and tiffany hartley reportedly involved in a shooting this past week on a lake at the u.s. mexican border. david is presumed dead. video of the couple at a traffic store are stop hours before heading to the lake. >> jamie: this is a fox news alert. tea party patriots voiced their opinion on who should be the next chander in chief. we have -- commander-in-chief. thousands of tea party patriots wrapping up the convention in richmond, virginia. julie kirtz is live in washington. what are the results? >> reporter: they announced the results. there were 15 people on the ballot at tea party about vist in virginia, including president obama. the new jersey governor chris christie came out ahead winning with 14% of the vote. it's interest iing because last

week christie was asked if he'd run in 2012. he said no way. to be president you have to want it more than anything in world and i don't. but the tea party supports gathered in rich monday today do want him. coming in second was sarah palin. tea party favorite with 13.5% of the vote. ron paul number three, with 12.5% of the vote. gingrich is four. number five is jim demint. several tea party activists gathered today. interesting to see who they'll throw their weight behind. >> jamie: we've been following it all day. are we getting an idea how important they've been in the 2012 race? >> reporter: no g.o.p. presidential hopeful in 2012

can expect to make a go without winning the tea party support. this isn't the traditional political movement. it's not organized in that way. support from the tea party activists is crucial. we heard today from headliners at the convention, ron paul, dobs talking about how important small government is. here is sound from earlier today. >> time to show our independence and self-reliance and understand the question of this year and this era in my opinion. that question is this: will the people be working for the government or will the government start working for the people? [ applause ] >> today i'm pleasantly surprised to find out there are so many of you who really care. and you're sick and tired of what you have in washington, d.c. virginia tea party activist billed this as the largest gathering of the tea party activists so far. they wrapped up a few moments ago. >> jamie: julie kirtz with the latest on the straw poll. good to see you. thank you so much. >> rick: election are about the numbers. here at fox news we have been crumpling them hard. what we've seen so far is the biggest number of voters are the moderates, those who don't want to go too far to the right or too far to the left. what does it mean for candidates? we have two strategists. good to see you both. andrew, looking at the polls. it's not just the conservatives who are upset with the president. out seems to me moderates are as well.

maybe it won't be too tough to get the moderate vote. >> at the end of the day, a famous democrat once said all politics is local. the more republicans make it about the pocketbook, they'll understood. the independents will move to the republican side and the moderate. >> hope for the democrats is the more conservative republican candidates backed by the tea party will move to be too conservative for moderates. what do you think about that? >> that is the hope. but what angela said to me as the democrat is true. moderate and the swing voters and the ipts are moving away from president obama who won by 52-44. his approval is 38%. virtually every democrat is trailing a tea party

candidate with moderates and swing voters by enough to make a difference. >> rick: i want to ask more about that in a moment. angela, do you have concern that perhaps the sharron angle of the world, the o'donnell or joe miller candidates on ballots in various states across the country in three weeks from now will be too conservative to appeal on the moderate voters? >> rick. three weeks is an eterpty away in politics. if the politician goes into advocacy and tell people what they'll do for a better america, i think that angle or o'donnell might be victorious if thaw tell people who they really are and what they're going to do. that's what folks want today. they don't want politicians. they want people to go to washington, d.c., and make difference. >> rick: doug, the story line

is unbelievable. if you talk about the turn-around, that is a president and white house swept in power on the backs of moderate and independent voters. only two years ago. now we see the democratic party in danger of losing one or two houses of congress because of the voter bloc. how did it happen? >> jamie: moderates and independents expected that the president would govern from the center. not a red america, not blue america, united states of america. the moderates perceived the president went too far left. in large numbers they reject ed his policies and the reaction we've seen state-by-state and district-by-district. >> rick: you know going out and trying to get people's votes. how can the g.o.p. lock up

the voting bloc? is it possible or will the moderate voters going to swing back and forth? >> it's the economy and jobs. the jobs numbers coming out yesterday. unemployment rates are not changed. the approval or disapproval rating of congress is at 72% all-time high. >> rick: doug, do we see a different obama after the mid-term? >> i hope. so i advised bill clinton to move to the center in '95 after the debacle mid-term in '94. so far, there is no evidence of that. i suspect we'll get a congress fronational congress. i don't think they've shown they want to go to the center. but i hope they do. >> since we learn result of the straw poll at the tea

party conference, i'd love your impressions. angela, you first. chris christie winning the straw poll for the next president. >> that's a surprise to me but this has been an election year like no other. palin, i wasn't surprised about but she beat newt gingrich. very interesting. >> rick: doug, what do you think? >> here is the thing. chris christie is optimistic. he has the new jersey finances under control. progressive fiscally conservative republican offering a different way and a different direction. people respond to that. that's why chris christie did as well as he could. indicator for the republicans and indeed for country about what people want in politics going toward. >> rick: doug and angela, thank you, both. enjoy the rest of the weekend. >> we will. >> jamie: a fox news alert.

a news conference on the 33 miners trapped in chile. rescue crews today drilling through to the cavern where the miners have been stuck. can you believe it? 66 days. setting off a tearful celebration above the ground. [ cheering ] >> rick: we could hear details on when and how the rescuers start to plan pulling the men out of the home. 2,000 feet below the surface. so many family members have been camped out there since the beginning. steve harrigan has the story in chile. >> the celebrations began this morning across the mine and the nation of chile where they have been watching and waiting for two months.

family members hunging each other with joy with the latest breakthrough. now the rescue, itself. likely that the cameras will be loaded. if it's strong enough, we could see mine norcwhe miners l. they will send someone in the mine lie,ly a navy paramedic to detect conditions each minor faces. they have one diabetic, a man with high blood pressure and a 63-year-old miner. the first miner is likely strong and fit to deal with challenges as they have been many of the unexpected. back to you. >> jamie: thank you. this has been dramatic ordeal for the miners and their families. cave-in trapping them on august 5. no one knew if they were alive or dead until 17 days later. rescue teams drilling 2200

backs up her account. >> rick: well, at least it shows they were on their way to the lake. you can hear a voice there. there is evidence cob rating her story with tiny amount of blood on her life vest. >> jamie: total panic is how witnesses described the scene at a school shooting in california. police arresting 41-year-old brendon o'rourke. investigators they they think he acted alone. police say two children were grazed but they will be okay. construction workers saving the day. one of them jumped in the truck and ran the suspect down.

>> i can't explain it. a crazy feeling. it happened. car on the sideline here. he had to jump a fence. i noticed he was leaving the playground, i ran across the street to grab my truck. i had to drive over and hit him with my truck. >> jamie: incredible. workers held him until the police could get there. >> rick: nightmare overseas where hundreds are evacuating homes in hungary. the prime minister warning that another sludge spill could be coming, saying it dani danieled aluminum reservoir has many cracks and is likely to collapse. river of sludge from the plant killed zeb people and injured more than 100 more. greg burke has the latest from western hungary. >> reporter: another big

scare. saying that the reservoir could get worse and the walls are weak and likely it would collapse. if it does happen, it could let out half the flow of the sludge from last monday and damaging more homes in more farmland. however, people should be safe. more than 700 people have been evacuated. in the wall does collapse there are 5,000 people on standby to be taken from another nearby town if, in fact, the sludge flows again. estimate of damage is $50 million. the famous hungarian financier george soros says he will donate $1 million to the cause. it will take more than that to get their lives back together. >> rick: when we come back, a warning for college students as a party turns into a nightmare.

iranian leaders are ready to hold nuclear talks with six major powers this month. it's coming as a spying scandal emerging at the nuclear facility. iran revealing that personnel were bribed to pass secrets to western nations. iran arrested several spies in recent week and even battled a computer worm at the nuclear facility. >> rick: a huge car ferry on fire in the baltic sea. look at the video. explosion on the upper deck triggering the fire with 250 passengers on board. they kept it from breaking apart and spilling 120 tons of fuel in the sea. everyone on board has been rescued. three people were injured seriously. the ferry was headed from germany to lithuania. ferry officials say the blast appeared to have been a technical mishap. when we come back, freeze

news that apple is going to make iphone 4 available to verizon users next year. it's only available through at&t. bank of america stopping foreclosure in all 50 states and more banks could do the same in coming days. what does it do for the housing market? caroline shively has the story from washington. >> this started out as a banking scandal and whipped up to a crisis. bank of america is the first name to shut down foreclosures in 50 states but one of five to do it in half the country. gmac and jp morgan chase stopped some of their foreclosures. across half the country. it doesn't mean they shouldn't have faced foer foersz -- foreclosure but the paperwork might not have been in order.

>> great to be here. >> jamie: for some people, it could be good news that the foreclosure that might be in process might be stalled. bank of america is doing it voluntarily. should the government get involved? is it a good move? >> not a one-word answer. it depends. >> jamie: it can be more than one word. >> a chance to do what is best for the country and not necessarily what is popular. we have toxic assets, foreclosure and bad mortgages and we understand that and we need to get them off the book. if there is a delay and there is a pause, good news is some people have a reprieve and won't pay back mortgages. great news, but many will never be paid back. if you can't pay your mortgage, you shouldn't be in the home. >> a lot of people got there by not giving proper information or getting the right mortgage.

>> some people are stuck. what happens to housing prices if there is a moratorium where the banks with loans on the book, that they can't do anything about it. >> that is an interesting point. right now today, 6 of 00,000 homes have been foreclosed that have not gone on the market. they haven't because they don't want to flood the market. and depression the crisis. now more loans or homes will go in the market and depress it further. this stall will help not depress prices. >> jamie: interesting. when i see the stock market go up above 11,000, which it did at the end of the week, but we know the banking stocks could take a hit if they are stuck with the bad loans, what happens? should we be concerned on monday? >> you should. 30 companies of the dow jones/industrials. it's all it is. the financials actually went down.

this is part of the reason. there is a bill in the senate if obama vetoes the bill to lower threshold and make foreclosures easier to happen, if he vetoes it -- it's called a pocket veto. if he does you will see the financials drop even more. >> 3808. you're in favor of that? tell us why. >> yes. it lowers threshold for the companies not to have 300 pages of documents. you have to have actual real signatures versus computer signatures. if we lower the threshold and make things easier and let the -- >> less paperwork. >> the program that they brought to help them with the mortgages. that proved to be paperwork overload as well.

>> jamie: you told us what is right. what is popular? >> what is popular, you have close to 1 million who can't afford to live in the homes they're living in and they are living in the homes. the financial ecosystem can't survive that way. if they don't pay back the notes, they'll have financial problems which we as taxpayer own and we'll take on the burden. >> jamie: before i let yougo, what did bank of america take the step on their own? they did it voluntarily. >> i'll call it the foreclosure mill. they had so many foreclosures they got sloppy. sloppy with the paperwork. they just sign things and take a pause. find out if we are making mistakes. fix mistakes and get back to process. >> jamie: big story. rick, nice to see you. good luck with the book. >> thank you very much.

>> jamie: rick? >> rick: three weeks to go until the mid-term election. the president and the g.o.p. trading barbs over spending. president ripping in republicans for cutting education. he says it will reduce the financial aid for millions of college students. >> i'm not prepared to short change the children's education. i'm not willing to undercut their economic future or the economic future of the united states of america. nothing would be more detrimental to prospect for success than cutting back on education. it would combine america to second place in a fiercely competitive economy. >> senators responding criticizing the president for spending and broken promises. >> the president's policies are irresponsible and unsustainable.

get caught up in the spam folder or something like that. reality is fewer americans have land lines in their homes than ever before. so, pretty much the only way you can reach them is through the mobile number. almost everyone has one. listen to this. 290 million americans to be act. 94% of the total population. no surprise that politicians are jumping on the wireless bandwagon to reach voters and campaign volunteers as well. listen. >> folks behind me, high school or college students wanted another medium to get involved in a campaign. that allows a state like california to engage volunteers in every part of the county. >> the proof is in the pudding. americans send 5 billion text messages every day. that number is only going to rise as more and more people

have the little mini computers in their hands. >> it's true. capable of doing more and more. >> do you have any idea how many candidates are using the technology? >> reporter: believe it or not, only a handful. there are 500 races going on in america in the election cycle. we understand only a dozen or so candidates are texting voters. california senate hopeful carly fiorina, the california gubernatorial candidate meg whitman and senate majority leader harry reid among the high-profile candidates that relying on the technology. it's estimated that next year 50% of mobile phones that people carry will be smart phones, iphones, blackberries and droids. you can bet by the next presidential election rolls around in 2012, the number of political text messages will only surge. >> some people out there now thinking they should buy phone carrier stock.

government and we need a plan. in december, we'll review the strategy. pakistan plays hugely in this. do we need to push pakistan to do more? >> absolutely. three things need to be done. we have to establish a better working relationship with the pakistani army. we have to do better with the narrative. winning the information war. so many pakistanis have a bad feeling about the united states. taliban is winning that war. we have to keep killing the bad guys. through the aerial attacks and through the use of clandestine ground forces. the command in afghanistan and sincom has to turn up the heat to keep them on the side of the border and cooperate to do a better job of taking them out. >> jamie: in afghanistan, we talk often when i have a chance to speak with you about corruption and the role that plays.

is that same situation in afghanistan? >> yes, absolutely true. they tell me if the pakistani unit on the other side of the border, clean you want, they are well-led and not tied to corruption, the flow of taliban is reduced. the flow of bad guys increases in afghanistan. views have to understand is that this has a direct impact on the lives of the men and women serving in afghanistan. we have to do all we can do to reduce the terrible problem of corruption. >> jamie: what leverage do we have with pakistan? we send money and we try to do what we can as a nation. we need their help. what leverage do we have? >> first, we have to understand how important this is. the most single important
