orthodox jewish neighborhood last night in new york city. totally predictable sadly. final hour of "fox and friends" now. >> ainsley: happening today new york city mayor eric adams is due in federal court, where a judge will decide if corruption charges against him can be dropped. >> steve: eric shawn is live from the manhattan criminal court. we have never seen anything like this, department of justice goes, drop the charges, half the office quits and the judge is saying not so fast. >> good morning, we'll see what happens today. we'll hear from federal prosecutors why the department of justice wants charges against new york city mayor eric adams dropped. today the judge could do just that. the hearing is in front of judge dale hoh.
5:03 am
the corruption charges against the mayor should be scrapped. adams faces charges of bribery, fraud, accepting campaign donations from turkey. the judge wrote, the party should be prepared to address the scope of mayor adams consent and resolution of the motion. the acting attorney general says the case should be dismissed because it interferes with the city's mayoral election this year and harms the mayor's ability to run the city. the mayor remains defiant. >> i enjoyed every moment of being a police officer, it prepared me for where i am right now, mayor of the greatest city on the globe. everybody should want to take it. they are going to have to take it. i'm going nowhere. i'm going to be the mayor. happy black history month.
5:04 am
>> former new york prosecutor refused to drop the charges and quit. she accused adams and the president of making a corrupt deal, quid quo pro, trump dropping charges in return for adams carrying out immigration orders. the mayors he knew nothing about this. growing number of local officials in new york city calling on adams to resign. "new york post" called governor kathy hochul a frayedy cat saying she must have courage the paper says to stand up to progressives and not boot mayor adams from office. the governor held meetings and said she will wait for the ruling to determine if she has power to remove adams from office, she has power to remove the mayor, right now that seems
5:05 am
unlikely, we'll see what happens here at federal court. >> brian: there is no procedure, if kathy hochuls i want adams out, that is just the beginning. it could go to court, unclear how this would proceed and why, knowing there is a primary in june, how would it behoove her to do this? >> yeah, i mean, you have the primary in june, staring us in the face. in the past previous new york city mayors have resigned under corruption crowd, mayor jimmy walker and mayor william dwyer, who was appointed ambassador to mexico. we'll know more today. >> steve: let's say the judge later today says i don't buy the department of justice argument, i don't think the charges should

be dropped, go forward with the case. who would take up the case? a acting attorney general quit last week, along with half the office. >> yeah, well, theoretically, the other prosecutors here in southern district of new york could take up this case, there has been talk of a special prosecutor taking up the case or perhaps it could be dropped all together. it will take time at federal court, not clear. lawrence incredible. >> steve: glad you are there. >> lawrence: interesting to see how this plays out. this is not a plea agreement, which is what judges get involved in and say in interest of justice, i will allow this plea to go through. >> steve: like with hunter biden. >> lawrence: you have the plaintiff, the state, and the defense both saying they wan this out. you can't force another branch

implimited. biggest function of doge team is making sure executive orders are carried out. this is very important thing because the president is elected representative of the people, representing the will of the people, if bureaucracy is fighting will of people and preventing president from implementing what people want, then what we live in is bureaucracy, not democracy. >> beautiful executive, you sign it and assume it will be done. heic tas it and with 100 geniuses, brilliant young people working for him that dress much worse than him, just in t-shirts, you wouldn't know they have 180 iq. >> sean: he is your tech support? >> he is more than that, he gets it done issue he's a leader. >> steve: his companies are

i am going to let you go. that is jarring for the federal workforce. this is one lighter moment from their exchange people are taking serious as if donald trump were looking for someone smarter. >> i wanted to find somebody smarter than him, i searched all over, i couldn't do it. i couldn't find anyone smarter. for the country. we settled on this guy. >> thanks for having me. i want to be useful here. i think president trump is a good man and -- >> nice the way he said that. something nice about it. >> really is. because, i mean, president has been unfairly attacked in the media, it is really outrageous. at this point, i spent a lot of time with the president and not once have i seen him do something mean or cruel or wrong. not once.

>> sean: i've known him for 30 years and i've never seen anybody take as much as he's taken. >> yeah. >> sean: we've discussed this, i'm like how did you deal with it? >> did i have a choice? >> sean: you would say that, what do i do, worry about it? culminate into two assassination attempts. and your endorsement. >> that speeded it up a little bit. >> sean: day of the aassassination? >> yeah. it sped it up, i was going to do it anyway. >> lawrence: so much happened under trump's tenure, even before he ran, just months ago, ainsley and i were here covering his first assassination attempt and i think something to elon saying, i think you're a good man. you have not asked me to do anything unethical, anything like that. you are trying to serve the american people. when you get to bottom of doge and relationship with elon musk,

this should be no surprise to anyone. he campaigned on it, he said he was going to send elon in there. it is working and amount of waste he found, we should not be surprised it happened. >> ainsley: the interview humanized them, i liked them laughing together and they seemed relaxed together. they are doing what he promised when he ran. democrats ran to save americans money and get rid of all the waste and they never did it. donald trump comes into office and exposes how much being spent on dei, and giving to other countries, wasteful spending, it is not a constitutional crisis when you are saving americans money and it is becoming clear what democrats were doing. they are saving 55 billion and elon is showing interest in idea that would guarantee 5000

payment to every american. >> brian: he's got to cut trillion, when you cut, it hurts, when you explain to people what you are doing, if on our country and not on deck, everyone understands that. we all took out mortgages, you pay off interest on your mortgage and sometimes i know i did, you have situations where you have a credit card debt and a lot of money goes to paying minimum payment and you can't get ahead. that is mindset. if president can put together a karl rove white board and say here is expenditure and here is record revenue and interest. >> lawrence: i believe this is our only shot. you have elon musk, richest man in the world, can't be bought. you have president of the united states, this is it for him, does not need to be reelected. rest of the people in congress knew we needed cuts.
5:14 am
they were too cowardly because nobody wants to be bad guy. >> steve: here is the thing, i know democrats hair is on fire about doge, expect in the future democratic presidents in the future following donald trump are going to do the same tactic and have the same legal interpretation of their constitutional duty to do exactly the same thing. it is new to all of us but look for essentially the presidency being trump-ified going forward. >> lawrence: programs republicans like. >> ainsley: before we move on to your great interview, he said neurolink, he will work on blind to see and spinal cord injuries so you can walk again. they have implanted in three patients to use this computer to control thinking and help -- >> brian: when it comes to being

daughter was changing after swim class, we walked into the locker room and there was a naked man standing in the middle of the room surrendered by other little girls changing, their moms. it was very awkward and scary moment for everyone. they put his identity ahead of his sex offender status, they didn't know it at the time, he was entering community facilities all over the county for months and prior to that, arrested and released just last summer for the same thing. so the identity theft, the assumption of identity to gain access to the women's locker room, it seems like a loophole that needs to be closed. >> steve: how does that happen? >> ainsley: that man looks scary

with his clothes on, i can't imagine. >> lawrence: the rules, you can't question someone in their transition, even if they look like a man, all this nonsense will get people hurt. we got to get back to as ainsley and the president been saying, common sense. this should have never happened. you want to be respectful to people, you can't have men going into women's restrooms, kids or anything. you pick your gender, separate bathroom, one bathroom, you can have your own restroom, but with little girls is stupid. >> ainsley: arlington public school operate a lot of schools in that area and have to adhere to arlington public school bathroom policy which say use either restroom that correspond with your chosen identity. donald trump said no longer.

>> steve: that is why they launched an investigation into that school district. i asked the mom about the daughter since then, has she used the locker room, they have indi individual -- closet-sized areas and that is what everybody is lined up to use because that person could still be in there. >> lawrence: everybody has to change for the 1%, now the children are being forced to use the private dressing room and he gets the whole locker room space, this is stupid. >> brian: someone not stupid, carley shimkus, breaking news. >> carley: you are a gem of a person. we have more headlines to get to. update on delta plane crash that took place on monday. 19 people sent to the hospital have been released, leaving two hospitalized. 80 passengers were onboard when the plane flipped upside down on the tarmac at the airport. officials are investigating and
