another hour of fox news live. all right from sending troopings to the border to allowing i.c.e. raids in u.s. cities. he's taking steps to fulfill one of his biggest promises to the american people. madeleine rivera is in washington with the details for us. hi again madeleine. reporter: good morning jackie that's right trump's illegal immigration crackdown isn't just focused on southern border. this week i.c.e. agents arrested hundreds of migrants in cities across the country including massachusetts, new york, utah, and california. the white house called it a detainees rather criminals. >> we know we've deported gang members we know we've deported predators murderers and rapists. i think we can all agree we don't want those types of people in our communities. reporter: fox news poll shows roughly 30% of supporters deportation of those in the country illegally and 60% support the removal of those accused of crimes but a mayor in new jersey is calling recent i.c.e. raid in the city of

newark unconstitutional. he says i.c.e. agents went into a business without a warrant arrested three people whom agents said were in the country illegally detained u.s. citizens. >> one person showed that military veteran and still questioned anyway. people were finger fingerprinted face were taken there.s ids and when i got this information, i was appalled. upset, angry, that this would happen here in this state in this country. that this will be allowed. reporter: meantime military activity ramping up at the southern border and 1500 army personnel and marines have been floyd and focus on things like placing physical barriers and monitoring activities. the military is also been assisting with deportation flights, state department spokesperson tammy bruce says guatemala received four flights

arrived in mexico yesterdays. jackie back to you. jackie: thank you so much. the big question is this type of thanks my next guest has been hoping to see victor is the mayor of texas hit so hard by illegal immigration. he joins me now. president trump promised that he's going solve the problem. he's trying to do it and he's moving very swiftly. have you like what had you've seen so far? is it making differences in the communities surrounding your area? >> thank you very much for having me. yes. we believe in the border security. now, not every border the same all cities across the southern border different laredo is largest port of entry to the united states and the commercial side so we have different challenges. but we all have challenges and we all agree that we need to have more secure borders. and as a doctor, i also will have focus on what we need to do with cartels and the legal crossing of fentanyl which has

affected americans tremendously. jackie: absolutely. mayor by the laken riley act that will head to the president's desk is that, deporting or detaining illegal immigrants that are accused of theft and violent crimes it violates undermines due process and is a threat to public safety. but there are americans in this country that would argue because of what happened to laken riley for example, that just surviving in this environment their due process their civil liberties with about their public safety is threatened. why do you have people on the other side of the aisle that are saying -- we shouldn't be doing this. >> we have to understand that we need to do a great overhaul to our immigration laws and systems. because we're a country of loss. we have to follow the laws but this is a delicate situation,

but we must see that illegal immigration and the costs that are being as a result of this illegal immigration have to be addressed and we have to look at it at a very, very different point of view. so the overhaul is long already. jackie: it is difficult to do and the president is in a challenging position because he's not going to get support from congress. we saw the kind of bill they want to pass through they baskly wanted to memorialize illegal immigration, you know, by adding allowing millions of more people into the country every year that's not necessarily the solution. think both sides are saying we need immigration reform. but they just don't see eye to eye regarding what that looks like. >> yes. these are challenges they have to be discussed. but we need to know how and where to put most of the resources like i said not all of the cities are the same. i have meetings with south texas alliance of mayors, with we meet

and discuss about the situations. because we live here it's not only a concept to us. it is what we live here prefer day. so our perspective, our point of view is something that the governor needs to look at because we have the direct experience on what goes on here. jackie: absolutely i'm so glad you brought up the fentanyl issue the president trying to tackle that for american citizens we will continue to check in with you. and see how it's going in laredo thank you so much mayor trevino. >> thank you for having me. >> from the border action to legal action president trump is planning to appeal after a federal judge blocked his executive order ending birthright citizenship. former federal prosecutor and constitutional law attorney katy on where this is all heading i'm wondering what you think of what the court said. but also the fact the president plans to appeal, and because he's not necessarily doing some of this through congress and there'll be executive orders are

we going to expect nor court battles to come? >> well, the reality is that there is not direct supreme court precedent on whether the children of people who are unlawfully in the united states are automatically citizens. now, the federal government in the governments at large have essentially recognized that as the case for many years. but the supreme court has not explicitly weighed in on that particular xerpation birthright citizenship but whether that alives -- applying to a citizen or lawful permanent resident that is what the executive argument targets and that will continue and ultimately reach the supreme court which i think with president trump's goal with pursuing this. jackie: absolutely, and how long do you think it will take for that process to play out? >> it is hard to say exactly the timelines on here. , obviously, these injunctions have been issued because in the meantime if this law or the

executive order were to go into effect any children born after that point would not be recognized as citizens as the petitioners pointed out that could cause harm because people who are here in this country to unlawful parents or undocumented parents would potentially not have any sort of citizenship because there's certain countries that don't recognize children born outside of their borders. in another country -- so there is a significant concern about clarifying the status of children born. so that litigation needs to be pursued in the lower courts and will work its way through the appellate courts ultimately up to the supreme court and, of course, the supreme court has ruled on this issue really over 120 years ago or so actually directly. but since then has not directly tackled this. jackie: it will get to the supreme court but, of course, there's also the court of public opinion. many people feel that this is practice that has been implemented we've been using it and it would be unfair to turn

the tide but you also had 76 million americans saying they want immigration reform and things to change in the country. and they were fed up with what happened over the course of the last four years under the biden administration. so how do you think that public about courtroom drama is going to play out? >> well i don't think it is any secret that there has been significant exploitation of the birthright citizenship. by people coming here through birth tourism and coming here just for the explicit purpose of violating immigration laws with ultimate goal of getting big reward citizenship of their children ultimately by extension many people have then received citizenship on their own and you can't blame people for wanting to pursue that and it is beneficial to be a united states citizen. but big picture here, i think we have to realize what this has opened up the country to whether this is feasible and sustainable and whether the 14th amendment requires that interpretation,

the supreme court case that's been referenced is lawful permanent residents and president trump current order allows residents to be recognized as american citizens. jackie: okay. well i have a feeling katy we're going to be talking to you more as this plays out thank you so much for that insight and expertise. great to see you. >> some democrats want to work with voting for laken riley act that president trump is preparing to sign into law massachusetts congressman jake joins me now congressman it is great to have you on the program. you voted no on the laken riley act but you're also calling for rule of law at the border. so those two things seem a little contradictly i want to give you an experience to explain. >> thanks for having me on and giving me the opportunity they're not contradictory because the core value of america is freedom. and freedom means that when the

power of the state is brought against you saying that you did something, you are innocent until proven guilty and you have the freedom to prove that innocence. and what the laken riley act does is it deprives that freedom from people by violating due process, and arrest is not a conviction. the crimes that are laid out in that bill are already crimes that are deportable as they should be. and so as a democrat who believes in freedom and rule of law i voted against the laken riley act, however, my question really for my colleagues on the other side of the aisle is why did they vote for it? because the other element of laken riley as you know jackie, is it gives standing to state attorneys general to sue the trump administration over differences in immigration policy without having to prove that they're an injured party. that means that every attorney general throughout the country now can sue the trump administration over every perceive difference in immigration policy get a sympathetic federal judge to issue an injunction.

and gum up the works so this is actually a bill that i think is going to boom rang on trump administration i think republicans will regret voting for it. >> how if you have the opportunity would you have changed it to make a yes for you? >> well two things. first, make it a conviction not an arrest so that we respect due process and -- undergird value of freedom from the country and second get rid just to gum up works of federal immigration policy but more broadly, i want to actually engage in more comprehensive bipartisan immigration reform, for example, the dignity act. which is bipartisan, and which would help seal up the border change the asylum stands create a process for those who built lives to pay back taxes and to fund worker training initiatives as well as providing aid to central american krnghtses for crime and for poverty to help stem the tide of migration or

resuscitate bipartisan border bill that i was supportive of last congress that was toughest board security measure in 35 years and that frankly donald trump torpedoed because he wanted to campaign on the issue. jackie: i'm not sure he did that congressman i think one of the issues that i brought up earlier with the mayor from laredo the notion that they wanted to memorialize illegal immigration we have to find a way to find a balance it is not necessarily going to be by letting more people into the country legally that we can't process and we can't have here. so how do -- sort of answer that argument in that questions? >> well you say that we can't let more into the country and process here that's -- not true. we have a very tight labor market pep and then we have programs in place uniting for ukraine is an example where migrants were coming here with housing and employment already guaranteed. we're integrating into their communities and i saw the people throughout the tours of the district ukrainians afghans in particular working in jobs,

paying taxes building lives, starting family here is in the united states. with housing and with employment already taking care of first week in office trump tore up programs those were examples of immigration -- >> i'm not sure which migrants you're talking about illegal migrants come over the southern border did not come here with housing and work plans in place. i lived here in new york city a sanctuary city with many of the folks we're paying for them we're supporting them giving them health care, food, housing other rights that are setses in our city. are not getting as a result of it and they don't even have access to working papers that's been a huge debate should we let them work, or should they not be working because they're not actually here legally. >> you're conflating two different issues here one is the programs i'm talking about. uniting for ukraine is an example. where we had people from war torn countries ukraine and afghanistan come here with housing guaranteed working -- >> i'm not conflating issues i'm talking about a different group

of migrants than you are. >> then we have a group of migrants 5 million or so without documentation and some of those individuals if they are committing crimes they are threats to public safety they're out of here. and i strongly support deportation programs for criminals or for people who are committing crimes of moral turpitude we have a moral triage of that i.c.e. has to triage as tom homan says worst first nobody i think is debating that. i think that includes by the way, and i want ton to be clear about this sanctuary welcoming cities. i was a cosponsor of a welcoming city ordinance i can tell you first hand there's nothing in the ordinances that prevents federal i.c.e. officials from deporting criminals. nothing. jackie: this is a larger conversation -- it is going to play out over time we look forward to having you back to discuss it further. >> take care thanks for having me on. jackie: sure. pete hegseth squeezed by kristi noem she's next city expected to vote on dhs secretary nominee

national security team after defense secretary now pete hegseth was approved last night and we know how important noem's confirmation is giving questions about fema and our border even tsa and screening at airports i think democrats are in alliance here that ones that want to support her are ready to get this done because how essential a dhs secretary in place is. >> still pretty long list to get through next week as well as we look ahead so bessent and duffy robert f. kennedy jr. on wednesday that one is probably going to be a little controversial. are you expecting that there will be fireworks there? >> yeah. i'm expecting some fireworks i do think that if i predict at the end of the day i think rfk jr. will get through, and i lean on the fact that he has sovereigned a bit on vaccines i think that made republicans feel

better about him. i'm not sure how many democrats will actually come -- through and back him. but i don't know how much republican opposition he'll end up having at the end of the day but i think he'll be facing really tough questions about the point of on vaccination and another tough line of questioning he's going to get from conservatives is his, you know, more proabortion rights. stance, he was a democrat. he has been supportive of access to abortion i think a lot of conservatives take issue with somebody like that at the head of hhs interestingly we've seen vice president pence coming out lobbying former vice president pence coming out lobbying against him trying to get ear of conservatives from the outside. so some really interesting dynamics there i think he'll have to talk about a lot. jackie: controversial issues that you mentioned so if i want to take that as a question on fireworks alex good to see you this morning.

jackie: house republicans hoping to hammer down their reconciliation package at the retreat next week president trump reportedly set to attend key meeting at his golf club will they be able to reach an agreement on a package and what will that look like wisconsin congressman bryan steil sits on the house financial services committee, is with me now. congressman it is great to have you this morning. obviously, president trump has a very aggressive agenda to deliver on his promises to the american people. he wants to make sure that he's stops border crisis already started to do that and also got a deal with economic issues that he's trying to deal with through executive orders but this reconciliation package is going

to be hugely important to americans, the big debate, of course, now is how will we see this go through one bill, is it going to be two bills what is smarter strategy to deliver on the promises? >> the smart strategy is what gets us to deliver on end result. i'm in the belief that one difficult negotiation beats two difficult negotiations but at the end of the day i'll vote yes on both of them if need be. the key about here is that we address three absolutely critical things we continue to secure the border an we build on the executive actions that president trump has made. two, we have to prevent a $4 trillion tax increase that will go into effect if congress fails to act and third, we need to address the reckless spending that we saw go run rough during the four years of the biden administration in particular prevent those policies from continuing helping americans truly get back to work but putting in place work requirements for medicare for example, but move us meaningfully in the right in

controlling spending helping americans get back on their feet. >> how does the president have these conversations at the retreat or otherwise behind closed doors to not only make sure that he's got the gop on his side. but in republicans but how does he make sure that he can pull democrats over too he'll need extra support and there's sticking points here that are going to be negotiation problems especially when it comes to the tax side of this? >> well thing the end of the day and reconciliation package i struggle to believe democrats will come along this is an opportunity for republican unified control to truly be unified. president trump is a great listener he's go doing hear us all out at the end daft when i play call is meads we have to work together to prevent the economic catastrophe the biden administration from continuing. whaing we're going to do here in florida is have that conversation to figure out exactly the strategy to deliver on the policies that were unified behind i would offer republican conference is

jackie: breaking news in the middle east this morning four more israeli hostages reuniting with family today after they were released by hamas as part of that cease-fire deal that is still holding for now. the white house praising release of the hostages this morning and also vowing to help bring all remaining hostages home. trey yingst is in tel-aviv with the very latest for us. hi, trey. reporter: hey, jackie good afternoon. we're talking about karina deyela and four individuals taken on morning of october th from the base along the gaza border where 54 israeli soldiers were killed drags into gaza and held by hamas ever since. this is the second hostage release of the first phase in this cease-fire agreement, and earlier today we got the first images of these women that were paraded through gaza city in a place called palestine square by hamas, then handed over to the red cross, then driven to the

gaza border where they reunited with their parents. this is such a long time in the process of 477 days of waiting for the israeli people. and when you see images of these young women reuniting with their family members, it is a sense of relief for the israeli people. they were flown to a hospital here in central israel, where they saw more friends and family members they're countrily evaluated by team of doctors and psychologists. local reports indicate that their medical and psychology situation is complicated that maybe makes since given how much time they were spent inside the gaza strip and getting palestinian prisoners exchanged for these four female hostages, among them are some people who are convicted of terrorism and murder. not all of the prisoners were released into the west bank where you see image of a bust that ultimately carried them to the city of ramallah and there

are real questions about if the cease-fire is going to hold. there are some reports today that indicate the israelis and hamas are not seeing eye to eye on one single israeli hostage who was supposed to be released as part of this agreement during's the second week. this does have the possibility of collapsing the negotiations and the current understands we know according to reports that steve witkoff, the middle east envoy for president trump is delivering a message to the qataris and egyptians today tries to get on the same page to determine if this female civilian from the community will be released next weekend. if that does take place we expect phase one to continue and proceed as planned and according to reports phase two is already being discussed trying to determine exactly how all of this is going to unfold. and ensure that remains hostages still being held inside gaza

noted in the controversial remarks we're about peace through strength i think you're starting to see that. and what that means is probably less war is going on overseas. but certainly, in the back of the minds of all of these leaders is the challenges that they face if they ignore what the president tellings them, of course, he's already going about strangling iran, russia, i think china is going to come next. >> i think you're absolutely right while i have you i want to pivot to the topic as well because russia president vladimir putin says there's plenty to talk about after president trump said that he wanted to meet with him. immediately trump says ukrainian president zelenskyy is ready to make a deal to end the war trump threaten to the hit russia with sanctions if they don't end the war. is the end in sight here or are we still far from the finish line? >> well i think he has an opportunity here to peel russia and china apart like nixon did.
