alexandria hoff is in washington, d.c. >> tonight is the deadline for workers to decide if they are taking this buy-out. it was originally on thursday but pushed back as part of a lawsuit against it. judge has not weighed in on the merits of the case but will hear arguments from the government along with a group of federal employee unions. the unions argue the office of personnel management lacks the authority to make this offer. they question whether the government is able to pay the buy-out. the opm responded to the deadline writing the program is not being blocked or canceled. the government will honor the deferred resignation offer. karoline leavitt stated we're grateful to the judge for extending the deadline so more federal workers who refuse to show up to the office can take up the administration up on this offer. tonight's midnight deadline comes as thousands of federal workers are returning to offices today. for many it's the start of their first full week back in person. according to the email sent to

judgment of an unelected judge for that of the duly elected president of the united states and many instances like the case out of the southern district of new york lawsuit brought by letitia james and other attorneys general injects the courts do into the relationship between the political supervision of federal agencies and the president of the united states and his authority. this is a clear anti-constitutional violation of separation of powers. nobody disputes that these courts will allowed to engage in judicial review. if congress or executive oversteps their constitutional authority in some other way, yeah, they can issue an injunction. but just because the judge doesn't like what the the president might be doing, that doesn't mean the judge gets to separate or inject his opinion and substitute his judgment for that of the president. it is unconstitutional, it is

gitmo. >> harris: so we know about what is happening in gitmo. there has been transparency there. and know there are challenges there. what is your take on it legally? >> well, i think the concern with respect to those individuals going down to guantanamo bay might be something along the lines of whether they have access to counsel. that's a legitimate legal concern. there is nothing inherently wrong with the president housing or administration housing individuals who are legitimately detained or arrested under the immigration laws there in the custody of the united states government where they are housed is more or less irrelevant. as long as they have access to counsel, basic constitutional due process, safeguards in place that is perfectly fine. it is my understanding that particular injunction might be going away. i hope that it does because once the government offers assurances to the judge that these people will have due process, look, the people that were there, the

terrorists that were there, the government has able to give them some type of due process. that's not going to be a problem i think in the long run. the president is going to be able to continue to use the facilities at guantanamo bay if that's what his judgment is. >> harris: so all of that, though, i want to quickly touch on this lawfare. you are right, that's what i've been calling it. you called it 2.0. part of the same chain. it is a push against a man who was a candidate experiencing that who is now president experiencing that. your take. >> it is lawfare. it is the whole idea of the left is going to resist. they are going to take it to the courts. they will take it to the streets and doing everything they can to thwart the will of the american people who elected donald trump president. he said he was going to do these things. he is doing these things. it should not surprise anyone. the end of the day it is wrong for the courts to overstep their article three power and try to

secretary sean duffy is touring the tennessee/north carolina border right now and he will join me live in a moment for an exclusive one-on-one interview. that important section of this major i-40 remains unpassable since hurricane helene hit the freeway on september 26th. part of i-40 in western north carolina collapsed and was washed away. as we've reported, 106 people died in north carolina alone. some 70,000 homes were damaged or destroyed. homeland security chief kristi noem was there just last week and reacted to the criticism of fema's handling of the disaster. >> i would say yes, get rid of fema the way it exists today. you need to let local officials helping. >> harris: the president revealed he would be signing an order to overhaul fema or

possibly get rid of the agency. he also suggested the federal government could give money directly to states so they could respond to the disasters. fema reports it has provided assistance to 153,000 house olds. thousands remain homeless, though, as of friday, about 2600 households were in fema-paid hotels, 150 in fema-provided temporary housing units. transportation secretary sean duffy in "focus" with me now live. he is in pigeon river gorge, north carolina outside of asheville. i can see that stretch of i-40 behind you washed away. first of all, questions about the department of transportation and what you can do and why you are there. >> so you see i-40 behind me. this is the eastbound lane. it has completely washed away for much of the section between north carolina and tennessee. so our role as the department of

transportation is to provide money and expertise to the two departments in north carolina and tennessee to rebuild this important artery that connects people and commerce not just between the states but across the country. we're out here looking at the damage and assessing how much money it will cost to do the rebuild. it will be billions of dollars to rebuild just this stretch of the highway. also as you see it has been washed out through here. it will take rock to fill this back in and build the roadway back up. we can get rock 30 or 40 miles away. it will take a lot of time and money. but the forest service can partner with us and think they're close, about a mile and a half over this mountain we can get access to rock to drive down the cost and time frame it will take to rebuild the road. we're here assessing and looking how we can partner with local

officials to rebuild quickly and donald trump doesn't move at the speed of prior administrations. he moves lightning quick so we want to go fast, we want to go cheap and we want to go safe. >> harris: having somebody on the ground and weaving together all of the connection points between where do we get the rock that's faster, easier, cheaper, that's critical. it is an all hands on deck approach to a disaster in realtime. i want to point out, because i'm learning more about i-40, too. i lived in that part of the country for a while. major east/west highway. i do know it stretches from california to north carolina. what i'm coming to speed with, the third longest freeway in the country. so getting this right also increases the ability to get stuff into the people who are still suffering, sean. >> that's right. it's not just the roadway here. california to north carolina. off of i-40 you are connecting

thousands -- tens of thousands of people and communities that rely on this artery to access food and materials. just as you look down here again this is very unique. you have a mountain on one side and you have a river on the other. when you start to see the slides of rock but also the mountain fall back into the river it becomes very complicated to engineer your way back to build a road like this. again harris, this is going to be the most expensive emergency relief project that the department of transportation has done in its 50 year history. that's how big this project is and how important it is to get the rebuild right. >> harris: you were talking about communities, arizona, new mexico, texas, oklahoma, arkansas, tennessee and north carolina, that third longest freeway in america crosses through parts of those states. little rock, memphis, nashville, winston-salem if you go by cities. this is critically important.

sean, up until now we didn't have the detail with the pictures behind you live. that tax people going beyond the emergency of just feeding folks right after the storm and we're so long after that storm now. why has it taken so long? >> well, listen, again for this roadway and others, you want to make sure you do it safely and the engineering side of this of securing what exists of the roadway back into the existing rock can be complicated and takes time. so again we are hoping in the next month we will get -- i'm looking behind me now. the western lane, it's two lanes. we'll hopefully get single lane traffic opened up in a month so trucks can get through here. the point of this is i come from small town america and i think when you live in small town america like many of the

came to the chaos on the southern border. they were pushing back against local officials in particular, governor abbott who was trying to do his best to secure the border and take responsibility for things that he really should never have had to do in the first place given the responsibility is on the federal government side. but look, we've seen how effective this is. it sends a very strong message that it has happened as rapidly as it has. i'm not that surprised. you neu it would be priority number one but part of a holistic approach to mexico that is being honest about the degree to which their government, their leadership and everyone else on that side has been corrupted by the cartels and by everyone else that has been getting what they wanted out of our southern border in terms of its porous nature while americans are screaming with frustration on our side seeing the effect it has had on our communities. >> harris: when you think forward based on where we've been it is hard for it to be

first. >> yeah, i'm sorry, it doesn't pass the smell test. very little that comes out of his mouth really does for me. this is not a situation where he was speaking to legal immigrants and americans about their rights. obviously it's something that is perfectly fine in inforge those people. in this case he is targeting that message toward people who want to come here illegally and want to try to navigate the system and throw gum in the works in a way that will push back against the policies from trump's administration that he despises like so many other elitist leftists who are insulated from the effects of so many of these problems that happen in our communities across the country. i think that it is the height of hypocrisy on his part to represent himself as being a defender of law and order, the whole reason he got elected in the first place, when he is trying to sew disorder and try to help people avoid the consequences of the laws that are on the books.

>> harris: how to work your way around it. let's get to this. i wondered how this would go out and now we're seeing it, how it is playing out. after more than a century the boy scouts of america has officially changed its name to scouting america. gender neutral. it comes years after a policy that changed the way that girls could join back in 2018. so boy scouts of america was allowing girls to join if they wanted to. since the name change was announced last year, membership has gone up fewer than 2%. as of may of 2024, 361,000 female participants had joined the organization representing nearly 16% of its membership. the organization's president says this. >> what the name change does is it allows us to rebrand and reset 115-year-old organization,

it's kind of nice to have some things that are new and fresh and different. really speaks to the organization that we are today and that we want to be in the future. >> harris: social media reactions one user writing they no longer want young boys to become young men. another one says woke ruins everything. we have daughters. my question is, that number isn't higher because why? why didn't more girls join this gender neutral no longer boy scouts of america? >> you know, harris, why do we have to move away from having things are for boys and things for girls? it is one of these things i don't understand. why does the left want to have this situation where we just have to force these different young children together in a way that doesn't allow for the space for people to learn and to grow as young boys, as young girls? to me that's something that is actually very important about

the future of masculine tee in america, to be able to have some things where boys can learn to be young men, where they can develop skills together, learn to work together. that's not a bad things as at and why youth sports is critical helping our kids grow and learn and one of the things that frustrates me time and again. i don't know why the american left thinks we can't have these spaces where boys can learn to become men in ways that benefit them, that benefit our communities and leads them to be stronger individuals as they grow older. >> harris: and will this push out or somehow diminish what is happening for girl scouts of america? i mean, i don't know if we looked at this fully. you will willing to wipe one away. what happens? does everybody go to the same thing? who decided that? it is amazing. >> it is careless. we need to help our kids grow in
