hello! yeah, in that faux news, yeah. apparently the obama administration is filled with a bunch of crazy right-wing paranoid nut jobs, because that's what i was called all weekend long. i was called a loon, a freak, a conspiracy theorist, blah blah blah. apparently the obama administration agrees with me. yeah, well, they may not agree with me, but they don't want any more heat. i've got good news for you, america. it started through our constitutional watchdogs, which, by the way, i am seeing just how awake you really are. my gosh, this country is starting to wake up and there is great hope! we are getting so many leads, like the one we got on friday in the cash for clunkers program. this lead came from a watchdog when the dealers log on to their cash for clunkers program, the website,

cars.gov/dealers prompted them with this warning. "this application provides access to the d.o.t. cars system. when logs on to the cars system, your computer is considered a federal computer system, and is property of the united states government. users have no explicit or implicit expectation of privacy. any or all uses of this system and all files on this system may be intercepted, monitored, recorded, copied, audited, inspected and disclosed to authorized cars, d.o.t. and law enforcement personnel as well as authorized officials of other agencies, both domestic and foreign. by using this system, the user consents to such interception monitoring, copying, recording, auditing, inspection and disclosure at the discretion of cars or the d.o.t. personnel." why in god's name would anyone ever click on "accept" after

that disclosure? other than you just sold a bunch of cars at a wildly discounted rate and you have to get your money back from the federal government, but other than that, why would you do it? apparently you and i were not the only ones who thought this was ridiculous. here is the good news. an hour ago we received a statement from the administration, and here it is, quote "a security warning on the cars.gov support page that stated computers logged into the system were considered property of the federal government has been removed. we are working to revise the language. the language was posted on the portion of the website accessible by car dealers and not the general public." i'll get into that in a second. oh, that crazy glenn beck news. apparently we must have had a decent point, because the old statement that the liberal bloggers spent another dateless weekend defending has been changed to remove the pesky little part about the

government owning private computers that this show had a problem with on friday. i wonder if those liberal blogs are the same ones that called me crazy and paranoid and are now making the same accusations against the obama administration? i don't hear them. of course, there are yeses that remain unanswered. well, why did they have that wording in the first place? will the changes be retroactive to include all the dealers who have already agreed to that last waiveer? we're going to be looking for those answers, but first, america, pat yourself on the back. you made a difference. this story was brought to my attention by a listener who took the time to e-mail me when he read that waiver, because it just seemed so wrong. he sent us the tip. we investigated. we agreed. he was a watchdog. i tell you that i would tell you his name, but a lot of tips are coming in and a lot

ring private computers even though they don't have the wording up there? it is a portion of the patriot act that they are permitted to write their own search warrants. they don't have to go to a judge anymore. glenn: i have to disagree with you on. this i'm not a fan of the patriot act. the only reason i went along with the patriot act at the time was it had a sunset. after we got past the hysteria, i said, get out of this thing. this is a nightmare, but even the patriot act, you still have, a, i think it's every six months you have to come in front of congress, and if there has been any abuses, they have to answer for it. >> that is true. that is true. glenn: the second part of the patriot act is it's my understanding that yes, they can write their own warrant, you know, they can say we need to eavesdrop on this

telephone, but sthe have to -- but they have to bring that after the fact to a federal judge and if that person doesn't make a good case, that person's butt is in a sling. >> that's the law that they have to go to a federal judge after they do the non-judicial search warrant. in the patriot act case, it never goes to a judge, and if they don't use the information that they have gotten from you against you in a public courtroom, you don't even know they have it. that's why my question is how do we know that they're not doing it? all we know is they took the disclaimer. they took the warning down. glenn: how can we find that out, judge? >> you can only find out that the government has copied your keystrokes or entered your computer if an expert can address the computer for you or if the government prosecutes you for something that's on the computer, then they have to reveal to you how they got it. glenn: let me bring in john lucich, president of e-forensics, a computer forensics company. you're a guy who can tell us

if the government is watching? >> absolutely. in fact, there are ways to prevent the government from doing what they want if you put intrusion protection systems. glenn: hang on a second before we get into this, because i don't want to go down the paranoid express here. >> right. glenn: i mean, i have always been a guy who trusted my government. i stopped trusting it in the bush years. they did too many things that just didn't make sense, but i don't want to get into this. do either of you guys believe that the government is, right now, getting into computers and monitoring computers? >> well, i absolutely believe that they are. >> i believe it is their intention. people put things in writing. they're trying to get you to waive your rights, and for government to do that to its own citizens to provides services that the taxpayers themselves pay for is unconscionable. >> that's why the fourth amendment requires the judicial oversight, not to stop the government from doing its job, but to make sure it only goes after people after whom there is evidence against

them, and that it follows its own procedures. glenn: that was the problem with this thing. they are coming out and saying we just want to make sure there is no fraud. well, that's a fishing expedition. >> well, the government prosecutes people for hacking into other people's computers. they are hacking into our computers. they should obey the same laws as the rest of us. glenn: show me how this can be done. show me how you know if the government is doing this? here is what happens. for them to do that, there is a communication going back and forth. one of the way hackers get in is to load these programs, what they're called trojans, into your computer, do high-speed key word searches, and then take the data they want and transmit that small chunk of data back to exactly where it is coming from. i think the problem with the warn something that it is so broad and ambiguous that we don't know exactly what they want to do, but the fact they worded it that reason is for reason, to give them the ability to do it. again, that's unconscionable.

glenn: again, i'm convinced that this government, this administration, through these czars especially, they're building something piece by piece. they're putting it in bill after bill after bill. they're building something. i can't understand for the life of me what they're trying to get at here that makes any sense. if you think there is fraud, you get a subpoena. that is what you do. why was all this put in there? >> why waste the time to get a subpoena from a grand jury or a search warrant from a judge when you can do it on your own? glenn: i understand that, that pesky thing called the constitution. judge, do you have any idea -- or, jon, maybe you would know, do you have any reason why this warning, the way it was written before, does that allow it to be some sort of a worm that it never stops? in other words, i'm on my computer. i'm the dealer, and i'm putting in your information. i'm on-line now. if i go out to another website or if somebody e-mails something to me, and i'm

exchanging anything with them, does this warning allow them to come out from that dealer's computer and say, oh, well, you're networked, you're part of this one, too? >> when you take a look at their wording, it violates -- other than the fact they try to get you to waive your rights, it violates the privacy communications act, title i and title ii. the act prevents government from intercepting communications of private citizens. title ii stops the government, nobody else, stops the government from intercepting store communications. >> it tries to get you to give up your constitutional rights, your basic right to privacy under the fourth amendment. you can't give up those rights unless a judge in a courtroom accepts their reason for invasion. glenn: i looked for this story. i looked for this story in newspapers -- did you see it anywhere? >> no, not anywhere. glenn: we did it on friday. one broadcast, this amount of

time, and this thing spread like wildfire. we asked the white house for a response, why are you doing this? what does this mean? they came out this afternoon and said, we're going to change that, we're working on t we have removed it from the website. obviously they got their hand caught in the cookie jar, or just based on this one tip show, enough people said whoa, whoa, whoa, what does that mean? >> here is the question for the white house, most respectfully, you have taken the warning down, have you stop the getting into the dealer's computers? >> i read a lot of liberal blogs this weekend and i wonder hod would pick this up? why is this the only show that talks about a lot of these issues? i'm looking at them and they're all saying, oh, this is just conspiratorial, blah blah blah, and i don't want to be conspiratorial by any stretch of the imagination. that hurts us as a nation. we must be routed in the

truth, but when nobody is asking the questions that seem logical, of course you're going to get conspiracy theories, but here is the one thing that i think is important that people kept saying -- this just affects the dealers. well, no, it doesn't, not if i buy a car. if i've got any kind of information. wouldn't there be a class action lawsuit if that dealer has information on me, and it's released to the government, i have and expectation of privacy with my car dealer, do i not? >> here is another problem with that. the fact is sometimes dealers work from home and work from a computer that is shared with their kids and wives. they don't have the right to waive the privacy of their wife or children, ok, but by logging into that system, accepting that, if they with able to download something on a computer and take that data, you are now violating the rights of other people who haven't waived their rights. >> so by getting into the dealer's computer, it could almost be viral in terms of the other individuals who have no dealing with the dealer who

have their privacy violated. >> and one more point. this may not be the white house themselves but maybe it is the administration testing the waters in an environment where they know most of the media doesn't beat up on this administration, and they figured it would never get this far except for your show, glenn. glenn: i have to tell you, these are yeses that i have never asked -- these are questions that i have never asked myself because i have always been in a position of trust, but when you see the next segment, america, with the czars, six months into this administration we are, and we have as many czars as we have had presidents in the history of this nation. we don't even know who they are, and when you see their resumes, when you see what these people have said, it's not crazy to ask questions, like that's crazy, that the president of the united states is going to have a communist as a czar. yes. it's crazy that the president of the united states is going to appoint somebody who, you know, actually advocated sterilizing the water supply

with chemicals. yes! so, is it crazy to say, wait, wait, wait, what are they doing with our privacy act? >> i don't think so. here is another point. they banged the bush administration for listening to listening in on domestic phone lines for terrorists, but this is on the people themselves. >> using the power that the bush administration acquired and left to them. glenn: let me tell you something, america, we must stop playing with these parties. the bush people were doing the same thing. they were standing up for things that didn't make any sense. the obama people standing up for things that don't make sense. damn it! we're americans, we're not democrats, we're not republicans, we're not independents. we're americans! value your freedom. we are the only people in the world that have ever had real freedom. that is the historic anomoly, freedom. slavery is the way the world usually is.

glenn: notes since the russian glory dazes of the 19th century have so many czars been so popular. i seem to remember they all died in the woods. president obama has had at least 44 czars, and i'm not sure when america decided saying, you know, hey, czar, that's kind of cool, you know, and we left the really creepy zone to being the new hip thing, czars, but obama has gone crazy with the appointments. he now has the high nest recent history. even senator robert byrd, former klan member is freaked out. he was freaked out about the influx of czars citing concerns over the fact that they don't answer to anybody. i'm more concerned with the fact that seemingly every single one of these guys shares one common thing -- they all have nut job beliefs, like putting sterilization in

drinking water, legal rights for animals, forced abortions. there is at least one communist that i know. the collective es mays of these czars has me on my knees every night praying for the run-of-the-mill socialist to be appointed! is president obama picking these czars -- here's the question, and there are only two reasons he would do this. oh, who is it, that nut job marxist guy, i hated him in college, can't we appoint him to an ambassadorship and get him out of my face? sorry, sir, we're out of ambassadorships. so he appoints them as a czar. or, is he selecting these people because they have one thing in common? he is selecting these guys because he wants them to hold positions of real power? simple question, and we demand an answer from the administration.

do the czars wield real power or are they just some joke from his beer drinking buddies from college? joining me is michelle malkin, author of "culture of corruption." michelle, let's just go over some of these czars that people i don't think really have an idea. let's start with the information czar. >> this is a guy named david cundra and this guy was a convicted shoplifter, stole a couple of shirts from j.c. penney's and is yet now overseeing very sensitive infrastructure in our information technology. glenn: i have no problem if you are 21 and go shoplifting, et cetera. everyone makes a mistake. hey, i have never shoplifted but i have done some things i'm not proud of, but there is no oversight on this. the senate has not ratified these people. >> that's right. glenn: we isn't heard, are you a reformed person or not?

>> that's right. they didn't put the screws to them. they didn't put the questions to them. the white house did not disclose this until one of my blogs disclosed the criminal background. yes, we all do stupid things, but this guy in addition to the shoplifting tried to evade the police and was a fugitive. glenn: can i ask you something? this one bothers me, because for the same reason as as sandy berger and the same reason for tim geithner. he was avoiding income tax. he now runs the i.r.s., and the excuse was there's nobody better. sandy berger, when he went in and took documents out of his pants, that was both bush and clinton. they were both in on that. >> yes. glenn: something was very wrong with that. he didn't even lose -- he loses his classified status, for, what, two years, three years? >> and then he's back in the mix. glenn: there's something wrong here. let me go to the health czar, nancy depearl.

she is making quite a lot of money. >> yes. glenn: what does she do? >> she made upwards of $6 million over the last couple of years as a consultant, lobbyist for the healthcare industry, in everything but, in the most technical term, and is also a member of the board of directors of many health healthcare companies. she was going in with people kicking and screaming about a corporate person in charge of this. glenn: i don't care about the pundits or anybody on t.v. or in washington but where are the good democrats, the normal people that thought these things were wrong before? where are you? >> and where is the transparency? the healthcare industry executives have been meeting in secret with the white house. it was only under threat of a lawsuit, and i will give credit to a left wing progressive crew, crew, that forced the white house to expose who those were. a counsel of the white house refuses to say which administration official met

with those executives. i find out there are many of these executives that have clear and direct financial ties, have given money to nancy for speaking fees an engagements. i want to know, did she meet with those executives? if not, did she recuse herself glenn: imagine that if that was an oil company. >> exactly. glenn: we are under a minute. carol browner, computer files, she destroyed computer files? >> she d the landmark legal foundation sued her and a federal judge in that case found her guilty, her and her agency guilty of, quote, un quote, bad conduct for avoiding a foya request. >> i don't know what that means. >> it's bad. glenn: is was a rowdy nationalist in 1992. by august, i was a communist. i met radical people of color, really radical, communists and anarchists and it was, like, this is what i need to be a part of. he has never taken this back. he is the guy who his poll low

the record -- or the vote from the record. they erased who voted and how they voted, from the public record. apparently, because they didn't want anyone to know. as assemblyman chuck devour who sponsored the proposal said "certainly george orwell would be proud." as devour pointed out, the whole thing was carried live on cal channel, which is an even more boring state version of c-span. the video was not posted on cal channel. we called to see where it is. they said, well, it takes about a week. we said, can you put it up faster than that? well, it's a state-run arm. we'll try. we haven't seen it yet. but it is coming, or at least they tell us. i will tell you that we have something else they don't want you to see. assembly man devour got a copy of that vote before they deleted the record. he sent it to me.

glenn: we are back with seep yore judicial analyst judge andrew napolitano. the judge is here. you were actually out of town this weekend. i want to show you pictures, america. this is what the press reported as a couple hundred people showing up for a rally. do we have the video? that could just be two. there it is. there is a couple hundred people for a tea party. the police are saying that it was 8,000 to 10,000 people, but i didn't see this anywhere, anywhere on the news. you with there. you spoke. >> one of my producers said that there was an article in an ohio paper saying judge napolitano from fox news spoke to 300 people. now, the police themselves told me 8,000 to 10,000. i saw the crowd. it was enormous. it was enthusiastic. it was happy. it was concerned about freedom. glenn, i talked to them as i might talk to law students about where do our freedoms

no reason for that, ever. i don't want to ever hear from our own americans, anyone, voicing some sort of muslim extremist-type justification as we heard in the circles after 9/11. well, i could see how they felt they had to do it, of course i don't agree. absolutely not. there is no excuse for violence. our founders sailed across the ocean, battled killer storms, smallpox. they vomited for three months on a tiny little wooden ship with a bed sheet for a sail just to get a grievance before the king. they did that for 20 long years. what have we done? oh, i sent an e-mail. they made a phone call. they won't listen to me anymore. so the next logical progression is e-mail and a letter to a gun? only for a crazy person. if you hear someone talking about turning violent, it is your patriotic duty to stop them.
