right now about why this democratic judge in houston did not deny bond to begin with. the suspect in this case, 27-year-old francis here, expected to appear in front of that judge again for the first time since posting his $1 million bond allowing him to walk out of jail. francis is one of two suspects charged in the capital murder of harris county sheriff's deputy last summer. the judge who set the bond faced scrutiny before for letting repeat offenders out on bond. now judges cannot comment on these ongoing cases but we did reach out and we have not heard back from them, dana. >> dana: brooke taylor, thank you for the update. bill hemmer, great to be with you today. see you on "the five" and special coverage. it is a big day here. glad to be with you. here is harris. >> harris: fox news alert.

president donald trump will be on capitol hill in just a few hours to give an address to congress and americans. the president's theme, the renewal of the american dream. we expect him to cover a wide range of issues, as he always does. we want to hear about his success at closing the border. the southern border and also dealing with the northern border. the department of government efficiency, doge, will likely get some play as well. americans want to hear about that. elon musk will attend. some democrats are bringing fired federal workers as their special guests. other topics could include woke gender ideology. online harassment. wars in the middle east, ukraine, tariffs and foreign investments. white house press secretary karoline leavitt. >> the renewal of the american dream underway already. look at all that president trump has accomplished in his first

month as president. he will highlight some of those accomplishment and also going to talk about his plans to fix the economic mess re created and left for him by joe biden and his administration and make an ask of congress. we need more border funding to continue with the deportations that have been successful because of the efforts of this administration but we need more resources. >> harris: vice president jd vance gave sean hannity this preview. >> he will talk a lot of the successes we've had in these first 45 days and also going to be himself. poke a little fun and we'll have a good time. >> harris: alexandria hoff is at the white house with more. >> the president said himself he plans to tell it like it is. we expect nothing less than that. tonight is not an official state of the union address but will function similarly. we're told tonight's speech will be broken into four main sections. the president's accomplishments

8:05 am
he loves the country. he wants action. he knows how to get things done. he wants americans to be safe, prosperous and more secure. it is a nonpartisan argument. something americans across the board want and made that statement and now we've got it. it is a remarkable transformation of this country after six weeks. the president has made it clear what he stands for. but this is, harris, a whole of government reaction. i happen to work for the state department and our secretary of state marco rubio. the president has chosen a team for the cabinet that understands what the american people want and can make it happen. so part of that dynamic, of course, is safety abroad. dealing with terrorists, arguing and making peace happen. bringing back, harris, the very basic ideas that everyone benefits from if you've got loved ones in the military, if you want a future you can count on for your families, donald
8:06 am
trump's vision makes that happen. but it is not just an idea as you know. tonight you will hear what you have to do to make that happen. as a business person you can get ideas but you have to implement them. as a leader the same framework. of course, everyone in the cabinet, every department, whatever it is america needs to be doing, is following that visionary lead and implementing it accordingly. >> harris: all right. i want to ask you about what you would like to hear from the president tonight because being at the state department there are a lot of things now that concern you. this blowup between ukraine and really ukraine against the world at this point. its president was representing its people didn't get a deal done that would have benefited them. you have that cooking. you have israel saying they want a new cease-fire. hamas isn't keeping its deal and pulled back aid in gaza, israel has. that cooking along, too. your thoughts. >> look, this is a renewal of
8:07 am
the peace through strength dynamic. we learned about that, of course, with president reagan. the fact is that the bad guys around the world are not going to suddenly turn into good guys dealing with a group like hamas. allies understand it. what is beneficial for both allies and enemies is to know that america is back. donald trump doesn't play games. that when we have a dynamic like with president zelenskyy, it was very unfortunate. he knew exactly what has happening and what was needed. it he decided to do something else in the midst of the oval office. that kind of disrespect for the nation, for both the president and vice president, is unacceptable and yet the commitment remains. there is a very distinct focus by the president and this administration for peace to prevail. i think now, of course, there is still an open door for this to be renewed, for this to take place. for president zelenskyy on behalf of his country.
8:08 am
but when it comes to the world in general people understand, like with the border, our partners understand that this is going to happen. we have a president who means business and is going to take action to make it all happen. it's a very exciting time. >> harris: no doubt. i would anticipate and i mentioned before we had you on just moments ago that the border would be in focus for them tonight i would think. all of everybody in the chamber, all of america and with the president speaking. this is just happening and something we could hear about tonight as well, tammy. the trump administration is looking at what is next and next steps with ukraine, and what those steps will be after last week's tense dust-up in the oval office. the white house has temporarily paused military aid to ukraine until they look to want peace. tammy bruce was just talking
8:09 am
about who wants peace in this deal? trump does. the president strongly pushing ukraine's president zelenskyy now to change his tune. >> president trump: i think it takes two to tango. you will have to make a deal with russia and a deal with ukraine. maybe somebody doesn't want to make a deal. if somebody doesn't want to make a deal i think that person won't be around very long. that person will not be listened to very long because i believe that russia wants to make a deal, i believe certainly the people of ukraine want to make a deal. >> harris: vice president jd vance earlier today. >> it's important that everybody come to the table. the president is trying to send an explicit message. the ukrainians have to come to the table and start negotiating with president trump. >> harris: this is part of the story that broke just moments ago. wanted to get it on screen so everybody could see it together. it looks like president zelenskyy may be listening and
8:10 am
that president trump is having some success with his pressure campaign. zelenskyy has just posted this. nobody wants peace more than ukrainians. my team and i stand ready to work under president trump's strong leadership to get a peace that lasts. we are ready to work fast to end the war. our meeting in washington at the white house on friday did not go the way it was supposed to be. it is regrettable that it happened this way. it is time to make things right. tammy, you and i are having a similar reaction right now. tell me yours. >> look, this is the result of leadership. some people operate through rhetoric and antics and then there is the continuum of the powerful nature of rhetoric asking for something that everyone wants, which is peace. we have a great leader in president trump and, of course, i would argue the best diplomat in the world to see the left with secretary of state marco rubio. this is the end result of what happens when you make it clear to someone that there is one way
8:11 am
to move forward and it is not a controversial way. it is about peace and saving lives of people that have gone through so much carnage and pain. it is great news but it happens because president trump remains focused and steady and his arguments work. that's what we're seeing right now. >> harris: all right. the state department spokesperson tammy bruce, good to have you on the program. can't wait for you to come back. you were here with me for the breaking news. >> thank you, ma'am. >> harris: more breaking news now. the tariffs are hitting home, too. canadian prime minister justin trudeau is speaking. let's watch. >> homes and everything in between. they've chosen to harm american national security impeding access to the abundant critical minerals, energy, building materials and fertilizers that

we have and that the united states needs to grow and prosper. they have chosen to launch a trade war that will first and foremost harm american families. they've chosen to sabotage their own agenda that was supposed to usher in a new golden age for the united states. and they've chosen to undermine the incredible work we've done together to tackle the scourge that is fentanyl, a drug that must be wiped from the face of the earth. so on that point, let me be crystal clear, there is absolutely no justification or need whatsoever for these tariffs today. now the legal pretext your government is using to bring in these tariffs is that canada is
8:13 am
apparently unwilling to help in the fight against illegal fentanyl. well, that is totally false. let's look at the facts. our border is already safe and secure. far less than 1% of fentanyl flows and less than 1% of illegal crossings into the united states comes from canada. but we acted because we know we can always do better. we responded to concerns, including from the president, by implementing an ambitious 1.3 billion border plan that includes generational investments in new a.i. and imaging tools to stop the flow of fentanyl in its tracks. stronger coordination and information sharing with american agencies. along with the deployment of drones, helicopters, and additional personnel to keep our

border secure. now a month ago, as part of an agreement with the united states that paused the tariffs, we made further commitments. we appointed a fentanyl czar. a man who dedicated his multi-decade career in law enforcement to combating organized crime networks and drug trafficking. we designated seven drug cartels sick, evil groups who cynically profit off the pain and suffering of people on both sides of the border as the terrorists organizations that they are. and just yesterday, we launched a new joint operations partnership supported by a $2 hundred million investment between canada's security and law enforcement agencies, a partnership to enhance the coordination of information and intelligence in order to thwart criminal gangs involved in the

illegal fentanyl trade. critically, our actions are working. as the u.s. customs and border acknowledge, a 97% drop in fentanyl seizures from january compared to december to a near zero low of less than half an ounce seized in january. even with all the further enforcements and actions we've taken at the borders. in sum, we stepped up. we engaged closely and constructively with the president and his administration. we did everything we promised. we stuck to our word. and we did it because we believe in working together to protect our citizens. now i want to speak directly to
8:16 am
one specific american, donald. in the over eight years you and i have worked together, we've done big things. we signed a historic deal that has created record jobs and growth in both of our countries. we've done big things together on the world stage as canada and the u.s. have done together for decades, for generations. and now we should be working together to insure even greater prosperity for north americans in a very uncertain and challenging world. now it's not in my habit to agree with the "wall street journal" but donald, they point out that even though you are a very smart guy, this is a very dumb thing to do.
8:17 am
we two friends fighting is exactly what our opponents around the world want to see. now to my fellow canadians, i won't sugar coat it. this is going to be tough, even though we're all going to pull together. that's what we do. we will use every tool at our disposal so canadian workers and businesses can weather this storm from expanding e.i. benefits and making them more flexible to providing direct supports to businesses. we'll be there as needed to help. but canada, make no mistake, no matter how long this lasts, no matter what the cost, the federal government and other orders of government will be there for you. we will defend canadian jobs. we will take measures to prevent

states of the he called him donald more than once. he said this is a very -- he said you are a very smart person but this is a dumb thing to do. paraphrasing that first part. we two friends fighting and he made the point that the world is watching and that this fight between him and who he called donald is not good. now we are fortunate because while she walked away for just a moment dealing with this kind of thing at the state department, we have back now state department spokesperson tammy bruce. tammy, what is this going on? is canada already feeling this? are we already feeling this? i am watching the dow. we are a little bit. >> look, we know that president trump is a man who makes deals. we know that there are results to the choices he makes. clearly this needed to happen. i don't know when it comes to the prime minister's attitude
8:20 am
about how this was a dumb thing when he also announces that they now have to have a fentanyl czar and they are focusing on the border and they are actually taking actions that deal with the major problem that our nation has faced as a result of fentanyl coming over that border. and his actions clearly indicate that that was something that needed to be addressed. so for both canadians and the american people, this is important. it also shows certainly for the united states a nation that is back, that we are focusing on the details of the lives of regular people that are impacted here. remember in the first term he really talked about the forgotten man and woman. this is part and parcel of that dynamic. the president is not afraid to do what is necessary. he knows the american people understand because he is a great communicator. you will hear more of that transparency tonight. but we also have in marco rubio, via the president's inspired choice, a diplomat who
8:21 am
understands why this is oh curing. who agrees with the nature of what needs to happen and is the person who goes and talks face-to-face with our allies and our partners who have experienced years under the biden administration without any real need to address any problems. but america is back and that means we are partners now that must be taken seriously. i think that it is unfortunate but he is leaving. for him to be taking the attitude he has taken toward the president, there is a -- respect is important, as, of course, president zelenskyy learned. the issue of respect is important on the world stage. and if the prime minister was concerned about what our enemies are seeing, it is ironic he is saying that at a press conference. we all have a different way of adjusting. but the americans will benefit from this in the long run, which is why it's occurring. frankly, so will the canadians.
8:22 am
it is a time when we look at what has perhaps gone wrong, what needs to be fixed, and we have a leader and certainly an american administration that understands all of those aspects and understand the vision and impact of president trump's actions. >> harris: i looked down taking a few notes as he was talking. you really touched on something. he basically has nothing to lose, justin trudeau. this is not the play of a winner. calling the president of the united states by his first name and likening -- like they are the same at this point. it was -- he has nothing to lose, trudeau. >> for him perhaps personality. he has been the prime minister for a while. he was elected in. canadian people make their choices about who they want to be leading their nation. but the world has changed and it has changed based on america being back. it is a renewal of the american dream, which is what the theme
8:23 am
will be at tonight's speech. part of that renewal is reinforcing our relationships. sometimes you have to have difficult conversations with your friends because something is going wrong or you want to be able to help. this is the nature of our own neighbors and friends, whether it is in south and central america and reaffirming those relationships or certainly to the north of us with canada. >> harris: we'll listen in one more time. justin trudeau, prime minister of canada was asked what do you want to say to president trump? >> working together to take on the world at this time. the facts show very clearly that in terms of taking action on fentanyl, we are doing everything that is necessary and not just for the united states, for ourselves as well, as canadians are suffering as well from the scourge that is illegal
8:24 am
fentanyl. we have laid out extensive plans, actions, cooperations, including as recently as the past days in washington and they have always been very well received. and the numbers bear that out. i think what president trump said yesterday that there is nothing canada or mexico can do to avoid these tariffs underlines clearly what i think a lot of us have suspected for a long time, that these tariffs are not specifically about fentanyl, even though that is the the legal justification he must use to actually move forward with these tariffs. >> [inaudible question] >> have you talked to mr. trump? >>] speaking french]
8:25 am
>> i hope to talk to him in the future. my door is open. >> harris: so through the translation i want to bring back the state department spokesperson tammy bruce. so they were translating and he was asked the question have you spoken to trump since your last conversation that we all know about and reported on? you heard him say the door is always open. wow, so he wants our president, who he can't even call by his last name with his title, to call him up. all i can think of is this. that day, it happened during the hour. the day they kicked him out and we knew once they found a replacement he would be gone, i can't imagine what the president is saying to him, 51st state, canada? it feels personal. this doesn't help canadians. >> well, it doesn't. yet he also admitted that the fentanyl situation is a scourge and that they've taken more actions, as we talked about
8:26 am
earlier. there he repeated that. then dismissed president trump's actions on tariffs as a legal mechanism. you see, canadians and americans concede the difference in if what someone is saying is really transparent, if it is personal or if it's about them, president trump, people have gotten used to hearing from a man who genuinely is doing things for the sake of the american people. of his people. i think around the world it has been refreshing and it is unfortunate but politicians sometimes have to say certain things. but in this case we are hearing about the importance of the results that prime minister trudeau has implemented. only as a result of the tariffs that the united states is now implemented via president trump. it is a scourge. it does destroy canadians lives and americans lives. that's the end result and that's what the citizens of these countries care about.
8:27 am
>> harris: i get it. look. at the state department right now to have you on is really important at this moment. this is what you in part are working on today and all of that filters into your day. we get first reaction from you, tammy bruce, we're appreciative. >> thank you, ma'am. >> harris: thank you. lessons learned by democrats. the count is zero. the issue of men playing in women's sports is one that could have played big in their november election loss. one opinion piece is asking will democrats stand up for women or let men destroy girls' sports in last night we got our answer. zero democrat senators supported the protection of women and girls in sports act. all 45 who were present voted not to support that. apparently supporting biological men endangering female athletes and having access to bathrooms and locker rooms. the bill passed the house with only two democrats on board.

8:29 am
79% of the american people, according to the "new york times" poll, support protecting girls and women in sports. and for the democrats and you know, harris, even 67% of democrats in that poll support protecting women and girls in sports. so the democrat senate is completely out of step with where the american people and their own party are on this issue. and to see them vote in lock step against this, when it is a very simple bill that senator tuberville and i and others brought forward for them to say no, we're not going to vote to protect women and girls, it is really astounding. >> harris: i'm wondering if the calculation for democrats might have included president trump has the power now and he has done this through executive order and action, what the

>> i think that speech will be a farce, a maga pep rally. >> i don't see why anybody should participate in the propaganda that is known as donald trump. >> harris: bucking all that american tradition, i suppose there. anyway, several democrats say they will boycott that address as she was speaking about, including senators bernie sanders and elizabeth warren. axios is reporting some leaders on the left are even considering using props like anti-trump and anti-doge signs, eggs, empty egg cartons. pocket constitutions. i like that one. pass that out. hand clappers and red cards. power panel now, leslie marshall, guy benson both fox news contributors . great to see you both. leslie, i will start with you. we've spoken at times like this. you like to stick to the facts. what do you think of all these antics? do they help? >> i really don't think the antics help on other side.
8:51 am
we've seen that on both republicans and democrats and boycotts on both sides whether joe biden and barack obama who were president or whether it was donald trump one or donald trump two. i don't believe in that. that is their choice if they speak for the constituents and that's what they want then fine. i understand bringing people there, harris, that represent what we're not going to hear. we won't hear what tariffs will do especially to middle and lower income families. talking about possibly $1,300 out-of-pocket. we won't hear why there are no eggs, three supermarkets for me where the price of eggs and price of gas has gone up. we won't hear about that. we'll hear about everything that he thinks he has done that is great. we won't hear the other side. that's my party's responsibility to provide. >> harris: guy. >> well, they can do that in the response. i think the egg situation is heavily impacted by the bird flu, of course. make their points when they want to after the speech. i just think -- generally agree
8:52 am
with leslie here it is counterproductive to engage in histrionics and antics during the speech itself. i think the american people showed in november they want non-crazy policy. trump struck them as less crazy than the democratic party. bringing noise makers and props into the state of the union would look very unserious and silly. which would defeat some of the points they might want to actually make on substance later. >> harris: i want to get this in the conversation. you are talking about bringing guests on and trying to show areas that needed attention. well, first lady melania trump is inviting everyday americans as special guests. one of them i noted is january littlejohn from tallahassee, florida. the mom and parents rights advocate who sued the school board of the county after school officials at her daughters middle school transitioned her
8:53 am
daughter without her knowledge. that has been not just a hot topic but at the heart of a few things being dealt with right now. girls in sports, transgender. part of the cultural conversation that democrats got in the middle of but couldn't win. >> parents rights. that's a huge components of this obviously. you see in virginia, for example. glenn youngkin largely winning in 2021 because of parents' right. the trans and gender policy successes of the left contributing to donald trump's victory in november. highlighting those issues in a way that highlights and brings to the foresympathetic figures and shows the extreme of the other side is politics 101. >> harris: this is an opportunity for president trump to get his messages out to do on this 43rd day of his presidency second term to do what he wanted
8:54 am
to do, to have deliverables, he will talk about those things. what should democrats be doing? i understand the guest situation. they have a lot of media today. all day long there are those of us in the media business that are talking to anybody who wants to come up to the microphones and get story before the president speaks. why no positive messaging from democrats? >> i don't think it has to do with positive or negative. it has to do with fact or fiction. it is a fact that the tariffs will hurt the american people. top economists have said that. >> harris: what are the democrats doing to improve the economy? >> that's another thing they have to put forth. they aren't running for re-election now. they are laying the ground work for the mid-term that could be a blue wave if my party does this right and the first thing is the messaging. the messaging is what did he say he would do? what is he doing? we're seeing at the town halls of republicans, their constituents are angry because
8:55 am
they say this is not what i voted for. maybe they voted for less government but they didn't vote for them to lose their jobs. maybe they voted for less government but didn't want cancer research gone away with and didn't want certain programs at hud to help lower income families be able to obtain mortgages which hud can do as well. and that's what i think democrats need to do is put forth what we're hearing from some of the republicans at these town halls. >> harris: guy, the last word. >> i think some left wing groups have stacked the town halls. trump needs to tell folks how he is delivering on promises. that's the case he has to make. >> harris: good debate. thank you. keep it here as we ramp up to president trump's address at 9:00 p.m. eastern. the only place to watch. keep it on fox. i will see you right after the commercial break on "outnumbered." and needs money... just use your va home loan benefit... it's a big one! the newday 100 is a special offer to military families
