tesla locations in the valley. >> dana: the f.b.i. is investigating an attack on a tesla facility. several cars set on fire and only the latest in a wave of violent incidents targeting teslas across the country. you covered one last week for us and you are now in denver. >> law enforcement says in las vegas this latest vandal attack on tesla did have the hallmarks of terrorism. the las vegas police department is on the hunt for the suspect who threw molotov cocktails to firebomb some of the cars and also shot a gun several times into different tesla vehicles. they also spray painted the word resist on a building. the f.b.i. says it is too soon in the investigation to say whether the las vegas incident is connected to the others around the country. >> there has been reports of attacks in multiple states ranging from everything from

graffiti and vandalism to targeted attacks where people are using firearms, firebombing a vehicle, arson. it ranges. it runs the gamut. the message is for people to be vigilant but not fearful. >> look at this map. tesla locations in at least 11 states have been heavily damaged by protest vandals. last night attorney general pam bondi addressed the incidents in a statement saying in part quote, the swarm of violent attacks on tesla property is nothing short of domestic terrorism. department of justice has already charged several perpetrators with that in mind. we'll continue investigations that impose severe consequences on those involved in these attacks. including those operating behind the scenes to coordinate and fund these crimes. for example, two suspects in colorado now face federal charges for damaging cars and property with insend rear devices and spray paint at a dealership in loveland. they struck multiple times over

to make their way to the supreme court and the supreme court needs to articulate exactly where the article two powers start and end. the president has to be able to engage in war, for example. needs to be able to engage in foreign types of combat. in the united states we need to have the president be able to protect us from that. i think the president has a high degree of authority to execute on that. if that means that these individuals aren't getting the normal course of due process that even normal illegal aliens might get, so be it. that's the role of the president. that's a political issue, foreign policy issue and he is well within his right to do it. >> bill: this is a district judge, right? i think we found 677 district judges in america. does that sound right to you? extraordinary. blew my mind. i thought there were a couple dozen, not 677. >> dana: big country.

>> bill: what time did the plane take off and leave u.s. airspace and what time did it land and subject solely to proclamation transfer, how many people aboard solely on the basis of proclamation? does a district judge have the authority to get those answers? should a district judge pursue that? >> the judge is looking for evidence whether his order was violated or not by the administration. there is a historical debate about whether the president actually can be even held in contempt by a court or whether the court really has the authority to take certain actions against the executive branch or the president. the president for his part has said and said on laura ingraham last night he will follow court orders. his intention is to follow court orders. sometimes when you have the bam, bam type of transactions where the judge is ruling one thing while there is an expedited action going on, those things

may overlap a little bit. i don't know what the judge's intent is. i think he is looking to see if he should hold somebody in contempt or taking action against somebody for violating his order. there are national security interests at play, though. so there has to be a lot of sensitivity that we're not transitioning the executive authority to the courts to interfere with what the president needs to be doing. >> dana: just in practice in the meantime if president trump and laura ingraham's interview says there are a lot more of these people out there the trick d a & m s13. right now is he barred from sending them out of the country? >> the order bars him from doing that. they are trying to create a due process system. trying to see how due process will work. there isn't much to be add there. perhaps if somebody has evidence they're an american citizen but even whether they are or are not part of that group, i think is presidential and not part of the court. >> dana: thank you.

all grown up now. nice to see you, good morning. what do you think? >> good thing i didn't homeschool my kids. although i am a big fan of it. i don't think i wouldn't have done a good job. >> bill: the state saying you knowed to register and need vaccination history and parents say you are infringing of our rights to take care of our own kids. >> if the illinois school system was doing a bang-up job and setting such a high bar they needed to make sure if you want to teach your kids at school we get it but they need to meet the high bar we have in the public school system because it is a public obligation to educate every child. the problem is that they want -- if they don't file the papers we'll decide they're truant. i'm like i have been asking where the word truancy in the language around this. we have a 30 plus% chronic absentee rate. don't they bang on the door and

tell parents their children are truant? no, they didn't. now they want to go after homeschool parents for having their children be truant. i find it amazing. homeschool kids, i looked up the numbers. they out perform on standardized tests by 15 to 20% above public school kids. if the public school system was hitting the mark and hitting it out of the park and say you have to live up to our standards that's one thing but not the case. >> dana: the teachers unions are clinging on to the past. the parents i think will probably win in the end. illinois state report card reading at 39.4%. math 27.9% is the proficiency. that isn't good enough. governor desantis wrote a piece last night saying good riddance to the u.s. department of education. florida shows how states can lead insuring children learn and become a competitive issue in terms of getting people to move to the state. i have lower taxes, crime is low, and i will educate your

children better. >> absolutely. and florida didn't always have that reputation in their public school systems at all. they are improving. i don't have any problem with public schools making sure that if you say you are homeschooling you are actually educating your children. maybe it should be a little bit the other way around. >> i would agree. put up number one. by the way, this is not necessary lay republican/democrat issues. a lot of democrats disagree with the bill. i don't know if it will be enacted. for the constituents i understand why they don't like it. loss of their autonomy. they lose autonomy over their children. they want to have control of their children's education including the curriculum, how they teach and the philosophy. >> i would be so shocked if members of the illinois bureaucracy were knocking on homeschoolers doors saying are you doing a good job? did you check all the boxes?

have you gone through this curriculum? they don't even have control over what is happening in their public school system. i think the motivation to try to make these people's lives more difficult will be very low. now one of the things that they're saying is they want to have some governance over if you want to participate in public school sports you have to have the same vaccinations. that's understandable. here is what you have to do. it is good for homeschool goods to participate in sports and local school system and gives them exposure to other kids in their community and get involved in sports. lots to come at 3:00. these judges pushing back on the trump administration at levels we haven't seen in any other presidency is very interesting. he is more active in what he is pushing out there and it's one of the reasons you see the pushback. it is a good test of the policy
