>> lawrence: lucas joins us with details. >> lucas: if you are a federal worker on the fence about taking a buyout you have more time to take it over. not the case for thousands of usaid workers who face a midnight deadline tonight. here is secretary of state marco rubio on the cuts. >> not trying to be disruptive to people's personal lives. we're not -- we're not being punitive here. but this is the only way we have been able to get cooperation from usaid. i have preferred not to do it this way. when we tried to do it from the top down by getting cooperation from the central office of usaid what we found instead are people trying to use the system to sneak through payments and push through payments despite the stop order. the united states will be providing foreign aid but it is going to be foreign aid that makes sense and it aligned with our national interest. >> usaid is being folded into the state department who plans to keep only about 290 employees, more than 10,000 will lose their jobs tonight at midnight.

unions representing the workers say these actions have generated a global humanitarian crisis by abruptly halting crucial work the usaid employees, grantees and contractors. they have cost thousands of american jobs. and they have imperiled u.s. national security interest. the u.s. office of personnel management says in compliance with court order, the deadline for federal employees to accept the deferred resignation program is being extended to monday, february 10th, 11:59 p.m. eastern. the program is not being blocked or canceled. the government will honor the deferred resignation offer. now, we have put together a list of some of the things usaid is spending money on with your taxpayer dollars. perhaps we can get a few more turns on the scroll there. 1 million gender diverse support in bag gla derby, 1.8 billion for honduran lbgt group. some of the bigger ticket items 15 million for condoms to the

dal ban. assisting migrant in colombia. 3.3 million for a caribbean lgbtq group. 29 million for young and female working egyptians. and 14.9 million for supporting lgbtq youth cambodia and 49 million for improving reading scores in zam bee a some lawmakers on capitol hill seem to support usaid that includes mississippi senator roger whitaker says usaid important to countering chinese influence also acknowledges some of these spending programs are a bit wasteful, guys. >> brian: thanks so much, lucas. you would think it would work to benefit some of the programs dubious and point out other ones that are necessary. instead, they want to condemn people for bringing it up. when as marc thiessen writes today with perspective. he said warren christopher, secretary of state under bill clinton was the first to say these guys are out of control. let's fold them into the state

fight for, you could just go to the president or the white house and say can we at least just keep this program? but that's not the argument that they are making. they want to keep all of the programs from the usaid. even though fraud, waste and abuse going on in place. i just don't think this is -- of course they are not going to win against the republicans. they are not going to win with the american people. they are not going to have all these americans calling and protesting to keep programs for foreign governments. >> you will have progressive people that want to keep all of those programs. scroll a list. but the common sense middle of the road democratic or republican is going to say and all the republican party is going to say stop wasting our money. we are in debt. we are giving money to these programs that we don't agree with, to other countries. they don't need these programs. some of them, yes. maybe. and there's an argument for that if it's feeding children or if it's preventing hiv from a child from getting hiv and they are allowing to send that drug over or the malaria drug. i get it. but, these programs, it's so

of silicon valley is populated by mostly 20 to 30-year-olds. this is their generation and intuitive to them. they are great at it and helped elon musk build 7 major companies richest person in the world. they 40 and 60,000 workers have applied for the six month buyout. examining whether we can do that or not. bottom line is, our federal structure is too big any company instrument to pare it down. when your number one expenditure is paying the debt on money you owe, this has to be the focus. but if you look at the left, all they are doing is mocking elon musk. the smartest, richest people in the world and ring 20-year-olds because they are examining the treasury. so, i hope the judges don't get in the way of this paring down and slimming down of the government. >> lawrence: i know the executive branch has large discretion over these funds. and when i look at all the

assistant attorney andy mccarthy joins us now. good morning to you, andy. >> good morning. >> ainsley: this was a clinton appointed judge. we expected something like this to happen. extending it a few more days, the white house's response was great. this is what karoline leavitt said. we are grateful to the judge for extending the deadline for so more federal workers no refuse to show up to the office can take the administration up on this very generous once in a lifetime offer. it is a great deal isn't it, andy? can you get another job. one of the federal workers moved to florida. can you have two paychecks through september. >> ainsley, it's a great deal that's getting greater, right? wasn't it six months and few days extended it for 6 months. couple more days it will be a year. getting better by the minute. >> brian: could the judge on monday you can't do this. it's not an offer. it's not funded. we're not going to do it? really comes down to what that judge says on monday, right?

>> well, you know, look. i would never say a judge can't do something there is a funding issue if the judge makes a ruling go to the circuit and go to the supreme court. take more time to sort it out that doesn't mean it will get upheld in the end. >> ainsley: isn't a boss allowed to fire employees? >> this is profound issue, actually, that goes back to the administrative state as it came to us beginning in the new deal. right? it's clear in the law that the president runs the executive branch. the president is the only one in the executive branch with power. it's clear in the law that the president can fire at will top officials of the executive branch. it's never made any sense to me that the president doesn't have authority to fire everyone in the executive branch. but congress started to enact these protections for government bureaucrats.

basically in the 1970s, and they have never really been challenged in court. so we may be headed to the supreme court one way or the other. >> brian: musk says right now while they delay what they can look at in treasury billions of taxpayer dollars are still being paid to fraudulent entities and still being approved by treasury. this needs to stop. that's why he is there. why democrats are fighting that is insane. also fighting pam bondi, says i'm going to sue you. stop funding these sanctuary cities if you don't cooperate with ice. where's the suit going? >> well, i think the suit is actually a good middle position because as tom homan has pointed out any number of times. they could actually put cuffs on some of these state officials. you know, you could arrest people who are obstructing the administration of federal law enforcement in an area, immigration and border security. that the courts say is exclusively the province of the federal government. so i think it's a good middle step that they are going to court: to sue them. that's better than, you know,

arresting mayors and other lawmakers who are interfering with this. and i think they got a very strong position in court. >> ainsley: doj is suing chicago. the state of illinois and cook county. they are arguing that local and state laws violate federal immigration laws. where will this go? >> it's going to be line-drawing exercise. basically, you can't commandeer the states to force you to help enforce federal law. but, the federal authorities have the authority to enforce federal law. so, while they don't have to help them, they can't interfere with them. the question from the court where do you draw the line and how do we judge the behavior the sanctuary cities engaging in. >> brian: i just thought didn't trump already try this in 2017, ant didn't the court stop him from beganning sanctuary cities. aren't we doing that now? are we going back to the same
