shivley, live with us in washington. caroline, good morning. let me ask you, first, how they found those remains and what testing has been done to confirm. >> reporter: sure, jamie, an anybodyi iraqi came to the marines and said he knew two men who would take them to the anbar province in the desert of iraq, and he had actually seen the bodies after being shot down, on the first night of desert storm and it took the military until this past week to actually find those remains and flew them back to the u.s. and brought them to a dna lab in maryland, for positive identification and this is jawbone and skeletal fragments were tested. >> jamie: do you know when they changed his status what information led the military to do that. >> reporter: it was a lot of

faulty leads and initially he was listed as killed in action and he was thought to be hit by a surface-to-air missile and the chances of him ejecting were slim but they couldn't quite close the investigation and there were multiple false leads over the years and you might remember, when the initials showed up, scratched into the walls of an iraqi prison, that was a false lead and the pentagon reclassified his status to missing in action and missing captured and last year the military had another review of the case and the resulting report cited compelling evidence that he was dead and actually listed his death as... >> jamie: when did the family find out? >> reporter: they found out before we did, of course and found out last night and the chief of naval operations, he called the family and they are until down in florida, and they got the call with the positive match, and he also said, quote, our navy will never give up looking for shipmates, regardless of how long or difficult the search may be, we

called after the arrest and the relation between u.s. and the iran, full of suspicion and tension over many issues including iran's disputed nuclear program and ongoing defiance of the united nations and the state department is asking the swiss to act as a go-between to try and get access to the three, in a moment we'll speak to former u.s. ambassador to the united nations, john about it en, about their fate and what the iranians could be up to. a new look at surveillance tape from a deadly shooting in tel aviv, suggests the gunman was going after a specific target. police say a masked gunman entered the club last night and opened fire and when it was over, two people were killed. the at least 11 were seriously injured. thousands have been taking to the streets in an impromptu march after the attack and the door-to-door search has been underway there this morning. >> jamie: we are counting down

for the health care take i don't ever and members of the house are now headed home for the ser breaks and many are planning get together with voters and the house energy and commerce committee approved a major health reform and said to be an overhaul bill on friday and it barely passed when every republican and five moderate democrats voting against the measure, as republicans warn about health rationing and soaring costs, the democrats are focused on expanding the insurance roles in defending their plans to pay for reforms. >> they don't take into consideration the cap on premiums, they don't take into consideration the number of people that have no insurance that can walk in any hospital, any doctor's office and be fully insured and don't take the productivity of the healthy, educated workforce and don't consider that americans -- america is the only industrialized country that dump have a national health plan. >> jamie: will it work and can

we afford it, congressman fill gingrey from georgia and the member of the committee, the energy and commerce committee that came up with their bill on friday, thanks for joining us, congressman, good morning. >> good morning. >> jamie: first, let me ask you how you felt when you left on friday. it went into the wee hours and there were changes at the last minute and the democrats now will go home and they'll be on a real sales pitch with constituents, what do you think they'll hear in response? >> well, i think they'll get an earful from their constituent and the constituent will not be very happy. i was disappointed. when -- in the late hours of the night on friday when they finally brought forward the amendment from the blue dogs, i was expecting much more, in fact i was expecting the elimination of the public insurance plan. and they didn't do that at all. in fact they did very little, it was cosmetic, and they'll have an awfully hard time selling that to conservatives or constituents throughout the

southeast, where many of them are from. i know, because those are the same kind of districts that i represent and i'm getting an earful, so, they can spend 1.4 million dollars a day, on television, trying to promote this, but i don't think the dogs will like the dog food. >> jamie: at the same time not just the conservative voters but overall many of the polls are showing that americans are not in favor of this overhaul, they wanted what they have, they are happy with the insurance they have and don't think they can pay for this. and they are concerned about illegal aliens getting coverage, and, others who can afford it but choose not to have it. so, at the same time, though, the president says he applauds the effort and wants -- wanted it before recess and now wants it when he gets back and how will the democrats, if they are successful, convince their constituents, and if they do, what will you do about it? >> i think it will be almost impossible, even though, obama, president obama is a salesman in

charge, i mean, he's pitch man and a good one but they can do all of that and can talk tim they are blue in the face, the democrats, the blue dogs, already blue in the face, and they are not going to be able to convince the american public, this thing is too expensive and will not lower the cost of health care, and dougelmendoff, the cbo said repeatedly, this is not going to lower cost and it does not do anything, did not -- certainly does not improve care, and we can the not afford it and we are 1.8 trillion dollars in the debt, and we are hemorrhaging jobs every day and democrats like to talk about, we are losing 14,000 people, every day are losing their health insurance, why? because they are losing their jobs. and we need to straighten out the economy, first, and foremost. listen, we can do this thing and can do it in a bipartisan way, when we get back in september, i'm hopeful that the democrats will work with us, you know, in

the house, we have a g.o.p. caucus of 12, 14 members and has 350 years of clinical medical experience and do you think any one over us have been resulted in regard to this? nad da. and they are willing to do it and we are willing to sit down and want insurance reform and want everybody to have access to affordable health insurance, and those that want it, we wanted to help those with preexisting conditions, get into high risk pools and equalize the tax treatment and we are all for electronic medical records, and we are for lie ability reforms and president obama went to the ama and paid lip service to that -- >> jamie: but that is not part of the plan and there is nothing about reform and many people will say, experts, and economists, that you can't afford to do this, at all, without the tort reform element. what are the chances you can get the g.o.p. perspective as part of this, the president was very clear, he wanted bipartisanship,

on almost everything that goes on on the hill and what do you think the chances are when you get back and it sounds like you agree some change is unorder but perhaps not a complete overhaul? -- in order but perhaps not a complete overhaul. >> of course, we have the best health care system in the world but it's not perfect and we can improve it and i think the health insurance industry is ready to work with us, ready to do that. the pharmaceutical industry is ready to do that. the stakeholders are ready to do that. indeed, ama, has even lent support to this bill, but we can do so much better and don't have to break the bank in the process. i mean, we are still in the the deep recession, and is this the time to spend trillions of dollars, of borrowed money from the chinese, to do a cap-and-trade regime, which will cost every household an additional $3,000 worth over energy taxes every year? and the same thing, with the health care system, just so we

trigger that was attached to a wire that went into his backpack and that is when of course police moved in. and it should it down the entire central terminal of la guardia airport, one of the nation's busiest for early hours and this identified the suspect as this man, scott mcgann, he is homeless and has been arrested three times in the last two years and a judge ordered a psychiatric examination, and he is facing several charges that include making a terror threat and placing a fake bomb in the transportation facility. >> jamie: meanwhile, long time homicide investigators are telling fox news that criminal charges could come at any time now, for the doctor treating michael jackson when he died, police last week carried out search warrants at the home and office of dr. conrad murray. who is pictured here and now there are reports that murray likely took the job as michael's personal doctor, because he had significant money troubles. he was in a lot of debt including more than $300,000,

they say, for office equipment and student loans all dating back to the 1980s and also owed money for credit card bills and child support. all coming out from authorities, on top of that, his luxury home in the a las vegas resort faces foreclosure after he missed $100,000 in mortgage payments. murray was due to make $150,000 a month as michael jackson's personal doctor, and that would be during the series of concerts, jackson had planned in london. >> eric: three americans are now in custody in iran, this morning. adding a new complication to our relationship with the country. iranian media confirm, right now, three american tourists were nabbed for hiking into iranian territory while on vacation in iraq. the three are identified as sean maxwell and shairn bower and shara short and a fourth friend stayed behind at the hotel and didn't accompany them and the tourists, will they be put on

trial and what is iraq up to and former u.s. ambassador the to the united nations and fox news contributor john bolten joins us now. ambassador, good morning. >> good morning. >> eric: how could this play righted into iran's hands. >> you know, the border area where they were captured by the iranians, is a long time route for smugglers, and, also, an area where kurdish guerrillas against the regime in tehran sometimes operate and i have to worry that these americans could become pawns in the larger struggle as the regime in tehran tries to paint the opposition forces there as tools of foreign governments, and here you have a case of americans slipping across the border, quote-unquote, so as i say, as part of the larger issue, that we can see in the trial, going on in tehran, now, i think we need to be very worried about these three americans. >> eric: that is troubling, and, certainly, americans should be worried, when you are that close and cross the border and they

are having what is called a show trial and 100 opposition leaders put on trial and they are talking about possible execution and now three americans are added to the mix and what should the obama administration or can they do to try to get them out. >> apparently, according to press reports we have asked our protecting powers, called, the swiss embassy in tehran to look into this and try and get access to the americans and see what we can do to get them out, i think as we have seen, recently, from the sybari situation, and the merge journalist who was held there, really the case of iran going all the way to the 1979 embassy seizure, when hostages, american hostages were held for over 400 days, this regime in tehran is capable of using even the most innocent people to its own purposes and let's not forget in the case of north korea, those two young american journalists have now been held close to 5 months and, again, i think this is extremely serious, we ought to be pressing the

iranians, to let them go, regardless of the negotiations on the nuclear front, or the internal situation, in iran, if these were simply hikers, who made a mistake, slap their wrist and let them go. >> eric: they'll probably say or could say, the hikers, roxana saberi, this journalist, they called her a spy and north korea, you mention them, they use in send people for their own nefarious purposes. >> absolutely, that is why we cannot be laid back about this. it is not a simple mistake where the country is crossing a border in western europe or something like that. now, that they are in the hands of the iranian authorities, they are in a perfect position to be used as pawns, so, i think there needs to be a high priority for the administration and i think we should -- for the iranians it is a demonstration of their good faith, they'll know looking at

>> eric: really getting big news concerning u.s. troops in afghanistan, soon. the general mccrystal now reporting finishing up his assessment, exactly how the wears going and military officials say he is likely to request more troops to help combat the growing taliban insurgency. one of the civilians who advises the general is reportedly recommending 600,000 troops in total and this number, is ten times the current level. president obama has already added 17,000 combat troops, and 4,000 military advisors to afghanistan, this year. the report was commissioned by secretary of defense, rob gates, and that is due in just a few weeks. >> jamie: congress may be headed out on summer vacation but there will be no rest for them, or the health care debate this august. we heard charlie rangel on fox

news sunday that was just a short while ago, defending the democrats' health care plan, on the other side of the debate, south carolina senator jim demint, who warns the reform effort is shaping up to be a job-killer. >> they cut medicare to come up with some money and they raised taxes on small businesses and they penalize any american with a two-and-a-half percent tax if they don't have government approved health care and this is not the america we know. >> jamie: and joining me now, the host of "fox news sunday," chris wallace.f fiery debate, w point out as the key issues on both sides. >> chris: i think the two key issues is how are you going to pay for it and what senator diment was talking about, as charlie rangel's plan, which is almost certainly going to pass through the house, for this sur tax. that would raise the top tax rate, top earners, if you include not only what the sur tax would do but also other obama policies like letting the

bush tax cuts expire, plus, stated and local taxes, it would raise it in 39 states, to over 50% in a number of states like oregon, new york, california, the top tax rate would be around 57%, that is higher than belgium and sweden. on the other hand, you've got charlie rangel saying, look, this is a good way to finance this, and you are only getting 1% of taxpayers and that is the one argue group and the other argument boys the public option, should there be a public government financed insurance option that competes with private insurers or not and this concern on the part of conservatives is would drive the private insurance business out of business. >> jamie: the cost has come down some. did senator diment feel that it needs to come down substantially more? >> chris: oh, he wants a completely different plan and he doesn't want to see a big public option and if you don't have the big public option that
