steve: it's good to have you. it's good all of you are joining us. speaking of sprints, the president of the united states made it very clear he wanted congress to sprint through debating whether or not we should reform our health care system in the united states. it's interesting, because, if you noticed yesterday, he backed away from that there was a little retreat. he had said they got to vote on it in both houses by august 8th before they go on vacation. now it's kind of maybe before the end of the year. perhaps it's because he is hearing the footsteps not only from republicans but from people in his own party. alisyn: absolutely from the first time yesterday abc news and the "the washington post" released a poll that the president's health care plan has dipped below 50% support among everyone. so up until yesterday, he had, you know, the american people behind him. they, too, feel that the medical system, our healthcare system is broken so they wanted it fixed. now when they add up the cost

and all of the criticism of it, it has dipped. he does want to do it very quickly before it dips even further. but he came out swinging yesterday. verbally against some of the senators who are attacking his plan. in particular, senator jim demint, republican from south carolina. let's take a listen to what demint said about the president. brian: there you go. it looks as though barack obama saw an open. ultimate campaigner. starting this week going to go out to the american people to sell his plan. a national press conference tomorrow at 8:00 eastern time. he says i smell some blood. this reminds me of the mccain battle so let's go after them and say this is politics as usual. here is barack obama with the response. >> this isn't about me. this isn't about politics. this is about a healthcare system that is breaking

america's families. breaking america's businesses and breaking america's economy. and we can't afford the politics of delay and defeat when it comes to health care. not this time, not now. brian: senator demint fired back again. you are saying the same things when you said in the stimulus package and that's been a clofl failure to this point. bill kristol said republicans should go for the kill here and destroy this plan. that, steve, plays into what you said about backing off on the deadline. if the president has a drop dead date of august 6th when the recess begins or august 8th and it doesn't happen, he is saying you can make win or lose out of belief american people, instead, we have got to get this done by the end of the year it sounds as if that whole soak the successful thing is dead on the vine. it's not going to happen. it passed by the house but the senate doesn't want to pass it then they would be tagged as tax

and spend liberals. but it's interesting, the may owe clip nick up in minnesota which is the are preeminent doctor place in the country. brian: cancer any serious illness you want to go to the mayo clinic from around the world. steve: they came out and said this system they are proposing in congress stinks. in particular, they said unless legislators create payment systems that pay for good patient results at reasonable costs the promise of transformation in american health care will wither. they don't like it. they have looked a lot at it. alisyn: that's a stunning one. steve: you have got republicans. you have got some democrats. you have got the mayo clinic. and now you have got delay of game. brian: 10 years $1 trillion. how do you pay for that? nancy pelosi says i have got a problem with moderate democrats who don't want to go along this plan. let's raise the cap. instead of getting on people

make them pay more making $500,000 individually let's just make it $1 million. what if you pay another $30,000 in the plan and in the end we are only taxing 1% of the u.s. households. as glenn beck will bring on in an hour. 1% of those people are hiring a lot of us. and if they are getting taxed more, they might not hire us anymore. alisyn: she is saying it's more palatable when you think of it as a millionaire's tax. you think of the millionaires we all know and donald trump and how many jobs he provides to people and they think better. brian: he will sue you it's billionaire. steve: i am thinking trillion narrow. alisyn: fellow at a think tank. steve: jeffrey anderson.

alisyn: figured out government-paid health care ends up costing more than private health care. the numbers. it gets complicated. you can see here we have done a graft gratify to explain all of this. steve: starting 1970. tracked it through four decades. now he has concluded that per patient the cost of being on medicaid and medicare is now at almost $9,000 per patient. whereas a private health care per patient is 7119. steve: wait a minute, little lady. alisyn: you challenging my math? steve: the president of the united states. brian: just your gender. steve: i'm not challenging that the president has made it very clear that the key to solving this health care problem is to have the government in charge. have the government run it and manage it and costs will go down. yet, this fellow from the pacific research institute has concluded that it has cost over the last 40 years, when you look

at the cost of private health care and you look at the cost of government health care, government health care has actually gone up one third more than the private stuff. brian: if you talk to doctors, they are not thrilled when they get a patient in who has medicare or medicaid. if you are going to make the medicare, medicaid system a national system. not many people are punching the air or saying this is what we need. seven minutes after the hour. what we need is to find out what else is happening behind the health care debate. alisyn: federal reserve chairman ben bernanke is in the hot seat this morning. the fed chair will testify on capitol hill and face tough questions from lawmakers on bailouts and when all this stimulus spending will finally end. bernanke will also have to defend the administration's plan to expand the fed's oversight of companies whose failure the white house says could bring the national economy to its knees.

well, the u.s. soldier kidnapped by taliban forces in afghanistan may now be another country. we are getting reports that private first class bowe berg abdulah's captors may have taken him to afghanistan. these are still photos of bergdahl. they are from a taliban video that fox news has chosen not to air. officials at the pentagon say they still believe bergdahl is in afghanistan but won't provide any more details. he disappeared july 2nd near the afghan/pakistan border. first service man captured in afghanistan since the invasion began. well, a big set back for closing down the prison at guantanamo bay. the white house says it needs another six months to complete a report on how to deal with the detainees there. the report was supposed to be finished today. president obama says he still wants to shut down the prison by the end of the year but white house officials cannot decide on how to interrogate prisoners or

where to put all of them. and it's wakesup time in space. shuttle endeavour and the international space station astronauts are just getting their wake up call. today, the space shuttle's robotic arm will do some work and the astronauts will participate in a twitter youtube event. twitter is everywhere. even in space. brian: i think they are going to be on it. alisyn: meanwhile on jupiter, check out what nasa's telescope captured. see that big white circle? astronomers think an asteroid hit the planet. five months after being beaten bloody, chris brown -- well, he is the actual culprit, now wants you to know that he is really,really sorry for what he did to his ex-girlfriend, rihanna. >> i am very sad and very

expected? how you can ask for a health care plan while things are worse than we thought. joining us now republican political consultant andrea tantaros and juan williams known simply as juan when we are in the break. juan, first off, why is the president delaying? is this politically savvy of him or is this showing something that will kill his health care program if we find out how bad the economy actually is? >> well, i think both are true. you know what? the white house points out that if you look back to the first year of george w. bush or bill clinton, the same report wasn't released until late august or even september. but i think it's also true that they are not interested in putting out bad news about the economy, given all the talk about the high cost of this health care proposal. brian: right now, andrea, the current deficit, it looks to be four times what it was last year at 455 billion. george bush left it the current deficit looks to be $1.8 trillion. if you are going to propose a

health care program that's going to cost a trillion. maybe now is not the time to release the numbers. >> time is not on his side. the white house is using the excuse well george bush and bill clinton delayed their budgets yes, but barack obama prom missioned us extraordinary change. not the status quo. he was going to be the most transparent administration we have ever seen. but, look, you said it. quadruple deficit. unemployment skyrocketing. the they didn't just misdiagnose the patient they screwed up the patient. these numbers reflect that they don't want this to get out because it will hurt their credibility. brian: rasmussen did a poll. whatever it means for the next presidential election. barack obama and mitt romney if they had an election today overall in a dead heat. 45% to 45%. this is a guy that trounced john mccain who trounced mitt romney 53% to 46%. how significant? >> not at all. in the business of american

politics, if you had a matchup right now with barack obama versus romney, barack obama would not only crush him. it would be the biggest landslide. i think we would go back to 1964 or something. it would be unbelievable. numbers like that pop up right now. romney has in terms of his economic background. people may be focused on the economy. barack obama seems to be in a summer slump. that's all i would put to that. >> no, no, no. i think this is a growing trend. i will agree with yuan this poll is a snapshot. it's early. barack obama's polling has nose dived 15 points in the last three months. i wrote a column a month ago. health care is going to end obama's honeymoon. i predict a rose. the bloom is falling off obama's rose. is he going to become very unpopular in the coming months. brian: will he get his health care program by august 7th? >> >>

most sites and espn is going after anyone who continues to publish it what if this happens to you. what are your rights? steve: privacy lawyer michael fer tech is the ceo of reputation defender. he joins us right now from san francisco. good morning, michael. >> good morning. how are you? steve: she is furious. i don't blame her. it was either a peephole or hole in the wall apparently in a hotel in omaha now when she was coverage the college world series. i understand there are protections state by state but in some places there are no protections if this happens to you. explain that. >> the federal law in this field is actually pretty new. there is no protection against peeping toms in federal law unless you are sitting on federal land which is pretty remarkable. about half the states have protection against peeping tom provisions but they tepid to be against the person who actually made the video or the photograph at a n. a particular case. not against the web sites that are most the content. in fact, the law of the internet

is very clear. if a web site is hosting content. put there by somebody else, then the web site is, in fact, fully immune from liability associated with the content posted by somebody else. alisyn: how can this be, if this is ill gotten gains as we say of a peeping tom voiristic video. why wouldn't all the web sites that put it on be liable for something? steve: accessories? >> so you are right. a lot of people think the peeping tom activity is actually a crime. in half the states it appears not to be. and the way the internet law has been set up since 1996, it immunizes web sites for content that's been put there by third parties. it's not the law as i would have create it. it made sense in 1996, but it may not make sense anymore. now in 2009. the internet has grown up. it has matured. it is no longer what it was back in 1996 when the only way to go to the web was to say aol or

if we don't act, medical bills will wipe out their savings. if we don't act, she'll be denied coverage because of a pre-existing condition. and he won't get the chemotherapy he needs. if we don't act, health care costs will rise 70%. and he'll have to cut benefits for his employees. but we can act. the president and congress have a plan to lower your costs and stop denials for pre-existing conditions. it's time to act.

when we actually got to 1990, it cost $66 billion. these people have no idea what they are doing. as evidenced by barack obama now holding back his his budget and half a year budget. you have to come back and say ok this is what we said and this is what it is doing. he is holding back because those numbers are all out of whack. at this point we are going to give him a third of the economy to run? bill. steve: he said bush and clinton did that too. >> i thought we were in the new era. why are we playing the politics of the past as he likes to say. alisyn: nancy pelosi has suggested some people are balking at paying all of this including freshman democrats who represent some of the richest regions in the country. las vegas, northern virginia. their constituents don't want to pay for it nancy pelosi says ok, let's just make it a millionaire's task. >> i know. isn't that great?

longest time and they thought that mitt romney was going to ride the massachusetts health care program right to the white house. did not work out well. you did something on your show that reviews what massachusetts did and what the country shouldn't. let's take a look. >> for years, progressives have pointed to massachusetts as the success story when it comes to universal health care. but is the three-year-old plan crafted by democratic lawmakers and republican mitt romney really such a success? while only 2.6% of the state residents are uninsured. a sixth of the national average, and by far the lowest rate in any state, the plan is farm from the beacon of hope it's proponents make it out to be. public citizen and physicians for national health program released a report earlier this year calling the program flawed due to its costs, alaska access to care, and the remaining number of uninsured. massachusetts is now spending $595 million more on health insurance than it did in 2006.

agenda apparently on the slide. a new poll shows on the president's to most important issues, health care and the economy, his approval ratings have dropped eight points. some prominent democrats are questioning the president. john caskik joins us live. i cited the washington post poll that shows less than 50% of those in the country support the president's health-care initiative. a new quinnipiac poll asked ohio voters, do you approve of the way president obama is handling his job? back in may, it was in 62%. now he is down 13 points to under 50%. what is going on with the president in ohio? >> i think it is happening really around the country in our state, the unemployment rate is up significantly. people are very concerned as to whether they are going to find a job.
