bill: no one asked about van jones or the acorn scandal. >> is not something i have followed closely. i did not know that acorn was getting this coverage. all that i know is that what i saw on the video was certainly appropriate. >> you are not committing to cutting off federal funding? >> not something i pay a lot of attention to. bill: political corruption is involved. something the president should pay attention to. it is a situation that should be investigated by the justice department. mr. obama should order that right now. as far as health care is concerned, the president sees it this way. >> what i have proposed is a modest attempt to make
11:03 pm
that hard-working families out there are going to have health care that they can count on. this is not a radical plan. this is not drafting a single payer model on to the united states. it is simply dealing with what everyone knows is a great problem. they have tried to use this as a proxy for vastly taking over government and expanding every sector of the economy. i think that they are wrong. bill: the key issue is the massive expensive health care. the president believes that the president -- that the country can crack down on waste and fraud to pay for waste -- to pay for health care. wells believes that?
11:04 pm
the interviewer should have zeroed in on that. but they did not. the president, making them pay a penalty if they do not. he is right, it is not a tax. >> i do not think that illegal immigrants -- we do that for a whole range of programs. that is a straightforward principle bill: -- principal. bill: i like the president when he speaks simply with no wiggle room. he did that on the race issue. >> this is cat net -- catnip to
11:05 pm
the media, because it is a running thread in american history, and i am not saying that race does not matter, but i am saying that this debate that is taking place is not about race, it should have been about people worried about how the government should operate. bill: that is 100% accurate. on the subject of national security the president was confronted by this. >> they have asked you to use your authority to stop the investigation of the bush-era interrogation. >> i respect all seven of them. i have absolute respect and

reliance upon a robust cia. i want to look forward and not backward on this issue. i do not want to get into the business of squelching investigations being conducted. bill: it is a weak answer. the president should make the call. he has the power. mr. obama is being disingenuous. more on this story, coming up. finally, there was this on cbs. >> i have no interest in increasing the size of government, i just want a smaller government that is regulating smartly, so i do not have to engage in this.

let's go to acorn, that is where you were wrong. when it comes to acorn the president was on target when he said that this is a knat of a controversy. they do not get many taxpayer dollars. $50 million over 10 years? what we are talking about here is this terrible indefensible behavior. bill: it is below the radar screen of the president. they get a lot more in state and local taxes. acorn owns $50 million of the real estate in city hall. i said, it is not afghanistan or health care. obama has a tied to acorn.
11:13 pm
for appearance's sake he should have been right out front. this is unacceptable. i am calling for a federal investigation. that would have put it to bed. >> do you not think that this is way overblown? bill: it was hard to get. the attorney general has issued a subpoena. >> you are talking about a little bit of money. you are going after the oil companies, pointing out how they are gouging people. bill: you know what i am talking about? >> there is another reason for
11:14 pm
the president to talk about acorn, just vote on it. it will eventually go to his desk. the president will have to veto it. or sign it. it is not irrelevant. you cannot buy the argument. bill: it is also the symbolic nature of the egregious this. juan, with national security we have the admiral coming up behind you. cia directors, they write him a letter. was that not merely mouth? >> i am surprised that you. what you have to understand is that the democratic congress led by the far left, people that you

11:16 pm
o'reilly is part of the problem. i am rude sometimes, but always in pursuit of the story. >> do not forget, obama talked to you. bill: i do not know if you live again. >> i think that he will. one, the broadcast side of fox did not carry his last joint address. bill: everyone else did. >> this was a big domestic policy for him. bill: he is getting revenge, it is small. let's look, the second thing is that he got called a racist on our network. he did not like that. he feels that the network is trying to pull him down. but i agree with you. for all the grants they, it was no news -- for all of that grandstanding, it was predictable.
11:17 pm
bill: elliott is the guest, she gets the last word. >> he thinks that he of the leader. that he is on the way. that he represents all the people. i think that they missed a tremendous opportunity. those people were at church, not watching sunday shows. bill: if he had talked to us it would have been an event. thank you. three muslims arrested on terrorism related charges. apparently they wanted to set off bombs. body language, the head of acorn getting grilled by chris wallace. mullins away. -- moments away.

federal authorities have arrested three men. an alleged terror plot. the ringleader, zazi, admits that he traveled to pakistan for explosives training from al qaeda, then he was charged with lying to federal agents and they appeared in court. also, seven former heads of the cia signed a joint letter to president obama that we just discovered, asking him to stop looking into the torture performed by the cia under the bush administration. chief, what i am not getting here is that if all seven of you guys, and i believe that leon panetta agrees with you, that this is destructive to national security and president obama goes on sunday shows yesterday saying that he respects you guys, but that he will not override his attorney general based on the integrity of the
11:22 pm
investigation, but it is national security, why are you not getting that? what do you say? >> if this were a brand new investigation, that would be one thing. bill: they do not trust it. eric holder is a left wing guy. they do not trust the investigation. is it as simple as that? >> they do not have a substantive quarrel with the investigation. bill: why does the aclu continue to sue if, as you say, it is put to bed. >> some of the non-governmental organizations have other agendas. the key thing is that the president is responsible for the intelligence community and the justice department. the executive branch works for him.
11:23 pm
he made a curious statement, that this was not a criminal investigation. bill: he is right. they have not launched criminal investigations. they're looking to see if there is enough. the appearance is what you wrote. >> i was going to say, if they want to turn this off, that this was an investigation to see if they would have an investigation, if that makes it easier, i am all for it. bill: obama is throwing sock to the far left. modern, conservative, libertarian americans, they do not want it. as you wrote in your letter, it does not matter if it is a criminal or pre-criminal
11:24 pm
investigation, it sends a chilling message to the cia and the intelligence network. you had better watch your step. do not take chances. >> not only watching yourself, but you cannot trust the guidance given to you in writing by the apartment of justice. that is what these people did. what is really crucial here is that the president' bid set the policy with any other way for the intelligence community. by broadcasting the details of the limitations, it is two things. you want your enemy to be uncertain. you also wanted her friend intelligence services from working with us. -- you also do not want to deter

11:30 pm
it was a tough question. americans do not like to be forced to buy anything. but he diverts said. this is a rhetorical body language thing. he seizes on the dictionary to try to get away from what has happened. >> the first thing that i noted was two defensive gestures. he tucked down his chin in he kicked out his butt. bill: how can you see that? >> in the two-shot. his foot goes out. bill: like he wants to kick george? >> the lower half of the body is where emotions speak louder. when you see movement in the lower half, that is when you recognize it. bill: interesting. so, when you get agitated or uncomfortable, -- there it is --
11:31 pm
that is an involuntary gesture showing that he does not like the question? >> no, you just know that you have hit an emotional chord. what he does is he leans forward. there is an intense look. he controls himself. that is when the finger stops pressing. bill: at the top, he seized upon the dictionary thing to divert attention, which is true. bertha lewis did appear with chris wallace yesterday. roll the tape. >> it is not entirely perfect. i think that covers, you know, will be looking at doing an anti-acorn amendment and singling out the organization. we continue to make sure that our employees, if they are too

11:33 pm
