yesterday. jon: you bought them. jenna: and jon eight them all. so we don't have any. jon: thanks for the burger and thanks for joining us. jenna: "america live" starts right now. jenna: fox news alert, breaking news coming in from the mexican border on the alleged murder of an american man on a text sass border lake. mexican authorities have suspended the search for david hartley's body, the man whose wife says was gunned down by mexican drug cartels while jetskiing on falcon lake. trace gallagher has the details. >> reporter: it's very interesting, megyn because when the lead investigator was killed in this case, his head delivered to the army, the mexican authorities came out and vowed to search for david hartley. now they have called off the search. the official reason, they are saying they want now to search for new strategies in the

search. at the very same time they are coming out saying look, if this was a mexican citizen this search would not have lasted more than three days. the hartley family has now come out saying this is a sad turn of events, and it shows that the cartels may be getting their way. very interesting in the timing here. yesterday secretary of state hillary clinton came out saying that the u.s. government is doing all it can in this search, and then a global intelligence firm called stratfor came out yesterday issuing a warning saying if the mexican authorities continue searching for the body of david hartley they believe there will be more beheadings, more killings by the cartels in mexico. as we continue to follow this breaking news i just want to make one final note, that since we have been looking into this, the lead investigator being killed, we have not confirmed, megyn, that somebody else has been put in charge of that investigation. right now nobody has been

announced as heading this thing up. jenna: no p u.n. intended. all right, trace, thank you. well from washington today new concerns this hour that a taliban operative may be inside the united states and planning the next big terror attack. u.s. intel agents suggesting that the same group behind the failed times square bombing will try to finish the job. earlier this year shahzad tried to detonate a car bomb in the heart of new york city. thankfully it did not work. this was a chaotic scene after one of the busiest areas of manhattan came to a grinding halt. authorities believe the taliban may have already sent a new operative on a similar mission. the the fbi conducted its own tests on the device, had it gone off, take a look.

and that, they say is what would have happened if faisal shahzad's attempts had been successful. jennifer griffin has more at the pentagon. >> reporter: three separate intelligence officials confirm to fox news that they are very concerned about new intelligence that they have gathered in which the pakistan taliban reportedly has sent an operative on route to the u.s. to carry out a time square-style attack. they are coming from the tribal areas, the border of pakistan, afghanistan, it's the same area where the failed times square bomber was trained. the new intelligence suggests this attacker wants to carry out the times square-style attack because it failed in the past. its not clear whether the attacker is already inside the u.s. the times square attack was the first time the pakistan taliban had attempted a strike in the west and the state department named them to its terror list in september. i'm told there are five

different threat streams that have the intelligence agencies very concerned right now. three focus on plots facing europe, two including the one we just mentioned pose a threat to the u.s. homeland. listen to the video that faisal shahzad made before he was caught. the department of justice provided it to us. >> it's not difficult at all to wage an attack on the west, and specifically in the u.s. and completely defeat them. >> reporter: we sat down a few moments ago with the marine corps general james conway. it was his last interview before retiring. and he told us, he described the threat that the pakistan taliban faces, he would not comment on the new intelligence, but here is what he said. >> jennifer, we've seen reports that there is an effort on the part of i'll say al-qaida/taliban to reach out into western european the united states. we think that it's probably coming from the other side of the border, and i think it's

i mean, how on earth could we function? >> reporter: you have to have low interest rates, right. that's the only thing that is keeping us a float at all. the federal reservist buying treasuries to -- jenna: no one has heard about that. you only heard about that on espn, i'm not sure we want to. >> reporter: let's call it money printing. >> that i -- jenna: that i understand. >> reporter: we are using our own money to buy our own money. jenna: they talk about the biggest strain is the debt, we have to pay the interest on our debt, the big, big number that we have, that has to be tackled. the entitlements have to be tackled. no one wants to touch any of those things. president obama has come out and said i'm not going to extend tax cuts for the super wealthy in this country, it's going to cost us $700 billion. i can save $700 billion right there. when you hear the numbers it makes a lot of sense. >> reporter: 700 billion over ten years, that is 70 billion a

year, that is a lot of money, that is almost alex rodriguez's pay. when you factor that into a $1.4 trillion deficit, right let's not forget what a trillion is, right it's a million billion, the numbers get real small real fast. here is the analogy for everybody at home. you take out a credit card for zero percent. you have your teaser rate for a year. then your teaser rate ends after a year and you pay 25%. suddenly you're in big trouble. if interest rates start to rise, megyn, we are going to owe as a nation, all of us, taxpayers, everybody, we are going to owe so much on our interest we will be unable to grow. jenna: that's why the republicans have come back and said forget about taxing the rich, it's morey duesing spending on like the stimulus, which they maintain we didn't need. let's hope we don't get to the staggering overall numbers the next decade. you can't even get your arms

before he even officially got his hands on it. oh. new developments now in a custody case that may suggest the government overstepped its bounds. new hampshire state social workers took a newborn baby girl away from this couple right after her birth. part of their reason, the father's affiliation with an anti-government group. trace gallagher has more from our west coast newsroom. hey, trace. >> reporter: when the motion workers took away the daughter of 26-year-old jonathan irish and his 22-year-old gir girlfrid stephanie taylor the supporting affidavit said it was because jonathan irish was abusing his girlfriend as well as his two other children. the affidavit went onto state that he was a part of a group called oath keepers, they call this an anti-government militia. it's a group of retired military and law enforcement officers who promise to fight government tyranny. they vow never to obey orders to blockade american cities because

that would turn them into giant concentration camps. oath keepers decided to protest outside the family court in new hampshire supporting jonathan irish's first amendment rights of freedom of association. listen. >> when you have this kind of a case going on it draws into questions the motives. i think the state through the legislature or the attorney general should take a good, hard look at the training they get and the motivations for why they did this. >> reporter: protest notwithstanding during that court hearing the judge did give irish and taylor back their newborn daughter. here is their reaction, listen. >> i don't think words can express how we feel right now. >> i do believe i'm the best mother for my children, and, obviously they returned an infant to us. >> reporter: aside from the abuse allegations jonathan irish also has a pretty lengthy police record, charges including

firearms and other cases against him. megyn: i'd love to feel all joy for him. what about that thing you said initially is that they suspected him of abusing what, two out of the three women in the household. >> reporter: i'm sorry, megyn i can't hear you. megyn: you started the report, forget the anti-government group that the main allegation against him was that he was abusing the girlfriend and the children, right? what came of that? >> reporter: that's exactly right. well, the judge in this case said that there was not enough evidence to take away the child from the parents. the judge said the child's best interests in this case is to be with the parents while this thing makes its way through further courts. remember the state says that they are going to go back and try and get this child back. megyn: uh-huh, that sounds like there may be more to that story. trace gallagher, thank you. >> reporter: okay. megyn: democrats are now going into a second week of pointing fingers at conservative groups and their so-called secretive campaign funds. our next guest, a democrat says

megyn: you know how we love a good car chase. we have never seen one quite like this. check this out, crazy scene in brazil. in the black car is a suspect who just broke out of prison. watch as the helicopter zooms in, he's trying to outrun police. he ends up blocked in by that bus and other cars. does he give up? oh, no, he does not. he backs up right over the motorcycle. the biker jumps off, amazing he did not get seriously hurt, and the suspect keeps on going smashing into police motorcycles. officers firing shots right into the window of that car, still he does not stop until he finally gets his car wedged between two vehicles and the cops grab him. a few people were hurt, nine cars and several motorcycles were damaged. let's just listen. listen. shoot, sorry, i was blabbing the

come out of academia and have never done anything real in their lives, and they are actually, he writes, in power, which he is stunned to realize. your tkoutsz on the doug -- thoughts on it doug. >> i agree with the judgment if perhaps not some of the rhetoric. there is no evidence that this line of attack is working. there is no evidence that this line of attack is credible, and the american people, as you suggested in your introduction care about jobs and the economy, they don't care about what the chamber of commerce is doing in newspapers like "the new york times," hardly no friend of the chamber have said that the charges are totally specious. my friend and colleague is absolutely right on the merits. megyn: in defense of the democrats they tried to talk about jobs. they were pounding that message, and it was the recovery sums and they -- summer and they were yelling us how things were getting better and we needed more time, that didn't move the

polls or numbers. they had to find something else in the absence of the jobs message working was this the next best option? >> well i don't see that many people who are worried about their well-being, worrying about who is paying for political commercials on television. i've been doing this almost as long as pat, and i've never seen a campaign where attacking the source of the funds for political commercials has ever moved the needle, particularly in a crippling recession. the recovery summer didn't work because there wasn't a recovery summer. unemployment went up to 9.6% so the democratic argument wasn't credible. they haven't even outlined an argument going forward how they are going to create jobs, much less delivering on their promises. megyn: it's clearly not working then i guess with independents and republicans. what about democrats? some of the wisdom that's been espoused over the past few days since the campaign has been unveiled it's going to fire up the base. trust me it's going to fire up the base, it's going to motivate the democrats to get out there

her statements in the pass, like no selfpleasure, let's say, is the president, are the democrats really going to be able to sell that message to the american people if the republican take over the senate and/or the house in november you're no longer going to be able to pleasure yourself between the sheets and no longer going to be able to have unemployment benefits, no more social security administration. no more teachers, you name it. >> on the economic side the democrats don't get it. social security is bankrupt. every young person i talk to today says i'm not going to get it. for the democrats to deny there is a problem shows how touch of -- out of touch they are. ronald reagan man on dismantling the department of education and won two landslides. i don't think any parent out there would say the federal department of education intervening in a federal affair has done any good. the democrats have been successful in moving mcdonnell off the economic landscape because of the past comments. the problem is it didn't translating to other races.

rand paul -- megyn: that is the key. >> let me make a point here. rand paul with his libertarian message which i like was supposed to have all this baggage too. he stayed on economics and he's up double digits in kentucky. they can try to hold christine o'donnell as the poster child, it's not working. megyn: i can understand if that's the president's goal he wants to make christine o'donnell the face of the republican party. how does he do that? it's not going to be carried live on all these channels, it's not going to be the lead story on the news tonight. maybe people will mention it, but how does it work in practice when he's standing there in front of a bunch of bell wear voters and making christine o'donnell the face of the gop. >> it's already happened. the republicans, there is no way they are going to take the senate and we'll probably lose the house. the democratic message is starting to burn through. the republicans are intent on

been on hormone therapy for two years which i'm going to assume miss lawless also has. if you look at history, she has got a great claim here. megyn: she points out over on the european tour there is a transsexual golfer who is not ranking anywhere near the top. so lawless is saying just because you were a male doesn't mean you will be the golfer. >> you saw her in the video. she is not 5'6", 120. that's me. you we don't look the same. she can crush the ball and i can't. i wouldn't want to play that. it's not fair. why is it no one is paying attention to the rights of the women trying to do a sport. fit was all okay why are there separate leagues for women and men? megyn: just because she happens to be transgender which is

something the transgender very much believe they are born with and it's beyond their control. they were born in the wrong body. should she be banned from playing professional golf forever? >> that's not the solution. maybe entrance genders should have their own league if they want to level the playing field. megyn: that woman in europe and this woman will play against each other. i'm not sure there is a right answer. you can look at other professional golfers like michelle wie. i don't think it's an unfair competition. how many transgenders are in the league. megyn: thank you so much. one final word. the olympic policy seems good to me. you wait two years after the surgery. once the hormone therapy has taken hold. then you evaluate the athletes on a case-by-case basis.
