67 people. we learned last night federal aviation system's main online warning system for pilots went down. technicians have been working for hours to fix the problem a backup system is currently up and running in a moment look at the very latest in transportation secretary sean duffy. but first we turn to fox news correspondent grady trimble near that crash scene. >> good morning. there are around 600 flight delays across the country right now as recovery efforts continue along the potomac crews have pulled 42 of the victims from the river many of their families are here in the d.c. area after a horrific week for aviation. >> ntsb investigators are on the scene back to back transportation tragedies on the east coast and was in a diverse deadly commercial plane crash in the u.s. and more than 15 years. army blackhawk helicopter collided with the american airline flight for wichita, kansas seconds from landing at

it's an old antiquated system it has to be upgraded. that is and that works it has been in the works for years. we have to rush the new system online. again second time in two years it's gone up. >> i'm glad you mentioned the crews that are working around the clock for living in this area i drive by that site every morning and every evening for these people are working around-the-clock dedicated to doing everythdoingeverything tht especially offer some amount of closure or help to these families of the victims there so hats off to them absolutely. i wouldn't talk about the situation was staffing what's been report about what's going on an air traffic control tower here in washington on wednesday night. "new york times" says the staffing it reagan national airport was not normal for the time of day and volume of traffic that's according to internal preliminary faa safety report. could he offer any more clarity about what was going on that night was staffing? >> to get up take the faa at their word that it was normal. that's part of the review

process we have to do. there is a consolidation of air traffic controllers an hour before it was supposed to happen in the time of the crash. what was the appropriateness of that? what are we doing to search our traffic controllers in this country that's a different story we have not have enough air traffic controllers in america for very long time but we are work with the faa to go how do we search the best and brightest air traffic controllers to get into the academy. get trained up and make sure we do not have staffing issues. they are stressed out for they are tapped out for their overwork to put this no excuse at the reality of what we have in the system. we have land that's going to come out to fix the problem. but the issue is you cannot flip a switch and get air traffic control is here tomorrow. it takes years to train them up. what happened in the tower at what gogoesout the staffing? what was the language used by air traffic controller question wasn't appropriate did they

appropriately directed traffic consistent with procedures at the faa? we also questions about what was the position of the blackhawk? the elevation of the blackhawk? the black hawk pilots wearing night vision causal? if so why would they be flying a mission at 9:00 p.m. at night through really busy airspace around dca as opposed to flying it at 1:00 a.m. in the morning when there's very little traffic customer i want our military to be trained up and ready to go. i also want air travel is to be safe as well for this time and place to do it. not at 9:00 p.m. at night when there's heavy traffic. >> you mentioned is more broadly the issue of air traffic controllers more than 90% of the air traffic control facilities in this country are operating below the faa's recommended faad staffing levels. we know last year when congress passed a massive faa reauthorization they said at that point were down about 3000 air traffic controllers. so the first question, our our airways and airport safe? >> yes they are.

we have the safest skies in the whole world. traveling by air is a safest mode of transportation. just to that point if it was not safe if there is an issue with air traffic controllers or staffing that could not keep the system of the people safe in it, the faa would shut it down. we have redundancies in places not just air traffic controllers we do have technologies on airplanes to keep them separat separated. this is the safest system, our system does need to be upgraded for sure i have a conversation about that if you want. it is safe to fly. >> is it a funding issue for air traffic controllers as you mention the recruiting, the retention issue is it a mix of those things? >> there are a number of issues. during covid there is an issue where they shut down the academies and then when the academies reopen the class sizes were smaller graduates from the academy got out they cannot get into a tower.

with supplement of air traffic controllers. there's a mandatory retirement age for controllers 55 years old. every year we have people cycling up the business. we need more young people coming in and again we cannot focus on diversity, equity and inclusion we try to hire air traffic controllers. you hire the best and the brightest. some people may like to have this conversation or on equity. if a chore pilots are your air traffic controllers, you want the best for you and the brightest to protect yourself and your family. that's what we are going to do at the department forever every air traveler. getting great students to make sure skies are safe. >> you mention were very early on we do not know if any of that had an impact on either of these situations. we'll talk about philadelphia too. congresswoman jennifer mcclellan said talking about that right now it is irresponsible to blame anything or anyone that does a disservice to the lives that were lost.

in the middle of this whole thing? >> so shannon, the mission of dot and faa is safety per that's the historic commission of this agency part of the last four years they're having a conversation the last administration on changing names from cockpit to flight deck or notice to air men to error mission meet student gender specific they are focused on social justice in the environment, racist roads and ev's. they've lost the sig sight of te mission of this department. and so we have no place for anything about the best and the brightest. when you look at what went wrong look at the people you have in place at the dot and faa and leadership in the direction of leadership gives them. it's been misplace of the last four years. we are back on admission were focused on safety have in the best people delivering that safety i don't care your race, your religion, your, sexual preference that does not matter just the best in the brightest.

shannon: i want to place on the on the ntsb tom inman said about the recommendations that come from the agency. >> unfortunately at some point all of you will be gone will still have the investigation open will have recommendations. it's devastating still with what is happening. several hundred recommendations for aviation you want to do something about it? adopt the recommendation of the ntsb. you will save lives. >> he sounded very frustrated. when he says ntsb recommendations need to be adopted who does that mean by congress, other agencies, what does that mean? >> it's a partnership it's part of the dot, the faa is part of congress. there's a lot of recommendations i've talked to ntsb we want to put a list together of the top 10, 15 recommendations they have made, focus on them and start to implement them. but shannon, our air traffic control system a lot of technology dates back to world war ii. read develop the best technology

american people do not know about have never been familiarized with. one of the goals of their communication process in doing this is to advertise the way federal workers are treated differently than normal americans in their jobs. they are asked to come to work put to a lot of americans that does not seem unreasonable. one has a point or you guys have a point if you don't do with a scalpel maybe have some disruptions. the american people ask for change. he said is going to change things. there's a sliding scale on the mandate for disruption and how much you can withstand. the leviathan is going to resist the harpoons being thrown at it. federal workers do risk a little overplaying their hands by thinking they are the most important thing to democracy. many people in america who are working different than federal workers who do not see them as a pillar of the democracy that they see themselves and pray they see them as federal employees who work at taxpayer expense for. >> they have to make a decision by february 6. will be interesting to see how

so, whatever the vote comes down on, is going to come an informed view. i approached with an open mind and i watch the hearing. and that is how the process works. shannon: have you made a decision? >> i, well, i've been following it and i talked to my colleagues on both sides. and i have said this on the record. it has been challenging for sure. absolutely. and certainly not a slam dunk for the nomination. shannon: will you reveal your vote before you get to the floor or is this going to be like gametime decision for you? >> no. right before i stick my thumb and the door? it's part of an on going dialogue on where we are at this. i have made an investment to really understand and talk to all the nominees.

i treated everyone with respect. i took the time to listen that is been my commitment. >> you have met with kash patel who was tapped to lead the fbi after you conversation he assurd you he would not go out for a so-called enemy list have you made a decision on him? >> again that's part of their process too. i think i'm part of the only democrat or maybe one of the only few that have met with all of them. again i've approached all of them with the open mind to have a conversation. i don't trust and certainly many other things written or said were true i assume the same for them too. i have maintained a dialogue to understand and i have watched these hearings that is a part -- make up our job is to consent, consent pray that as part of the process.

there are some out of them that i have voted for them and their son that i won't vote for them it's going to be about an open process that i maintain it throughout the entire time. shannon: a note that includes meeting with tulsi gabbard and your conversations with her? >> again the exact same as that you just brought out. shannon: you have issued noted voted for some of president trump's nominees in this process. you're one of the only democrats to vote for the lake and rightly act to produce value as part of the signing ceremony for that with the family, with president trump this week. now, there has been a blowback from the left about the ice raids going on across the country. i want to get your reaction to some local officials who say either they're not going to cooperate, they're going to actively block these or in some cases they will avoid the raids but here are some local officials reacting.

>> police officers will not be cooperating with federal law enforcement. around federal immigration law. >> being a welcoming city our local police department will not behave as federal agents progress we have an ordinance, state law sb 54 that generally prohibits an immigration enforcement. >> local officials have with respect to the feds in the deportation? >> i hope every local would agree that her hero's criminal backgrounds or engaging in criminal behavior. now if ice comes to round them up i hope that it would provide that kind of support. i certainly would never support terrorizing otherwise innocent migrants and those kinds of situations or kicking in a door

whether we need a u.s. military strike and i run what do you mean? what are you urging president trump to keep openness and option? >> trying to define the world in which we live i and accurately. senator fetterman has been a champion for the state of israel. i went to him and asked him which you work with me too do a census senate resolution saying that over decades iran is been trying to acquire nuclear weap weapon, not a nuclear power plant for the largest state sponsor of terrorism, they would blow israel off the map if they had eight nuclear weapon. they would come after us. he said i'll be glad too. what this resolution does it lays out the case against iran's nuclear ambition. beebe and the israelis are going to have to make a decision relatively soon, what to do about the ironic nuclear program. is not an authorization to use force. i am here to tell you and the audience and the world that i think america should support an effort by israel if they should

[audio difficulty] >> even where we deeply disagree, we have in common a desire to get at the truth of the matter. shannon: what do you think people can take from this book, from those principles and that conversation about, you know, if it's a family member or a friend

or somebody you've become completely cut off from because you do have some ideological differences, them learning the value of this kind of friendship and conversation? >> the lesson should be a person, an honest, decent person who disagrees with you, has an honest disagreement with you, is not your enemy. he's to be engaged with in a truth-seeking spirit. understanding that although i may have something to teach him, i may also a have something to learn from him. if. shannon: do you agree to the disagree? that sounds simplistic, but what do you do? >> i've already learned so much from if him anyway. but i think also as christians, we deeply believe each person made in the likeness and image of almighty god and, therefore, that's not reducible to politics. love never if reducible to just politics. >> it's always so easy to interpret what your critic or challenger is saying in its worst light. don't do that. [laughter] interpret it in its very best

light. shannon: have we lost some of those skills? how do we redevelop those as a society? >> oh, no if, we've lost a lot of those skills. we're concerned with integrity, honesty, decency, compassion and openness or are we manipulating, transacting and dominating? >> you know, shannon, there is a beautiful part of the the liturgy in the jewish tradition for yom kippur, the day of atonement. the congregation goes through the various sins9 from the ten commandments, and then what i find so so fascinating, we have been zelle os every -- zealots for bad causes. now -- [laughter] nobody is ever a zealot for a bad cause deliberately. we become zealots from bad causes because we don't recognize the cause is bad. we think the cause is good. we think we're warriors for justice, for right, for truth, but we need to be self-critical enough that we're fallible, fallen human beings that can
