micromanaging what we can and cannot do. mr. obama does not get that he is still using his power to demand his vision of social justice. >> if you attach a surtax to people making 280,000 or more. isn't that, in fact, punishing the rich. >> no, it's not punishing the rich. the way i look at it is if i can afford to do a little bit more so that a whole bunch of families out there have a little more security when i already have security, that's part of being a community. bill: wrong. that's being forced to fund obama's vision of what's fair. being part of a community means voluntarily helping your neighbors by charitable acts and donations. we americans lead the world in that. look, the feds need to provide convict oversight on the health care industry. it's out of control. the price gouging, sleazy lawsuits, insurance cons and the like need to be policed. weave all know that. guidelines for fair medical treatment need to be established so the folks can catch a break. all of that is true.

but president obama and his gang cannot run the health care industry and if they try, they are going to create chaos for the entire nation. the folks know that. and that's why the president is taking a beating. he doesn't understand that freedom trumps ideological legislation. and that is the memo. now for the top story tonight, reaction for this. with us now jamie floyd and tara. both are democratic strategist who support president obama. jamie, i'm glad you are here. you worked with hillary clinton on the first health care fiasco. this is day jaw view all over again as joking guy berra said, is it not? we in the clinton white house, spent weeks, in fact months preparing legislation that we then sent up to the hill here, president obama has suggested some broad policy proposals to those on capitol hill who have now devised some legislation. >> we are have this debate

somewhat in a vacuum. bill: here is why it is similar. here's why it's the same thing. people come up to me and say hey, bill, what's this health care thing all about? i don't know. you don't know. tara doesn't know. nobody knows. it's more than a thousand pages coming out of the house. nobody knows what it says. everybody knows it's a trillion dollars over 10 years but nobody knows what it's going to do. obama says it's not going to change your health care. other people say it is. this insurance is going to go out. people don't like confusion. this is mass confusion. >> we know it is about ensuring the uninsured. we know -- we know it is going to cost money and be honest about that. bill: it's going to change our lives. >> we know it's 17% of the american economy. that he was why. bill: but those are all stats that don't matter. >> it does matter. bill: no, no, it doesn't matter. here is why it doesn't matter. >> feel the effect of it and we have to be honest about that. bill: we are honest about it and why americans are turning

obama failed to lead. look, there is a lot of rhetoric going on. his theory that health care should be fair and accessible to americans is correct. it's correct. he can't -- either he doesn't want to or he is not smart enough. to ache particular could you late. go ahead, tara. i have to refute that. come out with legislation. bill: and they blew it. miner people have been investigating. this that's why there is also a lot -- absolutely. the tax on insurance benefit that's gotten blown up. that's gotten thrown out of the window. that's a beautiful thing. >> as part of the democratic process. >> complicated world. people want to know what they are going to buy how much it's going to cost them and who is going to pay for it none of those questions are answered.

captured the soldier. now they are using him as propaganda tool. there may be more to this story. joining us from washington lt. colonel ralph peters. ok. why don't you just lay out what you think happened here first of all. >> well, let's lay out what our military knows happened, bill. first of all, i asked a very senior military leader for a yes or no answer. is pfc bergdahl a desserter? the answer was yes. according to the military code of justice at a minimum he is awol in a war zone. he told that story on the videotape and the tall back about getting separated from a unit during patrolled army also knows he left his outpost, his buddies in the hours of darkness, left his weapon behind of his own volition. that's what we know. the story about patrol is

has been turning this -- not necessarily awol in combat zone and some kind of hero. why does it make me angry? because we know bergdahl's name. how many know the soldiers and marines fighting through crippling injuries at our military hospitals. the names of those who came home with flags over their coffins because they did their duty. they get no media attention. bergdahl gets it all. bill: i don't see anybody in the media glorifying him. >> yes. obviously air america, et cetera cetera. they paint him as a virtual hero. they are not questioning. the other networks aren't doing the investigative work say what's the circumstances. can we talk to the guys in his unit? now, the army is being quiet about this for a very good reason. bill: they are embarrassed and they want to get the guy back. >> that's important. it's also a legal case.

bill: beginning there is something very strange about the story. seven people, there they are, have been arrested and charged with first degree murder. that is highly unusual in a home invasion situation. one theory making the rounds couples were victims of a hired killing a hit squad may have assassinated them. with us now is our legal team attorney and fox news analyst lis wiehl author of the book "face of betrayal" good beach read and attorney and fox news anchor megyn kelly. one of the reasons i want to make everything clear we have that kid blacked out 16 being

charged with murder in florida. the authorities say the hit team assassination thing is bs, correct? >> the sheriff's office told us that is not a motive that we are pursuing. they didn't this report that was in the daily beast citing two unnamed sources who they said were position of know. publication said this was, according to one of the people involved, a contracted hit. that the price was between 20 and 50 grand and that this guy, i guess, leonard gonzalez who is 35 years old, according to everybody, was the main guy behind the operation. bill: trigger guy and they could steal whatever they could steal on top of the 20 to 50 grand. bill: if that were the case they wouldn't need seven people to hit them. i don't believe that for a second. now we understand wiehl that the drug enforcement agency is on it. and that raises all kinds of questions. obviously, it's a local crime in florida. the feds come in. what do you know about this? >> why are the feds coming in? why would the d.e.a. be coming in unless there is some drugs

involved. apparently prescription drugs in the safe that was taken. but these are like kid prescription drugs, you know, because they all h. all these children with special needs. bill: it's not that. >> it's got to be something more than that we also know, it's been reported anyway that the couple was having financial trouble to the point where they actually sued their own son for child support of another child, a granddaughter. there is a lot of stuff coming out here. bill: so we don't know why the d.e.a. is down there then? >> no. but the d.e.a., the drug enforcement agency, come on, they are there. bill: there has to be some kind of suspected trafficking component in that. >> the fbi is already involved. just want to get the feds involved you have that. bill: why is the fbi involved. >> looking at the surveillance pictures to glom on those surveillance pictures. >> there may be a question about whether this crime crossed state lines. that's always an excuse for the feds to get involved. the thing that jumped out in me in all the articles i was reading in preparation for tonight. that is this weird behavior by one of the victims bird billings ohio hadn't heard about before who apparently tried to

copyright the names of those children and whenever the division of child and family services would send him a letter about the children, inquiring about their status, he would send them back a threatening letter demanding tens of millions of dollars for the use of the children's names in the letters dcsf was sending to him. i don't know what that tells us. it raises a question about one of the victims' mental state that i had not yet heard. bill: the whole thing is insane. we will unravel it we want to give everybody an update. here is a very interesting thing. in italy there was a young woman who was dating and then she decided to become a nun, all right? a sister. >> good for her. bill: she entered to study to become a sister. all of a sudden her exboyfriend who didn't want her to become a nun, wiehl, did what? >> he put nude pictures of her up on facebook, you know. bill: worldwide? >> worldwide. now the problem is though i may be going to hell for this, bill. you have to tell me.

bill: i don't know if i have that kind of connection. i will try to find out. >> she doesn't have a case. because these pictures were taken on vacation where obviously she consented to them being taken on a public beach. bill: is this topless. >> oh. bill: it's everything? >> i disagree. she doesn't have a case for invasion of privacy or copyright. she could sue for intention of emotional distress. that's the claim. you need extreme and emotional conduct. she poses for a private photo with her then lover, before she was a nun. now this guy, to prevent her from becoming a nun post them in international forum for everyone to see. you have got a pretty good argument. bill: does facebook have any responsibility? >> facebook has told us they are going to take the pictures off. bill: i think they already have. >> they have taken them down. bill: do they have any responsibility to make sure these pictures don't get up in the first place. >> they have a policy we don't allow nudity. they have an obligation to live up to the policy. if they don't, you can't sue

them. bill: bottom line on this story is, number one, the privacy rights of everybody in the world are gone. would you both agree? >> well, certainly if you are posing out there and. privacy rights of everybody in the world are gone. if somebody can take a picture of you through a window, through a keyhole. >> but that's not true. that's not true. that's different. bill: they can put it on an internet site, and you can't get the site. you might be able to get them. >> can't get the site, true. bill: but if you don't know who they are, which is very -- look, wherever i go, and i'm not saying this out of any conceit. people are taking pictures of me with their little cell phone cameras. i smile, i walk, i keep moving. i don't do anything. but i can't stop any intrusion even on my own property. >> no in a public place. it's a totally different story. you have a zone of privacy still even if you are a public figure. >> the damage is already done. the pictures are already on

facebook. we have the espn reporter. bill: that's what i'm trying to get at. everybody should understand that privacy in the world is gone. they get your medical records, they get anything, psychiatric records, they are going to throw it on anonymously. particularly if you don't know who they are, it's going to go out there. and that really has been the worst thing about the internet. >> well, that's the problem is that the courts have given them blanket immunity to the web site providers. bill: ladies back in a moment with the shocking story out of rhode island. this is hard to believe this is happening in america. children in rhode island are legally entitled to work as strippers in night clubs. and then: glenn beck gets a little frenzied on the radio. he will be here to analyze his he will be here to analyze his own behavior. you have questions. who can give you the financial advice you need? where will you find the stability and resources to keep you ahead of this rapidly evolving world? these are tough questions.

bill: continuing now with is it legal and this situation is simply shocking. the state of rhode island is a very liberal place. some of the laws there are flat out disturbing. earlier this year providence police are investigating a 16-year-old run away who was found working as a stripper in a nightclub where alcohol is served. turns out that rhode island says it's ok. the children are legally entitled to strip for money as long as, quote, they are home by 11:30 on school nights. unquote. you can believe it? shouldn't the authorities check their home work sh work, too? >> so shocking how can this

happen? >>this is ridiculous. basically it was a loophole in the law. they said, you know, you are allowed to strip and they forgot to exclude people under the age of 18 from it. bill: it's more than that and the d.a. said the law says it has to be lewd or indecent and this doesn't qualify. bill: that's what the d.a. said. they didn't base it upon a loophole. they based it upon the age of consent in rhode island is 16. so that you can consent to any activity as long as it's not illegal. >> it is still illegal to photograph it you can have sex illegally in rhode island but if you photograph it or somebody films it, that's unlawful. if you take off your clothes in a strip club that's fine. bill: you can get them with the alcohol business, wiehl, you should be able to get them. you can't have people on the premises where alcohol is served. >> guess where they say that in nevada. las vegas says that. you can't have kids under the age of drinking age anywhere near alcohol. so here in las vegas, which is supposed to be this crazy place, it's not allowed. but, let me tell you another

they gave her a plan to help this kid get in better shape. this kid is not knocking on death's door and this mother is blaming it on oh, is he sneaking snacks. guess what, you don't get that heavy without help from mom and dad. she should be held responsible. she needs parenting classes. he needed the state's intervention. >> she may need parenting classes and help. she needs help not prison. if you send this kid to prison. is he going to get more depressed. bill: the kid is already in the foster home. >> get him out of the home which they did. >> single mother with three jobs. >> look what a job she did. >> we have no idea what medical issues he may have. he may have throid issues and million different things that have nothing to do with her parenting. >> why don't we know? because the mother didn't get him tested. she didn't bore to look out for her son. >> how about the fact they said you show up in court or we are throwing new jail. she got scared. >> she made a run for it. bill: how can you make a run for it if you are 555 pounds? >> ignored the court order and
