beco another big story breaking today: president-elect trump says the future of tiktok is now in his hands. saying "the supreme court decision was expected, and everyone must respect it. my decision on tiktok will be made in the not-too-distant future, but i must have time to review the situation," telling us "stayton." saying that the apps ties to china post significant security risk, outweighing concerns for free speech for tiktok and its 170 million u.s. users. there are a lot of lingering questions about how the ban would work in the practice because there is no precedent for the government blocking a major social media platform. joining us to make sense of it all, chief legal correspondent and acre of fox news sunday shannon bream. >> you know that the court is

deferential to the legislative branch and they think they've gotten this right -- let me read from the opinion. it is not signed by any author. it's a procuring opinion, meaning the court speaks with one voice. acknowledging 170 million americans who use this, saying "congress has determined that divestiture is necessary to support its well supported national security concerns regarding tiktok's data collection practices and relationship with a foreign adversary." much of the arguments are if it's a first amendment issue. people run their businesses and make political payments on this app. it does not seem like the justices bought that. hears something from justice gorsuch. he wrote i concur so he agrees with where they got to this. "speaking with and in favor of a foreign adversary is one thing, but allowing a foreign adversary to spy on americans is another." the justice department is out with a statement saying "the law stands. it will be up to the up

limitation in the weeks to come," which is where president-elect comes in. he has been all over the place on tiktok. it sound like he wants to save it now. there is a provision in the law which would let him do that, at least for 90 days, if there is significant progress on a divestiture deal. can he make the argument? we will see if he does. >> shannon, thank you. for those of us '80s kids who wore the "save harris" shirts, now it's tiktok influencers. thank you so much. todd, there's no first amendment issues because it is owned by a a national -- a united states company like mr. wonderful buys tiktok, and divests, to her points, the company itself. do you see that happening, and do you see this question repeating its pattern as other foreign nationals create apps that the kids all use? >> potentially. in order for there to be an

issue with those apps, there needs to be an issue with the approach that the supreme court took. let me just read one key line. "efficiently tailor the law congress enacted to address the governments interest in preventing a foreign adversary from collecting fast swallows of data." beside the first amendment concerns. at the end of the day, that's not at issue. it comes down to is this company stealing data? the government said potentially, that's why we will enact this law. at the end of the day they say they think the law is legal. with the supreme court decides is is a law legal. i know it's on simplified, but that's what the supreme court does. here's where the rub comes in. chinese law prohibits the selling of the algorithm of tiktok. now, we have an american law that the supreme court sided with that says "you need to sell." something has to give.

my guest tells me that even though the inauguration is now indoors, the ceo of tiktok will be there. he and trump are going to go over this at some point in the next 72-96 hours. >> here is my question, and i have the luxury of sitting here where my small business is dependent on tiktok to gain new users and i haven't grown up with it, feeling that my social value is tied to it because i don't have that with apps to begin with, but i don't understand why the dependency on a chinese app is taken as a given. white people, notwithstanding that -- fighting harder to produce a u.s.-made alternative to tell these kids "guess what? we are going to distract and redirect. here is the next carrots." the kids don't care. they will do what you tell them to do. for the businesses, provide an alternative so they don't miss a ccp app. >> i might be the only gen zer who is not on tiktok so i won't miss it when it's gone, and i think it's a goner at this point. instagram reels is another

situation. don't take away my instagram rails. but, i understand the concerns. a lot of kids are upset because they have made a living off of this. it's the new form of social currency. however, that in and of itself is a bit of a concern to me that you have become so dependent on a chinese communist party controlled app for your mental well-being. may become a wish to take a larger look at how social media is affecting our youth. todd is right. this ultimately was never a first amendment issue. you listen to the oral arguments about this case before the supreme court a few weeks ago. it is telling that every single justice on the bench, left and right, agreed that it was not a first amendment issue. no one is arguing you can or cannot say something on tiktok. the question has always been whether the chinese communist party has the right to collect the data of american citizens and use that for whoever knows what kind of purposes. >> and you contrast that with the fact that the ccp doesn't let our apps within china --

>> well, a group of progressive staffers on capitol hill are pushing their boxes for a 32 hour workweek without reducing their pay. the congressional progressive stat association wrote a letter on thursday to house and senate leaders asking the members of congress adopt a shorter work schedule. according to the letter, congressional staffers based in d.c. would reduce their hours when members are in the home districts, but would work a standard 40 hour workweek when congress is in session. however, staffers and the district offices would follow a lighter schedule when members are in d.c. the staffers claim that working fewer hours would reduce burnout, improve worker satisfaction, all while maintaining or increasing the level of productivity. i call this utter crap.
