arresting somebody when there was already proof that they were in their own home. >> julie: yesterday he called his choice of words unfortunate and called both gates and the arresting officer, sergeant james crowley in an attempt to diffuse the situation. it began on monday when colleague responded to a call of a reported burglary at his home in cambridge. it's a city got home from a trip and could not get into his house as the door was jammed, so he and his driver tried to force it open. at the time police arrived he was inside. officers say gates did not show them his idea first and then verbally harass them. that's when police arrested him for disorderly conduct. dates accused the department of racial profiling. charges against him were later dropped. courtney keeley is live in cambridge massachusetts. berger this weekdays is running up his legal team. this is a marked change of tone.

the suspects arrested by the fbi which had been monitoring that group of yemeni americans. by work arrested or buffalo in september of 2002. another was picked up in bahrain. they all pleaded guilty to terrorism related charges. sending the military would've raised legal questions since the constitution bans unreasonable search and seizure and in 1878 law called posse comitatus prevents the military from acting in a law enforcement capacity. >> is a military man, if i was asked, i would say no, i don't believe you need to do it, because we are trained in the posse comitatus act is very important to us and we're not trained to be law enforcement. we are good at other things. so my recommendation to them would be don't do it. to back vice resident cheney reportedly urged the president to consider sending a military arguing that national security in the wake of 9/11 or did such

to my president obama said the democrats in congress will set up an insurance exchange where small businesses can shop around for a health insurance plan for their employees. listen to this. >> small businesses that choose to insure their employees will also receive a tax credit to help them pay for it. if a small business chooses not to provide coverage, its employees can purchase high-quality affordable coverage to the insurance exchange on their own. >> he says low income workers will get money from the government to help pay for their health insurance. >> julie: so how are republicans responding to give. >> republicans point out that both the house and senate have versions of healthcare reform that hit small businesses with significant taxes if they don't provide health insurance. the gop said the democrats plan is "a prescription for disaster." listen to this to make because the democrats plan is bankrolled by a small business tax, or jobs

two on a fox urgent a massive manhunt underway for the suspected killer or killers of a border control agent. the shooting happened thursday night at the border fence near campo about 60 miles east of san diego. the fbi and police are searching hospitals on both sides of the border. they said the blood evidence at the scene could help them track down who is responsible. >> we do believe it is a wound significant enough to cause blood and cause the person to bleed which leads us to believe that it may be a wound that could have, would have required treatment. >> julie: agent robert ross is was shot tracking a group of people presumed having crossed into the country illegally. this 30-year-old father of two, a husband, the first border patrol agent to be fatally shot in the line of duty in a decade. christina davis is tracking the

story for the san diego union tribune and she joins us on the phone. her stinger, i cite the reports out of san jose that were saying three people had been arrested at an area hospital. has the fbi commented on any possible arrests? to make the fbi in san diego is not confirming those. san jose police said that yes, there is a federal raid at the hospital, they assisted the fbi in arrests, but then i have not said if there's any connection to the shooting death here at the border. all i would say is so far that they are following several leads, but they are being pretty tightlipped on what the leads are. >> julie: to have any idea what the lead could have beenetter them to that hospital he said they raided? snakiness reports in san jose where that it was a ping on process cell phone that possibly lead them to the hospital, but once again, we have not confirmed those reports to the fbi here. >> julie: any of his belongings

missing? >> we asked that question at a news conference at order patrol headquarters yesterday, and the fbi and border patrol and want to get into those specific details, and whether his cell phone or his weapon were found there at the scene or they were missing due on his cell phone and weapon are missing? >> we don't know. they have not confirmed that. >> julie: tells the evidence at the scene that indicated one of the suspects was injured during a confrontation? america did say that there was blood found at the scene and i guess that was enough like to think maybe it was a gunshot wound or significant enough that someone might be getting treatment at a hospital or clinic. i think that has been a focus of their manhunt on both sides of the border. >> julie: i want to know more about the person mexican authorities appeared to have in custody right now and they're questioning him, i understand. this person was found in the accident side of the border shortly after the shooting. what about him to give to make a

script. he was on the mexico side of the border right in the same area around 130 or 2:00 am a few hours after the shooting took place. apparently he was armed with a gun, typically used by mexndan soldiers are by law-enforcement. and it is illegal to have those kinds of weapons and mexico. so he was arrested on a charge. but they are questioning him to see if he is involved in the shooting someone is not named a suspect yet. >> right see what think you very much christina davis. >> border patrol agents to a very dangerous job tracking down darko terrorists and dealing with increasing violence all on the border. but robert process is the first agent shot and killed in the line of duty in more than ten years. joining me now, scott weber, counsel for michael chertoff at the department of homeland security. take you for talking to us. this is such a devastating story on so many levels. this agent was a 30 -year-old

father of two small children. justice. when will we see it and what's being done to find these killers now seem actually, there is a massive manhunt underway with several federal agencies. the fbi is the lead on this because the killing of a federal officer is a federal crime. so the fbi in conjunction with department of homeland security, the ice component which is immigration's access to enforcement and the border patrol's working with the san diego sheriff's office and our counterparts in mexico two try and hunt down the killers of agent roses. >> julie: from what we know, the officer responded to the first incident alone. i understand the president of the border patrol unit and -- you expressed concerned over the increasing danger agents face especially since they often patrol desolate areas alone. often they don't have time for backup -- back up to -- for backup to arrive. why is that? >> it's not entirely clear that's the case. we know the agent must real

contact with other agents. they heard gunshots fired, they responded to the scene very quickly as those local law-enforcement first responders. the southern border is tremendous. it's immense. the border patrol agents, though there are thousands of them, have a very difficult job. the increase in the narco terrorism as well as the coyotes who smuggle drugs and individuals across the border, they become more brazen in their efforts over time. it is probably one of the most dangerous law-enforcement jobs out there. >> julie: you mentioned in your previous answer that the killing of a patrol agent is a federal crime. here's the problem: what if those involved are across the border. would we do then? >> the hope is with cooperation from our counterparts in mexico, that they will extradite individuals to the united states for prosecution. >> julie: that's a very sad to know that it doesn't seem like there are enough forces on the border to control the drug traffic to keep our border

patrol agents safe. am i wrong to assume that? >> julie, you're talking about hundreds to thousands of miles on our southern border as well as our northern border. the department of homeland security has worked hard to leverage off of technology and other devices as force enhancements to help patrol the borders, but there's only so much that can be done with the vastness of the borders. >> scott weber, thank you very much. >> think you very much, julie. >> julie: all 13 astronauts in orit now enjoy a little downtime this weekend. but she's her downtown. there shouldn't -- -- much-deserved. downtime. they've been told to take a day to relax. the first often more than a week. these astronauts been busy. they finished four grueling space rocks before maintenance on the space station, and have a market on monday. and ever and its crew are scheduled to return back to earth at the end of the week. >> nasa scientists using the hubble space telescope to capture this incredible shot of an impact on jupiter. i got for jupiter.

seem actually, this is some very cool stuff. a lot of people are reliving history over this weekend. but you don't have to be a history buff to really appreciate the beauty behind me. i will step out of the way and let you take live look at what we're talking about hear. the uss hornet is back here in the san francisco bay, tilt and served in world war ii and the tours of vietnam, which is perhaps best known for her mission, 40 years ago in july of 1969, the massive aircraft carrier and its team were responsible for plucking the apollo 11 astronauts and space capsule out of the pacific ocean. once they return home from that historic visit to the moon. president nixon even money on the hornet to meet with the crew at the time or it is short time ago, i had the great fortune of speaking with buzz aldrin and he told me he is still humbled, all these years later, but -- by the experience. >> they loved the nation. they loved the spirit that are presented by this museum. this memorial to service. of people.

courtney keeley is live in cambridge, massachusetts. earlier this this week it's was running up his legal team out a pretty big change of tone. >> absolutely, julie. a very significant change in tone. he was just saying he was outraged this could ever happen to him, to a black man in america, that it was completely racist, that it was outrageous, and he even said he would make it part of a documentary is going on racial profiling. now after president obama came out on television in canada called everybody down, cooler heads have prevailed. he is vacationing this weekend we are not hearing any statements from him and we have to see if they have that beer, julie. >> julie: i want to be able to see pictures of that. what about sergeant crowley? >> sergeant crowley talks about the fact that he was really consulted by being accused of being a racist. he has given detailed -- a detailed interview to one local news station where he talks

exactly what was happening. he went up to the door, how you didn't know who this gentleman was, what he wanted to do, they got insulted. ultimately you have to never the professor was arrested for disorderly conduct. it's also tedious once a nice weekend with his family. he said he regretted it because he didn't want to become a big issue. >> julie: think you very much. >> the exiled president of honduras rally of his country's border again today to challenge the powers that kick him out of office. he was speaking to supporters in the garage watches steps from iraq was border with honduras. the embattled leader said he will set up camp there until his family is allowed out of the country. celaya was ousted in a military coup last month after he allegedly attempted to change the constitution to give himself an office. just yesterday he briefly crossed the border into honduras. steve harrigan is neither in the capital on doors about 50 miles

from where celaya tried to cross. hi steve or it can actually, this increasingly bizarre story has taken yet another twist. for the past two days we've seen the ousted president of honduras, and while celaya. he has been at the border region between the tarawa and honduras. weekly crossing over underneath the chains that marquette area just a few feet and across the back internet nicaragua. he vowed to margin, he vowed to be led and protected by his supporters he thought the soldiers would lower their weapons and let him in. that's not what happened and now a new twist. the ousted president said he will camp out on that border until he is legend. of course this move accompanied by dozens of television cameras as really increase the pressure and attention. but opponents of/it's a reckless move. a move that could lead to death or injury of some of his followers. the interim government leader here said it was a silly thing
