begin debris removal and trying to find what is left of the helicopter and regional jet involved. we learned through ntsb they recovered cockpit data recorder and voice recorder. they are in a government lab for evaluation. they say it will be at least a month before a report is released about the crash and it is far too soon to know if air traffic control staffing was at level needed to mprevent a cras or if there were communication issues. president trump appointed new head of faa and directed government to review all aviation hiring and safety decisions. >> we feel like what happened last night was preventable? >> president trump: we do. that was something that should not have happened and we'll not let it happen again.
2:03 am
>> mark: on capitol hill, lawmakers are accusing trump of politicizing the tragedy. there is talk from lawmakers about holding hearings to look into the crash. the question is if there is too much congestion in the skies in washington. we have reagan national and a lot of military traffic that continues to go up and down the potomac. we will have to see whether or not traffic returns as the sun comes up. todd. >> todd: a lot of questions. bring in former ntsb investigator charlie perrera. they were experienced helicopter pilots. 1500 hours among them. what reason could explain why they were flying higher than the 200-foot max? >> well, they are on a training flight, we don't know exactly what their program was for their
2:04 am
training or what they were attempting to train for. regardless of that, i don't think after having worked there a short distance from the crash site for 15 years and over the river for more than 15 years, i don't think there is any legitimate reason why they should be flying military helicopter flights in that area other than real defense purposes. for training flights, i don't think it is appropriate to have them in a busy area like this and as i mentioned before, they should go ahead and ban that for 30 days until they get more data. from a permanent standpoint, you should have essential helicopter flights in that area, no more training or playing war games and stuff like that. that should be taken elsewhere, where there is no danger to commercial traffic going in and out. >> todd: let's get more into

that. as everybody knows, reagan is an infamously difficult airport to fly in and out of for planes, for commercial jets, with a slew of near misses over the years. i want to read part of an article i found online. 50 feet separating maximum allowable altitude for helicopter and planes that are landing in the spot, leaving almost no room for error. so to your point, charlie, if we know it is so close, why are these helicopters playing around in this air space in the first place? >> because they're allowed to, simply put. it is high visibility area. i'm sure there is a sense of thrill about it. they have gotten away with it for a long time with a lot of close calls. i've flown over 300 jump seats with ntsb in and out of

washington, d.c. in the cockpit of the air carriers and river approaches from south side in the 33. everybody knows it is high-stakes game, very close, and humans will make mistakes every now anden this. no wonder this happened. sitting in my office looking at the river and d.c. airport 15 years, it was amazing we didn't have more much these as close as they were all the time. this accident will be the end of that, hopefully. >> todd: air traffic control, they ask, the helicopter, do you see the crj. they are more specific for those, they are saying do you see the regional jet out there without being specific as to the specific plane or location. i am not a pilot, never been on comms like this, is that ordinary, customary instruction from air traffic control with such lack of specificity?
2:07 am
>> unfortunately, yeah, for see and avoid type separation, that is. they rely on the training and the skill set of the pilots to make sure they have those aircraft in sight and maintain visual separation, not a very comfortable feeling when you are that low. the auto mated systems, especially on older helicopters like that, that don't have collision avoidance systems, it is really the only thing they have to keep them apart at that point. i think here we are, we know enough, seen enough tragedy, we should not allow this again. >> todd: i hope they listen to you, i hope that watch this segment and implement the changes. it was a heated day on capitol hill we'll dive into next. some of president trump's

instructors having more than 1000 flying hours. congressman tom barrett, former black hawk pilot, joins me now. what possible explanation could there be for the helicopter flying higher than it was supposed to? >> yeah, thank you so much for having me on today and just it goes without saying our prayers and hearts are with the families of the souls onboard that lost their lives. this was a tragic accident and this investigation will tell us hopefully some causative factors that led to this. unfortunate mishaps always have knowa investigation that follows and reconstruction of facts that led up to it to allow us to learn lessons going forward to make this, ensure we have safety for civilian and military air crews that are converging in the same area to make sure things like this don't happen again.
2:34 am
i certain on aviation sub-committee of the transportation infrastructure committee, i know we'll take an off theive look at this. flight paths and congestion taking place, i think it is not unreasonable to look at some of the audio of what took place, the acknowledgement by the black hawk flight crew they had seen the aircraft, is it possible they were identifying the wrong aircraft and conflicting air space with. there are a lot of questions yet to be answered that i expect a thorough investigation to reveal for us. >> todd: originally on our a block, we had an ntsb former investigators who basically said these black hawks should be nowhere near reagan international airport. do you agree with that? should training missions take place this close or in the vicinity of reagan? >> well, i will say there is a safe way to have aircraft
2:35 am
operating in the same area, you can deconflict aircraft that are passing through versus aircraft taking off and landing. everyone has to be aware of their surroundings and every pilot mindful of other aircraft in the area and listen to air traffic control guidance that you get. it is not just as simple as saying aircraft can't be in a congested area. aircraft are always in a congested area. there are safe ways to do that, corridors that are established. there is separation of air space that can be developed. end of the day, we'll have aircraft operating near an airport, that are all coming and going at different times and require coordination, that is why we have air traffic controller and air space divided up in certain ways. i think there are going to be some lessons learned from this we have to apply going forward
2:36 am
to make sure we continue to have safe airline travel and we keep our military and civilian air crews safe because these things should never happen and we have to make sure lessons learned from this going forward are applied to keep everyone safe. >> todd: the controller was doing the job till cally assigned to two air traffic controllers. do you think that could play a role? >> it is absolutely a question we need answered. was workload too heavy? were there other factors at play? they will look back to did the crew have enough rest the night before this took place, both the airline crew, military crew. one thing i'm interested in looking at, should we outfit military aircraft with collision avoidance system civilian systems have. the systems only work if the two aircraft can talk to etch00
2:37 am
other through transponders. if one has it and one doesn't, it won't alert the pilot. we need to decide whether or not these need to be undated and systems to prevent this from happening? would it have prevented this accident? that question is open right now. we need more facts and i'm committed to making sure lessons we learn from this as this is reconstructed and we go back to the beginning of how this took place, hours before even this collision occurred, what can we apply going forward to keep everyone safe going forward both from the army, from civilian side, entire aviation network. >> todd: you are on the house aviation sub-committee, you will get us answers. thank you. president trump not backing down on tariff threats against neighbors to the north and south with 25% tariffs on goods set to take effect tomorrow. cheryl casone is here with her
