terrorists are supposed to be put into. we need to, one clarification, and two, to tell the american people there will never be a situation where someone who tries to commit a terrorist act on the united states of america would ever have access to miranda rights and will be interrogated to try to get whatever information we can get to save american lives. >> greta: i am seems you have two choices. either try him as a civilian or charge him as a civilian or consider him an enemy combat tan if you charge him as a civilian and gets miranda rights we can't back up, if you treat him as an enemy combatant that is probably constitutional. the problem the hair trigger was to charge him criminally and not consider enemy combatant or don't you think they thought that? >> there should have been no consideration to give this person the rights that american citizens have. miranda rights, the rights to

a civil trial. he's an enemy combatant. an enemy combatant should be placed under the jurisdiction of the military and tried by a military commission. we should make that absolutely clear. >> greta: do you think they want a do over? i guess the american people wonder the next time, we hope there isn't, but the next time this happens, do you have a sense from this white house, this attorney general that he will be treated as an enemy combatant not civilian and get miranda rights or is it still up in the air? >> we need clarification. process. none of the three heads of our intelligence agencies, homeland security, dni or counter terrorism were ever asked or consulted before they decided to give this christmas >> greta: why wasn't anybody

called? >> we have no answer to that question. >> greta: a single decision made by presumably the attorney general. >> somebody said it was the attorney general in consultation with lower level fbi. there are many things coming out about this story. supposedly they have a group that has formed up that is supposed to be tailoring to interrogate these suspects. number one, that never happened. number two, we now hear that still not in being. the hig they call it, something like that, a group of qualified individuals who are supposed to be dispatched when one of these individuals is apprehended to do the interrogation. an that group not only wasn't there, but apparently they haven't been formed up yet and it has been a number of months. >> greta: interesting the late night comedy about the underwear bomber. all the jokes. setting jokes aside. we lucky. had that bomb gone off, there would have been over 250

people murdered. we really lucky on that one. >> i think we got lucky. i also think it is interesting that osama bin laden claimed credit for it. and there appears to be ties that this individual had to al-qaeda. we don't need to go through all the fact that his father went to the embassy. that he showed up on a one-way ticket. all of the things that should have connected the dots, a phrase i hate, by the way. but we should have. it never should have reached that point. thank for some brave people who were on that airplane. >> greta: it is almost to the point of delusional with all those red flags that we got so lucky on that one. >> we certainly did. >> greta: don't ask, don't tell. you are still in favor of that policy in light of what secretary defense gates and mullen said you think things have evolved?

>> i know that it is working. i spend a lot of time with the military, it's working. second of all this decision was made by the president not by the military who have their hands full in two wars. third of all, i respect the views of admiral mullen who said it was his individual opinion that we have not heard from the rest of the military leadership. i would be very interested in hearing from our military on this issue. finally, i have a letter signed by over 1,000 retired admirals and generals, over 1,000, thousands of years of experience that say, don't repeal don't ask don't tell because it could have an impact on our combat effectiveness. so, there gonna, i hope do a study. i hope we're gonna get the opinion from our military leadership. i've always said that i believe that don't ask don't tell was working and i believe it is. >> greta: in terms of the

letter, i think some of the leaders said that was then but things have evolved. is your letter in the last year or two? how current is the letter? >> the letter is as i believe october of last year. >> greta: what is it that you think, if they serve openly, what is it the effect it would have? play it out for me? what happens? >> well, as you know in combat, our members of the military live close together. we are not prohibiting people who are that orientation that is homosexual or lesbian. we are not prohibiting them from serving. we are just saying that we do not talk about the fact that's what don't ask and we don't ask. so, i think again, he i talk to men and women in the military, they say it's not broke, it's not broken so we

don't need to fix it. again, i will be very interested in hearing the views of our military leaders, particularly our marine corp as well as army, air force as to what they think that this policy needs -- whether it needs to be changed or not. my view now is, that it is working. and we are in two wars. we need to have an assessment of the combat effectiveness and morale of our military, if that effect would be if we change the policy. >> greta: personal view, secretary gates speaking on behalf of the president. in the event that after a full study, i think secretary gates called for a study, let's say six months or a year down the road they conclude from the military leaders in theater who are fighting these wars say we can get away -- do away with don't ask don't tell. would you then be in favor of doing it? it is a decision made here not at the white house, right? >> we will have a number of hearings. we had many hearings before

the policy of don't ask don't tell was adopted. we will have many hearings, hear from our military leaders. i believe the system, present policy is working. if they can show me the evidence that it needs to be changed, obviously, then i would give that serious consideration. that has been my consistent policy. but i do believe that the policy in effect today is working. >> the economy, got a big fat suggested budget dropped on your doorstep here on capitol hill. what is your thought on the president's budget and the effect on the deficit and what are you gonna do with it? >> i think it is horrific. i think this incredible deficit and debt is going to -- act of generational theft uncon -- unconscionable. somebody say the other day you can't remain a world power if you owe the rest of the world

such huge trillions of dollars of debt. no country, no family, no business, can continue to function if you have an ongoing debt and deficit of the magnitude we have. for the president to say we're gonna having a spending freeze next year which could be 15 billion dollars in savings and immediately turn around and say, but we need 100 billion dollars jobs, i.e. stimulus bill, they haven't learned anything. they haven't learned anything. and the deficits as percent of gdp size in every measurement are beyond anything that can be sustained for a long period of time. >> greta: obviously one is standard of living and people's ability to hold jobs and build futures for their family. one consideration if the united states gets too -- with china we lose our authority in

the world that we look weak is that a consideration to you or not? >> if we continue to owe this amount of money, you are not going to be able to pay it back. then what happens? you debase the currency. and so you can pay these debts back. then you get inflation. inflation is the greatest enemy of the middle class. also fundamentally, we shouldn't owe all this money to foreign countries even though they wouldn't want to do it, particularly the chinese. they now have their hand on the throttle of the world's economy and our economy. that is a terrible situation for america to find itself in. by the way, it didn't start with the obama administration. the spending was out of control under the bush administration. but the magnitude in just one year of the spending increases is unbelievable. >> greta: next, more with senator mccain. majority leader reid called

i know the numbers we hear in the trillions now billions don't seem like much. even millions are beginning to not seem like much. i'm curious and i read coming over here that the united states has purchased a ad on the super bowl 2.5 million to advertise the census. i'm thinking, 2.5 million dollars, for 30 seconds. frankly, i don't -- i know how i feel. i know it is not a whole lot. are you in favor or against that one? >> i don't think it is necessary. it is symptomatic of the spending practices of the federal government and the congress in a way that is completely out of touch with what is going on out there in the real world. in the city of phoenix and across my home state of arizona. 48% of the home mortgages are underwater. in other words, they are worthless than the payments people are making. 17% real unemployment. so we spend a couple million

dollars on irritable bowel dream and a couple million on an ad in super bowl sunday. and we continue the practices that infuriate our citizenry because they are hurting so badly. they are having to tighten their belts this is what feeds the two parties this is what feeds the anti-incumbent mood out there. an out of touch congress. an out of touch administration. >> greta: you mentioned the out of touch, president obama said to the democrats today they need to stop paying attention to cable news, we didn't get singled out this time. >> i don't know who -- >> greta: i think he said cnn and fox news. he said they needed to go out and pay attention to their constituents this is president paying attention to his constituents? are the member of the house of both parties paying attention to constituents or not? >> first of all, i advise my friends to watch the cable

news bass our constituents are. >> -- news because our constituents are. >> i'll take that plug. >> i walk done the streets and they say, saw you on greta. lousy job. but they say, i saw you on greta. people watch and get news and information and opinion from cable news. i would advise members of congress just the opposite. because you want to know what information that you're -- that your constituents are getting. second of all it is always the wait we have politicians do in all respect, shoot the messenger, in all due respect, shoot the messenger, don't worry about the message. the message is they are sick and tired of business as usual. some polls have the approval of rating of congress in single digits. you get down to blood relatives and paid staffers. the message i think may come in this november and it might

be the most interesting political election that you and i have seen. >> greta: speaking of election one of your colleagues senate majority leader harry reid has been -- has had some things to say you about you on a las vegas talk show. playing petty politics. stuck in the 2008 campaign. refusing to do good things for the country. he says you are a great name caller. and he says you should leave president barack obama alone. what is going on between you guys? >> i'm very appreciative of all the attention that senator reid gives me. i'm fascinated hardly passes up an opportunity to mention my fame and maybe i will run in nevada -- my name and maybe i will run in nevada. >> greta: the level of have it roll i'ms -- the vitriol seems to be cranked up. >> despite what he says i'm fighting everyday for the people of arizona and the

taking major heat he's leaving canada coming to the united states for heart surgery. if this guy is leaving canada for treatment, should we really change our system to be more like canada's? joining us political reporter for the toronto star. first of all, how much of a controversy is his coming who to the united states creating in canada, if at all? >> it's created a lot of talk. but, you know at this point the controversy depends on one key unanswered question what is the surgery he has again to the u.s. for? we are told heart surgery. we don't though what kind. really virtually any cardiac procedure that can be done in the u.s. can be done in canada. it has raised a big question in a lot of minds. >> greta: it is not a situation, as far as we know, because we don't know what the procedure is. it is not like he can only get it in united states. he's not giving out the

information as to what the procedure is? >> that's right. he's a public figure. he heads the province of new finland in charge of delivering health care in that province. yet, he's insisting that he has a right to privacy in this instance. once he recovers from this procedure, whatever it is, he would be prepared to answer questions. that doesn't appear to be good enough for many people right now. they are wondering what does this do to instill confidence in the canadian system. if premier danny williams is anywhere in the u.s. watching your show tonight he would blow a gasket if he thought he was becoming the poster boy for the conservative side of the argument in the u.s. if he were to be seen as poster boy for the status quo on u.s. health care because he has long defended the health care system in canada. there's a big question at play. we don't know. he's insisting on privacy. >> greta: his staff isn't giving out any explanation why

if he thinks the canadian system is the right system? if he think the -- and if it is not the situation as far as we know this is a presidenter only available in the united states, he's not giving any explanation why he's opting for the u.s. over canada? >> you know what, they haven't given any clear explanation. all they said is he took the advice of doctors in new finland. he was apparently not offered that procedure there was option this is a smaller proven while his political status is an quinn to a governor in the u.s.. in his home province he's quite a popular leader. his approval ratings are around 70%, he's also independently, a wealthy man. he donates his premier salary to charity that that charity happens to be a foundation that he himself has established to assist children

who go out of province for medical procedures they may not be able to get in province. they haven't given out any information other than to suggest that the option wasn't available in his home province. to suggest that there are some techniques that are approved earlier in the u.s. and plus there's the volume of patients through the u.s. that there isn't here. so the physicians certainly in his province wouldn't be trained on. again it much depends on, is this something he could have gotten at any of the centers of excellence in this country. there are several sympathies who can perform complex -- several cities who can perform complex heart procedures if he thinks health care is a hot potato in the u.s. it is a hot potato here part of the touchstone of canadian identity. most politicians in this country while they might argue it is a expensive system and

there is a slight debate with whether there should be more availability of private services in canada, politically none of the parties go near, don't want to go near opening up the door to a so-called two-tier or u.s.-style health care system. it's got many elements. >> greta: 30 seconds left. to the extent you know, do they like the single payer system or not? what are the numbers like? >> it's by and large a fairly popular system. as i said, kiefer sutherland who stars on "24" jack bauer, his grandfather is one of the founders of medicare in this country. he's practically cannonized. it's a very popular health care system by and large. i would say a majority of canadians regard it as the option they want to keep. >> greta: if we can figure out this great mystery live from

money to have fun. not exactly. there's no place better to have fun than vegas one of our country's great destinations i've always enjoyed by visits look forward to visiting in a few weeks and hope folks will visit in record numbers this year. who wrote that one for him? >> look, the president's point, we were talking this today when we saw it, before i was asked to come on tonight. she said the president makes a good point you shouldn't be blowing your money if you have money for college. he should have been more aware of what he was saying and he should have known better. >> greta: new senator tomorrow, sworn in. the democrats say they are going to accommodate senator-elect brown and swear him in. i don't know if that's the word accommodate. that's a bad word since it is the will of the people. what do you think? >> i think scott brown has a decision. this guy has a national platform.

he's a nationally known figure. has to make a decision whether he is going to start out of blocks and become a national figure. he will be able to come on your show. i'm sure you will have him on with frequency because he's a big name and he will draw ratings. i would recommend to him, no offense that he doesn't do a lot of gretas, seans or o'reillies or anything else. he has to go home, stay off national shows. he can't be the republican voice on these issues. he's got to focus on serving the people of massachusetts. i can say from the couple of weeks he's been senator-elect he's done that you haven't seen him on national shows, a couple. but he's done what i think is a very good job so far in letting the people of massachusetts know it's their seat. he's not running for president right away he's not going to be the leader of the republican party here in washington. that he's going to do his job as the people's senator from

massachusetts that's the way he will be most effective mere in washington and the best way to get back in office in three years. >> greta: sounds like you are telling him to keep a low profile. here's the problem every vote is that 60-40 vote. the spotlight going to be on him. almost like we've become a one senator nation. >> he made the point saint a good point. every one of those -- point and it is a good point. every one of those votes a republican vote. >> greta: i'm a scott brown republican. our eyes are going to be on him. he's put himself in that spot. >> i an -- i would agree except there are other republicans on other issues who will be that vote occasionally for the democrats to give them 60. i would suggest more likely some other republican senator than him. that would be my prediction. >> when former first lady hillary clinton became a

attack on a cia base in afghanistan. i'm ainsley earhardt. we return to "on the record with greta van susteren." thanks for watching. ing. >> greta: great news, uncle sam wants you! lots of you. in 2010 the federal payroll is expected to hit 2.15 million employees. that is the highest level since 1992. who is going to pay for this? what are they going to do? steve moore joins us live. so, lots of government employees, good jobs, stimulus bill? >> at least somebody is hiring out there. it is amazing we've lost something like three to four million jobs over the last two years overall in the economy. but the federal government has hired about 150 to 200,000 more workers this is one of the reasons that washington is booming now the city with the fastest rate of growth you see it in real estate, population

growth, lowest unemployment rate. government growth of employment is fine except for the fact that government employees can only get paid if private sector workers pay their salaries with their taxes. when you get declining numbers that contributes to the big budget deficit. >> greta: i throughout list. -- [ inaudible ] jug 'tis department. >> at a time when the number of farmers has been shrinking there's a joke that the agriculture department employee for every farmer in america. >> greta: census department 106 going up to 119, increase of 13,000 at the justice department. >> big number. >> treasury from 107k to 114 increase of 7,000 jobs. >> i think the context is not just happening at the federal government. states and cities the power

base of the politics is now with -- almost all of these federal government workers are unionized big percentage of the state and local municipality workers are unionized unions have huge impacts especially at the state and local level. one of the things that is bankrupting states like new york, california and other states that can't pay their bills these state local federal employees are paid 30 to 35% more than a comparable skilled worker in the private sector because of their clout in negotiation at the bargaining table. >> greta: my sarcastic thought last night we did the segment about the sec where over two dozen employ his been searching the web for porn. probably the sec needs to hire people to do their job. that's my sarcasm. but, in reality, i can't for the life of me thinking, you know what do we need 13,000 more employees at justice or

seven more at agriculture what are they going to do if the underlying economy is not booming? what are they going to be doing? how do we pay for them if we don't have this booming economy to generate tax revenue. >> these workers can own be paid if private sector workers are paying taxes because that's how they get their paycheck. here's the thing that is outrageous. you are having major growth in these government agencies there's seldom times when government workers get fired. the most outrageous thing about the story yesterday about the sec workers looking at porn, they weren't fired, they weren't penalized. >> greta: wait back to this. the inspector general didn't want to name the people because they didn't want to embarrass them. they are stealing money, searching for porn and they can't be named because we don't want to embarrass them. >> people on the new york city payroll, teachers, sexual

misconduct or gross misconduct in the classroom, they should be fired off the payroll. people wonder why can't new york city balance its budget? a big and growing problem. at the federal level i would favor a 10% across the board reduction in these agencies. >> greta: the president put that program together to find 100 million excess in each office, at least we know some was completed, a report said it totally completed july. >> few workers get laid off when you have those reductions in spending. one of the reasons it is so hard to battle budget. >> greta: steve, thank you. here we go again. aig plans to dish out 100 million dollars in bonuses to its executives. joining us white house correspondent. sounds like aig's bow fuses going on again? >> remember, last spring they dished out 168 million dollars

in bonuses and the public outcry and the president said people should be upset and he's been railing against wall street excesses for sometime. this is the latest in the series of bonuses aig has been contractually obligated to pay folks in this financial products unit. these folks traded derivatives that some people blame for the whole collapse. >> greta: the ones who are getting bonuses, the unit in aig, which going to set everybody on fire if we look behind it, this is the unit that created the risky transactions that created the problems for aig? >> they were doing risky trades that were hedges against aig's core business how big financial houses work. it didn't look good when you rail against excesses and this type of trading contributed to the collapse. now the government with a stake in aig has to oversee these bonus payments. it doesn't look good. >> greta: loan is 180 billion dollars to aig?

>> yes that's about how much in bailout money the company has received. >> greta: has any come back? >> they said they are going to repay it over two years they have to sell businesses and do other things to generate the cash. >> greta: the answer is no? >> not yet. >> >> greta: they still got our dough or the ability to get it down to -- to get the dough. >> they are working on getting it back. >> greta: yet, the very i it in that -- the very unit that created the risk to the organization causing the bailout are the ones that are eligible for this bonus? >> correct. >> greta: you listen to that it sounds nuts. >> it does. but the rational is once they are in these heavy financial positions trading these instruments they have to unwine the positions or remaining assets could be worth nothing. you rational keep the fire burning, keep traders ememployed, retain them by
