pull the constitution the supremacy clause now we can act to make it

abundantly clear to every d.a. in the country every attorney general in the country every state judge in the country, this will not stand you cannot do this in a presidential election. you cannot do it to a presidential candidate but you do not get to interpret federal law once you reveal what federal law you're talking about but you do not get to usurp the authority of the federal court in this court, the supreme court that is what they should have sshould've saidwhshould havesain opportunity the president's lawyers have given us this opportunity under bush versus gore ted olson brings the case and what were the questions of the florida supreme court the supreme court of florida violet article two section one clause two of the unite unites its constitutional making new election law? that is rather than the state legislature the accounting was still going on the court was still adjudicated. the counting was still going on the supreme court said the process is the problem. we are stepping in now to stop

the process. we cannot have a state court even a state supreme court interfere with the federal presidential election and the electoral college process. by changing the accounting system after the fact it violates equal protection clause of the fifth amendment as is applied to the states they stop the process which was becoming a scandal, an abomination they did not docket. the chief justice, the associate justice did not say let the system play out. because the system the process is the damage. the process is the damage. it is the damage. now here's the other thing. depending upon what that new york appellate courts do donald trump may have to go back to the supreme court assuming the new

york appellate system is corrupt as this the new york trial level system. ithey go back to the supreme court let me suggest to you at that point may in fact it take the case. who knows anymore may in fact take in the case and vote with the other four i have six constitutionalists, not activist come constitution was taken up the case what are they going to say? what else are they going to say? that's the primary basis as other thing they can say he did not have jurisdiction. what you were doing was without authority he did not have the power to do it. the question is asked why didn't you do this in the first place? why do you put the country through this but the president of the united states he will be president at the time, through this. how are they going to justify

the fact they did not act the first time? it gets much more complicated, doesn't it? the bottom line this is not about inter- lough at torrey appeals this is not about that new york appellate system. this is not about any of that this is about a majority of the supreme court refusing to uphold the federal constitution in the face of an assault by a state. fight new york. every other blue say every other hacker prosecutor and some big city as of today have the ability to do what was done to donald trump in manhattan. because the supreme court would not fix this on behalf of the supreme court the federal judiciary the framers of the constitution and the supremacy clause what's the point of having a supremacy clause is something like this can take

intervene in this case in claim wait a minute, these local guys have no authority whatsoever but especially given the fact the southern district of new york took up this case and took a pass. isn't it also interesting to you that most of the arguments we are hearing have absolutely nothing to do with jurisdiction? they get caught in the weeds about internet walk at torrey appeals the new york system that's all very, very interesting. but it seems to be a straightforwme astraightforwardl supremacy clause matter here should have sufficed to print what you think? lexmark i'm sure america wishes you were back as chief of staff of the justice department. this would never have happened. a lot of the commentary about president trump's sentencing as you suggested will be about the tactics of l'affaire. unfortunately they are missing, i think the bigger constitutional picture which you laid out. this is a bigger long-term threat to our constitutional system of government that goes beyond donald trump. although he is a symbol of it. one, you have a state here

attacking someone who is the president-elect. as you said the supremacy clause is supposed to stop states from interfering with the valid operations of the federal government. it's almost as if lincoln, after he was elected trying to get to washington d.c. and maryland decided to arrest him on his way to the capitol. that of course would never be permitted. one, you've got a state trying to interfere with the federal operation of the presidency. second you've got a state trying to take over the federal government's authority to enforce election loss. as you said the southern district of new york justice department the federal election commission. they all looked at this the issue in this case and decided not to bring any prosecution. the bite in justice department should have been out there saying this is our job. this is a jump of the federal government to enforce federal law no state can then come in and say we are going to hijack federal law enforcement because we think it means something
