>> and no one in the middle class was going to get a tax increase on your watch. yet several democrats said that this bill from senator baucus has a big middle class tax increase. do you agree? does that mean that you cannot sign it? >> i do not agree, i think that they were concerned about whether or not this was affordable. if you are saying to people that you have got to get health insurance and they have to -- and they cannot afford it, there's a penalty, which is a concern that i share. bill: stuart, good morning. what is affordable? when is a tax not a tax? >> that is what the president is arguing and talking about. he says that you can insure the uninsured without raising taxes on middle-class.

what does he do? he changes the language. fines, penalties, levees. all kinds of fees, as well as revenue enhancers, which he says are not a tax. let me draw your attention to this headline from "the new york times." "a proposed tax on the cadillac health plans." they say that it is a tax. more than that, it is a tax on the middle-class. essentially the president is using semantics, shifting the language to make his point. in my opinion he did not move the needle on those talk shows. lunch is not free. bill: the idea is that if you are forced to buy insurance for health care, it will be a charge to you in your family, which in itself is a hidden cost.

we must be clear, democrats have not even figured out who will pay for what. that is part of the debate now. >> the big picture is that under all of the proposals that have gone to the house and the senate, there is an income wealth shift from the people in the back half of the population to the lower half of the population. that is consistent throughout the mall. the tax bite comes down the food chain to hit the middle class. that is the bottom line. bill: stuart varney, thank you. see you this afternoon on the fox business network. megyn: not only did president obama take heat about his health care reform plans, he had to address the acorn scandal. the left-wing activist group that the president used to work with. the president said that there

should be an investigation into this group. undercover video, shot in several offices, showed workers how to do the fed's, avoid taxes, and make money on -- how to dupe the feds, avoid taxes, and make money on it. here is what the president said. >> is that true on the other side as well? of course. frankly, it is not something i had followed closely. i did not even know that they were given a lot of federal money. what i know is what i saw on that video is certainly inappropriate. >> you are not committed to cutting off federal funding? >> this is not something i have paid a lot of attention to. megyn: he said that what is on that video deserves to be investigated, although he has not been paying a lot of attention. chris wallace, snubbed by

president obama, was talking to the ceo of acorn about those tapes. chief organizer, technically. we will look at what she had to say throughout the morning here in "america's newsroom." bill: in the meantime, general stanley mcchrystal submitted a classified report that was leaked to "the washington post" over the weekend. general mcchrystal, hand-picked over president obama, said that the war will likely end in failure without more troops. at the moment the president has not made a decision as to whether or not to send more troops. >> we are going to take all of disinformation and we are going to test whatever resources we have against our strategy. >> the worst thing did you could

do is not act at a time when our military commanders say that we need more bodies in the battle today. bill: jennifer griffin is at the pentagon. there are no troops available to send to afghanistan until at least january. we have the reaction to this and the upcoming meeting that the u.n.. megyn: president obama, when he is there at the u.n. security council meeting, he will be sitting a few feet from mark khaddafi. this is after president obama was very critical of libya for the hero's welcome for the convicconvand released pan am bomber. kelly has more. is the white house expressing concern about him being in the same room?

kelly: susan rice was asked if the u.s. delegation would walk out when khaddafi speaks and how would the president handle it if he is approached by khaddafi. she did not want to guess what they might say, saying that is in the realm of the hypothetical and with respect to the fact that khaddafi will be there for the united nations security council and will be present at the summit, they will have a special session on nuclear nonproliferation on thursday. along with gordon brown of the u. k. would you not like to be a fly on the wall and here with the president might actually say? megyn: you would. many times these things are arranged in advance, diplomats have already worked out what will be said.

so, what do we know about that? is the president expected to say anything to him? kelly: at some point they are going to be talking about nuclear nonproliferation. it is difficult to say what will be stated. different sets, different types of areas, entrances to get in there. we are not getting a lot of word from the white house specifically. you will recall that president obama strongly criticized the hero's welcome that was given when lockerbie bomber returned to libya. megyn: thank you, kelly. bill: we have a developing story here, the appearances of freemen suspected of lying to the fed's

on a u.s. terror plot. new information on why suspects like these are so critical in the fight against al qaeda. megyn: folks along the east coast filing in ufo reports. what are these mysterious lights in the sky? bill: the acorn ceo going public, saying she wants an investigation into her staffers. that is not all she is saying. roll this. >> president obama is a very smart, very thoughtful person. what he does is his position. i would never presume to tell the president. >> he said that he believes that acorn should be investigated. >> that is his opinion also.

bill: we are waiting three high- profile crimes for three men at the center of a terror investigation. they are in court in denver, charged with making false statements to federal agents. more charges could be filed today. in new york they are holding a hearing for the leader of a mosque in queens. there were a series of raids in new york, the fbi is looking at a number of people in the u.s. and elsewhere. was there a target? if so, who was that? -- what was it? mike baker is the head of a global intelligence security firm. good morning. he made two trips, we really miss this guy. it could have cost us a lot.

>> there is so much to talk about here. what is important is that this is still part of an investigation that has been going on for a great deal of time, covering a number of state, local, and federal authorities. this thing has been building. it is not just something that happened because he popped up on the screen. bill: september 10, this guy drives the new york city from colorado. september 14, erase carried out in queens. last week he was questioned three times before his lawyer said hang on for a moment. late on saturday night these arrests were carried out in aurora, colorado. usually it does not go this way. can you fill in the pieces as to how the investigation is going?

>> ideally it follows a certain process. in the real world you unfortunately have a range of factors influencing how things happen. you never get to the point where you get all the information that you want before you take action. in a case like this, as is often the case, he made these trips to northwest provinces, by his own admission, apparently, he traveled there twice. there is computer evidence, which can be very important in investigations like this. nine pages of handwritten notes, in his handwriting, apparently, about bomb making. also evidence from the computer that there had been scouting of sites in new york city. bill: sports arenas? >> subway systems and other facilities.

one of the problems here is that because we have not had another attack since 9/11, people do not get -- not complacent, but less aware of potential threats. there's a tendency to believe that the tent -- that the threat will come from some kind of lex luthor type character. then you see a guy like zazi, there on the screen, you think how can this guy be behind it? but then it all starts to add up. no offense to docks, but if it walks and talks like one. bill: it is a duck. my question was, how many more of these guys are out there? we have three characters, do we have all of the guys involved? another great point that has to be mentioned, he is an american

citizen. this is part of their overall strategy. going back to 9/11, they know that they cannot go that route anymore, so they have got to get people who are already in the country. >> this is an important part of their strategic effort, identifying individuals allied with the united states. how do they do that? they work with what they have got. already sympathetic contacts in pakistan and elsewhere. those individuals start to work on that, just in tobacco recruitment they look for those individuals that they might be able to bring into the fold. bill: some have suggested that they were forced to act earlier than they wanted to. are you able to evaluate? >> that would be speculation on my part. from what we are hearing, they

were contacted by their own admission, training with the evidence that they have been building on the computers, you do not need a high degree of sophistication to carry out a deadly attack. look at madrid and the bombings there. look at london and the bombings there. these kinds of attacks, they do not need a high level of motivation or resources. bill: one more point to make, according to reports last week he admitted that he had trained in terror camps along the border. we are keeping a close eye on that to see how things develop in brooklyn and denver. megyn: they were supposed to keep this report secret. that did not work. fox news is confirming a dire warning from the top general in afghanistan about the war there.

megyn: is that how you remember it? really? eric, all right, bertha lewis says that she was out rage. what is she going to do about it? >> today she may announced the deployment of an independent auditor to audit acorn, its finances and procedures. this after the scandal that resulted in the firing of five employees and the suspension of two. during the interview she did not promise to open the books. critics have accused acorn of using taxpayer money for political purposes. one of their own lawyers has warned that could be a possibility. in some cases those politicians fund acorn with taxpayer money. they would not say if she would clke the finances publicly

lawmakers to actually threatening. >> last week she actually thanked them for making the videos. she said that they performed a good service. talk about a change of heart. let's look at what happened when we broke the story, this was their first reaction on september 10. that the tapes were false and defamatory. two days later lewis said that it was clear that the videos were doctored and added it -- edited. fox did not make the tapes, we reported on them. if acorn is thinking the filmmakers, they should thank us for breaking the story. you know what? i do not think i will hold my breath. megyn: further updates to follow. thank you, eric.

he is warning of a possible failure of more troops do not join the fight. we are learning that the pentagon is going to ask for more forces. what is the headline this morning? >> essentially that the top commander in afghanistan is saying to give me more troops or there will be failure in the war in afghanistan. "failure to reverse this in the near term, afghan security capacity mature is, the risk in the outcome in defeating the insurgency may no longer be possible. we rent -- we know that the report exists, to get the detail forces the hand of the administration a little bit. bill: on the sunday talk shows he was asked about a couple of times, what was the answer? >> he tried to avoid boxing

an unexpected definition in word definitions on the sunday talk shows this weekend. take a listen to this exchange with george stephanopoulos when the president was asked how an individual mandate requiring people to purchase health insurance or pay a penalty does not translate into a tax hike. >> for us to say that you have got to take a responsibility to get health insurance is absolutely not a tax increase. it is saying that we are not going and have other people carrying your burdens for you. george, you cannot just make of that language. >> i do not think i am making it up. merriam-webster dictionary, it defines tax. >> the fact that you looked up in the dictionary -- looked it up in the dictionary indicates

to me that you are stretching a bit right now. my critics say that everything is a tax increase. megyn: who is right? is it a tax hike? joining us now, bob beckel and andrea tans borough. good morning. bobbie, i will start with you. is it fair to describe this as a tax hike? >> it is not fair. you cannot put a car on the roads without insurance. you call that a tax hike? you cannot enter a national forest without paying a fee, is that a tax hike? you have to pay a fee when you fly an airplane for the federal aviation people to keep you safe. is that a tax hike? george stephanopoulos just figure is that trying to spellings own name is a tax hike. megyn: [laughter] [applause]

is it a fee or a tax hike? what does it really matter? >> it does that matter. this is all semantics. at the end of the day, when this is impose on mostly middle-class families, they are going to say that there is less money in my wallet, more going out because of barack obama. call it what you want. "the new york times" called it a tax hike. the jury has come back to tell us that this is an increase on middle class families. megyn: that is how george stephanopoulos got into it, "a bid -- a big middle-class tax increase." whenever you call it, the american people are going to have less money in their wallets. >> the american people are going to have more money, i will tell you why. the people that do not have

insurance, we are paying for them. the fact of the matter that every one that does not have an insurance policy, they go to the hospital and get themselves well and the rest of the people in this country pay for it. in the long run this is going to be a net cut for people. megyn: is that true? the democrats are putting that cost at around $1,000 every year. yet you have to pay a lot more if we do not get the coverage. >> that is right, 2.2%. very small when you look at total health-care costs. bob, that is misleading that overall this will cut costs in the end. right now, today, 43% of the uninsured could purchase insurance but do not. there will be people that are not going to purchase this kind

of insurance. >> if you do not take into account the $1,000 per person, if you do not take into account what this will do to lower the cost of premiums -- >> that is not true. >> what you mean it is not true? >> the congressional budget office -- megyn: let her make her point. >> do not argue with me. argue with numbers. they said that an individual mandate would cost middle-class families 15% of their income. i do not know how it is going to save people money. it has got to be boiled down in some way. i do not hear democrats telling me -- >> first of all, this is a classic republican response. middle-class people are going to pay 15% more? most middle-class people have

put forward that all of them got behind. one final point that i have not heard a single democrat answer, how come barack obama say that we have 46 million uninsured, now there are 30 million? where did the rest of them go? >> if you are talking about those little pieces of paper that the republicans are waving , they do not meet the lab test. only if there was a low supply of toilet paper. the fact is you are none going to come up with anything. >> how did we go to 46 million to 30 -- from 46 million to 30 million? megyn: people are taking of the illegals. >> why were they there to begin with? megyn: a question for another day. megyn: that is a tough one,

that they are more docile. this is not to say that the rock python would be more aggressive in the wild. bill: is that so? i am reading that they are mean and vicious snakes. >> i think that they are just fighting for survival when they know that someone is trying to capture them. bill: with these snakes come together and make? >> that would be a possibility. our scientists believe that they would probably create a hybrid like a mule. the chances for them to have reproductive qualities that are fertile are slim. they may have the qualities of a burmese python, which means they could be a bit larger than the rock python, and it could be a bit more aggressive, but that does not imply a superstate.

bill: frightening days over the weekend in the state of washington. the police captured and escaped killer four days after he got away from the staff of a mental institution. he had been telling a friend that he had been released -- he was going to be released four months. that man and knowingly allowed him to stay at his house. one of those involved in the

arrest was a county sheriff that also caught him after he gave police personnel the slip in 1991. this time it was at the state fair where 31 mental institution patients were taken to the state fair without warning to the locals. hehas been recaptured. megyn: the audience for the emmy awards show has been dwindling in recent years faster than a model getting ready for fashion week. this week they tried to spice things up. did it work? >> the emmy awards are billed as television's biggest night. we heard plenty of references to some of the small screens struggles from neil patrick harris, poking fun at all of the competition from the internet. >> the future of home entertainment is the internet.

three men are under arrest this morning, headed the federal courthouse in colorado and new york to face charges in connection with this plot, the details of which are coming out and they are disturbing. welcome to a brand new hour of "america's newsroom." bill: good morning. the central suspect of of the plot, investigators say that he was working as an airport shuttle driver in denver. he had been trained in explosives in pakistan. zazi's father and a new york area of imam were arrested for lying to investigators -- new york area of imaimam were arresd for lying to investigators. megyn: help us figure this out. from colorado to york city. what were these men plotting to do?

>> that is not entirely clear. there have been reports that this was a plana pl to possiblyw up sports stadiums, venues use it for fashion week in new york. if you look at the legal papers filed at the courthouse, there is only a mention of a plot to detonate a device. there is no further elaboration. the only charge right now is lying to authorities. there are no formal charges linking them to a specific act of terror. we may learn more about this alleged court -- allegedly attacked later today. megyn: what is the specific evidence that they say that they have against the defendant? >> backpacks, cell phones, legal papers saying that during one of the raids in queens they say

that they found in a car that they were renting a computer, on which work jpeg's of handwritten documents, nine pages decamping how to make a bomb. what is interesting about this is that when zazi was asked about this, he denied any knowledge. he said that he was downloading a religious book and that it was possible that it contained information about jihad. that is one of the reasons he is accused of lying to investigators. at this time, there are no other charges. megyn: do they believe that these three are rogue terrorist or that they have larger connections? >> that is also one of the things that authorities are still trying to ascertain themselves. they say that this is an ongoing

investigation. to what extent zazi was the ringleader is not clear, but for now he is the central figure in the case. megyn: david, thank you so much. bill: an unprecedented move to stop a criminal investigation into allegedly cia prisoner abuse. seven directors, they are urging president obama to stop the attorney general from reopening the criminal investigation into the cia's post-9/11 interrogation techniques. "it creates an atmosphere of jeopardy." president obama was asked about this over the weekend, saying that he wants to move forward

but that if laws were broken those cases deserve investigation. that matter is still on the desk. megyn: a rather touchy week ahead of the international stage as world leaders gather at the u.n. general assembly here in new york. mahmoud ahmadinejad just made the whole thing a bit touchy year. last week he called holocaust a "myth designed to generate sympathy for israel." we have heard this kind of rhetoric before. he has said that he is proud that his comments have angered the west. bill: in the meantime, from the state of florida, an update on the teenage runaway who will be back in court in a few hours in florida. 17 years old, a teenager that ran away from her parents back in july. she says that her family is

conservative muslims, angry that she has converted to christianity. if forced to return home she says that she fears for her life. her parents say they love their daughter and support her decision. what should we expect from the judge today? a final decision? >> it is possible that the judge could decide whether to keep ri fqua bary long term in florida, or perhaps send her back to ohio. which is what the parents want. they have filed a motion to have all of this dismissed out of the state a flare-up -- out of florida. they believe that their daughter has been brainwashed by christians that she met over the internet. that day the word her to run awaya from home in ohio, illegally harbored her here for

two weeks. bill: where is she saying this morning? >> she has been staying in a foster home here in florida in orange county. but before that she was staying at the home of two pastors. they have a church called global revolution church that they founded recently, which preaches, among other things, that right now we are in the midst of the epic struggle of good and evil, between islam and christianity. she has just turned 17, still a minor. which is why her parents say that she should go back to their household, that this is a family matter. that when she is 18 she can do what she wants. bill: have her parents showed up at the court proceedings? >> they did at the first one, not two weeks ago.

their attorneys have advised them to file an incorrigible and unruly charge, basically getting a paper trail started, trying to get ohio children's services involved in the situation, clearly one in need of some communication. bill: we will watch that story from here in new york city as it unfolds. megyn: there has been a major update in terms of florida law enforcement when you look at this. ohio law-enforcement look at it, now a florida law enforcement officials have found information about whose story is more credible. we have more of that in "kelly's court." bill: we are hearing of a delay in court because of unexpected developments, we are live in gitmo with why he was called in

in the weeks that he has -- in the weeks since he has released his bill there have been more than 500 proposed amendments. 500 amendments. it appears that everyone wants to weigh in. >> no question about it. we are being told that there could be big changes in store for that $856 billion max baucus plan announced last week. the committee will start discussing it tomorrow. it got no republican support last week. it got a measured welcome from the administration. but democrats, many of them said it will lot provide enough in government subsidies for lower class and middle-class families for people to purchase health insurance, which they would be required to do. certaon sunday the president suggested that he could support bigger subsidies for those people. among the amendments, bringing back the idea of the public

concession. bill: the thinking is that if you give it here, they will give some on the backside. maybe get some concessions from iran. what is his next move? >> he is going to the u.n.. now you are going to see, has this gesture of goodwill that he has clearly offered to the russians and iranians, is he going to get something for it? are the russians going to cooperate with the united nations over gasoline sanctions on iran? maybe they will cooperate in making sure that iran does not have the assistance it needs for a nuclear program. bill: do you think that happen? >> no, i do not think that what happened at all. bill: we have a weaker hand? >> we used to have a strong hand. it was an extraordinarily missed opportunity. we had very little pressure on iran directly.

we have lots of ability to pressure them through russia. we have just given it up. bill: many have argued that the president's greatest attribute is to sit across the table and do you buy it? >> no, he has done a lot of opening moves to a number of countries. he has offered a hand of friendship five times to iran. his inaugural address, his cairo speech, on and on. none of those have produced anything other than the iranians belatedly saying that they will come to the negotiating table but it will not talk about the nuclear issue. bill: what about what lindsay gramm is selling? >> there is a credibility gap between his speeches and what he is dealing. he cannot even close the deal. this is a significant short- selling from the obama administration, that he is not willing to take the tough approach that he needs.

good morning. you know, the more that we see in this case, the more that law enforcement authorities look into it, they seem to be siding with the parents. they do not see any evidence of abuse or a threat. so, what should this florida judge to do? >> i have got to tell you, this does not surprise me in one sense. the juvenile court but said two issues, risk of juvenile harm, risk ought -- risk of physical harm, risk of psychological harm. there were two young girls in dallas last year that were allegedly killed by their father as an honor killing. maybe she looked at his fundamental values and feared harm. kids that are allegedly sexually abused, one of the strong pieces of evidence was

the psychological harm as the court continues to detain the children based on risk of psychological harm. megyn: is that enough? even if it is not a legitimate fear that if there is no evidence to support her, but she fears it nonetheless, is that a basis for withholding her from her parents? >> not so. david makes a decent argument but it does not fly when it comes to law. you have two groups of officials that have already said that ohio and florida officials have both said they have investigated and spoken to the parties. they are siding with the family. in all likelihood this judge is going to send her back to ohio, to her family, as there are continued issues that can be dealt with by an ohio court. that does not mean that the florida court cannot -- megyn: i do not care about

that is what it is set up to be. it is kind of out in the middle of nowhere. it is a wooded property. they have chickens, a garden. this is a way to get away from the things that people are addicted to like blackberries or the internet, but mainly games that people play on the internet. the target audience is that 18 to 26-year-old guy. now he is on his homown and he cannot function in society. it starts at $14,500. it is not cheap. it is a 45-day inpatient program that is devoted strictly for people addicted to internet use. bill: in a word, does it work? >> in a word, i think there is debate whether people actually need this or not.
