issues of the last four years. that would've been much better use of time. >> in this political theatre that we watched and jennifer was right about how fiery it was, does either side score points? i think the idea is there are three g.o.p. both that can be lost. who is all of this aimed at? i think it's the american public but there has to be three potential votes that all of this theatre had to be aimed at. >> you look at what has come back in terms of his record and i think how does he avail himself today and hearings. he was very polished, very professional, answer the questions. i didn't see that he made a single mistake. the only thing that i see coming out of this is he's going to be

confirmed. i don't see any of the republican senators not voting to confirm because he does have a pretty solid background. so really what you are going to see is a bunch of talking points for tonight's newsreel. >> one of the points he made, i want to get your thoughts on this. today we have a 44 four-star generals and it's starting to feel that our military is unlike anything else. participation trophies. there's something to be said about the leadership but strong leadership is in their. >> if you think about it what we had in 1986... created all these regional combat and command. that's all -- that's wear a lot of the growth comes from. it's created a lack of prioritization. we have all of these different regions that we are trying to resource. we don't have enough resources.

i slimming that down and focusing on a more centralized control would be much better for the united states. >> another issue, our adversaries. the drumbeats are building louder and louder. we know the closer relationship with china, ukraine, russia rather. bringing back accountability and the warrior culture, how important other messages that not just for the american public but to potential adversaries who may have ideas on their minds right now. >> one of the things the president has focused on is this importance of nuclear weapons as a strategic deterrent and his ability to prevent war. the other thing is it really -- you got to it today. it really affects recruiting will me have a military that's not really merit-based and

totally focused on that. it's one of -- the u.s. military is one of the bright spots of our society in terms of integration and it always has been. you are starting to see the recruiting numbers arise because i think we went away from that in the four years of the biden administration. i think it's important for messaging for our adversaries as well. >> i spent a lot of my childhood own army bases. i know what you are talking about. thank you for your service and for sharing your thoughts with us. this thing is highly partisan. where do you said heading, the boats maybe done but there are things that are happening right here right now that will play out later on right? >> if you look at this just as a political exercise, we are actually trying to define a good

secretary of defence so that's really important. if you look at it as a political exercise i do think a number of the points that were covered today would probably resonate with the republicans and the independence who recently elected donald trump president. there was a lot of talk about women in the military. women or about 18% of the u.s. military. the question of standards. there was a particular exchange between pete hegseth and senator tom cotton was a veteran himself. about keeping standards of performance for combat roles. allowing them all to be open to women by keeping the standards at a high level. i think that's the kind of thing that will resonate pretty well with independent voters. my feeling is that with those 53 republicans, unless something big changes, he's on a path to confirmation.

>> he said that women make amazing contributions and he tied it to military standards and readiness which is really critical right now. it does feel like in some ways this was echoed of what we saw during the presidential campaign the one-sided you are mistreating women, the allegations, the baseless allegations in many cases, verses are we actually prepared, how do -- how do you do the job. the line is so amazing isn't it. i thought it would go away at least on the democratic side. they would say that doesn't work right now. americas moving in a different direction. >> i think it was interesting that a lot of the earlier hearing did focus on at least some policy things if you include women in the military. before it got to what you call

character issues with egg seth. as i watched democrats not score points on the policy issues i thought they are going to have to get pretty down and dirty and boy did they. one of the chief down and dirty inquisitors was senator tim kaine of virginia who was hillary clinton's running mate in 2016. it was really rough suggesting that egg seth had done all sorts of things wrong. my guess is it didn't score a lot of points. >> thank you so much, appreciated. the question is will he have the votes. jim banks who was in today's hearing, he's coming up. first to the middle east. fox is live in tel aviv with the very latest.

no kidding in the final week of this administration. david weiss taking to task comments made by president biden after he pardoned his son hunter biden. the special counsel charged hunter biden with gun crimes in delaware and tax crimes in california but those prosecutions now history after president biden issued those pardons for his son. special counsel weiss bit back ... in doing so not have taken the occasion is an opportunity to malign the public servants at the department of justice based solely on fourth -- false accusations. hunter's attorneys saying what is clear is that the investigation and hunter biden is a cautionary tale of the abuse of prosecutorial power. criticizing david weiss. jack smith and his report on president-elect donald trump, release just after midnight. smith resigned as special counsel last friday just a few days after semitic the report to

attorney general merrick garland. they gave the green light at midnight specifically because of a hole from a trump-appointed federal judge. while he never got to take donald trump to trial, the election interference case in d.c., the alleged election interference case in d.c. whatever resulted in a guilty verdict. smith writing the office assessed that the admissible evidence was sufficient to obtain and sustain a conviction at trial. the report was divided two sections. we are only going to see volume one released by this justice department. volume two deals with the classified documents case that also never went to trial but merrick garland, only on the job says a few more days, says he will not release volume two because president-elect trump's two former codefendants are facing active prosecution and they say that would tip the scales of justice and would not be fair to them if that was released.

>> thank you very much. so why now,'s what is he thinking taking from these findings. it's fascinating but there's a cautionary tale here also and i that they had on that. he blasted biden over the pardon. talked about how the president maligned the entire organization. i thought another part of this was the broad coverage of that pardon suggests it's almost a defect owe admission of something illegal happening over a period of time. >> the broader lesson to take away from this is what a disaster the special councils have been. both of them. even though the one in delaware did get two convictions of hunter biden. we shouldn't forget that this special counsel also dragged his feet and left behind some of the more egregious violations because they happen to long ago. never really got to the bottom

of hunter biden, how he brought the money end. there is tantalizing suggestions in the report that hunter was trading on his last name. he was doing work for these foreign companies when he had no skills or nothing to add. instead the special counsel went after tax evasion and the gun charge so with president biden giving out this pardon, he ends up squashing all of the investigation into something that looked much, much worse than what we've seen so far. >> law fair is a term i don't know that most folks in the audience had heard of three or four years ago. i'm wondering if it -- if you think it's a word that can go back in terms of the political it -- politicize asian... it took a hell of a beating the last couple years. do you think we've seen the end of it?

>> we talked about that on your other show what we should really take away and understand about the second prosecution against donald trump. for the first time in our history, the justice department when after a former president and maybe importantly, the major candidate for president of the opposition party. 's had never happened before. that's what we mean. using prosecution to try to influence the election. to try to knock out donald trump if you read the smith report that was just released right after midnight today, you don't come away with any confidence that if this came up again that democrats wouldn't try the same thing. he shows no regret are second-guessing. he thinks he could've prosecuted donald trump if the supreme court hadn't stopped him. that doesn't show someone who's learn the lessons of what a disaster this law fair campaign was. what we are left asking is after

what we're worried about is this evening. the winds will kick up. they are saying maybe 45 mile an hour gusts. that's something to be concerned about. on any normal day if we don't have the fires, we would be fully staffed up ready for the red flag conditions. a big concern is the places that haven't burned. we are ready for deployment here. on this fire, we have everybody in place and pretreated the hills. we're in a good position to handle what happened. >> charles: i know volunteers have come >> all over and other countries. are you okay with all the tools you need right now? >> we do, we have all the tools we need. we have over 5000 firefighters on this fire alone. 540 rigs. 140 dozers and water, we are

fully ready to go. they have been working super hard the last seven days. it's pretty incredible. the other people working hard are putting up the power lines and trying to clear things out and get the grid and infrastructure back together. >> charles: it's been a heroic effort to get people home or what is left of their homes. real quick, we talk on this network and the business channel about ai and technology. we are talking about the wind says that are predictable. as a most mortem, do you think there are ways to figure in on this. i am readying 1800 articles about santa anas taking over. this has been happening since the beginning of time in california. how do you mitigate it next time? >> i think a big thing what we're going to have to do is when we think of rebuilding, you build so you really build within

the confines of mother nature. that's building materials, different watering systems. the different technology that safeguards your house. i remember they really learned a lot about bracing for earthquakes and we have done a great job where buildings roll with the earth as opposed to be rigid where they collapse. as they grow and keep moving, if people want to live in the urban wildlife interfaces, they have to think about how they rebuild in those areas. >> charles: captain, anything else you want to say? >> just thank you for the outpouring of support. the human spirit is just incredible. we feel the love. there's tired crews out here. we have been going for seven days straight. they feel the love and it's

really appreciated. >> charles: containment, we're talking about the unpredictability about the winds. if we get lucky, we can wind this thing down soon? >> that's what i see. if that wind cooperates. if it doesn't, it may push us back a couple days. that will put in extra work as we work on the fire front. you see the last two days the wind lied down and we put in incredible work where we put the containment up as well as the eaton fire. yeah, it's going to come, we're good at this part. we're really good making sure we get our arms around it and it's coming. >> charles: evacuations, is everyone evacuated where they need to evacuate or are there areas where people should be getting out? >> yeah, right now, everybody is in a good position. we will watch the wins tonight. in the evacuation orders come up, i feel southern california is on alert, especially those in
