available, where we are not taking money from places that need it in order to support efforts, so much has to go into it, i don't think this administration has thought about. >> carley: great point. john, final question, you are former shelter director, what did you learn in that job? do you think because of this testimony there will be changes made to your city? >> i pray changes come to the city of boston and commonwealth of massachusetts. if tom homan could come today, it would make massachusetts and boston a safer place. there need to be accountability for this agenda, which is putting protecting criminals who commit heinous crimes on vulnerable teenage girls. job of government is to protect the vulnerable and that is not happening right now.

mixture of dna found under one victim's fingers. chanley painter has details. >> chanley: more motions, new details about evidence in case again bryan kohberger, including dna found under one victim's fingernails. madison, along with kaylee and ethan were brutally murdered in 2022. under logan's fingernails three-person mixture of dna was found. bryan kohberger defense is asking judge to limit testimony about this because they say it doesn't match their client saying mr. bryan kohberger lr is similar to almost every other person for whom well, r was generated and focusing on inconclusive well, r would mislead the injury implying the well, r means mr. bryan kohberger dna might be present

in that sample. the defense has been unsuccessful in trying to suppress dna in this case including bryan kohberger's dna found on a knife sheath that was believed to have held the murder weapon and found under a body. bryan kohberger's defense is trying to convince judge to take the death penalty off the table, they say bryan kohberger has autism citing his failure to make eye contact and rocking in place while seated, behavior that could be misinterpreted by the injury. i have been very close to bryan kohberger inside a courtroom multiple times over the years and never personally observed rocking back and forth, he was very still and did make eye contact with me once. his defense is making arguments and expert testimony to persuade judge to take the death penalty

off the table. trial is set for august. >> todd: throwing it all against the wall. thank you. bring in criminal defense attorney lexie rigden from rlr to issue at hand here. does the defense have a good argument? should this evidence be excluded? >> you know, i'm not sure all evidence would be excluded, i think they are trying toin approximatepoint language around evidence. they don't want somebody getting on stand and saying evidence was inconclusive which could lead a injury to believe that maybe his dna was under her fingernails in layman's terms, these people are not scientists deciding this. reading the motion, the lawyer that wrote the motion is a dna expert herself. this is convoluted in of science. they don't want them to say

inconclusive and people think if they can't excludehim then he is inincluded. biggest bombshell is like an afterthought in the motion, it said that further testing actually excluded bryan kohberger, so they tested that sample and he was excluded. there will be competing testimony in the trial. >> todd: important point. science can get wonky for a jury, bottom line this for us. if this dna evidence is excluded is there enough evidence to convict or could bryan kohberger be found not guilty of these murders? >> that is the 60,000 question and he has talented attorneys who represent him even in other states have been allowed to participate in the proceedings. this entire case comes down to the dna and we've learned a lot

through the motion. one thing we learned by listening to oral argument is the defense said prosecution never said how he's connected with the victims. we learn a lot by reading and hearing what is said that is not coming out. dna will be crucial. >> todd: another case that really has captivated nation. two suspects arrested after three kansas city chiefs were found frozen to death last year. turns out victims did not die of what i refer to as voluntarily freezing themselves, they were poisoned. >> yeah, and they were given a cocktail of drugs and took a cocktail of drugs. this is happening all across the country, especially with the fentanyl coming over our border and there are a lot of states including where i practice in new jersey, where supplying somebody with drugs that kills
