attorney general merrick garland said he would not release that since the co-defendants are still facing prosecution. so expect that a little bit later on. let's bring in constitutional law attorney, former federal prosecutor katie cherkasky. it's not news when a prosecutor says he would have got a conviction. what's your take away from what we just learned? >> that's absolutely right. nothing more than a prosecution on paper. every prosecutor's dream. have you no rebuttal. enough to cross-examination. you don't actually have to prove this case. and, in fact, nothing in it report is particularly new. jack smith had released the superseding indictment. all the facts are there. the american people overwhelmingly voted for president trump knowing all of what he claims would have sustained conviction on unpress dented charges. so quite frankly this is just a partisan effort at lawfare again legal jargon. >> lawrence: he said he had to do this, had to prosecute the former president, now

president-elect because there were other j 6ers prosecuted. he went on to say he had to do this criminally because the political act of impeachment wasn't enough. but the thing that got my attention was number 3. when he talks about when the president said peacefully and patriotically president but he the president said fight, fight, fight, ten times after that. he hinged it on fight, fight, fight. my mind goes to the most iconic moment of the president when he was attempted to be assassinated and he said fight, fight, fight. how does he use that as justification? there is obviously no spoking gun peels of evidence. all subject to interpretation which is exactly the point of the adversarial system exactly confronting the prosecution's evidence with the rebuttal such as what you just mentioned. so, again underlying issue to

prove this case was always going to be to prove the criminal intent of donald trump. that hasn't been established by this report. and i don't think it would have been established in a courtroom with any sort of due process. but certainly i think this is a shame this was released. it is just pure lawfare and serves absolutely no purpose but to undermine americans' competence in the justice system one last time here. >> ainsley: also release dollars was the doj david weiss into hunter biden confirming hunter did make millions using the family name. he writes, quote: as a well educated lawyer and businessman. he choose to not pay 1.4 million in taxes over four year period. mr. biden made this money by using his last name and connections to the secure lucrative business opportunities. what are your thoughts when you read through this? >> well, this report was very strongly rebuked that there was any sort of selective prosecution of hunter biden. there was overwhelming evidence of criminality against him.

i think, again, this has been established through his court proceedings and, of course, the blanket pardon that he received very unprecedented. which mr. weiss also feels was highly unusual and maybe even unfair given the gravity of his criminality here. just as kind of overarching issue. i think that we really need to revisit the legitimacy of releasing these special counsel reports in cases that either were dismissed from courthouses or were never brought. there is a discretionary policy of the doj that allows for this to occur. but i really take issue with it on really both sides of the aisle of it politically. >> steve: katie, i love the fact that they did release -- mr. weiss did release the hunter biden stuff. because essentially he said yeah, hunter biden traded on his name. made a lot of money didn't pay his taxes. we knew that but then he goes after the current president of the united states. joe biden and says essentially he blast joe for the pardon.

and making baseless accusations about his inquiry that threatened the integrity of it the justice system as a whole. you can't have a guy who is the president of the united states in charge of the administration of the department of justice saying yeah, those guys down at doj they are screwing with my kid. not true, he said. >> well, that's actually a good point. and certainly i think joe biden's legacy in large part is just the undermining of the justice system. in total. so it works on both sides. using it to target political enemies and then claiming that any legitimate use of it to go after your criminal son is somehow illegitimate. it's an inversion across the board of the prophecy that we should be respecting here as americans and certainly the president of the united states should be the leader of that this kind of reiterates joe biden's issues with the justice system in total. >> brian: my sense is james comer's book and investigations will proceed once is he out of office. will answer the question where did the money go?

hey, maddy. >> madeleine: good morning, guys. we could see fireworks in this room defense secretary nominee pete hegseth appears before the senate armed services committee in a few hours. don't expect democrats to go easy on hegseth. they are expected to press him on a number of issues including his qualifications, previous comments on diversity in the military and the financial mismanagement and sexual assault allegations against him which he has denied. senate minority leader chuck schumer also sees the confirmation hearings as a chance to hold president-elect trump's nominees' feet to the fire. holding them accountable for trump's agenda. axios schumer told top democrats in a private meeting this month, republicans spent four years attacking the democratic brand and we need to use the hearings to begin returning the favor. several republicans think pete hegseth veteran army national guard served active duty in iraq and afghanistan will ultimately be confirmed. >> i am strongly supporting pete hegseth for a couple reasons.

we have the most highly educated, and powerful military in the history of the planet and we haven't won a war in 80 years. >> so this year 9:30 eastern time. 27 senators on this committee. each of them has seven minutes to ask questions in a first round that's more than three hours of questions and there could be more questions in a second round. other hearings for trump's nominees for the interior department and veterans affairs doug burgum and doug collins perspectively have been postponed. burgum's is delayed because of a paperwork issue with the office of government ethics and collins is delayed because his background check with the fbi hasn't been completed yet. lawrence, steve, ainsley, and brian. >> steve: maddie, it sounds like republicans and trump aides both believe that if nothing new comes out during the confirmation hearings, he will be confirmed, right? >> yeah, they are certainly signaling some confidence

surrounding hegseth's nomination. they are also putting a lot of pressure, republicans, to get trump's nominees approved quickly so that they can get started on the work they say they want and need to do for the american people. now, remember, republicans have a 53 to 47 majority in the senate hegseth is afford to lose three votes in the senate. >> brian: thanks so much, maddy, no one has come out on the republican side and said i'm not going to vote for him. as we mentioned yesterday pete had over 40 meetings before christmas. now he finished with over 50. hirono expect her to meander way through the hearings and attack him aggressively. she would not meet with him. they asked repeatedly. blumenthal did a delay of game they finally eventually did meet. the one who is going to sound off on him is tammy duckworth. she is going to challenge him, go ahead, about women in the combat role. she a wounded vet. pete has described that as that was my view as a war fighter. i worked for the president of the united states and president trump doesn't feel that way.

this is in the santa clara riverbed between the cities of ventura and oxford, california. you can see the helicopters working quickly oxnard the latest update having some success in that. but it's significant, ainsley because it is in this red flag warning area that stretches all the way from that ventura oxnard area down here to malibu and the surrounding palisades area where we have seen so much disruption. this is a problem and we're heading into a day where we expect the wind gust to get up to 70 miles. meanwhile, another problem that officials are having that continues are these drones. the fbi says they are seeing 20 to 30 unauthorized drone operations every single day and that super scoorp hit by that drone the fbi now buying the public for help in finding the operator peculiarity of that drone to pulled that out of the.

hurricane force winds that's the problem the firefighters need to contain that fire here with the wind gusts. upwards of 50, 60, 70 miles per hour. this is the peak wind gust as we go through wednesday. yeah, fairly calm right now. but things will kick up. that is for sure. and a particularly dangerous situation again for some of these areas outlined in the white here, that's where we have particularly dangerous situation. and the ongoing wildfire danger extreme wildfire danger yet again. the same type of setup we saw last week that ignited and spread all of those wildfires and the fire weather danger continues tomorrow. 9 air quality is going to be poor, of course, for the next couple of days and then taking a look at the weather pattern as we get into friday. area of low pressure, that means on shore winds. we're not going to see heavy rain with this but that will help with the winds and the very

this it is one of three that is still standing on their street but they are still terrified to see what they are going back to. altadena resident claire wayble and mark turner join us now. good morning to both of you. >> hi, ainsley. >> ainsley: i'm so sorry to what's happened to y'all. i guess congratulations. what do you say? three houses still standing out of 22 on your street. what do you think saved your house? >> that is great question. nobody knows. there were only three houses a block of three that survived. the fire went around the back so it didn't -- it's not like we didn't have any damage. it tore through the backyard like a flame thrower ripped out the garage and all our memories. all the things we but the in the garage to protect it from the wind storm was destroyed. plus all the vegetation and it did all that all to those three houses and carried down the street and everything else,

including everybody else. >> ainsley: claire, what happened that day? >> it was a long day. we had stayed with two different neighbors that successfully got evacuated. and in a panic, mark said you and may, our 13-year-old got pasadena evacuation center. and i'm going to go and try to check on the house. so, may and i spent the day at the evacuation center. mark went to the house there was no internet no. cell. the only way i heard from mark was he managed to get a satellite sos that he was trying to reach emergency services. saying if we could just have one fire truck here, this there are houses on the road that could be saved. and no one came. that was the only way that i knew that he was okay. friends and neighbors came to help. there was no water. so he took buckets out of the

fool pour on the flames. >> ainsley: my goodness, mark, we watched video you shot of gorgeous houses in your neighborhood now look at them just reduced to rubble. what are your neighbors saying? are they going to move? are they going to sell their property? y'all ended up staying with friends in arizona for better air quality and to prepare for the next santa ana winds, what are your neighbors saying? what's the plan? >> that was the hardest part of all of this was facing our neighbors on the street when we saw. lost everything. some of them are intending to rebuild. some of them have lived in those houses for 50 years. and are unsure whether they should rebuild or leave it to someone tolls rebuild. we really hope they do. altadena is a community. and if the people that made it and we really hope they rebuild. >> we saw some people on the street once wednesday.
