president and much of the federal government from exercising their own lawful authority to withhold funding without the prior approval of the district court, meaning again they can disperse the money they were allocated within the confines of the law and the government doesn't have to seek preclearance from the courts on terminating funding as long as they have the authority to do it as governed by the applicable statutory regulatory or grant terms so essentially the court is confirming what the trump administration has maintained and what common sense can project, which is that within the confines of regulatory and normal authority, of course you can do what you want with your own money and you don't need a court's approval to do so. >> that's in it a nutshell. it's a victory but a small victory and when you back up at look at the big picture here every you have an administration that has an enormous amount of energy. this administration is on overdrive and can be data griesed as we discussed monday,

trump has had more executive orders in ten years than prior administrations in hawaiian years so he's on overdrive and you have the geers turning and progressive lawyers throwing rocks in the gears. it's all they have. they can sthoult constitutional crisis and slow the process so what do you have with a number of these courts? they put in place temporary restraining orders so temporary stays, they are temporary and say we are likely proceed on the merits we progressive lawyers therefore we will pause the administration as it plays out but you know what it means as an attorney. that means weeks to decide whether that temporary restraining orders stays in place and months potentially for regular litigation so these proceed aggressive lawyers are throwing rocks. i believe trump is sturdy on the law. it will take time to figure out this is the best play that a listless group has to play at this moment. >> fox news legal editor carrie

with more. can you break down the decision and what this means moving forward? >> well, this decision is certainly a win for the contusion and separation powers. as they look for fraud actually what i meant was of course the government can freeze funds as they deem necessary as provided they have the authority to do that and it will be a case-by-case basis with some of this funding what are the terms of the grant, what are the terms of the appropriation, but the reason i find this to be a relief was because frankly i've been concerned about a brewing constitutional crisis not from the executive bench, from the article iii judiciary from what we have seen and the court blocking the treasury department are conducting an audit is this push by judges to interfere in the day to day legitimate mat functions of the executive

branch and that's a violation of the separation of powers and we have seen this again and again over the last week and a half so certainly the clarification with respect to the freezing of federal funds is the a step in the right direction. >> carrie, it's harris. i have a question. would this be something that something that would assist the dhs secretary and clawing back the funds we didn't know about until it was moving of does this decision say anything paid out if this federal judge's ruling a paralyze to those funds can you get that money back but none can claw that back. that money was almost surreptitious after over a billion had already been spent so i'm wondering if money that should have been frozen should have gone on the. whauts the claw back process?

>> i do think again we are going to have to look at situations on case-by-case basis so with respect to your question i would want to know what were the terms that fema set up with new york city, the money that has caught attention that was paid out, the news in the last couple of days, you know i'm not clear on if that was say for a bill from 2024 that was owed is it something that was forward looking but certainly what it does is it rightfully confirms the federal government's authority to be able to dictate how they spend their money. that's what is important here provided they have the opportunity to do it, and the key is the terms of the contract, the terms of the grapt so i think with respect to fema we would need to know with the hotel what the terms were but it's a step in the right direction as far as the executive branch being able to function on a basic level. >> final question to you, there are a lot of current lawsuits against the trump administration

and are there overlapping wishes this, will this set a precedent in any events around the corner the president can look forward to confirming the stable ground as you said earlier? >> yes, i think it is a step in the right direction to just restoring the separation of powers, just more generally, so for instance the treasury department audit we have been talking about it's outrageous a judge has said that political appointments can audit the treasury. it's unpresents dentdz and i think it's in part not an excuse but there is confusion and doge that a security clearance is needed say, look at information containing some one social security number that's not the case unless it's tied to government deemed sensitive positions.
