for transgender treatments for people who are under the age of 19. a lot of this will end up in court if not already. >> jacqui: with respect to the treatments and surgeries, there was a major case argued at the supreme court and i don't know if people forgot about it that we are waiting for a decision from the court on that. i don't think anyone can do that this is the case involving tennessee law that was passed that prohibits administering puberty blockers or facilitating these kinds of procedures for minors who are struggling with gender or experiencing gender discomfort. now, about half of the states in the country have passenger laws. the u.k., as we know just last month indefinitely band puberty blockers. think constitution before the court is to pass laws that protect kids from what they say are risky harmful drugs when the science just isn't they are not yet. i would argue yes because it

allows states to pass laws that regulate the safety, health, welfare of their citizens. about what happens in that case is going to have a big impact in this space in general. now that gender identity issue in title ix is a little bit of a different issue. but we have to remember the history of title ix. why was title night passed and the first place? to give men and women an equal shake. >> john: for a day at the national archives. >> white title ix even exist anymore? two things need to happen, one, congress needs to act there. and clarify what sex in title ix means and secondly the supreme court declined to take up the case and address directly addressing that issue in women's sports. i think they probably will at some point but i'm wondering if they are waiting to decide this tennessee law case first and how they decide that will probably give us a window in what they will do next. >> jacqui: how much does

report card as sort of the basis for what you have said. outline white the explanation is there. >> absolutely we know the department has been -- and it was underscored with the most recent nation's report card results showing that only 7% of eighth graders and fourth graders can't even read at grade level. if you can't read, you can't learn. and the department of education's results have been dismal over the 45 years in existence. it was founded to close the achievement gap spirit to the achievement gaps have only widened since 1979. it is time for a full reset. president trump is absolutely right with going for a dismantling it, and i hope that congress will go along with this and see the wisdom in returning the power with a control back to the states and importantly, back

up to speed because of covid learning losses. not only have those learning loss is accelerated since covid, but they were well on the way in the wrong direction before covid even came about. so people's eyes were open. this is a moment of opportunity. the public is demanding change. >> jacqui: do you think congress' eyes were open because the agency was created by congress for spending ordered by congress and you would need congress to get across the changes the president wants to make. do you see congress following through with this? if not, what can be done without congress? >> well, i am hopeful congress will take all of this seriously. but shy of congress actually dismantling and shutting down the department, one of the most important ways to get power pack to a more local level is to simply take the funds appropriated by congress and block grant them back to the states. take all of the bureaucrats in

washington out of the equation and let states put the policies together that will work best for the students at that level. at the local level. importantly, supporting universal school choice, education freedom, so that families can make those decisions. you start there and then the other parts of the department, what it does is easily be handled by other agencies. >> jacqui: do you think there needs to be a sweetener for people who will oppose this, you know, the facts on the schools rely on federal money, especially low-income schools, special education programs? would you have to make sure that is taking care of is what you are saying question might speak of the reality is the federal government only supplies about f all education funding. yet, the regulations and all of the red tape around education come from the federal department of education. so there are many teachers,

hand, we are a long way from rebuilding phase. but practical level, it seems somewhat impossible to pull this off. do you think this is opening door to el salvador with bigger middle east peace deal? >> jacqui, i did not have this on my bingo card either so i'm surprised too. i don't think we know yet what play the president is making here. it is possible it is diplomatic negotiating. say something provocative and put extreme idea on the table in order to sort of move the window of what is acceptable and possible and set the stage for future diplomatic talks. is this an example of that? it might be. we have to watch the white house and see what comes out from the president and his advisors over the next couple of days. but we should watch the region. with this was designed to provoke a response from countries in the region who do i want to hear from them, okay, what are we prepared to deal? if
