for clunkers. is the program off the table because the money ran out so quickly? >> the department of transportation says that we are of of money, but the white house says that we are still evaluating and very popular program. all indications are that the white house wants to keep this going to help the auto industry. we should be getting an update later this hour. we will bring back to you. bill: thank you. megyn: gm is reversing its decision to close dozens of dealerships. they admitted their error after analyzing the finances of about 50 dealerships. some dealers credit letter- writing campaign to end the help of local officials. chrysler, in the meantime, has not reversed any of the closings

that it was given. bill, andrew cuomo says he large -- nine largest banks receiving your taxpayer money has played a game when it comes to issue in lavish bonuses. he says 5000 employees from these banks got at least $1 million bonus. the three financial institutions that awarded bonuses were substantially greater than their net income includes 1600 workers at j.p. morgan. the same goes for just under 1000 at goldman sachs. in the meantime, congress wants to make sure that they have a say in wall street compensation. the house is expected to pass legislation to give the fed's a direct role in how much these executives are paid.

megyn: it has been six months, so it must be another -- time for another stimulus package, right? a house democrat is asking to clear the way for billions of taxpayer dollars to overhaul the nation's transportation system. it is now really the time for that? who is behind the proposal? >> jim oberstar, a 34-year veteran of the hill. he does believe that now is the time to tackle our infrastructure system. he is proposing a six-year, $450 billion infusion to improve the infrastructure of the country. he says the time to do this is

now. megyn: you are telling me another half a trillion we spend on transportation? correct me if i am wrong, but that stimulus money was to go to shovel-ready projects, many of which had to do with transportation. >> that is right, if you go to recovery.org, it shows that $150 billion will be in views into the infrastructure system. actually, the department of transportation only received $41 billion of that money. why we have not heard more about this transportation bill is largely because the white house is not on board with it, which is a point of frustration for oberstar. >> we are ready to take it to

the floor. >> why is the white house not billing with this? >> i do not know. we need 18 months to study the issues. >> he believes the time is now for this particular bill, which she has described as a second stimulus. megyn: you have virtually every member of congress working on health care and trying to find a way to pay for a $1 trillion health care plan. now he wants another half a trillion in spending on transportation? how does he plan to pay for this? >> it would be over six years, and he had provided a list of suggestions including an array of taxes and fees, including increasing the gasoline tax.

there is a container tax, free shipping tax, a national car registration fee. there is a whole array. that is in the hands of the ways and means committee, but it is likely those items that is causing the white house not to support this bill. and you also have the health care battle. they would probably like to get that done first. megyn: is there anyone else who is behind this? >> on the transportation committee, there is broad support for this particular bill. what republicans would like to see is the red tape removed so that they can get projects done faster. there is support on both sides. the outgoing senator from ohio,

megyn: texting while driving is to blame for yet another accident. this one was in upstate new york. it took to calling several vehicles smashed into a smaller car at full speed and then landed in a swimming pool. the driver who was hit have to be flown to the hospital. her 8-year-old passenger sustained only minor injuries. officers say the driver admitted to texting and talking on his cell phone in the moments leading up to the accident. bill: back to the issue of health care reform. a house committee voted on and and and, if passed, may allow for taxpayer dollars to fund abortions, and it was right after that vote were a committee held a second vote on another amendment that shot down the idea. it was shot down by two votes.

with me is a member of the house subcommittee. good morning to you. it is still not clear to me by their taxpayer dollars in this reform bill will take taxpayer dollars and fund abortions in america. based on what is on the table, is that possible? >> yes. most people who are pro-life believe that this will allow a taxpayer money to be used to fund abortions. one of the leading proponents of opposing taxpayer punt -- funding argues that this will come upon the use of taxpayer funds if the hyde amendment is ever appealed by the congress. what the language says is we will segregate money, but you only do that to pay for procedures and other taxpayer

money wind up paying for the whole process. using taxpayer money to pay for abortions is offensive, even to people who are pro-choice. bill: that is in committee? >> some would argue that it is not. that is one of the disputes. there was a lot of arm-twisting and a lot of pressure brought by the speaker and others to produce a result, which most believe will result in tax. being used for abortion. bill: it is my understanding, and correct me if i am wrong, if certain taxpayer dollars are going to certain insurance agencies to cover their programs, and they are covering you for, say, a prostate cancer, then they also cover

programs that fund abortions, perhaps you could use that money and a shell game and ultimately reverse the cost of an abortion. is that correct? >> exactly. beyond that, there is language that compel the public plan, but said that it will do so with private money. it is a shell game. bill: are you satisfied with this? >> i am not. the president has said over and over that if you like what you have, you will be able to keep your plan. we took language out of the bill that said that if you have a program you like, you could keep it. the bill says every policy in america, whether it is individual or employer based, has to change in the next five years. even if you like what you have, you will not be able to keep it. last night they rejected every

amendment to give you the right to keep your plan. bill: did you think a bill was even going to emerge from your committee? was it not your committee that 15 years ago never produced a bill in the first place? >> there is an open question as to whether they do produce a bill. one of the blue dogs who had this kind of -- decided to cave in apparently just recently changed his mind and will not go along. it may get out of committee without a full debate, and members of both parties are going to get blustered. i think it is very much up in the air. the speaker is determined to drive this through, no matter what.

bill: why do you say that those who vote for it will be blistered? >> people think it is wrong to use public funds for abortion. seniors who have seen language that would suggest that they would just go away -- seniors are very upset. i understand aarp members are being told to call the president's office to say that they support the bill. i think there will be union members who will see that this will continue to hurt them by saying they do not have a remedy when the plan wrongfully denied them care. i think this will be in very interesting issue. bill: thank you. megyn: four guys drinking beer around a picnic table, and the whole world watched, so what is 80 -- was it a teachable moment?

megyn: a follow-up on this story we brought you yesterday. four police officers are on administrative leave, accused of trying to cover about a traffic accident from one of the hon. their plan was to blame the victim. they thought it was easy because the diver that they pulled over at a few drinks. they may have gotten away with it if it was not for their dashcam. brian wilson is in florida with

the latest on the story. he spoke with the police chief, and he is with us with an update. >> two years ago, the fbi arrested four police officers here because they say that they were protecting a drug and gambling operation. now the police department here is embroiled in another scandal. video cameras never blank, and sometimes you forget there are there. that was the case last february when do we presley decided that he would make up some stuff on an accident report to help a fellow officer. >> that is the board county

public defender, a 31-year veteran. >> these officers clearly conspired to manipulate the truth, and they did in when nothing was at stake. >> two cars pulled away from a green light the night. one car stopped abruptly and a police car plows into the back. the lady has been drinking, and she has her own problems, but the policemen was technically at fault because he did not stop in time. when his fellow officers show up, they tried to make up a story. she said it took forever to get their hands on the video. the video sent to the state attorney office was edited to remove those comments. he said that they later repeated

the story that they made up in sworn depositions. all the officers could do jail time if convicted. we wanted to ask the police department about this, but they were less than accommodating. nobody can talk to me? that is coming from the chief's office? thank you. it is hard to estimate how serious this might be. many of the cases over the past year that these police have been involved with are now in question. if you cannot believe what they say under oath, they may be thrown out. megyn: we spoke to mark by largehglarsh and he is from the area. we saw your best efforts to speak with the police to get a statement. are they saying anything?

>> in fact, after that report ran earlier this morning, the police chief came over and visited for a moment. he did not want to be interviewed, but they will be holding at 11:00 press conference to bring people up to date on where we are in the investigation. i should say, the charges were dropped against the woman. i think we may see a lot of that in the next few days ahead. megyn: find that it will be millions against the police department. -- i bet it will be millions against that police department. bill: new swine flu number is expected today from the cdc. they are worried thousand could die from the virus in the coming year. when will we see a vaccine, and will there be enough?

stu varney is with us now. what are the trial lawyers -- those pour trial lawyers -- what is it that they want? >> they sued in dr. for malpractice. my client is in such pain. they take one-third of what they win in court, and personal expenses. they want those expenses deductible in the year they occur, not in the distant future when the payoff may or may not come. this is a direct payoff for their support of the democrats and president obama. listen to this from linda. this is what she told the litigation group. these are the people who brought you the fences of caesarean sections.

megyn: she is helping the trial lawyers? >> yes, she was speaking to the litigation group. she said we are not going to get a stand-alone bill just to help lawyers, but we have to put it in somewhere. direct payoff for political support. they are a special interest, which is not supposed to exist. megyn: they know that these lawmakers will not vote for it. the other problem that critics have raised with this is if you give these plaintiff lawyers, who work on contingency fees, another incentive to file, break away in will lead to more lawsuits. >> essentially the lawyers have bought off any talk about this

health care debate. it is one way that you could reduce the cost, but lawyers are not considering that. megyn: by the way, the intro put this on to the democrats. however, i am told there is some bipartisan support. there are some republicans who are on board? >> no doubt, they will be able to get some of them. i cannot imagine many republicans being opposed to tort reform. megyn: maybe it was that 4% who got those donations. in any event, another day, another handout. thank you. bill: the cdc keeping a close eye on the spread of the h1n1 virus. they are set to release their weekly numbers. at last count, it killed 302

last five years, but right now is a season for decision. they are looking at the funding that will be coming along for nasa. there is a panel set up by the white house which will report by the end of august and lay out some options. they are waiting for their marching orders, finding out what their future will be. bill: do you support keeping the program in place until they get further down the road? granted, it is expensive, but any other option is, too. >> the option is to keep it and not wanting anyone from here. we could send people up with russian astronauts. i believe that would just delay the switch to this newer vehicle

scene of the crime. nobody knows more about watergate then you do. what do we know about this? the tape was erased in part. many thought that that was going to be the thing that confirmed his criminality once and for all. now what? >> when news of this was surfaced, it was damaging to the president. we are talking about a conversation between president nixon and his chief of staff that took place on june 20, 1972 read days after the famous watergate arrests. those 18 minutes were missing when prosecutors got their hands on the tapes. there were about five separate erasures made to the tape, which means that it was not an accident, as the administration claims, or they were not very skilled.

strategist came up with an opinion on this and said the president's involvement send a clear signal that there is a president in the white house that understands opposed racial issues and will not ignore them. they say he is right to bring about the reconciliation here, saying he had done the country good by injecting himself into this. do you agree? >> here is the situation. you want a president who is sensitive to racial issues in the country. president obama, as the first african-american president, is right up his alley. when he speaks about this, he carries a great deal of authority, but without having the full set of facts -- which is on my camera -- the first -- he first made it into racial

was allocated for it has all been spent. mike emanuel is on the white house lawn. what are they saying today? >> the message from robert gibbs is if you are considering buying a car this weekend with cash for clunkers, you should go ahead and do so. the white house is working with bipartisan leaders to work on a solution to the program. the white house is ailing and as a success having run out of the money so quickly. dealerships were processing transactions from july 1 on assuming that the program would kick-in. the message here is they consider this a very successful program, obviously for car buyers and dealerships, companies, and taxpayers as well because the american people will be driving more fuel- efficient vehicles. bipartisan members of congress,

these kennedy space center right now. officials waited until the last minute before officially clearing them for a landing. there were some worries about a thunderstorm, but it is all systems go. the crew spent about two and a half weeks in space. you should see what they have done up there. there is one gentlemen, an astronaut who has been wearing an experimental diaper, for one month. they say is sanitary, odorless, and one for employee at nasa will have to confirm that. bill: take a look at how the markets are shaping up. the dow is on track for its best month in about seven years.

it is moving up after the gdp report. while the economy continues to contract, it was not as bad as expected. also, it reports show when the top 1% of income earners in america are already producing more than 40% of the nation's tax revenue. that means 1.4 million americans pay more to the treasury and the other 134 million americans combined. is that fair? stu varney has some thoughts on this. >> if you think wealth redistribution is there, you will like this, because that is what this is never before have so much been taken from the rich. and it is going to get worse, or better, the spending -- depending on your perspective. state taxes are going to go up. however, if you think the

primary function of taxation is to raise revenue for the government and not a form of social engineering, and this would not work because it does not bring in as much tax revenue as you think, and the rich change their behavior when they are taxed. bill: that does not seem to be the debate is shaping up on capitol hill. all of this legislation is targeting that top percentage of americans. they are the one that will be targeted if new legislation comes out again. >> it is not a question of looking for sympathy, it is about the practicality. if you raise the tax rate on the top 1% on more, you cannot bring in the hundreds of billions that you think you will for health care reform. the millionaires amongst us have lost $2.80 trillion in wealth in the last nine months because of
