♪ steve all right. it is 7:00 here on the couch in new york city. it is wednesday, january 15th, 23 degrees outside. let's stay inside for the next two hours. welcome to "fox & friends" today ratcliffe, bondi and rubio all face the senate in today's confirmation hearings at 9:30. after hegseth performance scored a key endorsement from johnny enns of iowa. that is critical. senator tom cotton was in that hearing room and he joins us? about 12 minutes. >> brian: plus biden's last dance what he will say in tonight's farewell address, i know, and his latest move that is leaving republicans speechless. >> ainsley: california teenagers losing their homes and schools to fires but refusing to miss

out on the high school experience their fight to continue in person education. >> lawrence: the second hour of "fox & friends" starts right now. we start this hour with a fox news alert. a new red flag warning has been issued in los angeles as dangerous winds are expected to pick up and fuel the four active wildfires that as you can see on your screen are still ablaze. >> this comes after fox news cameras captured the moment that crews discovered human remains and a burned down house in malibu and griff jenkins is live outside of that property right now. griff? >> griff: good morning, guys. the official death toll stands at 24 but that could soon rise as this case is still under investigation. we'll show you behind me. this is being treated like a crime scene. you can see the police tape and the l.a. county sheriff's deputies cordoning this area off.

a grim discovery. we were out here yesterday. take a look at this footage, the california urban search and rescue team dog through the charred rubble for hours accompanied by the cadaver dogs and the mexican army who specialize, particularly in the search and rescue. they were digging through here and made a discovery of human remains. we were talking with california fire folks who were out here about how difficult this task is. here's a little bit of what they told us. listen. >> we are here with the international team from mexico. and task force three. we are validating that everybody evacuated in this section as you can see there is a lot of stretchers that have been destroyed. we are working throughout this whole area very detailed. >> and we believe the remains belong to an elderly woman. after we contacted the homeowner

she told us the tragic story the homeowner said an elderly woman was a tenant living with her in the residence. and that when they got the evacuation order to leave, the elderly woman refused to go. 30 minutes after the homeowner departed here, she learned her house had been engulfed in flames. just one of the many tragic stories out here. it was fascinating to see these dogs work. they are so trained. the handler telling us they are trained on ash, meaning they can go through this charred rubble and actually still detect if human remains are present on a site. finally, let me just say that we are not out of the woods that's the message from the officials because of that pds red flag warning. expecting these winds may pick up with those two fires particularly in this area the palisades fire and the eaton fire still only contained at 18% and 35% respectively. guys? >> steve: hey, griff. i'm looking at the "l.a. times" this morning. you know, we have heard in the

last week or so stories about how, you know, one the reservoirs was empty and they had trouble. there was no water in the hydrants at certain points. and now the "l.a. times" has a story a little bit about how l.a. fire officials could have put more engines into the palisades fire before the fire broke out but they didn't. they could have said to people okay, you got to work a little longer but they said we're not going to do that. obviously, in the after action report, that's going to be one of those things where it's like why didn't you do it? >> griff: well in that after action report is certainly everything that the firefighters i'm talking to off camera about. and, you know, it's interesting, steve, you ask that. and there is going to be a lot of accounting specifically about that and the resources. notwithstanding that they are short on resources because of previous budget cuts. that's another frustration with the fire union. but, specifically, with how this happened. remember, the eaton fire in altadena and the palisades fire

in malibu and pacific palisades are areas that are not far from each other and so this spread so fast, so big because ever the unprecedented 100 mile-per-hour winds that resources went to various different locations and the response is certainly going to be picked over for a long time coming. and there will be continued answered. we got another press conference every day they have been holding a press conference at 8:00 a.m. local time. we will see if they get any more answers on that today, steve? >> steve: thank you, sir. >> lawrence: real quickly, griff. has there been any response from the residents there with kamala harris' speech that she gave asking people to be patient essentially after that word salad? >> griff: i haven't talked to any residents about that specifically. but, there is certainly a lot of frustration among the residents the more they learn about not only harris but also, obviously, with the mayor, karen bass.

a lot of scrutiny coming on her. and the fact that as we all now know, she was in guana at the time that really the evacuation orders were going out, according to the "l.a. times." she was at embassy cocktail party literally at the time that the palisades area got the evacuation orders to come. >> brian: pictures have emerged proving that, griff. it's no longer antidotal pictures out there. >> lawrence: she promised when she ran that she wasn't going to do out of lawrence. >> steve: she wasn't going to leave the country. >> lawrence: she obviously didn't do that also, i think it's interesting that kamala harris, when things were happening in florida, she wanted to insert herself. even though ron desantis was talking to the president, she wanted to insert herself in the conflict. now she is from california. and now that she is not running for president, she is doing zero to help these people. >> brian: i know. >> lawrence: she is not on the ground. this could be a leadership moment for her. >> brian: no one blames her. one of those things everything

plus, kamala harris is here today. malibu today. oh she is at this fire. she is at the firehouse. wow, isn't that interesting because she does want to be governor according to sources. this would be a chance to show what shield be like. >> steve: she should stay out of the way because the people on the ground have already got things under control. it's too late for people from washington. >> brian: steve, to have a vice president on the ground to be able to call president biden to say this is the area needed mostly, stop saying no to new york firefighters. they volunteered before, get them out there. i would think you could really assert yourself if that's within you. >> ainsley: now that want to recall gavin newsom and donald trump says is he going to go within the next week or so to the fire. check in with our senior meteorologist janice dean tracking all the winds out there. janice? >> janice: another day where we could get wind gusts that could hamper efforts. take a look at the wind gusts yesterday, 47 miles per hour image mountain and winds exceeding 60 miles per hour. that's exactly the set-up that

we will see today, particularly dangerous situation until 3:00 p.m. local time. and winds in excess of 40, 50, even 60 miles per hour in some of the areas that are affected by the wildfires. still burning out-of-control. the eaton and the palisades, they really have not gotten a handle on this and that's not going to help with those winds in the forecast. so, today we have got elevated critical danger and then tomorrow an elevated risk for southern california and then the smoke as well. we haven't talked about that but the smoke is going be lingering in this area for many days, many weeks. and the forecast, you know, that's a beautiful looking forecast but, unfortunately, no rain at all in the foreseeable future. so, if you get that set up, again, which might happen next week, of high pressure anchored across the great basin the santa ana winds winds are going to i can can up. time is of the essence right now. i just want to point out one other dangerous situation that's going to be unfolding this weekend and next week. the coldest air since last winter, maybe the coldest air in decades going to invades much of

throwing outrageous accusations your way. >> brian: senator markwayne mullins kaine went from virginia really so you are talking about drinking should disqualify you and problems with marriage should disqualify you or divorces. how many of you guys showed up drunk to vote? >> lawrence: so true. >> brian: you got divorced or cheated on your wife you should resign immediately? so everybody just was silent. you know, i haven't been perfect either just another quick note, i think when it comes to marco rubio, they are going to try to say, you're different from trump on foreign molly. they are going to try this say this is your foreign policy which is like ours. but trump is over here. what are you going to do? that's how they are going to try to create. >> ainsley: mullin also said -- senator mullin after he asked about the drinking, how many of y'all have showed up and had drinks before you came back for a vote he? goes, you know, all of you have, basically. he said how many of y'all have cheated on your wife?

with things like this. it has been the privilege of my life to serve this nation for over 50 years. nowhere else on earth could a kid with a stutter from modest beginning from scranton, pennsylvania and delaware sit behind the oval office desk as president of the united states. that desk is where president biden is going to leave a letter for president trump on monday morning if he sticks to tradition. that desk is also where president biden has been very busy trying to exercise every last ounce of presidential power while he has still got it. look at just the last month and a half or. so he pardoned hunter. he commuted some death row sentences. he gave medals of freedom to hillary clinton and george soros. he banned new offshore drilling. he transferred prisoners out of guantanamo bay. gave ukraine 500 million more taxpayer dollars. and added -- and rather took cuba off the list of state sponsors of terror. and last night president biden was designating some monuments

in california and he was talking about how he thinks he has executed over the last four years the most ambitious climate agenda in the history of the world. and maybe some day historians will agree with him on that. but for the time being, that seems to be a very, very small part of his legacy. back to you. >> steve: one other part of his legacy, peter, it was not on that screen that we just showed. when is he going to announce the last batch of pardons? is that going to be like one minute before noon on monday? >> peter: it could be because all the networks have to take the speech live over on the east steps of the capitol. we expect that to happen some time over the weekend. they advise that he is going to go south carolina on sunday, which is kind of a surprise. we don't know what he is going to be doing down there. but his last day as president, last day with the keys and the drew air force one go down to south carolina for a while. and so it could happen at some point over the weekend or on

monday morning. >> brian: hey, peter, i'm not sure if this would come across anywhere. i have been reading it. is there now a new system in place to find out what documents he can take to put in his garage and what he can't? is there new systems because of what happened last time in 2020 when you have interns grab box and put them on the chopper? >> peter: i a lot of that going through the national security council and getting farewell emails of people's contact information. a lot of phonings from the national security council have already left the building. so the folks that are going to stay that are part of the permanent apparatus would be the ones who are in there probably right now with some of the moving truck that's might have seen in the background over the last couple days. and they are saying okay, you can take this. >> brian: good. >> peter: these have to be screened. these can go to the future biden senator at the university of delaware. this is the batch that can go next to the corvette. it needs an oil change by the way. >> brian: i hope so.

senator tom cotton will be among those questioning mr. ratcliffe after attending pete hegseth's hearing yesterday and joins you live. good morning to you, senator. >> good morning, steve. >> steve: let's talk a little bit about john ratcliffe for cia director. is he not going to have trouble. he has been confirmed before. >> i don't think so. as chairman of the intelligence committee i will reside over the hearing this morning. director of national intelligence. he and i agree that the cia is vintle for our country but we have to get it back to its roots. simply not doing good enough job about our adversaries around the world. for instance, i don't think anyone in washington anticipated that jihad rebels were going to rampage across syria and topple the assad tyranny over thanksgiving. that's the kind of failure we need address. we needed cia focused on its core mission, not focused on things like climate change. or whether african country is going to pass gay rights legislation. i'm confident that john is going

to focus on that job and get it done. >> steve: one of your colleagues, marco rubio, is going to be up for his confirmation hearing today. what sort of speed bumps do you think the democrats are going to try to throw up in front of the senator from florida? >> well, i think marco will do a great job not just at this hearing but implementing president trump's foreign policy. i suspect the democrats will focus on some of their past differences they did after all run against each other in 2016. but, there is precedent for that barack obama and hillary clinton had a pretty tough race against each other in 2008 and she went to work for barack obama. but i think what marco will lay out today is president trump's plan to put america first, to make sure that we are advancing the interest of our own citizen and our own economy not -- not those of other countries. we wish every country well. but we obviously have to put our own citizens first. i suspect that's what marco is going to outline today in his hearing. >> so that is all today.

yesterday as we look in the rear view mirror, you were actually one of the people who he queried pete hegseth, one of our leagues from fox, formerly. and you asked him about his qualifications and whatnot. after your line of questioning, i'm sure you remember this, the senator from the great state of new york, senator gillibrand, said yeah, by the way, tom cotton, those questions were too easy. watch this. >> so specific to senator cotton's questions. because senator cotton was giving you lay-ups to differentiate between different types of combat. and, specifically, as secretary, would you take any action to reinstitute the combat arms exclusion for female service members? >> i have never disparaged women serving in the military. i respecter every single service female member that has put on the uniform. >> steve: how dare you ask those easy layup questions, senator. >> well, steve, what i think senator gillibrand is upset

about was i was distinguishing carefully in an area where people often get confused. when i talk about women in combat. that's too broad. women have been in combat many years as pilots or mechanics or what have you. we are talking about specifically women in ground combat jobs like the infantry, the artillery, special forces, those are irreducible physical demands. there is nothing that pete hegseth or kirsten gillibrand and i can do to make a artillery shell way less than 100 pounds or tank round less than 50 pounds. shoulder full combat load 250 to 300 pounds. we have to have high and gender neutral standards to ensure that our troops are going to be safe and fit to fight. but the democrats would rather impose quotas or goals to make sure we have an arbitrary number of women or other ideals in our infantry or artillery or special forces as opposed to focusing on fighting effectiveness. that's what i laid out.

that's what pete hegseth will do as secretary of defense. i thought he did a great job. i know you are proud of him as a former colleague and friend. i commend him for a great job. >> steve: indeed. exit question, are you surprised at how it looks like all these nominees are going to be confirmed. and for the most part, there aren't any real road blocks in their way. >> no, steve. i'm not, i mean, we do, after all have 53 seat majority in the senate. and if you want to take a little trip down memory lane, going back to the clinton transition for 72 cabinet secretary nominees, only two of them -- only two out of 72 have gotten a single vote against them by a senator from the president's party. and none of have them have been defeated because the votes by senators from the president's party. the past is not always prologue. i would say that's a pretty strong track throord dispels this idea that republican senators are supposed to be voting against the republican

palisades charter high school on the search for a new campus for 3,000 students after being burned by the blaze. many of those including our next guest also lost their home and are now fighting to keep in person learning. palisades charter high school student body president carley spicer joins us now. charlie, thanks so much for getting up this morning. >> thank you so much. good morning. >> lawrence: i mean, most kids, you know, would be mourning, you know, the fire but not be trying to get back to school. why are you different? >> you know, we started our high school experience during covid so that was online really didn't work well for anyone. students or teachers. so we're really just trying to get our community back together and pally dolphins as we like to say back together in one roof in person sports and learning together again. >> lawrence: charlie, are you guys looking to find a temporary location because i think your school was completely destroyed,

right? >> yeah so our school wasn't completely destroyed. the front main building was made out of bring so luck will you that is still standing. we have bungalows in the back made out of wood completely torched to the ground and parts of the field. we are looking for a temporary location. somewhere in l.a. we are reaching out to anyone we can whether that's old office buildings, warehouse spaces. really anywhere we do have a very large student body of 3,000 students from. over 100 different in l.a. close knit community definitely affected but there is still a handful of students throughout los angeles that also current little can't go school. we really want to get back to in person with everyone. >> lawrence: charlie, you are the inbody president. they trust you. what's the general mood for the students there. i know some of them their homes were destroyed. and they have no place to go right now. they are probably living in a hotel or shelter?
