>> we are live in los angeles county where the district attorney is expected to announce the arrest of intervals accused of looting and arson in the wake of the california wildfires. residents abrasive for the return of the santa ana wind. welcome everybody i am charles payne this is "your world". we have fox team coverage with matt finn in altadena and jonathan in pacific palisades. we want to begin with matt. >> hey,, charles, i'm standing in the aftermath of the eaton fire which of this afternoon is the deadliest. let me just walk you through what it would be like returning to your house. you go up to the front sidewalk and in the stairs lead to nothing. and this is a situation we are seeing all across l.a. county. i spoke to a neighbor next door she was lucky return to her property she says she was looking for heirlooms and things like that. i talked to another gentleman in his area he

says he is acting like neighborhood watch taking pictures of suspicious people and their license plate here is what he had to say. >> just knowing somebody is watching you the old-fashioned neighborhood watch where they know somebody is watching them they are less likely to do things. >> the new l.a. county district attorney nathan hochman who is supposed to be the tough on crime d.a. says that people who are caught looting will be maximally punished. he is expected to make an announcement within the hour on people who have been charged with crimes in relation to the aftermath of these fires. as of this hour the total number of death 34 people across l.a. county. the sheriff says that number has been growing by the day because they have been finding human remains every day. >> charles: thank you very much. california governor gavin newsom is calling for a massive rebuilding effort and

suspension of regulations. jonathan hunt in the pacific palisades with this part of the story. >> it will take a massive rebuilding effort when you look around pretty much every street and the palisades and where max is in altadena this is what you see. destruction in every direction. not talking about single houses on each street. a lot of streets in the palisades and i mean dozens of street if not hundreds of streets almost every home is gone. almost every home looks like this. just about 2 miles as the crow flies. charles up into the hills that brian is pointing the camera at now. that is the palisades highlands that is where this fire started. we managed to get a crew up there today to take a look at this video not easy to get up to the very top but that is the start. and again the destruction where this

fire at first a cold is really something to behold when you were up close to it. have to be stripped away if there is any chance to get rebuilding. we have renovations or buildings in the california knows that it is really difficult at times that there are so many regulations and rules it can take months if not years to get the permits that you actually need to get building done. so a lot of people will be relieved to hear governor gavin newsom say they will strip away a lot of those regulations but the proof will be in the actions when it comes to it. but either way even with no regulations, charles, the destruction is extraordinary and unprecedented destruction we have seen across great swaths of the palisades. it will really take very, very long time. i know the palisades really well i spent a lot of time here because

my kids have been in one case are still going to school here. this is going to take years to come back as any sort of community resembling what it was. one of the most idyllic parts of the l.a. area. now it is to put it bluntly a house scape. it will take a long time to rebuild. >> charles: thank you very much. in the meantime south anthony wins -- santa and the winds are sent to pick up tonight. let's go to adam on what we can expect. >> a change in weather pattern that will bring those went back. maybe not extreme as last week but still pretty powerful. those areas where the wind will be most intense. this is the set up that allows it to happen it is the warm desert air over portions of nevada that is being pulled down by the low pressure

system. that will settle further south and start to drag all of that dry air once again fairly quickly across some of these mountain regions. these are currently what we are talking about as far as wind and wind gusts. close to 40 miles per hour this wind will continue to increase that is why we have the window alert in place and everything. wind gusts 17 miles per hour ultimately in the tuesday and into wednesday as well. widespread 30, 40, 50 miles per hour. if i assume you will be talking about 50, 60 miles per hour. isolated wind gusts up to 70 miles per hour. that is when we have a particularly dangerous situation across pretty much the same tire situation. next to malibu and in the hills further towards the north in ventura as well. this is the highest fire rating we have when we

see the pink color extreme that is in place today because of the wind that will continue to increase overnight. you see the exact same set up tomorrow. back down a tad on wednesday so the next couple days we will be paying attention to it. i love -- i know folks would love to see rain but there is really no sign of that this is the forecast in los angeles the next 10 days temperatures in the 60s. mostly sunny pretty much every single day. >> charles: thank you very much. and i want to understand these dangerous wins have a threatening response it keeps coming back to politico the california wildfires. david i was doing some research before the show you have been hitting the airways pretty regularly over the last few days. talk to us about the most imminent danger is that the shifting wind right now once again a? >> thank you for having me on absolutely. that is our big

challenge because with this wind out of the north and the east it is the reversal on top of the reversal. we have thursday they swapped they became the west and south wind. as they sweep through again it is making get more of a challenge. not only the areas we are trying to contain trying to put out all the spots but even more so and a new spots we have which is the public cooperation. >> charles: what would you like to see from the public? >> the public needs to help us and create one more spark. that means no mowing right now. you will run over a rock. if you are driving make sure you are not driving a chain that show your vehicle is in good condition. all these things are pieces that don't have a campfire for example. all of these things will help us not have another fire although we have

resources prepositioned they are just they are ready to go to protect from the next one. >> charles: so resources are prepositioned which is great. i was in los angeles last week i flew in tuesday night and as we approach lax maybe 20 minutes out you can smell the smoke. but as i waited to board the plane i was surprised how many people swamped me and giving the horror stories. because we didn't know at that moment how bad it was and preparation. i know you don't like talking about this and lots of folks don't but you talked about being prepared and asking for the public's help. a lot of people wondering what the heck went wrong with the fire hydrants and the reserves. these santa ana wins i have red articles back in the late 1800s these are not new and yet it feels like everybody who was supposed to be in charge was flat-footed.

>> you are right and they are not new. and what we are urging people because as meteorologists pointed out this is such a wide ban of particularly dangerous situation. particularly ready for wildfire.org and there we can see preparation steps, lip -- list of what to take in your evacuation go back and where to find shelters for yourselves, small animals, large animals, or livestock. so fully prepared which works pretty well. whether it is wildfire, flooding, earthquake, for whatever reason having these preparations is key. >> charles: what do you need to get the all clear for the public to have the all clear? we look at the weather map the pink area high risk area subsiding substantially by wednesday how long before you think we will have the all clear and cathy begin -- begin the process of cleaning and restoring these communities.

>> after the wind slowed down to coming out of the north and the east they will come back from the west on the south so that will be another additional challenge. our concern is that there is for primary hazards. you have a bunch of power lines that are down we don't know if they are deenergized or not. gas lines that are asked boast that create a hazard. these buildings are decimated there might be just one wall holding it up and then that might injure people. and then all of the toxic ash out there from houses that contain mainly petroleum production a very dangerous for any families to be out there right now. >> charles: thank you for coming on. >> thank you. >> charles: governor gavin newsom invite for trump to visit is still standing will he be going? also to the gdp rift there is actually a rift develop it go for

california for wildfire damage while also criticizing his rhetoric. what to of this back and forth. he gives this a little interview that is for sure and the reporter pushed back a little bit but what do you make of this? this is the same state that raise 2 million said they would raise millions of dollars to fight the trump agenda after he won the election. >> that is right, charles. governor newsom began this year by trying to trump-proof california and reportedly democrats in the state capitol have already settled on a plan to set aside tens of millions of dollars to fight the federal government in court if need be. the president-elect responded by attacking newsom's record. would could be tragic as if you have american citizens in california who are caught in the across fire when you have newsom going hat and had to metaphorically of course to the incoming administration and there will be a cost for the

taxpayer. trump has said he wants to change to california water policy. >> charles: i think a lot of people would like to see that and maybe it can only happen in an emergency situation. >> if this does create change the president-elect steps in and change is how california and other states to function. but i think this is the immediate impact of these are people who need help right away. january 20th trump and newsom can't figure out a way to work together it and supporting citizens that is an issue. it was interesting seeing newsom invite the president-elect to california to see for himself and that is something presidents do. they go to disaster starts -- sites whether it is a red state or a blue state. we saw biden and governor desantis

working together on hurricane relief years prior during the biden presidency. so this is something that happens but if newsom and trump actually come together that would be notable after the series of exchanges they have had to. >> charles: we definitely would not want it to be like palestine where it took a long time for the biden administration to even acknowledge that. house speaker mike johnson says he believes that california should have conditions to their election by the state and local officials. so that adds to the mix. how long do you think the fight could drag on? >> this could become political football but i think as we look at natural disasters generally the inclination from lawmakers but republicans and democrats is that any partisan victory it only has so much of a runway. you can try and force some changes here or there but at the end of the day you will see citizens who are in need of. that will be pretty difficult for lawmakers to try to put their powers and preferences

over one another. my expectation is that if there were changes or types of negotiations they likely won't get in the way for too long because we are looking at these images coming out of california and they are heartbreaking. >> charles: north carolina as well an area where a lot of people feel like at this very moment to not getting enough attention from the white house. i was in california last week i was in los angeles last week i was shocked how many people on the political side saying this open their eyes. i don't know how much pushing the g.o.p. has to do with this particular case. >> i think people are seeing for themselves the federal government's response to this but aldo -- also the local response, the way california and attacked -- is handling this. yes, it has become politicized through conversations online. but also this is something that people can see for themselves on the ground the impact of what policies have and how it impacts their

own lives. so we will see what changes are made out of this but i think in terms of immediate disaster relief phil is right congress will come through and provide for american citizens what they need in order to clean up after them. >> charles: absolutely let's switch gears. the judge clearing the way for release of special counsel jack smith's report on the 2020 trump interference case what can we expect from that? >> it is interesting in this decision now to maybe pushed forward the of this report. business a victory for the justice department. looks like we can get them in later this week but if the election is over, president-elect trump will be sworn in on monday. the way americans feel about what happened in the wake of the 2020 election and election interference leading up to january 62021. that is something people had the opportunity to vote for if they had the opportunity to believe

when president biden made it up a campaign issue and then vice president terrace they voted decisively for trump. so i don't know how this will reflect on the public anymore because of all the events that happens after that including the 2024 election. >> charles: phil? >> it is a victory but i. one because as alex noted the majority of the government did not care about this case or at least are not enough for it to vote. i think this is the last gasp of some democratic efforts to try to undermine or undercut donald trump in the legal realm with the president-elect the president-elect would call lawfare. so whether or not you agree or disagree with whether these cases should have been brought to what is interesting is that this is sort of the second season of trump and t begins it without a special counsel. without some massive legal scandal for him the decks are clear to. >> charles: thank you both very much. when it comes to get it because aggressive

local taxes by raising the current, but he also can't take off fiscal conservatives skeptical of a perk for some taxpayers that will cost everybody by adding to the debt. >> he does have to deal with the fact that the states that he had there myself included we were very adversely affected by the deductibility for the income tax that was taken involuntarily. so yes there is a demand for some sort of recognition of that the president recognized it was very supportive that we need to find a solution. >> but spending watchdogs worn raising the salt deduction cap is expected of -- expensive and not much payoff for the middle class. the cost of doubling the salt cap to $25,000 per household would be $175 billion per year in lost tax revenue. but this would save americans one dollar on

their taxes. families making under $100,000 would save one dollar. those making between $200,000.300000 would save just two dollars or three dollars because of that some republicans may not back the tax package if it does not -- if it includes changes to salt. >> future generations will have to pay for these mountains of debt. we have a general agreement before christmas where we would come together and say we need to cut at least two and a half and $3 trillion for a debt ceiling increase. >> it may come down to the total tax for this and with republicans in the mix it may mean more cuts somewhere else. >> charles: thank you very much let's get right to new york republican congressman mike waller he was at mar-a-lago we saw the photographs. this is a very contentious situation. you hardship and roi he was adamantly opposed to

those he is not the only one in your party what are you saying to them when they say we are supposed to be cutting to trillion and adding things -- and cutting not adding. >> first of all if no bill passes assaults comes back on limited however, it would be accompanied by the largest tax increase in american history, rates would go up, minimums would come back. it is incumbent upon everybody on both sides of the negotiation to negotiate in good faith. often times people talk about salt as they don't want to subsidize blue states. states like new york are donor states. we sent more tax revenue to the federal government than we receive back. so salt is the function of avoiding double taxation. yes, i agree the leadership in new york is terrible. the governor is an absolute failure and needs to be replaced in 2026. new york taxpayers

should not be penalized with double taxation by the federal government. to say somehow this is we are losing revenue. the fact is the cap on salt was nothing more than a paid for for other provisions within the tax bill. as we renegotiate a new tax bill moving forward i and my new york, california, and new jersey colleagues have made it clear we are not going to support a tax bill that does not lift the cap on salt. we understand it is a negotiation. >> charles: what then are you suggesting? >> again, they used assault as they pay for in the last tax bill of. there are a number of provisions we will work through. ways and means of coming up with potential pay force there are as part of this new tax bill negotiation. but what we are saying is that 10,000-dollar

cap on salt is unacceptable. the fact is i can tell you my district, west district county, rockland county, we have the highest property taxes in america. that is before we get to stay taxes, income taxes. i can tell you a house like mine 2000 square foot home i'm paying over $15,000 in property taxes. >> charles: i live in jersey play close to 50,000. let me jump and it sounds like you will torpedo the entire trump package if you don't get what you want to. you and your fellow blue state republicans are prepared to torpedo the hire -- entire package if you don't get something on this. >> first of all you hear somebody like chip roi saying if they don't get requisite cuts they will vote against the bill. the factors everybody can say they won't support it if they don't get a, b, and c. all of us have to work together as a team. we are negotiating in good faith. >> charles: let me

bring up one other thing because we are running out of time. you antiwe complain about these taxes but folks in these other states that might actually have a deficit in terms of the taxes they send to d.c. are saying these are tax laws that the state themselves put in why should the national taxpayer bear the burden of the fact that these dates are so irresponsible that their taxes only go higher and higher and higher and that their deficits only go higher and higher? why should the rest of the nation have to pay for that? >> when the federal government is sending more to many of the states then taxes they receive i can make the opposite argument. to me the fundamental point is all of us have a responsibility to negotiate in good faith, come up with a tax bill that provides wheel relief to middle class and working families. that is what my objective is i will work tirelessly with president trump.

governor gavin newsom vowing to cut the red tape. but california's strict environmental laws it is tough. so what would that look like? we bring in the president of the california building industry association and that is something i was out there i got there last tuesday i left on friday night and that was one of the big issues. obviously people losing their insurance their house insurance some just months ago on the eve of all of this. and then some of the caps on this insurance they were able to get won't be enough and that is part of the problem is in it? >> you are right we are definitely in a very tough situation here in california the virus are still burning we have an insurance crisis, a housing policy crisis. all of this is coming to the forefront on the national scene that california is struggling as we deal with these fires on the rebuild afterwards. >> charles: i'm looking at a list of some of the regulations. density restrictions,

land use restrictions, construction permit fees, prevailing wage requirements, environmental regulations, proposition 13 impact fees it is a wonder that anybody can afford a home out there in the first place. is there an opportunity since the governor's de facto admitting that this red tape gets in the way could this be an opportunity to turn the tied a little bit? >> we think so i mean we are actually very pleased that this early in the process while the fires are still burning governor newsom came forward he had two paths to take. one is we want to rebuild we will conserve this and not nearly come back the way we should are the other path is the path he did choose to take witches i'm going to take steps to remove those impediments and i will take steps to bring california back and we will rebuild these communities. charles you touched on exactly right we have a state of california created more policy impediments, more delays, more

regulations, than any other state in the nation read or blue. we have unfortunately taken a path of bureaucracy overbuilding and that is a great challenge for us in the great state of california. >> charles: do you have a checklist on the urgency factor of the things that you would like to see done first? >> what the governor did on sunday morning was very positive and dealt with those california environmental call act, the delay process, and then the coastal act, those are two very positive things. the other part of the question what we have learned is when the remove those two impediments local governments still required to get a permit to rebuild the identical home which blows our mind to. some states don't require permits to build a brand-new home in a new place. so the issue that confirms -- concerns us most of us get out of the way and help us rebuild it. can we build the palisades without having to go through months of delay.

so the city process and then the last thing is even though the governor has opened these doors the challenge having worked for governor schwarzenegger' s you have to get your entire administration on board with the admin on top that is different when you have thousands of people going their own direction. they have to follow the governor's leader. that has been a challenge for him we are hopeful he will deliver on that promise. >> charles: we are all hopeful and hopefully maybe this will change things bring some common sense into the equation. our friends everybody out there and thank you so much. southern california residents reeling many are organizing to help them rebuild. the wounded blue organization is raising money in our unique way and pairing up with music stars.♪ we will hear w from the founder and the music founder and the music stars next . as for me ♪ (knock at door) ♪ i'll wait and see ♪ ♪ and maybe it'll bring my love to me ♪

tell us about this. >> we all know this, the devastating fire and the catastrophe in the area is the worst we have seen. the deputies and california highway patrol are out there working 24/7. they are also in the affected area, and many of these are being affected by the fires themselves even though they're out there in the front lines, some of them have lost their homes just like the people that they serve. so the wounded blue, of course is the national assistance and support organization for injured and disabled officers that helps injured and disabled cops. when we look at this catastrophe and join these stars like neil mccoy, we help the officers affect >> charles: neil, tell me about the musical instruments

auctioned off. >> sometimes when we go to these organizations, promoter will find the way to get stuff to you. if there's numerous artists at festivals or events like in alabama, they were a bunch of stars there. we don't always know where they go but they tell some of the different ways they can use them. everybody there is always kind and takes time to sign them. but find out more about the wounded blue and this guitar for cops thing they're working with in particular, we just think it's pretty cool because again we didn't know too much about sometimes where they were going and then randy gets in and tells you what they're doing. i can't say enough. i love police. i have done a lot of trips overseas and entertained troops and firefighters and stuff, these policeman are on the front line and even they're struggling like the firefighters with the tougher things they're seeing and finding out. we want to help wherever we can.

>> charles: neil, do you envision down the line, that would be a concert or benefit to extend this further? this would be one for the record books. the damage will be north of $150 billion. >> it is, and sadly to say, just neil mccoy showing up probably won't do much. >> charles: definitely bring friends. >> i would definitely be will be to be there, because i can find more time than some of these great big stars. they are booked pretty solid. as a rule we work a lot but would find a way to get there. it's one for the times. >> charles: randy, what i'm happy about is that there's been a lot of criticism of the folks in charge, and believe me, they did themselves no favor in all the press conferences last week congratulating one another. they let their citizens down, but it's always important to make sure that we don't confuse the firefighters who wanted to

have a hose in their hand and no water coming out of the hydrant or the first responders. it's important these folks that are the first responders know the citizens of america and this case the citizens of los angeles know that they are trying their best. putting their lives on the line isn't it? >> you're absolutely right. i thank you for pointing that out. the men and women who are working the line, the men and women fighting the fires are heroes, they truly are. i talked to a deputy who told me a horrific story about finding a dead body and how that affected him. we're going to have many, many stories like that. emotional trauma leads to post traumatic stress and the wounded blue deals with that. some of the country music artists you mentioned travis trit is one of them. tracy morgan. martina mcbride and tanya tucker
