you are always there team rubicon. thank you for coming on the show. thank you. take care, jake. fox news alert. critical warning of extreme fire danger. los angeles county and ventura county now under the highest level threat warning. treacherous santa ana winds returning whipping up dangerous weather as crews battle to contain existing wildfires. welcome to a new hour of "america's newsroom." i'm dana perino. >> bill: here we go again watching the hour, watching the forecast and the wind. i'm bill hemmer. good morning at home. you have critical weather conditions potentially fueling yet again the growth of new and existing fires. national weather service issued red flag warnings destructive and life threatening off shore winds picking up from today through wednesday thus far this week. >> dana: security is high in the affected fire zones. law enforcement making dozens of arrested for us a sected looting. l.a. county sheriff with a stern warning for anyone trying to take advantage of this ongoing

disaster. >> regarding any illegal activity that may be occurring in these areas. don't do it. the fact that anyone takes advantage of anyone who has been victimized already whether it's burglary, looting or any other crime, whether it's a scam of some kind that you are con jarring up to make money off the poor people involved in this. >> dana: griff jenkins is live in malibu. the sun is up. what do you see, griff? >> well, dana, i see widespread damage and destruction. charred remains of homes and buildings. you mentioned the looting there. there were four more arrests yesterday bringing the total number of looters to 39 in the malibu and pacific palisades area. let's look at this sun coming up here. whoever lived in these homes must have woken up every day and said i have it made. i have everything. well today they have nothing. you can see the steel i-beams

and foundation is rubble. it goes for miles up the iconic beautiful pacific coast. you can see burned out s.u.v. another car there . it comes with this warning from the national weather service particularly dangerous situation. the pds warning is the highest the agency can issue intended to invoke the highest level of urgency for residents to evacuate if indeed these brush fires that firefighters are trying to tamp down with these high winds of 70 miles-per-hour for the next possible 48 hours. we talked to a captain with the l.a. fire department eric scott. here is what he said about the dangers people are facing. listen here. >> this just stirs up all of the other embers because things are still burning. it is still active. and it is so dry because of these winds that the brush or fuel if an ember lands on it has a 65% ignition. we are chasing fires.

>> back out here in malibu there is nothing left to burn here. the fire palisades fire came across the hills and burned everything in its path until it met the pacific ocean. we'll show you an image here in malibu yesterday, sheriff luna who played the sound bite saw a firefighter in distress. turned out it was an individual who was not a fireman and he was arrested. you can't be in this area. another incident. i want to show you this video of a man that was found with a blow torch. sources confirming to fox he was an illegal immigrant from mexico and being held on probation, not charged with arson but complicating the issue, as you can see trucks, emergency fire trucks and crews trying to come in here trying to do their work all a part of the complex situation with this high red flag warning on its way as we expect a press conference from mayor bass in the next hour.

>> thank you so much. our next guest is promising looters will be prosecuted and punished to the full extent of the law. nathan hochman is the newly elected l.a. d.a. how can you make it clear that looters will be prosecuted? are you able to expedite some sort of hearing so it can stop? >> that's exactly what we intend to do. we have sent an unmistakably clear warning to looters, people engaged in trying to scam people suffering from the tragedies to people even thinking about arson. if they want to engage in these crimes they will be arrested, prosecuted and punished to the full extent of the law. at 2:00 p.m. today, los angeles time we are going to announce charges being filed against certain looters, against an arsonist, and when the public hears and when would be criminals hear the types of punishments they are facing,

they will think twice about committing these crimes. >> dana: can i ask one thing? maybe you aren't able to say. on charges against an arsonist. do you think that person was responsible for any of these fires? >> no. the person who will be charged was not responsible for any of the large fires that have taken lives. but was effectively looking at the opportunity at this as an opportunity to set off fires. which is again incredibly dangerous and will be even more dangerous as these red flag warning winds come through los angeles over the next several days. >> bill: some of this water is under the bridge. look to the future and how to best help the folks trying to recover. we were with a guy last hour lives in altadena. he was shattered. here is jd vance talking about what needs to be done. >> there was a serious lack of competent governance in california. i think it is part of the reason why these fires have gotten so bad. we need to do a better job at

the state and federal level. >> bill: what can you do now knowing that all that is behind you and you are dealing with all that dust and ash, nathan? >> so what we can do, in fact i'm one of the people who has been evacuated. my sister lost her house in pacific palisades. what we'll do is first deal with people who are looting, people who are taking advantage of this with crimes right now. then we begin the recovery effort. sadly, we'll have people who want to take advantage of the recovery money coming in from insurance or government benefits. we're sending the same unmistakably clear message to them. if they want to rip off people who suffered these type of tragedies we'll come after you and throw the entire book at you. so please do not commit these crimes. our goal is to deter them in the first place. thus saving a lot of victims in the process. >> dana: you are newly elected. do you have the resources you

need in your office to take on the task? >> 750 assistant district attorneys. some of the finest prosecutors in the nation. they're motivated and inspired to go ahead and help people. they always have been. they haven't had the opportunity over the last several years but they are all fired up right now to go help the residents of l.a. county get through this tragedy and make sure that the criminals who want to take advantage of them meet full justice in the system. >> bill: what do you think went on here? was it just a confluence of events of mother nature that could not be overcome? or is the empty fire hydrants and reservoir that holds 100 million of gallons of water that wasn't working. what is it? >> they'll look into the causes of the various -- whether it is arson or manmade. they will be looking into the efforts -- initial efforts to try to put out these fires, to figure out if los angeles was

not with any grand fanfare but just mentioned in a footnote of a court filing that came out on the public docket on saturday. i want to read it to you. the special counsel pleated his work and separated from the department on january 10th. as for smith's report it is separated to two volume. volume one is the the report on 2020 election interference of trump. volume two is a report on trump's mishandling of classified documents taken to mar-a-lago. merrick garland will release only volume one of the public. the two is co-defendants. garland won't tip the scales of justice. they said this about the raid on mar-a-lago. >> we always try to pursue the least intrusive means. first trying to get the information back voluntarily, then with a subpoena, and only

14 years ago, i was on a training mission. did a military freefall, and i had some faulty equipment. i hit the ground. going, 30 to 40 knots and was instantly paralyzed. i met jack fanning when he invited us to park city, utah, through his foundation. i was able to actually get on the mountain and ski with my family, i can't put into words what that meant. i got paid in the military to do crazy fun stuff. and after my accident, i'm still that same guy. and when i was able to jump out of a perfectly good, helicopter, at 10,000 feet, i did it. i was talking to some vets last week amazing how we have these houses where they can come over because they■re in chairs too. carpet and wheelchairs don't mix very well. tunnel to towers, they got rid of all that. they redid my whole bathroom. that's probably the favorite part of my house. i thought they were just going to do the upgrades.

a particularly dangerous situation is about to unfold once again here in southern california. the national weather service warning that winds between 45 to 70 miles-per-hour are expected between early tomorrow morning and into wednesday at noon. the reason why this is so serious is that there are embers, of course, still left in these fire-scarred areas and also the vegetation is just so dry. take a look at this right here. you can just see the dryness of all the grass and vegetation out there on the slopes. if an ember catches one of these bushes it can go up in an instant and spread the flames even further. right here on the palisades fire we have about 13% containment. currently sitting 24,000 acres right now. it was earlier in the weekend making a run toward the neighborhood of brentwood. firefighters there have gotten that line pretty well buttoned up. again with the winds beginning to rise into the evening hours and early tomorrow morning, more

little easing of comfort because of the significance of these winds with fires already burning. 60 to 70 miles-per-hour winds could hamper fire efforts. flames are raging. you are factoring in big winds and why the national weather service issued this particular dangerous situation. the winds strongest and humidity lowest. >> bill: tonight maybe 30 to 40 miles-per-hour. tuesday night seems to be much stronger. is that the worst at the moment? >> that's where it looks where winds could top 60 to 70 miles-per-hour. some of the winds we saw last week when we look at it from a magnitude. 90 to 100 mile-per-hour. we won't see that threshold reached. that was before the fires

started we were looking at the significant windstorm last week. we already have fires burning. containment has been great. a few. the woodley fire, sunset, kenneth, have all been fully contained. they aren't put out but contained. some of these, though, the palisades of note and also in pasadena close to altadena where we've seen so much devastation out of the eaton only 33%. >> bill: what else can burn? you look at the images from palisades and malibu, not much can. if you get winds at a certain capacity they can take embers and throw them like they did last week. >> you don't have to look far. you look at the pacific coast highways and the beach front properties. one of our -- that's a 60 foot jump the flames made. those embers.

to stay. and listen, yes, the decision to go was an incentive for the aggression that we have seen since that time. what do i mean by that? it wasn't just the chaotic emergency retreat that took place. that's what we saw on our video. but it was the judgment -- the judgment. when our adversaries look at this and look at the biden administration, biden was willing to walk away from an ally that we stood with for 20 years to defend against radical islamist inside afghanistan who killed 3,000 people in the united states. and he was willing to surrender the country to the adversary that we were fighting. it's not surprising that shortly after that, that we see war in europe in a way we've not seen it since world war ii. that the middle east is on fire initiated by iran to do what? to destroy the state of israel

once and for all and to drive the united states out of the region. and president xi became considerably more aggressive. all of that is taking place why? because they believe the united states is weak, lacks the resolve to confront their adversaries. and that is really the history. the facts are there and they are going to try to dispute those facts. the truth is, as much revisionist history as they attempt to do there is nothing that can hide the fact that this is a failed presidency when it comes to national security and foreign policy and protect theing the american people. >> dana: final word. let me put this up on the board first. shoring up the u.s. presence in syria. trying to get the hostage and cease-fire deal between israel and hamas, boosting venezuela sanctions and surging aid to ukraine. they'll try to do that.

next week we'll begin new with trump back in office. final word to you. >> well, i think the american people saw it for what it is. i try to stay out of politics but it is hard to ignore the fact that over 70% of the american people believe that the country was moving in a new direction and obviously they spoke in a november election and the trump team is going to come in and i think right from the outset -- we're already seeing some evidence of it -- a willingness to confront our adversaries, the biden administration has been unwilling to do it and push them back on their heels. that's what needs to be done and certainly we're not talking about going to war. we're talking about trying to prevent a war. we have two wars going on right now with president xi threatening a third one. that's what we're really facing. i believe a step in the right direction will be to push those adversaries back and i think this administration coming in is likely to do that.

years. what it was before and now what's left on the right side. rob is with me now, the owner. good morning to you. on the weekend i love a good hardware store. i was looking at the pictures inside and you had a good one. can you tell me about how close you came to trying to save your store, rob? >> good morning, bill. thanks for having me on. i on wednesday morning we received a regular shipment. to be honest with you i didn't have any expectation that the fire would get anywhere close to the store and i did my best to get up to it but the fire was raging even below where our store was. so i would love to say i did my best to put the fire out but i couldn't even get to the store at the time. in fact, my dad, who is the one who initially purchased the
