fine or jail uninsured americans who won't pay for health insurance, but who goes to jail is based on how much money they make. jonathan, you say this is classic class warfare. >> yeah, i mean. sure, think about this. either you are your brother's keeper or you're going to jail. this is class warfare at its worst. it targets the productive non-needy members of society. this is the continued looting of productive people. they dress it up as a free market choice. oh, you're making a choice. but you're forced to buy insurance. how is that even constitutional? it is not like they're regulating something that you have chosen to do. they're forcing you to do something you haven't chosen to do. if you happen to make too much money, then we're sending you off to the hoosegow. this is terribly wrong. >> the argument could be that basically if you make enough money to of a afford healthcare and you don't get it for whatever reason, you're going to go to jail? i mean, that seems a little

extreme in this day and age. >> well, what you said, cheryl is that the democrats are pushing this. first of all, let me say this -- it came out of the group of six, an reported at the behest of the insurance industry, so everyone has to buy insurance. i don't think it is going to make it through, but for the sake of argument, let's say instead of class warfare, what about personal responsibility? because when you can afford health insurance and you choose not to, and then you go and put that off on someone else, you are he essentially shoplifting. you are taking advantage of everyone else and the class, jonathan, that benefits most from there is the upper class, because they're paying their premium and what is a 1,000 hidden tax for people essentially shoplifting? >> how are they benefiting? they are about to go to prison if they're going to prison. maybe bernie madoff will be my cell mate. this makes no sense. we need government to back the heck out. we need them to stop saying that i have to do anything other than

put states in arizona, texas, maryland in jail. this debate will go on for potentially years. >> i didn't realize i was living in russia. i thought i was living in the gold old usa. the fact that somebody in a voluntary program can enforce this by putting you in jail by a threat, by coercion and all of those things as opposed to having an incentive plan where people voluntarily want to do this is an outrageous thing. it is the tyranny of the government again. we're slowly slipping into total fascism in this country. you got to be careful. you have to know that your congressman is jeopardizing your own freedom. >> hold on. hold on, nancy. listen, here is the thing, i mean, again, your's going back to taxing the high-end earners, potentially the middle class. this is a tax. >> well, to your class warfare

point, go to any prison. it is 98% poor people, but if anything, there is class warfare the other way in prison. anybody who owes the federal government money and doesn't pay it could face jail. it is called not paying federal obligation. states have no say in this, by the way, and this talk of states they might as well have a civil war because the federal government will have the final say. it is a federal obligation. forget the reason why you didn't pay your health insurance thing. you go to jail when you don't pay it. is it unfair that only wealthier people would have to go to jail? that is ridiculous, in my opinion, but this is the -- >> hold on a second. nancy, let me go to you on one point and that is the fact that you have statehouses that are going to fight this until the end. they say this is too much interference from the federal government. how do you respond to that, nancy, from your party? >> i will tell you what, i don't think it will survive, but what might survive is the idea of states actually opting in and

using the power at the state levels to get the buying power of individual policies that they won't get through something like a across state lines, and so the idea, though -- but this is a law. this is a law and if everybody is covered, then the costs go down for everybody. we are paying $1,000 hidden costs right now. when you break the law, that is spernal responsibility. when you choose to break a law when you run a red light or shoplift, there is a fine. jonathan, you're using this to scare people. >> jonathan. >> well, you keep saying personal responsibility, but the law that you are so cherishing is based on force, forcing you to buy something that may you doonts want. you have to be responsible for your own healthcare costs. >> one at a time, folks. jonathan, finish your thought. >> exactly. nancy needs insulin or a heart stent or something like that, i am happy to not help her pay for

t she can appeal to charity, or pay for it herself. >> let's give tracy the last word. >> that should be your prerogative at end of the day. whether i pay cash on the table or use insurance for that insulin shot should be my decision, not the the government's. >> but there are people getting in the way because they chose not to have insurance and use the e.r. as a doctor's office. that's passing it on to other people. >> this debate is so not over but we have to move along. some parents across the country jumping for joy over the president's push to keep kids in school longer, but will it actually spell disaster for the economy, plus tracy byrns uncovers the one good thing coming out of this financial recession that could be the nail in the coffin for healthcare reform.

probably because of this story, the president is considering making school days longer and extending the school year deeper into the summer. tracy, all right. you got kids, trace. smart or dumb move for families and for the economy? >> i hate this idea. look, economy aside, the kids mentally need a break. you got to be a kid in this world. but let's talk about how fun the summer is and how much the economy benefits from it. summer camp. travel. we take vacations, we rent houses down the shore. so many businesses are reliant on the kids being off and coming down and having a great time. look, that's the beauty of being a kid. who wants to work 12 months a year? >> but look at tourism industry. this could really hit them hard. the stocks are already negative. >> what about the school supply makers. nobody talks about them, the pencils, you name it. the money will go from one arm to the other. the only benefit is that it lets people work longer because their kids are in school longer. it is bad for traffic.

i can't stand to think of buss in rush hour. this will not make us smarter n finland, they kick kids out of school who are dumb. here we have this no child left behind theory that everybody has got to go to school forever and only dufuses drag down the school when they should go to trade school and learn something at some age rather than making everybody have this mediocre classroom. that's the problems with schools. wayne is making faces. i have to go first to jonathan on this one, because the idea is from the administration that if we put kids in school longer and they are getting smarter it is going to be better long term for american mines, american businesses. do you buy that? >> i don't think so, because from what i understand they will spend the extra time learning the lyrics to mmm mmm mmm, barack hussein obama. i don't know what that will do to help kids. let's be frank. the public schools are disasters

as it s they are poorly run bureaucracies with terrible ultses. i don't think extending those contracts keeping kids in poor schools for longer periods of time will do anything than pour more money down the drain. we should be working towards privatizing schools and putting those divisions into the hands of parents instead of barack obama who is the expert in everything. >> wayne, you are being quiet today. what do you think? >> i think this is all foolish. the brookings institute has got a lot of stats on. this we know from experience that kids in school, they are going to learn a lot more, and this whole business, this reasoning that you say that it is going to hurt the tourist industry, on that reason alone, you should say why go to school at all, let's have tourist industry 12 months out of the year. it's foolish. when kids go to school and take certain times off during the year, not all at once, at the end of the summer, it has proven to be much better and it is a

use of that. by the way, you have an investment of 100% in infrastructure, meaning buildings and land. what are you going to do, use them only 75% of the time? that's dumb, also! >> wairn, you just said are we russia and to me it is like russia. i picture these soldiers marching around 12 months of the year. when do you get to let your brain be imaginative? >> with all due respect, why don't you just be a kid right now. it makes no sense at all. we've got to have people who are trell gent in this society who think. that's your problem right now. you have congressional members who probably never went to school. >> real quick, nancy, they have to raise taxes to keep kids in school, they will have to raise taxes across the board t comes down to that. it is a no brainer that we can't compete with the billions in

china without education. if we're shipping all our jobs, manufacturing jobs over there, we have to be smarter and every study proves more time in school, more math education, more science education is going to raise our intelligence levels and our quality of life. every single study, period. >> all those things that make you stay in school 18 versus 16, i see no correlation between those states states have havingr s.a.t. scores. we already go to school a long time, even compared to japan when you look at the hours wsm where is this study that shows more mediocre schools will create smarter kids? >> we will have to let our viewers at home with kids decide on this one. we have to go. coming up, we going to go from the classroom, to capitol hill, as the nation tightens its belt during this recession. congress is planning to spend even more of your money on itself. you won't believe what you about

>> here we go again as families cut back because of tough financial times, lawmakers vote to increase their own spending budget with our money. wayne, i know this makes you crazy, congress proving once again it is out of touch with everybody. >> yes. i call this the tyranny of the bureaucracy. once again, i mean, you know, you wonder where the congressional staff is, whether we're living in a totalitarian government. they vote themselves increases when, in fact, two businesses that we're involved in, we had to make cuts as opposed to laying off people. we made the cuts instead of

laying them off and in the second case, we froze salaries. the congress, on the other hand, says, oh, we got to have everything. we need more for the staff, more staff. what they ought to do is cut the staff and lower those costs and then they don't have to do so much. we don't have to have every law in the world passed. they ought to just enforce the ones they got. >> i'm looking at the increase that is anywhere for 4-6% for congressmen, both sides of the aisle. >> this is a rare display of bipartisanship this bill passed 25-0 out of committee. i got to say that much. i'm agreeing with the choir on this, i wouldn't use words like totalitarianism or tyranny, wayne, but it's less than in past years but still, nonetheless, i am appalled and i don't think you should add staff or consultants. if there one thing, if they make the buildings more energy efficient and wren sate them for long-term future savings, that's worth it. the rest of it, it is not the

time. >> no one is saying we want the buildings to fall down on our lovely congressmen and women but at the same time, it it is a lot of money. we're talking millions. >> i try to not get worked up but the concept is animal farm-ish. we had deflation last year of 2%. they should be spending less money and getting the same stuff. there needs to be caps. if you have a roof chance, it's if you have a roof collapse, it is a different store i have but the discretionary spending should not go up. >> like all the people that have been hired over the past year, all hires governmental employees. it wouldn't surprise me that they need to pay them and make room for them and actually, it's down about 4% from last year overall, so they did do some cost cutting. look, we want to keep a business going. this is what a business does and they keep hiring people around

the clock. they have to figure out a way to put them somewhere and pay them. >> jonathan, are you read ready to get to the balance sheet of congress now? >> this is peanuts compared to the programs that are locked. nancy wants to enact the trillions in entitlement programs arc couple million bucks on postage at a new museum is basically nothing. the basic functions of government is limited, right? prey tenth me, protect my rights -- protect me, protect my rights. unless the money is going to the court, the police or to fight islam, i don't know why they are doing anything at all. >> thanks for joining us and the "cashin' in" gang today and a warning on how the too big to fail banks about to create a new financial crisis. wayne will tell you all about it
