never been achievable in the history of the united states or any country for that matter. now is the time. >> contrast artificial intelligence with a story that you may have covered last week. the warehouse in pennsylvania where you have to take an elevator to get down and everything is in paper. federal retirees. if you want to retire, they have all of these employees going literally searching for pieces of paper. that is 1950s kind of stuff. so yes, you have one of the smartest people in the world who happens to be rich. so i get a little bit of a chuckle out of the notion that elon musk is going to have some monetary conflict of interest. i would argue this is probably taking away from his net wealth because he is doing something that is not profitable. so let's give him a chance but let's also not -- the president was pretty clear, entitlements are not on the table.

so even if you are successful at eliminating all the waste, fraud, abuse and duplication, that's a separate conversation from balancing the budget. if you don't take on mandatory spending you won't fully eliminate the deficit. >> dana: we'll see how they figure that out. house and senate trying to tussle with each other over it now. yesterday a judge in d.c. basically gave president trump a win against some democrats trying to stop doge saying that in these circumstances it must be indisputable that this court acts within the bounds of its authority and cannot issue a temporary restraining order without clear evidence of im meant and harm to the plaintiffs. the current record does not meet that standard. a lot of lawsuits flying around. how do you help people understand what they are? >> the best example i can give them let's assume there is a national championship high school basketball game tomorrow

night. and some ruling body says a player is not eligible. that's an emergency. you have to go to a court for a temporary restraining order or an injunction. it is not like a normal trial where it request be months or years in the future. what they are doing now, this judge, i don't get to say this very often but she was correct. if there is no immediate harm, if monetary damages can take care of it later on, there is no need to act immediately. these are temporary emergency injunctions. that is not the way our system usually works. it is a high standard to meet that. the fact that a non-trump loving judge said you didn't meet the standard should be pretty clear for everyone no matter what your political orthodoxy, that they aren't going to prevail on this lawsuit. some they will. some they will not. but it is a high standard to enjoin someone from doing something. >> bill: look at gowdy praising a judge. save the recording.

play it back in a year. trey, nice to see you. thank you for coming on. talk to you soon. all right, musk and doge setting sights on social security. the social security administration, ssa raising questions over mismanagement and signs of potential fraud. >> social security has a dead people problem and doge is trying to fix it. inspector general in 2023 found that the social security administration did not have a death date for 18.9 million people born before 1920. the social security administration says almost none of these 18 million dead people still alive in the database are getting benefits but the inspector general says because social security has not identified them as dead, other agencies who rely on their death master file could be making wrong payments to these people. one agency that relies on the death data is treasury.

improper payments across agencies is a huge problem. government accountability office says in 2023 there were more than $236 billion in improper payments made to people, including people that are dead. >> president trump: when i saw the social security numbers i said wow, that's really something. so let's go above 100 years old we have millions and millions of people over 100 years old. everybody knows that's not so. how many of them were getting paid social security? if that's the case it's a massive fraud. >> democrats aren't cheering the changes. instead they fear that fraud hunters at doge might leak your personal information. >> there were thousands of people and seniors came up to me and just said point blank ron, what in hell is going on back there with social security? if you have one of these 22-year-olds mishandle the social security information and

they can't pause payments. ultimately this is going to go to the supreme court. to me it's common sense. there are things that congress specify when we pass laws. we say there has to be a usaid, funding for title i schools in working class neighborhoods. other things we just appropriate the money. things where we don't specify, you have a lot of executive discretion. if you are cutting wasteful contracts, fine. but in things that congress specifies you have to come to congress and i don't know why they wouldn't do that. >> dana: okay. you just used a phrase common sense. something that president trump has been using a lot as well. here is from the fox news voter analysis saying basically the vogters said we want change. they want substantial change and 27% actually said complete and total upheaval is what they were looking for. i wonder about how you as somebody who wants the democratic party to do better

talk about what -- why people still need certain government services like funding for schools, funding for social security, funding for medicare. >> dana: they were very explicit last night saying social security and medicare and medicaid president trump said will be roped off. nothing will happen to those funds. let me ask you one last question. do you think the democratic party is fixable at this point? >> absolutely. look, if you had asked someone in 2021 would donald trump a week after january 6th became president of the united states in 2024, i don't think even many of your viewers would have said yes that's going to happen. i know kevin mccarthy didn't think it would happen. we can't come back if we offer the same old status quo but if we have a vision recognizing a lot of things have gone wrong for working and middle class americans and a positive vision about what we'll do for their economic success and their community's economic success.

loopholes that could allow biological males to compete in women's sports. what is going on? garrett tenney live in chicago with more. >> dana, hours after president trump signed his executive order to keep biological men out of women's sports the ncaa new policy athletes male at birth could not play on women's teams. now some argue when you look into the details this policy isn't all it's made out to be. one of their biggest concerns is the ncaa new standard for dirge an athlete's gender is their birth record. majority of states allow you to change the gender on your birth certificate and a lot of states will issue an amended birth certificate. some issue a new birth certificate. the gender change never happened. the ncaa is pushing back on those concerns telling us the policy is clear. no waivers are available and student athletes assigned male at birth may not compete on a
