events here today around midday. in austin, texas, there were protests against the trump administration's actions. hundreds of people turned out of the texas capitol as part of the no kings on presidents' day movement. despite the holiday, federal judge heard arguments about elon musk and his team's access to federal data. there was no r ruling issued. the judge seemed skeptical about the state's argument that for her to issue a temporary restraining order there needs to be imminent harm. fox sources suggest doge access to the system at the internal revenue service is imminent. critics worry because that system contains sensitive taxpayer information. experts note elon musk and his doge team are government employees and if they've been hired to cut waste, fraud, and abuse, they must be allowed to do so. layoffs are hitting at the irs,

believes kamala harris will run for governor in california. he thinks she's going to clear the field but ric grenell who was also considering a run for governor says he thinks that opens the door for republicans. what do you think? >> i think it probably does. luckily for me if you want to look at it that way, i am probably poised better than anyone else because of the public safety background. i am won two countywide elections in one of our largest counties and i have been embedded in sacramento fighting them. i know public safety back of my hand. i know the issues we face. i would welcome a run between myself and kamala harris. >> trace: talk about fighting for what you believe is right. what do you believe about california fighting against trump, getting ready to spend money that they do not have trying to sue the trump administration at every single turn? >> it shows how completely lost they are in sacramento from governor newsom to every leader

>> trace: breaking tonight: new information about the delta airlines flight that crash landed in toronto. the plane flipped upside down and miraculously if you look at the wreckage and there, it looks like everybody survived. we are being told there are no life-threatening injuries. ashley strohmier's live in new york city with the latest. good evening. >> hi, trace. it was a scary scene this afternoon when i delta commuter plane coming in from minneapolis crashed on landing and it's really unbelievable footage of the plane flipped upside down and then on fire. first responders flooded the scene including three medical helicopters. all a.d. people on board, 76 passengers and four crew miraculously survived. at least 19 passengers were injured including one child. more than a dozen were sent to the hospital. the airport ceo deborah flint says two runways remain close to

the past few days. what is your take? does it look like a pilot issue? what are you gleaning from this? >> thanks for having me. definitely the gusting winds, blowing snow, not for the junior varsity team. unfortunately 70% to 80% of civilian aviation mishaps are pilot errors. obviously you and i are speculating until the tsp, canadian safety board comes out with a final report. those are very sporty conditions. unless the wins come straight on your nose, any angles often those are called crosswind and those are sporting conditions to land. >> trace: the plane turning over is what i'm fascinated by. it was going on a high velocity and i know it might've been

slipping. it's unusual for my experience, maybe yours, to have this plain rollover. >> yeah, i saw some recent cct view footage of the landing and it doesn't roll until the end. thankfully this thing didn't roll at the beginning. i am old enough to remember the beginning of the steve austin show. if it would've been spiraling down the runway it would've been a lot worse. since the aircraft was landing, i didn't have that much fuel. it looks like the crash rescue boats were on scene pretty quick so we didn't have that big of a fireball. >> trace: i remember the crash, the plane lost control and was turning and flipping. meantime you look the wreckage, pretty amazing. no life-threatening injuries. in and of itself is miraculous.

the possibility of takeover by the united states is a nonstarter. >> trace: a lot of democrats have echoed that, the hot mess analogy. no better alternative. they have been given a better plan. >> they haven't. we are waiting on plans from the arab communities as well and i do believe the trump administration does have the best plan. when steve witkoff was in the region and surveyed the gaza strip a few weeks ago and reported back to donald trump, the whole situation is so extraordinarily decimated in the gaza strip. the buildings are booby trapped. gazans have nowhere to go. the palestinian gazans have nowhere to go. i think you're going to find them wanting to leave the gaza strip and doing exactly what president trump suggested, getting to a place where they can have their own lives, or they can rebuild.

this is the determining situation for the palestinian people. >> trace: meantime, montana, the jerusalem post kind of picks up where we left off. israel prepares to receive most likely four bodies of hostages on thursday. you made a good point, bring them all out. the president said bring them all out or there will be hell to pay. israel was making the decisions right now but which way do you lean? >> it's stuff, right? hamas, they are so psycho than any move you make can determine the status of these hostages so if they are alive, it's a little bit scary to say if you make a drastic move hamas might kill them like they had done in the past to other hostages when they knew israel was coming in at the idf was coming into save them, they killed them. ones that are alive we need to make sure we do everything we can to protect them. it's a tight rope. >> trace: it is, it's a tricky situation.

lastly, heather. i want to get your 30,000-foot perspective because it's going to be a big subject in the coming days. talking about talks involving the ukraine war. the hill writes "european leaders are scrabbling to respond to president trump's moves to end the war in ukraine, shocked to find themselves on the outside of high-stakes talks. grappling with a potential retreat of u.s. forces from europe." it sounds like everybody wants in. montana was talking about the arab countries and what they are talking about, it's the same in europe. everybody wants in because there is this belief this might be the real deal. >> i think you're right. people do want to be on the winning team, they want to see a result. both wars, the middle east conflict that's completely untenable, cannot continue, they want to see the end of hamas and a resolve this conflict.
