of the u.s. border patrol agent shot and killed during a traffic stop yesterday. the shooting happened in vermont about 12 miles south of the canadian border. molly line has the latest from that spot. hi, molly. >> good morning, dana. this border patrol agent that was shot and killed in the line of duty has been identified by sources as david mi will, land. killed at 44 years old. experienced agent that was here serving on the northern border. the shooting happened at a quarter past 3:00 on a section of interstate 91 that runs through coventry, vermont. the f.b.i. is calling an alleged assault of a federal officer. albany reports one u.s. agent was killed along with one subject and another subject injured is now in custody. the deadly incident happened in the sector of vermont, new york

and new hampshire, 295 miles of the international border boundary with canada. last year they apprehended more than 19,000 subjects from 97 different countries. since october 2023, it's more than a 17 fiscal years combined. the acting secretary of homeland security wrote every single day our border patrol agents put themselves in harm's way so americans in the homeland are safe and secure. my prayers and deepest condolences are with his family and loved ones. the last time an agent was killed in 2020. we came here in october to highlight the challenges and dangers that border patrol agents face on the northern border and our deepest condolences to everyone who lost this agent. >> bill: tough news there. back in d.c. trump team

no surprise here marco rubio getting confirmed by a unanimous senate vote. every democrat and republican voting to confirm him. last evening he told us he was honored and about to be sworn in by vice president jd vance any moment here. he is expected to address the entire staff at the state department later on today getting right back to work. and one of the first things and priorities he will have is to help president trump end the many conflicts around the world including russia's war on ukraine. >> it will be the official policy of the united states that the war has to end and we'll do everything possible to bring that about in a way that is stable and sustainable. >> last night trump's dhs nominee kristi noem had a vote out of committee. defense pick pete hegseth favorably voted out of committee but this was a party line vote

and still some republicans that are undecided. susan collins is not sure yet about pete hegseth. sounds like they will have the 50 they need. while it is possible we could see a confirmation vote for him this weeks the democrats could try to the delay this whole thing. russell vought and john ratcliffe favorably reported out of committee. ratcliffe has democratic support. smooth sailing for him. congress woman stefanik has her hearing for u.n. ambassador. widespread bipartisan support because of her support for israel and we're watching these three very closely. tulsi gabbard, rfk junior and kash pat el. most controversial picks. their hearings haven't even been scheduled yet. we're working to find out what will happen possibly later on this month for rfk jr. >> bill: how comfortable are your shoes? >> we are used to this level.

>> dana: thank you. jd vance is about to swear in marco rubio to be secretary of state. >> thank you guys for being here. a great occasion, i will say it's pretty hard to top being sworn in as vice president and the buckeyes won the national championship the same day. a hell of a start to a run because marco is one of my favorite people in washington. and, you know, he is a son of cuban immigrants to this country. grew up in very humble beginnings but has a deep love of our nation. he is a bipartisan solutions seeker, a guy who can actually get things done but a conservative of great principle and great vision. i think more than almost any body i've met in washington, senator rubio understands the priorities of president trump and why it represents such a significant and frankly important and needed departure from a generation of failed

foreign policy. senator rubio will be the chief diplomat of the united states of america. but he will remain a friend. i'm proud to know him and proud to do this. senator rubio, thank you. guess. but first i want to thank jeanette, my wife, who has been so supportive as the vice president knows well it is impossible to do any of these jobs we do including the senate but now in this new role without the support of our family and particularly of our spouses. thank you for being supportive every step of the way. i would not stand here before you today without that. i'm thrilled and grateful that all four of my children are here. the most important legacy any of us will leave behind and most important job i will have is father and husband and honored they were able to joins, amanda, daniella, anthony and dominic. i'm happy you can see this today and thank my colleague senator rich and his wife joining us. he managed the committee that brought us to this point but also one of my closest friends in my time in the u.s. senate. we by reason of chance we wound up basically being first and

second behind one another on seniority in every committee. we sat next to each other on the floor. people thought it was a plot. not by design but it is one of the most special relationships i have established. an honor to the with the vice president. someone i knew and admired and relied on for policy ideas before he was elected to the senate. i can't think of a better voice for the world and president's policies. as far as the task ahead, president trump was elected to keep promises and he will keep those. his primary promise to foreign policy the priority of the united states department of state will be the united states. it will be furthering the national interest of this country. he has given us a clear mandate. president trump made it very clear everything we do, this is true in government but especially at the department of state, everything we do must be justified by the answer to one of three questions, does it make us stronger, does it make us

saver and does it make us more prosperous. that's the promise he was elected to keep and the promise he will keep and we'll help him keep. a transformational moment. the united states, i think, is now as president trump pointed out last night and i believe deeply headed into a new era that i think will make the world a safer place. we have a president who made clear yesterday in his speech that one of the primary goals of american foreign policy is the promotion of peace. of course peace through strength, peace and always without abandoning our values, but i think it's extraordinary that it is something that needs to be said and hasn't been said enough in recent memory and we look forward to being a key part of helping the president achieve his agenda that he has a clear mandate to keep. if i may take the liberty for just 15 seconds to say something in spanish because i know a lot of people back home are very proud and i want to make sure i acknowledge that.

disastrous immigration policies coming out of the biden administration. i found out last wednesday night that the governor was going to appoint me to the senate. and so regardless of ledge is particulars my entire family is here and living out of hotels and suitcases but i cannot tell you how excited i am not just with the executive orders coming out yesterday from, you know, sending military troops to the border, canceling the cbp one app, remain in mexico. these are all things. >> dana: let me play a little bit of president trump. this is on the national emergency at the border. >> president trump: first, i will declare a national emergency at our southern border. [applause] all illegal entry will immediately be halted and we will begin the process of returning millions and millions of criminal aliens back to the places from which they came.

>> dana: senator, our most recent fox news poll shows immigration and deportation were at the top of the list for priorities along with the economy and jobs. from your experience, what practical applications can the actions that president trump took yesterday have for attorneys general across the state or local communities that want to work with the federal government. >> one of the first things that biden did -- this is one of the reasons i don't say this lightly, he really became a trafficker in chief. one of the first things he did was tell local law enforcement officials to start releasing people who had been arrested on serious felonies here illegally back into the community. this reversed precedent under democrat and republican administrations. it was one of the first suits that we brought and it was frustrating because the courts told us states you don't have standing to sue. you can't sue. so we have an administration that dropped the ball, just let people into our country,

because most of supported people being held accountable. it was a terrible today. the justice department unleashed one of its top lawyers a shock and awe campaign and scooped up hundreds of people and often demanded really excessive sentences in my view. most of these people were charged with trespass or unlawful entry. most of them were not violent. the government tended to oppose bail. they kept a number of them for a very long time in segregation. some cases they demanded limitations on what people could say or read or associate after they were released. all of this tended to undermine their case. so when the president campaigned on this issue, i think a lot of people wanted to see this chapter closed and he certainly did that. this was broader than most people expected or even asked
