we've got lots happening on the busy news day with control of the senate up for grabs. every seat counts for republicans and democrats. one race that could have an impact is illinois. julie kirtz has more. >> reporter: this is a high profile contest. if the race for obama former senate seat and a loss for democrats would be symbolic. the latest numbers show a tight battle in obama's home state. republican mark kirk up a point in the real clear politics average against the democrat alexi giannoulias. they faced off on nbc with giannoulias charging that kirk's claim of being a fiscal hawk and military record aren't true. >> this race is different. kirk says she a fiscal hawk. the congressman has told real whoppers in the campaign, but that may be the biggest one of all.

>> it's ironic to oppose my record on fiscal conservative. the tribune asked him to name a spending bill he would vote to cut. he couldn't name one. as they said when they endorsed me it was painful to watch. >> reporter: character has been a theme of the race. it came up today as you heard kirk accusing his opponent family bank of making loans to the mob. giannoulias says his family bank didn't know the extent of the criminal activity and says kirk's charge is offensive and misleading. so they sat side-by-side today and calmly accused each other of lying with just 23 days to go before voters have to decide. >> uma: the gloves are coming off. well, a senate race once thought to be a safe one for democrats has gotten tighter. the latest real clear politics average is now having west virginia governor joe manchin trailing his opponent republican john raese by five points. manchin's effort has been hurt

by raese's effort to link him to president obama, who according to polls has a very low approval rating from voters in that state. now tomorrow, manchin will welcome former president bill clinton to his state and he is hoping that mr. clinton will help him gain traction with voters. the former president plans to campaign for manchin in west virginia, knowing that the stakes remain high for democrats in this race. joining us now from west virginia is governor joe manchin. thank you for joining us today. welcome. nice to have you here. >> thank you for having me, uma. >> uma: you won the second term as governor in 2008 with 70% of the vote in your state. where there is a democratic majority. so how do you account for the fact in the time weeks before the mid-term you are trailing your opponent? >> people here are as mad as i am with what you see in washington happening. basically when democrats and republicans both put themselves and the party before the country, that's wrong. we didn't do that in west virginia. six years ago we put politics

aside and we brought everybody together. i'm endorsed by the national chamber of commerce, all the labor unions, everybody together is working in west virginia. and we're one of the best states in the nation right now. that needs to happen in washington. >> uma: well, gornor, do you think the senate race in the state is absolutely a referendum against president obama? the republicans exploiting the anti-washington sentiment in the country right now? >> there has been a smear and fear campaign and scaring everybody to death i'm a rubber stamp. only rubber stamp i've been is for the state and the people's interest in west virginia. we have done well working together. i don't think west virginia will let them by in the election. when they find out the opponent lives in palm beach, florida, and his family and where they pay their taxes, not supporting the school system in west virginia. i think there is a lot of things they'll find out, they are getting interested. it will be a competitive race.

>> uma: you are the only governor to demand partial repeal of the healthcare law, even though you supported it earlier this year. why did you do this? is this an effort to distance yourself from the president? >> uma, what i did is i supported health reform, which i still do. we have children right now they cannot drop off. we can take the children with the preexisting conditions. democrats and republicans, both of them working for the best of the country. there are good things that can be done. why would they want to throw them all out and repeal everything when you can fix it? if you can't fix it, then repeal the entire thing. that's all i said. that's how we work in west virginia. when something is broke, fix it. this is broke. it's not going to work. people don't accept it. this government under this administration has reached too far with the overreaching indulgence in people's lives. that's not who we are. uma, 150 years ago, the state of west virginia went to war against our mother state of virginia, because we were so

independent. in the spirit of senator robert byrd, you know, he didn't care who the president was, democrat or republican. when you are wrong, they're wrong. they are wrong on the issue. >> uma: let me ask you this. there has been negative campaign ads going on and you were saying the actor with a "hickey" look. you said this was offensive to people in your state. what impact do you think this kind of an ad has had with the voters there? >> it should outrage -- it should make them enraged and to the point they are saying listen, we are the hardest working people in the country. we helped build the country. coal miners are the salt of the earth. truck drivers deliver a product. they could have used castle call and said we want hard-working west virginians, people who do it all. no, they went to the derogatory remark "blue collar hickey look." that is offensive.

john hasn't apologized. they haven't come out and say we're sorry, we shouldn't have done that. it's wrong. nobody is thinking they've done anything wrong. i do. this is personal for us in west virginia. if you think of the work we've done and the factory work and the things we do to build the country, i'm proud of the workforce we have. i hope they are a little bit mad at this. they should be. >> uma: you know, some political observers say many voters don't want to lose you a governor because they've been happy with if leadership of the state. they are concerned you may abandon some of the conservative values if you win the senate seat. what is your response to that? >> uma, i have been around for a long time and in private business all of my life. i am who i am. i'm a centrist and fiscal conservative. they know that. our state is ranked the third best state as far as financially manage the responsibility. we are in great shape. we haven't cut anyone's services. we haven't raised taxes or laid anybody off. we are taking care of the people of west virginia, living within our means.

i can assure you, if i go to washington and they think i drank the tea, only two years to wait. throw me out then! but you ought to judge it first on what they've been able to perform. i have worked the hardest i can. my wife, the first lady, we have given our state everything. we're the backbone of the country and nobody will defend it like i will. i'm not leaving my principles for anybody. they know that. >> uma: governor, thank you for joining us today. we wish you the best. what is obviously a tight race for you in your state. i want to let our viewers know that we did invite john raese to come on the program but his campaign declined to be with us today. >> we are happy to be with you and be with you whenever you need so people will hear the truth. the lies on cap-and-trade and everything else, west virginia the greatest energy state in the nation. we'll fight hard to make the country good and come back and you'll be fine and we'll be fine, the nation will be fine. we'll work together.

put our country first and quit putting ourself first. >> uma: thank you very much, today. thank you very much. democrats are desperate to close a so-called enthusiasm gap that may lead to campaign on the election day. 23 days to go and president obama is holding a big rally in philadelphia in a few hours in the hope of recapturing the excitement that carried him to victory two years ago. mike emanuel is there. mike, should we expect a big turn-out today? what does it mean for everybody? >> well, uma, we expect a big crowd. obviously, the reporters will be looking to see how big of a crowd, how energized they are to try to get a sense of the so-called enthusiasm gap you made reference to. bottom line we expect the president to come out and say don't let frustration with the economy, with the job situation keep you from coming out to vote. on that mid-term election day. there has been concern because the youth vote was critical to president obama in 2008.

a lot of the experts are predicting that the youth vote may stay home because they are frustrated and not inspired as they were two years ago. the rally will be to try to ignite some of that, get the obama surge going again. >> uma: with 23 days to go, close to the final stretch. do we expect anything new in the day ahead, mike? >> well, this is going to be the first campaign rally where the president and the vice president are going to be on stage together. joe biden grew up, part of his childhood in pennsylvania. served the state of delaware nearby for many, many years. so expect him to put a hometown spin on things. the president will be here and then throughout the course of the week we'll see the first lady out on the campaign trail. and then next sunday we will see the president and the first lady at a rally in columbus, ohio. and so, they are turning up the energy and trying new wrinkles down the home stretch of the campaign. >> uma: thank you for bringing

us up to date on the story. i know you will watch it closely throughout the day and this week. this week, the government is expected to announce 58 million social security recipients will not see a cost of living increase in the 2011 monthly benefits. it would be the second year in a row without an adjustment. the second year of benefits will not increase since the adjustments began in the 1970s. in light of the news, bank of america is halting all foreclosures for the time being. 40 states plan to announce investigation in the growing foreclosure mess. brenda buttner is joining us live from new york with more on all the details. what can you tell us? >> well, uma, it seems the housing market can't get any worse. think again. allegedly faulty foreclosures could pull the rug out from under shaky foundation for the market. the answer for bank of america amid concern that its foreclosures were not on the up and up halt it, stop it, end it for now.

yes, the largest u.s. mortgage services froze foreclosures across the country. why? freddie mac, a big housing giant run by the government put b-of-an under the microfor worries about the documents it was using to foreclosure homes. putting pressure on other banks and other states, too. what is the problem? they're called robo signers hired by the banks. in other words, employees charged with signing hundreds of documents daily. little careful review of the documents are criteria used to foreclosure the homes apparently. what does this mean to you? first of all, if you are in danger of foreclosure, you may get breathing room. three of the country's biggest lenders halted foreclosures, gmac, jp morgan chase and now b-of-a. the aim is reassess and process, check out what may be inaccurate paperwork. this could bring sales to these homes to a sudden stop.

hitting hundreds of thousands of homeowners across the country. some people who should not have lost their homes may have. in august alone, at least one form of foreclosure filing was issued to 340,000 homes, according according to realty tracks. banks are expected to take over record 1.2 million homes this year. the trouble is it could keep banks from getting rid of bad loans and the inventory of homes that will face foreclosure is building and building, putting off any resolution of the housing crisis in the country. that may mean home prices could fall even further once the homes come back on market. all in all, once again, problems with red tape tying the housing market into knots. >> uma: a tough situation, brenda. thank you. if you have any questions about the foreclosure crisis this morning, brenda is here to help you. you can e-mail your questions to brenda at --

>> uma: she will answer the questions live on the hour in about an hour from now. a dozen college students are recovering after possibly drug at a house party in washington state. place say unknown substance may have been flipped in the victims' drinks. students at the party say it was a very scary situation. >> they were rufis, and they were falling down, drinks going everywhere. we were picking them up. i carried four people downstairs and put them on the sides. we were worried about them like passing out. because they were not responsive. >> uma: all but one of the victims has been released from the hospital. police say they are waiting for toxicology tests to figure out what was in the drinks. so far, no arrests have been made. well, a group with the specific leaders and goals. the tea party movement has had a big impact in the election

year. there is now a tea party caucus in congress and now a tea party group across the country arm coming together ahead of the november election with a common goal. getting the candidates elected. the question moving forward can the tea party maintain the momentum once the elections are over? here now with thoughts on this, alexandra acker and ron nearing, chairman of the california republican party. welcome to you both. thank you for being here. >> thank you for having eme. >> hi, uma. >> uma: hi. ron, a recent poll showing the tea party participation is up as the election nears with the 29% of the voters saying they are members of the tea party or they know someone who is part of the movement. what impact do you think the tea party can have for the long-term? >> we see the tea party activists across the country and across my state of california being active and involved in the voter registration and the get out of the vote effort. we recognize the world is run

by those who show up, and the effort is on full speed right now to make sure the republican vote turns out. we see the tea party activists from one part of california to another, being actively engaged. they're walking precinct, canvassing, making phone calls and they're providing incredible activist back boep as we get the republican vote out for the november 2. >> uma: the level of anger against washington is high. how frustrating is it to you that the republican challengers who are embracing some or all of the tea party agenda are suddenly threatening democrats and are now leading in some of the races? >> i say bring it on. i think we have seen the tea party evolve to a movement. no one can deny that. but the more tea party activists take over the republican party, the fewer elections they are going to win. i don't want any of the democratic candidates to lose in november. but i think one of the best things that could happen to democrats is for some of these

tea party candidates to win and be a continuing thorn in the side of the republican party. and are a great way for us no show voters about the choices that come out of the elections and to be able to say look, these are the candidates that the republicans are electing. is that what you agree with? moderates are not agreeing with the tea party agenda and we'll see stark differences coming out of the election. >> uma: ron, the g.o.p. establishment in some states have difficulty accepting some tea party candidates. do you feel it could further divide the party after the election? >> i don't see it at all. i was up at siskew county in california and sitting down with the tea party there, they are excited to elect our republican candidate. and incumbent and also candidate for the local office. tea party brought incredible amount of new energy in the republican party. independent voters are supporting republicans by 2 to

1. even in our own state of california. the wedge that democrats try to divide between independent voters and tea party activists isn't materialized. they support the republican candidates by very, very strong numbers. >> uma: let me ask you this. some tea party groups are setting aside differences and g.o.p. and backing the mainstream candidates in the mid-term, do you think this is an alliance that can last after the election if there are differences that remain on issues like healthcare and the budget? >> i don't at all. in ron's own state of california when sarah palin coming to town next week, his own statewide candidates are running away from her and not showing up at those events. i think this is a marriage of convenience. one that will be a thorn in the side of the candidates. i have don't see them having mainstream values or mainstream effect on policy. like i said, having the candidates in congress trying to pass some extreme legislation is one of the best

the stimulus bill provided tax cuts for 95% of working americans with $250 billion. mr. johnson says he would wipe out the obama accomplishments. he would have to wipe that out. >> what they should have done is come in the first day of office and said you know those tax cuts that are about to expire in 2011? we are not going to let those expire. we'll continue it permanently. that would have created confidence in the american economy. >> uma: welcome back, everybody. there were very few surprises in the first debate. feingold and johnson. feingold had been a lock to win but johnson pulled ahead in the latest polls.

for president? if so, can she get the republican nomination? >> i don't know if sarah palin will be a candidate for president. if it does run, it will be entertaining to watch on the other networks, watch their head spin around, because it drives them crazy. it has been entertaining to watch the chaos on the democratic side. when you see the chaos two years out before the election it shows it will be interesting on both sides. >> uma: he is calling it chaos. what do you think? is there chaos on the democratic side? will there be a crowded field of republicans that want to get in the sweepstakes? where do you think the voters will move the upcoming race if thatp happens? >> look, i think the republican side will be fun to watch. snow white and the seven dwarfs.

a bunch of has-been and nobodies and sarah palin running for president. i don't see anyone to be threat to obama run. and it will be an obama-biden ticket. they've squashed the clinton rumor. it will be amusing to watch the republican ticket battle it out. i think the tea party will have a huge influence on this election and will splinter the republican vote. you might get to see someone like john thune eemerge. it would be mistake for christie to run at this point. as far as palin goes, i can only hope. >> uma: as she points out, she says she believes the tea party will have a big impact on the 2012 race for the white house. what did you think of the straw poll with christie leading the attack, saying right now that he has no plans to run. >> he is a rock star in the

republican party, because he has come in, in a state which is democratic and still is democratic. jon corzine is so arrogant he didn't prepare a speech on election night. christie is taking on the liberal democrat union establishment head-on and pointing out how the republican unions in his state have taken the taxpayer for a ride. they looted the treasury for their selfish benefit. they are unwilling to suspend taking a pay raise while americans continue to lose their jobs and christie has taken it head on. people responded positively to that. it doesn't surprise me that chris christie would do well. he is confronting the liberal establishment straight on and speak in the plain language about the challenges we face and the taxes and the economy. how the democrats in new jersey in his state ran the state in the ditch.

that culture. after a two-day journey, three crew members arrived at the national space station saturday and docked before joining three other astronauts on board. the crew will stay on the i.s.s. for six months before returning to kazakhstan in march. those are the top stories right now. back to you. >> all right, julie. thank you very much. >> uma: we all know that anti-government sentiment is on the rise across the country, now a new "washington post" poll is proving it. it likely does not bode well for democrats. jennifer griffin has more on the story. >> reporter: if the latest polls are to be believed, the american electorate is sending a mixed signal to washington. while voters say it's anti-washington, they want to want the government to solve the current economic problems with the large government programs. according to a "washington post" poll done in conjunction with the henry kaiser family foundation and harvard university, most americans who want limited government call

social security and medicare important. nearly half want the government to regulate healthcare. most of those polled say they are angry with incumbents but almost 60% in the "washington post" poll say they want the representatives to fight for more government money to get jobs in their district. this is a turn-about from september 1994 when 53% of americans polled said they wanted their representative to battle against spending. but there is still no denying the discontent. 59% of americans say the country is seriously on the wrong track, up a dozen percentage points from the summer of 2000. >> we got a sense around the country with unemployment at 10%. 86% of the country knowing someone out of a job. people want things to get better. >> are we satisfied with the pace of the recovery? of course not. why would you go back to a set of economic policies that served the big banks, the big oil companies, and the insurance industry at the

expense of working americans? that is not a direction that people want to go. >> according to the polls, americans are divided almost evenly on whether washington should provide more services even if it means higher taxes or should reduce services and collect less in taxes. that was not the case in 1994 when most voters preferred smaller government and republicans wrote discontent to take control of congress. >> uma: fascinating, jennifer. thank you. they are the heros from the front lines. thousands of men and women injured in conflict of afghanistan and iraq. for many, the road to recovery emotionally and physically takes its toll. now in an effort to create a community of support around the u.s. warriors, the uso is launching effort to lift service of u.s. men and women and honor their sacrifice. it's called give back 10. joining us with more is richard meyers, now chairman

elect of the uso board of governors. welcome. nice to have you here. it's a great honor to have you here today. >> uma, thank you. honor to be on your program. >> uma: thank you. tell us more about give back 10. >> first, give back 10 is based on premierships of three things -- based on a number of things. one the folks deployed in the last anyone years. 1.6 million men and women. there is 40,000 that are wounded but there are many, many more. they come back with a post traumatic stress or brain injury or psychological ailments. if you couple that with the fact that the family members of the folks, the wounded two warriors returning, worry how they will be reintegrated in the community and their long-term care. then the third part was the

importance of establishing a national dialogue. we have been at war for nine years. most americans are not associated with the war. unless they have the family members serving or they have served, they're disconnected from the war. americans feel a need to connect with those returning, particularly the wounded warriors. it gave rise to 10-10-10, which we are launching on 10-10-10 to get american citizens connected with the military. >> uma: do you feel that wounded soldiers are forgotten by the public and the sacrifice taken for granted once they return home from the battlefield? >> in some instances yes. there are good organizations helping the wounded warriors. the idea behind 10-10-10. the adage that rising tide lifts all boats, the uso wants to be the mechanism that raises the tide so all boats

rise. out of silent, out of mind. some of the care will go on for many years, mentorship and finding them places to work. reintegrating them to their communities they left. we do have to remember that they volunteered to give up their security so all of us can be more secure in our lives. again, most americans feel this. and want a way to reach out to the wounded warriors and 10-10-10 is that way. the concept is ten minutes to study the problem and find out problems that the wounded warriors are having. tell ten friends and by the way, give $10. not asking for a lot of money. we're trying to get people engaged with the wounded warrior population. 10-10-10 was the idea of a

former marine tim noonan after he got out of the marine corps and his service recently had some time to think about how to connect the american citizen with our wounded warriors. i think 10-10-10 is the perfect vehicle to do that. >> uma: it sounds interesting. i know that the uso is working hard to upgrade the image from more than being an organization to provide entertainment and provide the care packages for the soldiers. >> you bet. the uso has been around since 1941. 69 years now. it's known for its morale and recreation and entertainment pieces. we have been deployed for many years in afghanistan, iraq, trying to take those services and others, other services to our warriors and their families. so we keep expanding to meet the needs of our warriors. and this is i think a natural follow-on is the whole idea of a continuum of care for our veterans. particularly our wounded warriors.

to know about harry reid? >> uma: wow! that is pretty brutal. is it an effective strategy? >> it is. you have a lot of hot button issues in there. this is the power of having money in the election. you are able to define your candidate. you can prop yourself up being the hero and the other guy as a corrupt villain doing all the awful things you see. illegal immigration, harry reid is funding this, sharron angle is doing that. if you trade barbs and it hits the hot button issues and no one is fact checking it. they are taking the yea or nay votes on the larger bills and initiatives. from there, you are seeing them extract the little votes. and basically you are ending up with a message that just does not, it's a real difficult thing for candidate to overcome. >> interesting.

is that the democrats keep control of the senate and the house for the next two years to help his agenda and so he is going to try to rally the youth vote, something that was obviously critical to his victory two years ago that got a hip-hop artist opening things up and he is hoping that there will be a lot of people in this germantown neighborhood of philadelphia turning out to try to inject some more energy into the democratic base, uma. >> mike, both the president and vice president have been out on the trail and today they are teaming up. what can we expect from that? >> that really is the new wrinkle of the day, both vice president biden and president obama on stage together trying to make their pitch to this philadelphia neighborhood for strong support by the democrats 23 days from now. obviously we expect them to try to make the case that, you know, calling for some more patience with the economy with the job situation and to say that they are heading in the right direction.

we expect to hear some familiar lines about if you vote republican you are especially returning to -- essentially returning to the old policies of the bush era and we expect them to make that sort of case today. >> interesting we are seeing both gentlemen on the stage today. a one-two punch there in philadelphia. any specific races the white house is trying to help out in philadelphia? >> a u.s. senate race to replace senator arlen specter. the latest poll suggests that pat toomey is up by two points or so. sestack is scheduled to speak. interesting dynamic. the white house was backing arlen speck tore and encouraging sestack to get out of the race. now, sestack is the man and now the white house is going to come in and try to help him win on election day, uma.

>> all in the name of politics. should be interesting mike, thank you very much. well, democrats may need more than the president's help. the latest crystal ball predictions are showing that republicans are picking up more house seats than predicted before. here to explain some of the numbers and to talk about changes an in some heated house races we have larry sabato. welcome, larry, nice to have you back with us. >> thank you. >> let's talk for a moment. are you still holding true to the prediction that you believe it is going to be a republican house majority? >> yes. we were the first nonpartisan agency to make that prediction. we did it before labor day and i'm even more sure of it now than i was then. in fact, i think the numbers may be higher than we projected that the time. i tell you what one of the key factors is that people haven't focused on fully, you have republicans picking up almost everybody agrees privately both parties picking up six, seven, eight u.s. senate seats,

picking up eight or more governorships. well, these are statewide races and they create coat tails for house candidates so it is pretty clear that the republicans are doing so well in the statewide races it is almost inevitable they will pick up additional house seats. >> let me ask you this. how much of this made the -- may be a referendum against president obama's agenda right now? >> it is a big part of it. a mid-term election is a change really the first major chance that the electorate in most of the states have to pass judgment on a new president's priorities, his agenda. what he has been able to do, what he hasn't done. maybe a referendum to some degree on what he has passed. i think that is a big part of this. the bad economy is a big part of it. but so is a kind of voter judgment on some of the big bills like stimulus and healthcare, financial services that president obama and the democratic congress have

passed. >> let's focus on the 11th district of illinois race. what are you seeing there and what are your predictions at this point this many weeks before the election? >> look, when you focus in on individual races you have to remember you picked one particularly difficult in illinois because the illinois senate race, the illinois governor's race are really quite tight. remember, that is obama's home state. if there is anyplace where he can influence politics still even in a difficult mid term it is going to be illinois. i think the illinois races frankly are going to be among the last that we call. they will be among the last that tip into a democrat or republican category. contrast that with where your correspondent just was in pennsylvania. i just left pennsylvania i'm in west virginia right now. in pennsylvania the republican ares are winning the senate seat handily, they are winning the governorship handily, i wouldn't be surprised to see four seats, four house seats in

pennsylvania switch sides. >> wow. >> the same in ohio. the same in ohio. so you have to look to the statewide races before you make firm predictions on the house races. >> and when you take a look at new york's -- excuse me, wisconsin's 8th district race, that is also something that we are finding as part of a surprise? >> yes, that is leaning republican. but, see, again because the republicans are likely to win the governorship in wisconsin and surprisingly may very well upend senator russ fei ngold for the u.s. senate that is going to increase the chances of one or two house seats tipping over to the republicans. >> fascinating. let me ask you quickly in terms of independent voters. how are they leaning this time around? >> the in dependents showing up

to vote in november look to be patriotic substantially republican. i have seen polls where up to 60% who are going to vote are going to vote republican. that is a significant switch from 2008 when president obama carried the independent vote handily. >> wow. and really quickly, are you ready to make any predictions about the senate? >> the senate moved down because of the delaware nomination. >> right. >> probably to 7 or 8 republican seat pickups but i think there is a possibility for it to move back up again. we have been watching several races get tighter including the one here in west virginia between governor joe mansion and republican john racy for the seat of the late senator bird. it has gotten very, very close. >> it has. very interesting race. and always a pressure to have you, lair -- always a pleasure to have you larry. you are like the grand wizard looking into the crystal ball

the investigation is set to look into allegations ranging from shoddy paperwork to downright fraud by mortgage lenders as they evict thousands of homeowners. brenda buttner is joining us live from new york answering your questions stemming from the news that the bank of america has temporarily stopped home foreclosures. hi, brenda. what are people asking you this afternoon? >> we got a lot of countries from all over the country. question no. unwas beth in virginia asked that if she actually buys a foreclosure, can the former owner sue me down the road? and the answer basically is no. the property should be free and clear and if there was no fraud involved at all basically that is her house. and generally that is the way it goes that these issues do not come up. so that is not really an issue

worry about and certainly not one in this whole moratorium issue. and then we get a question, number two, is it a good time to buy a foreclosed home. very timely i would say given all the moratoriums. if i buy a foreclosed house and there are paperwork problems discovered, what do i do? >> you know, there are so many foreclosures throughout. if you find one in the neighborhood ha you are looking for and if you factor in all of the costs associated that is one of the problems that many people buying foreclosures don't consider, the escrow, repairs, all those various issues but right now so much is in the air while b of a and other banks are reviewing the foreclosure moratoriums they approved with all of the issues about bureaucracy, it is hard to know when exactly the moratorium will end and when exactly you might get your

house. perhaps you will find another one that is a better deal. so it certainly is a gamble. foreclosure cassiopoeia pay off but there are a lot -- foreclosures can pay off and there are a lot of issues here, especially now that many banks are out and out saying we have got to take a look at the documents and make sure that the foreclosures actually should have been foreclosed upon. so you will be reading a lot more fine print and chances are you are going to be waiting much longer than you might have. >> wow. one big mess, brenda. thanks for updating us and thanks to the viewers with all the questions and hopefully you can been able to help them with some of those concerns. a massive military parade in north korea and the secretive states leader in waiting taking center stage. the youngest song of kim jong il standing next to his father. state television broadcasting live giving north koreaians the

about what the president said about the u.s. chamber of commerce getting foreign money. so joe trippy and karl rove on that was fun to watch. >> karl gets fired up about, it. >> he was not wasting any time. >> i don't know if he will return my calls now. i don't know. we'll see. >> as you are pointing out, the messaging seems to be what is really center stage at this point. >> and how they can transform that message in 23 days. with the economy at 9.6, the unemployment rate at 9.6%, losing 95,000 jobs last month, the dye is sort of cast as far as the economy and how people perceive it. the challenge for democrats is to change people's perception with 23 days and that is really an uphill climb. >> and the foreclosure freeze that is going on right now. >> that was interesting to hear congressman cantor and congressman debbie waserman schulz deal with that. when you have banks and lenders

lateors when i was in afghanistan. one of the cutting room floor pieces that didn't make it into the book is we had to relook linguists because some were plants from the taliban going in. we knew then they were trying to i infiltrate the process of hiring to have insiders. >> how can the vetting process take place like this and you miss the situations where you are actually putting our people at risk? >> because this is an area where no one has taken concern because they left it to almost a blind trust. one of the things we failed to understand as a culture we are dealing with here. these people have brothers some of which are probably in the taliban. i have credible friends of mine who have been embedded in the taliban who tell me about how government troops have one brother on one side and the taliban on the other family. they will call and say we're attacking tomorrow morning, don't shoot to the left because that is where i'm at.

we have known this and this is where we have not done due diligence to figure out what is going on and this resulted in huge problems many of which were predictable and now we are seeing the net effect. >> and meanwhile we are hoping to make progress with the war lords out there but apparently many also have ties to the taliban. what does this say about the situation? >> we need to get out of the middle of it. this tribal rivalry. they have been part of the landscape for thousands of years. the form of the taliban is something art fixly created by the isi is really an end growth of the soviet occupation. the answer is not for us to remain 10,000, 20,000, 100,000 in the middle, our job is to pull back and let the afghan people figure out what kind of government they have. it is not our job to install a jeffersonian style democracy. we have others in the region who are not democracies so we

work with all the time. how do we move forward? by identifying what the true national security interests are for that reason. it has po b to be pakistan. loose nuclear weapons is something our country needs to be concerned about. the taliban and al-qaeda said over and over their objective is to obtain the weapons for use against u us and that is a credible threat. nothing to sway them from going down that path. afghanistan a distraction. we need to focus on other issues. >> hamid karzai is doing what he can in terms of a public display trying to find o peaceful way out of the mess and reach out to the different factions of the taliban. is this all for show? >> john petraeus stated something that is actually out of my book about the fact that we need to find a northern ireland style peace process in

the insurgency. i agree with that wholeheartedly. however, president karzai is not the man to lead that process. i believe he is trying to seek control of the process for the purposes of keeping it at bay rather than to see progress. we have to embrace everybody. having a minority group is not in our best interest. we need to take a step back and look at how we can solve this. >> knowing that our people are at risk, do you expect anything to come out of this white house or congress should put a stop to in this terms of the vetting process? >> right now, everybody is focused on the december review. if i were the president i would declare victory tomorrow and say we need to focus on the real issues here. we talked about a set withdrawal next summer. we announced everything we are doing time and again. we need to throw the taliban off the timeline and we need to establish some framework of a future engagement no matter what. not saying we are leaving. say we will be there as long as

the reiman auditorium and it was the first thing that the workers came and tried to salvage and fortunately they were able to do so and now it looks beautiful here at the grand ole opry. taylor swift and chase atkins and dolly parton were here to help celebrate the birthday. they brought out the cake and balloons and sang happy birthday. i got a chance to talk to them back stage and i asked them what they thought of the new place here and they say it looks better than it looked before. >> you witnessed some of the flooding that happened back in the spring here? >> well, i live here, i live in nashville and we came to see all of the horrible stuff that is happening. it is so great to be back in here and they have done some wonderful things and we vamped it. a lot of things that is more wonderful than it was before. it was great then. >> beautiful. beautiful. what they have done with the place now, i mean they captured

protest outweighs a family's right to privacy when burying their fallen soldier son. congressman cherry is a veteran who has been outspoken on the issue of military funerals. thanks for being here today. >> i appreciate it. >> i know that you were a pilot flying mix in operation iraqi freedom and iraqi enduring freedom so the issue is personal for you since you flew wounded soldiers out of baghdad. you have a law in ohio that keeps protesters 300 feet away from funerals. tell us about the resolution that you introduced in the house. >> there is no question that this is deeply personal for me and i have flown wounded and fallen soldiers out of the two conflicts. the landmark case is going test the right to privacy th versuse rights to free speech.

that is what this court case is going to address. in ohio back in 2006 we had a bill passd that suggested that the right to privacy begins at 300 feet away from the grieving family's funeral and we had this enacted. it has not been challenged in the court as of yet but the very group that is now before the supreme court protest me in the statehouse. we have introduced a resolution in the congress that would uphold congress' intent of protecting the rights of privacy of the families. >> what do you say to those people argueing that this is a basic free speech issue and that no matter how insensitive protest groups are you will not be able to take legislative measures to stop it? how do you respond to that? >> in previous court cases it has been about the content of the speech and i think at issue is where the rights of the grieving family privacy begin. the court has spoken many times and we have seen presidential debates and protests as such

the protesters have been moved back 300 feet and it has been upheld in abortion clinics and the like. we want to respect the family right to privacy. not talking about the content of the speech. they have the right to say whatever they want but they have to do it at a respectful distance respecting the family's right to privacy. >> do you believe that the right to privacy trumps free speech? >> i don't believe any one right upholds the other. we can't pit the right to privacy against the right to free spinach. there should be respectful -- free speech. they will identify who, indeed, is a public figure and who is not. that is a separate issue other than the family's right to privacy and where that should begin. >> let me ask you on a personal note what aupsets you the most when you see the protesters showing up at the funerals when the families are grieving and they are so vulnerable? >> i think it is abhorrent that this group in who in the game

this is a fox news alert. los angeles police are investigating what may have been a vehicle explosion in an underground san pedro, california parking garage. casey stegall is heading out to the scene and meanwhile we want to go to karen rainer with the los angeles police department joining us on the phone to tell us about what is actually happening on the ground there. karen, can you confirm that this was actually an explosion in that garage? >> you know, actually at this point i cannot the. radio call ofo a raid crow someone hearing a loud explosion. we have a lot of resources down there right now and it is under investigation. and any time there is the potential for an explosion of

police at this hour, suv blast in an l.a. parking garage. karen rainer updating us with the situation at this time. thank you. >> thank you. well, the family of the american man allegedly killed by pirates on the mexico/texas boarder is accusing mexican authorities of doing little to help out in the investigation. the body of david hartley hasn't been found but two suspects have been named. does this mean the mexican government is fully cooperating? texas congressman hen ha has bn working to help the family and is joining us from texas. nice to have you here. >> i'm glad to be here in your hometown, uma. >> thank you very much. what do you know about the suspects? >> i really don't know. i read one of the stories that came out in a paper of mexico and that is all i know from there. i can tell you that the mexican government is trying to do everything they can to find the the body. i have spoken to the

ambassador, the mexican ambassador twice and they have four boats out there and two helicopters. two vehicles and 60 individuals, federal police and mexican military and state and local officials trying to find the body. >> a lot of folks out there in effort to try to find the body. the family has been accusing mexican authorities of not doing enough and that they are allegedly being paid off by drug cartels to cover this up. what do you make of that? >> i haven't heard those allegations but i will tell you that there is a couple of things we got to keep in mind. this incident, this couple went about four or five miles inside mexican territory to go look at this church that is partly underwater. the shooting occurred according to a local sheriff there about two and a half miles inside the mexican territory. it is believed to be that that

particular area it a hornet's nest for one of the drug organization there's and therefore the mexican police and when they came in to do the search it is not a regular search where they are just looking but they literally have to look over their shoulders. in fact, just about two days ago, there was a shooting with some of the drug cartels in the area and three people got killed. they captured three 50 caliber guns which can actually shoot down the helicopters they are doing the search. doing a tough job, i believe they are trying to do everything possible. >> you are saying that this happened before and there have been other incidents. do you believe that american citizens are vulnerable on a regular basis to these attacks by pirates? >> if they go into the mexican territory we don't have border patrol or the texas parks and wildlife or the other officials. the sheriff's office is doing patrols on the u.s. side but if you go four or five miles
