ambulance. this after coming in outside the intended drop zone. he spent the better part of two hours stuck in a tree but he's okay. jenna: maybe he'll join our town hall tomorrow, you know never. "america live" starts right now. megyn: an ohio town grown into -- thrown into the national headlines where one school district is defending its record on bullying after four students have now committed suicide. welcome to "america live," i'm megyn kelly. the focus today is mentor, ohio where parents say bullies literally tormented their children to death at this school you see here. two of those families have filed suit. the suicides stretched out over several years creating what the grieving parents call a pattern of failure in this district. in one shocking case the tormenters reportedly showed up to this victim's funeral to make fun of her in front of her grieving family as they prepared to bury their daughter.

>> she was a beautiful girl, always smiling, always trying to make everyone happy. megyn: trace gallagher is tracking this breaking story from our west coast newsroom. trace, it spans over a couple of years, but it has got even more a cute -- acute as of late. >> reporter: it has. butt link experts say this is the first time they have ever heard of two lawsuits being filed against one school for kids being bullied to death. this is four students in the past three years who have killed themselves because they were bullied. mentor high school, this was named one of the hundred best places to live by money magazine. the first lawsuit was filed by a boy. he was apparently called gay. he liked the color pink, his family says he wasn't gay but he shot himself in 2007. the family doesn't want money from the lawsuit, what they want

is the school to admit that their son was bullied to death. they saul it bullicide. the second lawsuit was filed by a girl's family. she was apparently bullied because of her accent and the clothing she wore. she hung herself last year, megyn. here is her friend and her little sister talking about it, listen. >> they were just cruel to her. she had something that they didn't and they would make fun of her. it was like horrible. >> the phone calls on her cellphone, three calls saying that our family needs to go back to croatia, that we don't belong here. telling her that they are going to get her after school and beat her up.

>> reporter: imagine the torment of that family. the father says he asked the school time and time again to do something, they did nothing. this is from the school, quote, because of legal and privacy concerns we cannot comment on the specifics of the lawsuit except to say that we will vigorously defend the district against the allegations. keep this in mind the school is not talk about this but they are apparently implementing a strategy against bullying, megyn by teaching the elementary school kids to make a pledge he will stand up against bullies and they will adults about any bullies. two other students at the same high school, one shot himself, the other one took an overdose of medication because they were apparently bullied about their sexual orientation and a learning disability, megyn. megyn: it is one thing when you have one student, it is quite another when you have four and the parents are asking questions about why the school is so committed to defending the lawsuit and they believe less committed to defending these students from the bullying.

trace, thank you. according to the late is statistics suicide is the third leading cause of death for young people between the ages of 10 and 24. they result in about 4500 lives lost each year. here are a couple of signs that every parent should be looking out for. a change in sleeping, or eating habits. withdrawal from family or friends. and a marked personality change. keeping a close eye on some of these signs, paying attention to it, not blowing it off could save your child's life and of course becoming interactive with the school when you know there is a problem. we are going to have much more on that case over the next day or two. good news for 33 chilean miners trapped underground for more than two months now. many could be seeing the light of day in less than 48 hours from right now. in the hours after midnight tomorrow. the news causing this celebration among the miners families who are anxiously awaiting the final stage of the

rescue. these folks, i mean, two months underground. it's incredible. and steve harrigan is at the mine in wh*eul lee -- wh eul lee where the -- chile where the rescue effort is in the last stage, and the miners know they could be less than 48 hours from rescue, steve. >> reporter: that's right, megyn these 33 miners really forming part of the backbone of kh*eulee's economy and the whole nation has been watching their every move watching and hoping for the best. they did get good news, they broke through to the miners after two months. the light of day is being seen down there, the heavy drill has broken through. they've been at it 24 hours a day since then. they've been reinforcing the escape shaft, the first 300 feet of it up near the top have been reinforced with steel casing sottered together so no rocks will collapse in when they are

pulling out that capsule. they are building a a platform to hold the crank into place. the capsule could take 15 minutes to an hour to pull each miner a half mile up to the surface. the capsule will spin as well when it reesess. the miners will be on a liquid diet in the hours before they come up. debate in the order in which the miners come out. as you were saying about the heroic behavior, they are actually arguing who will be the last man out of that mine. many of them want that honored position. megyn: it's been amazing as you hear the reports of folks also not wanting to leave their comrades behind, not wanting to be the shaours out, wanting to make sure the others go and get out safely. steve has been on it for us. thank you so much. a follow-up for you now on a disaster in hungary. the pictures are incredible. last week an aluminum plant spit

millions of gallons of toxic sludge, an acid-like material that burns on contact. eight people are dead, dozens more are injured. several towns are uninhabitable, and the sludge has started leaking into the danube river which runs through several countries. the prime minister in hungary announced police have arrested the head of the industrial plant at the center of this disaster. look at all that red. and to the campaign trail now where there are accusations of secret foreign funding, and a white house enemy's list. we first told you last week about the white house suggesting that conservative groups are funneling secret money into these midterms. the president himself taking up that accusation and taking it up a notch last night. >> don't let them high jack your a skwrepbd today. the american people deserve to know who is trying to sway their election, and you can't stand by

and let special interests drown out the voices of the american people. megyn: but republicans are firing back saying the president is dead wrong, and alleging that he knows he's wrong. >> have these people no shame? does the president of the united states have so little regard for the office he holds that he goes out there and makes baseless charges against his political enemies, this is beyond the pale. how dare the president do this. megyn: karl rove going onto call it an out-and-out lie. james rosen with us. president obama dialed back on this issue the second time he spoke about it after a national outcry from people on the right. >> reporter: he may have taken to heart a new york times article published on friday that found, quote, little evidence for the charge he was making. when mr. obama spoke at maryland's bowey state university ot thursday he alluded to an article online at

think progress.org, with a left leaning think tank. on saturday "the new york times" following up on president obama's allegations about the u.s. chamber of commerce reported there is nothing improper or even unusual about the group's collection of cease from overseas sources. and the aflcio and the see air -- sierra club do the same thing. on sunday the president trotted out new language. >> just this week we learned that one of the largest groups paying for these ads regularly takes in money from foreign corporations. so groups that receive foreign money are spending huge sums to influence american elections, and they won't tell you where the money for their ads come from. just attacking people. without ever disclosing who is behind all these attack ads.

it's worth looking into. ♪ megyn: fox news alert, new details in a foreclosure fiasco shaping up to be one of the biggest financial stories since the collapse of the economy. an economist who consults with the white house now says the scandal could have a major impact on the housing market for years to come, whether you're facing foreclosure or not.

lou dobbs is a syndicated radio talk show host and my guest now. lou, we covered this last web. they messed up with the foreclosures, now they are going to be on hold with america r-r and -- with rank of america and other banks. >> imagine that banks screwing up in the mist of all of this. megyn: it's relevant to everyone in this country. housing is the way we get into this mess and housing is the way we get out of this mess. i want to put up the vote from a chief economist at moody's. we don't have it, trust me. he said before, before all this, a month ago that a housing recovery would be underway by the third quarter of next year. he said things were looking good. now he pwhraoefts the foreclosure scandal could prolong the housing depression, this is from the ap for at least another few years. so this is a big deal if this is going to prolong a housing depression for three more years. megyn: >> i would be very cautious

about any forecast from any economist at any time about when a recovery will be fully underway in housing or any other market, but what is important here, megyn, is that bank of america, for example and a number of other financial institutions, with mortgages in 23 states have said, stop. megyn: right. jon: the reason they are saying it is, one they don't know what they are doing. by that i don't mean to imply that they are completely ignorant of the process, they literally don't know the details of what is in the file for that mortgage. megyn: why not? >> because for one thing a lot of institutions have gone bankrupt, they've failed, been bought by other lending institutions. megyn: you support the decision then? they have no way to determine whether they are for closing rightly or wrongfully. >> i not only support the decision, i can't imagine that they got to this point without becoming very rigorous about their paperwork, because here is the effect, one is the person living in the house who has the mortgage doesn't have to leave

the house if there isn't documentary proof that that institution owns the property. secondly, the market itself, and this is where zandy's comments come into play. the market itself has to have confidence that when someone does by a foreclosed property -- megyn: you're really going to own there is not going to be a challenge after the fact. they said that 41% of residential sales this year were going to be on distressed properties, sort of foreclosed properties. typically it's just 7%. there were going to be huge sales this year based on foreclosed properties. that number now is going to be a lot lower. i get that you're saying it's necessary, but how will it affect the people who do pay on your mortgages. now you have people about to be foreclosed on, some of them who deserve foreclosure, they are going to get a pass for several months. they are not paying. the banks will take the hit and the people who are paying their mortgages according to this article the market is going to get hurt. >> the market is going to be

hurt. the institutions themselves it's a question of timing in write offs and not to get into the esoteric aspects of this it's not going to have a material affect on the institutions themselves. what is important is to restore confidence in the foreclosure process itself. the ownership that is that the deeds are in order and that the promissory notes that are the mortgages are in correct order so there can be confidence to get this all cleared out of the market. megyn: even if you get confidence back i can speak to you as a recovering lawyer. the lawyers are going tole kha edge it. you've got a hook now, a reason to go in and say there is funny business going on. >> since you're only a row covering lawyer i can say this out loud, the lawyers are dammed. this is about a market that has to be regulated and straightened out and the than institutions understand it. that's why you're seeing leaders like b much a step in and do the right thing, they understand the legal marketplace as well.

megyn: they know how we lawyers are. you were all over the news last week, late last week, you were the news, because the folks over at the nation. >> that's never happened to me before. megyn: they wrote a nasty piece accusing you, somebody who has been very outspoken on illegal immigration of hiring i will legales yourself. you have a family that is really into riding horses. they say they documented several illegals working on your farm. >> not our farm. megyn: taking care of your horses. >> they did accuse us from benefitting from illegal labor and in point of fact the landscaping service that we employ at our -- at a house in florida may have been using illegal labor. i don't know. but the reporter herself acknowledged that i have never hired an illegal immigrant nor would i. megyn: she wants you to make sure that the companies you're hiring are not hiring illegals.

her position is for somebody who is as outspoken as you are do you have that obligation? >> i do not have that obligation nor did she articulate the obligation tkpwaeug i do have like every other citizen which is not to commit racial profiling which seems to be precisely what was disappointing the nation. this was a hit because i was the keynote speaker at the virginia tea party convention yesterday, and they came after me for that reason and acknowledged that i never had never hired an illegal immigrant, went on with this nonsense and apparent will he discovered there are 12 to 20 illegal immigrants in the country. never once acknowledged that the people who take care of my daughter's ho*ersess are all legal, period. megyn: of course it's reminding me of the meg whitman situation. she said she did what she could to not hire an illegal.

went through social security, got a driver's license. and it was brought to her attention years later by the illegal maid that she was and she fired her. what is your take on it. >> one is we have an accounting firm that does everything absolutely crosses every t, dots every i. megyn: she said she did that. >> i can tell you that we did it and it has worked without fail to this point at least. secondly people are not acknowledging that this administration has suspended the match rule on social security numbers, which means you can't do much about it any way as a employer, and thirdly, the only way to rec ta fight is to directly inquire -- rectify it is to directly inquire of an employee which is opening you wide open for a discrimination suit, and by the way appropriately so. in meg whitman case my great question is why if you had somebody working in your house for nine years would you just simply dismiss them without more discussion about it?

megyn: new reports just coming out now that a second woman who used to work with brett farve is coming forward with allegations that the star quarterback tried to seduce her. the nfl is already investigating alleged inc inappropriate behavr between favre and game day host jennifer sturger. she says favre sent her racy texts and naked photos of her. a former jets massage therapist tells the "new york post" that favre also made inappropriate advances toward her, and looked at her like she was, quote, a slab of meat. the massage therapist's husband

says he eventually phoned favre personally to tell him to stop. coming up in "kelly's court" we will unravel the growing favre than scandal now and talk about what kind of trouble he and the jets could be in. you can expect your paycheck to get even smaller in a few weeks. how much smaller i may wonder and why? we've asked shannon bream to figure that out. she has the information live for you. what is the deal. >> reporter: even if congress gets its acts together and passes something about the bush kabgs cuts before they expire at the end of the year, still the treasury department and irs needs time to calculate new tax rate tables and send it out to employers and that takes time. an analyst says that means delays. >> however, there is so much uncertainty right now it's hard to say how long it will take the irs to figure out the correct withholding amounts. it's very likely that beginning in january the first paycheck that we receive will be considerably less.

>> reporter: it could continue beyond that point. here is the thing, some employers say the irs is telling them, go ahead, take larger chunks of everyone's paychecks until we get this all figured out. come january, all of us getting -- every american get ago paycheck will find out its much smaller megyn. megyn: what about the study that says lower income americans stand to be hardest hit if they don't get something done on capitol hill on this. >> reporter: there has been so much talk about the wealthy and tax cuts and how it will impact them. this is a new study out from the tax foundation, nonpart son, nonprofit group it looks at how tax policy affects all of us. they say it's a perfect storm in a bad way for the low-income people. this group is going to lose child tax credits, standard deductions, and their overall tax bill is going to go up. while top earners pay a larger tax amount, the low-income

megyn: a sudden new twist in the reported shooting death of and american who was jet skiing with

his wife on a texas border lake. mexican police naming two suspects, two brothers. they say that these men may have killed david hartley as he jet skied with his wife tiffany on falcon lake on the texas-mexican border. this is a big switch for the mexican police, last week they were suggesting that tiffany made up the shooting attack and could find no evidence to support her story. trace gallagher has the latest from our west coast newsroom. that is a bit of a 180. >> reporter: i thought for a minute there did i miss something? i've been following this very closely. last we heard from the da in mexico there was no evidence of a crime. couldn't find a body, or a jet ski and they were doubting tiffany hartley's story. boom all of a sudden they come out and say, by the way we have two suspects and we have their names. they are brothers, apparently who work for the zeda cartel and they are wanted for a string of murders and kidnappings and robberies.

both men from the new tkpwaou rare owe area, the church that the hartleys were exploring on the jet skis. here is tiffany hartley's response to the potential of having suspects, listen. >> it's definitely frustrating. we don't really know if the two people were actually involved in the shooting, so -- or are they just using two names that they've known that have had -- been part of the other attacks. so hopefully these two guys are the ones that are responsible, and then they can lead us to david. >> reporter: but here is the flip side of this thing now. texas law enforcement saying they have no knowledge of any suspects on the mexican side of this, but they are saying they do have brand-new evidence that leads them to believe that tiffany hartley was not involved in a crime against her husband, so so much for that cross border cooperation that they said has been going on there, megyn for the past two weeks. megyn: this case is just getting

curious er and curious er. trace, thanks. new questions today involving a casting call for an mtv event featuring president obama and young voters. take a look at this notice. it pre screens potential audience members on items like their political views and the issues they are interested in. and it asks them to forward their photos. is that fishy or just fine? brad blakeman is the former deputy assistant to president george w. push and dick harpootlan is a former democratic chair. the group behind this is backstage.com, that is the talent agency that is looking for i guess talent to be cast for the mtv town hall. brad, i ask you is there anything unusual about it? >> yeah, it's weird. the president is a prop not a

member of the screen actor's guild. we don't hire casting calls for audiences in white houses. we get voters, likely voters, we get them from all over america, we certainly don't hire an entertainment to do that. this is entertainment masquerading as news. when the president agrees to do an event he should be responsible for how the way the president is portrayed and represented. megyn: what do you make of it dick? is it weird? is it unseemly to be asking for people's photos. can we only have good look people for the town halls now if they are on mtv? >> god, i find it shocking that a network that has stphaobg key -- snooki and "the situation" on it would be accused of stage managing an event like this. megyn: very nicely done. now we know what you do in your spare time. that demographic of young kids who are open on a lot of issues, it's the way to do it. now brad, if the president were trying to reach bitter white men over the age of 40, what network would you think he'd want to go to? megyn: i don't know what that is supposed to mean. >> got any ideas. megyn: as a not bitter under 40-year-old woman here i hope you're not talking about us. [laughter] megyn: by the way i should point out a spokeswoman for viacom that owns mtv denies that either republicans or ugly people are going to be screened out of the town hall. so that's good to know. >> that's comforting. [laughter] megyn: it's mtv. they say it's not that we don't want ugly folks, we are fine with ugly folks but we want diverse a taoerbgs we want to see the photos to make sure we have black, white, latino, you know, asian and you name it and there is nothing wrong with that because we want diversity and we are asking for political views because we don't want it to be all democrats, republicans or

all tea party folks. >> look it's a casting agency that is accumulating these people to attend a presidential event that is supposed to be a town hall meeting. it's not a town hall meeting. megyn: as somebody who has worked in the white house how are you supposed to do this? >> what you do is you work with a television company with a reputable group like ras muse and -- rassmussen or gallop, that does this for a living that can get you an audience that is not made necessarily for television which is exactly what casting agencies do. they are making a television event that looks good for television, and it will help this president with youthful voters who, incidentally every credible polling is showing that the president is having a terrible time with the 18 to 26 demographic. 20% unemployment among the youth. what the president is doing is stacking the deck so it looks like news, but it isn't news, it's entertainment. and it's a fiction alevent.

megyn: is there a difference between what -- i don't know, brad teams to think the white house is doing this essentially or at least approving it and what the republicans did the national republicans senatorial committee did in that ad in west virginia. they hired a talent agency, it wasn't the republicans direct lease, they hired a talent agency and they said they were looking for quote, people who have the hickey, blue collar look to sit there on camera and complain about the governor, joe mansion who is now running for senate. i think we have the ad, maybe we could show it to them as i'm asking dick about it. is it the same thing, dick? >> absolutely not. this is mtv, the folks that brought you "jersey shore" that brought you flav-a-flav. that brought you bret michaels with all his skanc girlfriends.

but he takes the bag and puts it next to a tree. all indications are that that bag stayed at that location up until yesterday. yesterday a volunteer was working in the same area. the volunteer sees the bag, looks into it, believes that it may be explosive material. he takes it and puts it into a garbage pail on the property. he talks to acquaintances who are familiar with he can pleasives and they say it may be dangerous. so today he calls the police. theth precinct respond, they see what it is. it's 8 sticks of c-4 military grade explosive. each stick is 1 1/4 pounds.

there is no ignition device, no prime were this explosive. the explosives will be removed shortly to our rank at rodman's neck. yesterday a note was found on a police car in front of the 9th precinct which is where we are now. the note is a rambling note, it makes some reference to 2nd street, and it has some religious statement in it. but investigators at this time don't see a connection between the note and the explosives. as i said, the explosives were initially discovered or dug up in may or june of 2009. megyn: there you have it. good news out of lower manhattan. this relates back to explosives
