these problems, including the bailout. she supported it. i opposed it. and a middle income tax cut which i believe is absolutely necessary for economic revival. i would give people a middle income tax cut now without holding it hostage. >> it is about raising taxes and sending it to washington. i want taxes, i want our money to stay in the hands of our families and in those who create jobs. when mr. blumenthal is talking about middle class tax cuts and holding hostage that is not true and he knows it. i don't want us to raise taxes on anyone. >> greta: our own bret baier moderated the debate he joins us live in connecticut. linda mcmahon is behind in this race are you hearing anything to indicate she advanced herself tonight? >> bret: i think it was a debate on both sides there were points at which each

candidate made some effective points. linda mcmahon challenged dick blumenthal about job creation. what you would do? how do you create a job? his answer had him back and forth a little bit. seemed like she scored some point there is. at another part of the debate, asked about which program she would cut, in the federal government? she didn't get specific. she didn't answer that question. i think there were high points and low points for each candidate. i know it sounds like a cop-out i think both candidates scored points on different issues. >> greta: scoring points isn't gonna do her any good as the losing in the polls these days a tie leaves her where she was. she needs to score a knock down or make a huge impression -- impression on voters to get any traction. >> bret: i don't that i happened tonight, you are right. our fox poll out tonight has

her down 10 points. another poll has her down 12. another poll that is closer. you are right. she needs to go after people who are either still undecided and there are very few of those. or independents who perhaps are leaning one way, but could be swayed to another. that ad came out today from the mcmahon campaign. that involved, as you have seen throughout the day, the vietnammer to that blumenthal told numerous times. saying he was in vietnam when never served. a very powerful and forceful negative ad about that fact. if he doesn't tell the truth here what is he going to do in the senate and representing connecticut? what i found surprising was, there were numerous opportunities after that ad was played during the debate, for her to go on the attack and make that very point. she didn't do it. it seems like she wanted to back away just a little bit

and let the ad speak for itself. we'll see how that plays in connecticut and perhaps independent voters who may get turned off by negative. >> greta: i watched the ad twice. i watched it when i was watching the debate i had the feed of the debate. i thought how does blumenthal not remember whether he was in vietnam or not? i thought it was peculiar that -- i didn't know that was inadvertent or some way to imply that he was still making that statement now. there is a date when he made the statements about being in vietnam many one that was out sequenced i thought that was peculiar, sort of a little bit, i don't know maybe i'm reading too much into it, but a little slippery. >> bret: he has apologized it is still a big issue and hurdle for his campaign. you are right this tape is old. it may be newly discovered,

rather, another nato convoy of trunks, tankers attacked by taliban taking credit for it. this is not stopping. >> it is not. the most important border crossing from pakistan to kabul, remains closed. that means the pakistanis have not opened it. trucks are beginning to build up on the pakistani side of the border and are vulnerable. i don't think that affects our operations inside afghanistan. if this goes on much longer, there is only so much you can take in by air. things like fuel and heavier commodities have to go through these overland convoys. with the flooding in pakistan disrupting a lot of that, if this does on longer you could see impact on our operates in afghanistan. >> >> greta: i read that 80% of the supplies goes in through that route. when you say if this goes on sometimes longer, like three days, a week, a month, how

>> greta: there's news about the american man downed -- gunned down on a jet ski. the man's wife record he was shot in the head while the couple was jet skiing on the mexican side of lake falcon. the woman called 911 after the shooting. >> greta: joining us live denver post reporter mitchell he interviewed the wife of the

man who was shot. good evening. >> good evening. >> greta: what did the wife say happen? did she give you detail by detail what happened? >> yes. she said her and her husband they were only a week away from returning to colorado, where they are from. they wanted to go to this church on the mexican side of the border. and they went on jet skis on their way back. after taking pictures of a church that is submerged in the water. they saw three boats following behind them. aware of earlier incidents with so-called pirates. so they were a little on edge. when they saw them with guns they decided they were gonna takeoff and try to get on to the u.s. side and to safety. so they -- in the process of doing that when shots were

fired. and tiffany's husband david was shot in the back of the head, fell into the water. she immediately wheeled around and went back to her husband, dove in the water and was trying to pull him on to her jet ski. she weighs 105 pounds he weighs 250 pounds, she couldn't do it. she said the fastest of the three boats that were after her, came right up next to the jet ski she was on one side with her husband and the boat was on the other side. and the men had their guns they were talking, obviously talking about what to do with her. they apparently didn't come to any conclusion, so the one boat returned to the other two boats. they were having the discussion and she decided in order for the sake of her own life, for her survival she had to get out of there

immediately. it was a horrible feeling for her to have to leave her husband behind. she jumped on her jet ski and went as fast as she could towards the u.s. side. she was two miles away from the border. as she was going, she started hearing bullets whizzing by her and striking the water on both sides of her and in front of her. she told met boat continued to follow her -- she told me the boat continue odd to follow her when she was on the u.s. side. witnesses confirmed her story. they saw a boat speeding after her. her jet ski was faster than the fishing boat. so she was able to get to safety. she went to a stranger's house and called the authorities. very traumatic experience for her. she was distraught. she was trembling and sobbing in the house when she was calling authorities, as you could tell by that call she

made. >> greta: have you talked to the witnesses? >> i have not spoken to the witness. the sheriff that i talked to didn't give met name of the witness. -- didn't give me the name of the witness. >> greta: is that water patrolled -- i take it the u.s. border -- any sort of patrolling of that water? >> on the u.s. side there's a lot of patrolling. you have the border patrol, park service employees that patrol. you have the sheriff's department that also does so. on the mexican side, not so much. in fact, on this lake it is a very popular lake, people come from all over the country to fish there. there's national fishing tournaments there. and you are not supposed to commercial fish on the lake.

on the mexican side they use regular commercial fishing boats and they fish with nets and catch fish illegally. so there really isn't oversight on that side. >> greta: when she was speeding from the scene and she got to the american side of this lake, did any border patrol or anybody see -- any law enforcement on the american side -- or was she able to get to ground and then go to her home and make a phone call? >> the first house -- when she reached the other side she went to the first house she saw. that's the location where she called authorities from. she was there for some time. when the sheriff spoke to her she repeatedly asked if they found her husband? right now she is going through a nightmare. she is in limbo. hoping that her husband's body is found.

we knew this day was coming. that's why we bought a subaru. >> greta: president obama's national health care law may have passed. voters in three states could fight back against the law, at the ballot box. in august, voters in missouri voted to reject the law by 71%. in three more states could follow missouri's lead. joining us valerie richardson. what three states are attempting to follow missouri? >> here in colorado, colorado is one. arizona and oklahoma. >> greta: i suppose it is a little over-stated legislators put it on the ballot. we don't know how the people in the states feel about it, right? >> in two of the states that's true. in arizona and oklahoma the legislature voted to put these

measures on the bat local -- ballot. colorado had to do a signature drive to get theirs on the ballot. >> greta: any idea signatures they had to get in colorado? >> colorado the bar is not high. you don't need an overwhelming number of signatures. it does seem like the measure is popular from the number of signs you see it is called amendment 63 there's quite a bit of campaigning in favor of it. the other one that is almost certain to pass is arizona's measure. arizona had an identical measure on its ballot in 2008, which as you know was a hugely democratic year. in the face of that tide arizona nearly passed it, it failed by less than 1% of the vote before there was a federal health care plan on the table. >> greta: arizona a little upset with the federal government to begin with. going in they may not be inclined to go along with the

federal program. in terms of what they are seeking to do in thee states, is it to invalidate the entire statute or simply one provision that being the mandate that you have to buy health care insurance? >> that's right. they are really focused on mandatory purchasing of health care provision. right now the law would require everybody to buy health care or face some sort of a penalty or fine. they are arguing that the federal government can't force the states to do that. similar to the tactic you see with the attorneys general suing the federal government over that provision. you also saw this last session, six states passed measures similar to the ballot measures, saying you can't force us to buy health insurance that is going to be up to us not the federal government you see an attack happening in the core, legislatures and now with the ballot box following the missouri measure. >> greta: correct me if i'm

wrong in state attorney generals actions in florida as well as the single one in virginia, if they are successful that would declare the statute uncons collusion -- unconstitutional. in the other states if they win they still have the law to contend with because it is largely symbolic they can't overturn the federal law is that right? >> that's something the critics are arguing. saying the federal law is going to preempt the state law the extreme clause the states can't get around that. what the proponents are arguing is that they have the 10th amendment on their side. which says the powers not specifically given to the federal government go to the people in this case the states. they are going to use the 10th amendment argument if these measures pass and are taken to court which is undoubtedly going to be the case. >> greta: the next big step in the courts is october 18th, when there will be a big motion argued in the state of virginia. we'll all be watching.

valerie, thank you. >> thank you growth >> greta: we thought it was bad over-- the summer when the times broke a story about people in california getting welfare cash at casino at m's. it just worse. jack, it seems worse. tell me what your investigation has revealed about welfare recipients in california? >> the dollar figures are higher this time. we asked the add stpraoeurgs a database showing all of the out of state -- spending with these debit cards that are issued to california welfare recipients. what we found was almost 12 million dollars spent in las vegas. much. that along the strip. $400,000 roughly in hawaii. a million and a half in florida, including plenty on south beach and on 14 separate cruise ships, sailing from ports around the world, including eight which sail

primarily from miami >> greta: it is hard to justify, come up with an innocent explanation trying to give it the best spin on the money spent in vegas the almost of -- the amount of almost 12 million dollars with the debit cards. can you come up with an innocent explanation why someone might be traveling to hawaii or florida or going on a cruise ship? it is sort of hard, but have you tried to come up with any reporting on that? >> the schwarzenegger administration decided this afternoon it couldn't justify any of the trips to las vegas or on cruise ships. they told the vendor that handle these atm cards to program the system not to accept the cards in those places. in places like hawaii and florida, the explanation that we got from the director of the department of social services today was, it may be that your originally -- that you're originally from hawaii, you have a sick parent. the parent pays for you to fly

home, you bring your children because this money is meant to feed and clothe your children so you withdraw money in hawaii, taking care of your kids and that's a legitimate expenditure. that could very well be the case. data that we got only shows where the money was spent. it doesn't reveal the names of the people so it is not like we can call and ask them. it is worth mentioning even in hawaii, we found expenditures on wikiki beach, gift shops next to the jimmy buffet restaurants and a couple of expenditures on a tiny island off the west coast of maui that has two four seasons resorts and very little else. >> greta: in terms of discovering this information, did you ask for it or did they do some sort of annual audit and discovered it themselves? >> no, we had to ask for it. >> greta:'s bad. that's horrible. >> pardon me? >> greta: that's horrible.

it takes you and the journalists to find the fraud and possible stealing of the welfare money or misuse of it, i should say. it takes you at the l.a. times to do it. the government is not even looking to see where the taxpayer money is going. >> no. investigators do get sort of a -- a richer version of what we got. interviewing investigators what i found out was when they look at this out of state spending they are only interested if the person has moved out of the state. they don't even bother to call the person until the transactions show that they've been out of the state for a month in most places. l.a. county, waits for three months. what they don't do is look for a week at the four seasons in la night and then call the person to -- to find out if perhaps they misrepresented themselves when they originally applied for welfare. the investigators who told us that he would never do that,

channel. see you soon! >> greta: have americans been totally had by free trade? did you see the front page of the "wall street journal"? the headline tells us how you feel. the article sites a new poll that says you, that means the person public are becoming increasingly hostile to fair trade. what is the story? what are the numbers like? >> numbers aren't good in terms of liking free trade. 86% said they thought out-source -- outsourcing is one of the reasons the economy is recovering so slowly. more than half said trade hurts the u.s.. >> greta: what is the ? what has been like in previous years? >> definitely a change? a couple years ago 30% people were saying trade agreements have hurt the u.s.. definitely a change among upper income and higher educated people.

>> greta: lawyers don't get outsourced, doctors don't get outsourced. those are people who liked free trade because they the cheaper products. >> right we know there are winners and losers to trade. when it comes to winners these are the winners. a lot of time they work for companies that expand in international markets. so the fact they are turning on it is a big deal. >> greta: outsourcing huge political problem. people hate to see their s go. any foreign companies that are outsourcing that are coming here? >> we haven't seen a lot of that. >> greta: that's a problem. that would at last alleviate some of the unhappiness. >> right. if that is happening it is not as visible as the fact there's shuts down and lays off 300 workers and goes abroad. there's the stories you hear and see. you don't see people opening businesses in the u.s., --

>> greta: besides the people, the wealthy people who haven't had their jobs outsourced, in terms of the middle class or the lower middle class, have they benefitted from free trade? >> when you talk to people and they say they are not totally posed to trade. they understand it is good for the economy in general. feeds demand into the economy when it is weak but they don't think it is fair when it comes to jobs same thing the middle class, upper class is saying, across all professions and income groups. >> greta: we haven't had a fast recovery from this last recession it is hard to understand how free trade speeds up our recovery, you like at china, china had a faster recovery than we've had. >> this is one of the big reasons people are turning negative. they see free trade as something that should be mutually beneficial. they look at china, they are doing so much better than we are, why isn't this a fair
