to campus we start with alexis mcadams at columbia university and that's where we begin. >> good morning. those protests started yesterday here at the ivy league campus at columbia university but spilled out all across the streets of new york city. i walked with them for hours and things got chaotic. nypd had to step in making dozens of arrests. they said they wouldn't stop until their demands were met. watch this. [shouting] >> this kept going as they demanded ice release mahmoud kalil saying they don't care from president trump said they won't stop doing this until palestine is free. listen. >> when you hear president trump saying that more arrests will happen he said that the agitators will get thrown behind bars, gets visas and green cards pulled. >> we have to have solidarity.

i'm a u.s. citizen. that's why i'm here. deport me, you can't. let's go. let's go. >> what about if president trump said they will make more arrests now at these campuses? >> bleep police, >> the white house says it is not about free speech. that's not what his arrest is about. the 30-year-old from syria is being investigated as a national security threat. we have oh he seen him on campus for months after no longer a student leading dozens of protests. they say he was leading activities that align with hamas. this is what it comes down to. the state department tells fox part of our immigration law allows the secretary of state to remove a non-citizen if they believe their presence would have serious adverse foreign policy consequences. also these pamphlets we've been talking about are part of the investigation and brought up in the white house briefing called the october 7th attacks by hamas

a moral victory. students say they didn't see him passing him out but at the protests where they were found on the table. there will be a hearing for him today. we don't expect for him to be there. i was asked ice sources being brought back to new york city. they said not any time soon. keep you posted. >> leding our coverage there today big story coming up here. >> dana: jonathan turley joins us now. this is a very interesting legal battle. she just laid out what the law says. do you think, one, do you think the united states has the right to deport him? will they have to show their work today about why they have the evidence to say so? >> well, not necessarily to show the evidence today but they do have an advantage. simply because the government always has an advantage when you deal with the status even of lawful permanent residents. that is a privilege granted by

the united states. now this is a 1227 determination as it is called from the secretary of state where he has personally reviewed this file and said i believe this was called lpr, should leave the country in the interests of the united states. now, kalil's lawyers will have a major issue up front because he is not in new york. and the question is whether this court even has the jurisdiction to issue any type of order because the actual what is called custodian of this individual is down in louisiana. so there has to be that threshold fight as to whether this court has any role to play at all or whether it has to defer to louisiana. underlying this is also what our legitimate free speech concerns. when the government says they will be rounding up a lot of folks to be deported, you have to look at what that standard is. you are aloued to protest in favor of palestinian. what the government is saying

here is that he went well beyond that. that he was involved in illegal conduct at columbia no longer a student. aligned himself with hamas, a terrorist organization, and that plays heavily in favor of the government. >> bill: let me ask you the evidence question in a moment. let's go back 11 months. the scene in april of 2024. the quote from hamas, right? we in the hamas movement believe any popular movement against our people are useful in support of activities for our cause. the importance of this increases if these activities involve young people and university students given that this reflects the vision of future generations. so what we've been told so far about the evidence is that he either posted or handed out or did both maybe these quote pro hamas propaganda flyers. i guess from a free speech standpoint, you may not like it but is that illegal?

>> not necessarily but the question is what the standard is here. because lpr, lawful permanent residents, do have a robust level of constitutional protections. not as much as citizen. supreme court over two decades ago said the government could detain lprs in the case called demoore in 2003. and that is on the books and they have a lot of support for that. we're not sure of the relationship of this material to this individual. some of the material even said it came from the hamas press office. that's a terrorist organization. so that's the type of evidence we're looking to see what the nexus is to this individual. but his involvement and unlawful conduct involving trespass ultimately and property damage puts him in a precarious spot. the secretary of state is given this authority under 1227 to

make this determination. the courts tend to defer to that. they will need to really ramp up fast to show evidence to the contrary. >> bill: a point of clarification. that's what hamas was saying about those protestors a year ago. they were claiming they supported their cause. go ahead. >> dana: the trump administration says this will be the first of many. so how important is it for them to clear this legal bar today? >> well, this case was chosen for a reason. i think they feel this is a good case for them to fight this issue initially. there is a concern -- i believe it's a legitimate one in the free speech community when you say we'll round up lots of folks engaging in protest. what is standard? they're aloud to protest, allowed to use free speech. what they aren't allowed to do is support terrorist organizations to spread terrorist information, threaten jewish students and certainly

not occupy buildings and destroy property. so each of these cases has to make that level of determination. so we'll have to work all of this out. there is a balance here to be struck. but it is important for the trump administration to show that they are striking that balance. >> bill: 15 seconds left. his immigration status is not determined today. that's done by another judge another time. is that correct? >> that's right. the question of who that judge is. there are two judges here. one will be the one down in louisiana that has direct jurisdiction over the custodians of this individual and the federal government is not sending him back to new york unless they have a court order. >> dana: fascinating. we'll watch it with you as this develops this morning. thank you so much. >> bill: talk to you real soon. trump agenda rolling on. education department laying off 1300 employees. they only have an entire division of 4,000. that's nearly half the

workforce. the cuts a precursor to closing all together. secretary linda mcmahon the other day on fox says the department's core mission will not be touched. >> what we did today was take the first step of eliminating what i think is bureaucratic bloat. not to say a lot of the folks -- it's a humanitarian thing to a lot of folks that are there. they are out of a job. but we wanted to make sure that we kept all of the right people, the good people to make sure the outward facing programs, the grants, the appropriations that come from congress, all of that are being met. none of that will fall through the cracks. >> bill: a lot more throughout the program today. american federation of teachers union randi weingarten argues the department is vital for vulnerable students. if you want to eliminate it, you have to get congressional approval. we are a long way from that step. today is a big one nonetheless. 11 past now.

>> dana: search is tense filing for the university of pittsburgh student who went missing last week in the dominican republic. officials naming a person of interest. we are there and have the latest with nate foye. >> good morning. it is day six of the search for missing american college student con aftering key. they are reinterviewing witnesses in the case including the man she was last seen with. look at this surveillance video from the hotel where she stayed with friends. you see them before they went to the beach after 4:00 a.m. last thursday morning. according to local reports the rest of the friends returned to the hotel about an hour after this but the man that she is with who at one point looks like he takes a selfie with her doesn't return until hours later. he reportedly told police he went swimming in rough waves with the woman before he got out, threw up and passed out on

the beach. meanwhile the resort confirms that it had a power outage during this time. lasted about 24 hours leading up to her disappearance. hotel guest tells fox news digital it impacted the guest's ability to communicate and safety was lacking. >> just the thought that there was no kind of safety or protocol going on the night she disappeared was the night that everything was kind of going on and was so chaotic and people were staying out later by the pools or on the beach because they had no a.c. in the rooms and it was so hot. that's the only way they could cool down or have any relaxation at all. >> the dominican armed forces are supporting search teams on the beach. we saw that yesterday with scuba divers in the water and drones and helicopters in the air. dominican police chief says they are also collecting digital

evidence which may have been impacted by the power outage at the hotel. if that's the case it will come out during the investigation. >> dana: thank you so much. this is the timeline, the last known whereabouts march 6th at 4:15 a.m. spotted there. she was last seen on the beach at 4:50, 35 minutes later. and then the last time you see her is five women and one man leaving the beach at 5:5five. an hour later. reported missing at 4:00 p.m. that day. >> bill: one of the things that's very revealing is onto the surveillance cam. he has his phone in his hand. is he taking pictures or is it video? i imagine police have looked at this already. that might be maybe one of your best early clues as to what they were talking about, what was happening between the two of them at the time. okay, marco rubio huge news on

ever since the ceo started his work at doge. the latest incident happened in seattle on sunday. police say fire destroyed four tesla cyber trucks. tesla owners across the country report they've been verbally attacked for e.v. of choice or seen their cars vandalized. this person startled a cyber truck owner when they rode up and placed an anti-elon sticker on the back. >> at the traffic light i heard two knocks on the back of my truck. just like oh, gee, what happened? >> tesla dealerships and charging stations are being hit around the country ever since the end of january including here in colorado where this tesla store front was vandalized multiple times with molotov cocktails and anti-elon musk graffiti. a transgender woman faces federal and state charges for

a crazy unhinged view but if you convert that and actually commit actual violence and property damage, then that's terrorism. although it is kind of interesting i don't think that donald trump driving a tesla is going to improve that situation a whole lot. but i do think that it underscores just how fringe a lot of the protests against elon musk and donald trump is right now. most normal people are even people who didn't vote for donald trump or don't particularly like him are going about their business and maybe find some things that trump is doing and specifically that doge is doing and probably applaud it a little bit. >> bill: i think the cyber truck is becoming a political symbol. you see it driving down the road and you make an association right away. message for the democrats. looking for something to say.

sitting at home who might be concerned about how it is going to impact them, what i think we should talk about briefly is what i believe is worst case scenario. worst case scenario as a country we bring in 25 trillion a year of total personal income. the total amount of goods we import is 3.3 trillion. if there is a 25% universal tariff on every single good we import, that equates to a 3% tax on taxpayers. not fun, but not the end of the world. so for everyone out there concerned, also recognize the fact that if we do extend the trump tax cuts that would off set that 3%. >> dana: they'll try to work on that next when they get the spending one back. lydia, great to have you here. david solomon was on earlier today. >> the president is engaged with the business community. administration is engaged with the business community.

that's a different experience than what we have had over the course of the last four years. the business community understands what the president is trying to do with tariffs. now the business community is always going to want lower tariffs everywhere in the world. >> dana: what do you think of that? >> the issue is markets want certainty and know exact will i what will happen. when it comes to working a deal or negotiating a deal with another country, trump wants to keep them on their toes and guessing. it is extremely difficult. he is flip-flopping to get a deal done with china and canada. he has to basically bring them to the table. he is using this as a piece of leverage. it is a very interesting approach and messaging we're hearing from him this term as opposed to last term laser focused on the stock market day in and day out. here he is saying it's snapshot. i'm looking at the big picture. >> dana: wait until it goes back up. >> bill: that interview was

with what doge is doing. they are cutting and they are doing some things that i think are very irresponsible and i don't think it is smart for us to further empower that effort. we all think we have to get rid of waste, fraud and abuse and the government could be more efficient. cutting people responsible for monitoring the nuclear stockpile or cut people responsible for monitoring flu or people responsible for monitoring measles. none of that stuff makes sense. there has to be negotiations between democrats and republicans to try to find common ground to move forward. >> dana: if there is a government shutdown a lot more government workers would be furloughed. >> i think whether it's a government shutdown or language that's in the cr they will keep on cutting more people. that's what their plan is right now and end up paying a price for it when they see government not working at all. there is talk about cutting more and more people from the social security department. what i fear is that when people call up social security and can't get the phone answered the
